List of Questions from the Industry and the Government’s Answers W90VN624QA016 P00001
Questions USG’s Answers 1 1. According to your bidding qualifications, it states waste collection and transportation, intermediary, and final disposal. In Korea, the government requires that all bidders must be waste handlers. Obtaining a permit for waste collection and transportation is relatively easy, and even if illegal activities are conducted, businesses can close and reapply for a permit.
However, in the case of waste disposal, engaging in illegal activities leads to strict consequences and obtaining a permit again is very difficult. Therefore, the Korean government grants authority to waste disposal operators. I strongly urge you to consider applying this advantage.
The solicitation states ‘The offeror shall submit a copy of current and valid business permission by the ROK Government as listed below. The Prime Contractor shall possess the current and valid licenses or permit for Waste Pickup Transportation Business License or Waste Disposal Business License for Intermediate/Final/Synthesis Treatment issued by ROK Government.’, page 5 of the SF 1449. In addition, the PWS clearly states that the Contractor shall comply the Korean Waste laws and regulations. Therefore, the Government does not see any merit to update the solicitation requirement nor the PWS.
2 2. Korea has a proper system where waste generators, transporters, and handlers are managed by the Ministry of Environment and local governments.
Violating this can lead to penalties. Currently, the situation with this bidding project requires illegal actions, which is why I have decided to withdraw from the bidding. Here is a proposed solution: consult with the Ministry of Environment to improve the system so that you can handle the waste legally and specially for your company. Starting from October 2024, the law will become much stricter in terms of waste management.
There was an authoritative interpretation by the Ministry of Environment, Republic of Korea, provided to the contractor for the solid waste management requirement in Osan Air Base. The interpretation allowed the contractor to have multiple roles (discharger, transporter, and handler) in the waste management system in Korea since creating USFK account in the waste management in Korea was found impossible. Therefore, it is recommended that the potential contractors diligently reach out to the local and the Ministry of Environment for such a clarification and waiver.
3 When visiting the site for the bidding item W90VN624QA016 in Daegu, if there is a discrepancy between the bid quantity and the actual disposal quantity, could you provide an example of the actual disposal quantity and price? Please help me with this.
I'm asking for examples of actual prices and quantities.
Please see the amendment attachment, excel spreadsheet, for the monthly average weight per type of waste.
