(4) (i) The Contracting Officer may, by contract or otherwise, correct or replace the nonconforming supplies with similar supplies from another source and charge to the Contractor the cost occasioned to the Government thereby if the Contractor--

(A) Fails to make redelivery of the corrected or replaced supplies within the time established for their return; or

(B) Fails either to accept return of the nonconforming supplies or fails to make progress after their return to correct or replace them so as to endanger performance of the delivery schedule, and in either of these circumstances does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure.

(ii) Instead of correction or replacement by the Government, the Contracting Officer may require an equitable adjustment of the contract price. In addition, if the Contractor fails to furnish timely disposition instructions, the Contracting Officer may dispose of the nonconforming supplies for the Contractor's account in a reasonable manner.

The Government is entitled to reimbursement from the Contractor, or from the proceeds of such disposal, for the reasonable expenses of the care and disposition of the nonconforming supplies, as well as for excess costs incurred or to be incurred.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

1. Basis for Contract Award: The Government plans to award a single, firm fixed-price purchase order utilizing Lowest Price Technically Acceptable (LPTA) source selection Procedures in accordance with FAR 15.101-1. The evaluation factors include Technical Acceptability. Contractors who do not receive an acceptable rating for ALL technical subfactors, and receive an OVERALL acceptable rating for each Technical Factor, will not be further evaluated and will not be eligible for award. Only those quotes that receive an OVERALL acceptable rating for all technical factors will be further evaluated on the price factor. The Government will not rate or rank proposals, but will select the proposal that represents the Lowest Total Evaluated Price of those proposals deemed technically acceptable.

It is the Government’s intent to award without discussions (except for clarifications as described by FAR 15.306(a)).

Therefore, the Contractor’s initial response should contain the contractor’s best terms for technical and price.

However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

2. Rejection of Unrealistic Quotes: Any proposal which is unrealistic will be judged either as exhibiting a failure to comprehend the Government’s requirements and may be so evaluated and rated, or rejected for such reasons.

Furthermore, any quote that is considered unreasonably high or low price, or contains significant inconsistencies between the Technical and price, if unexplained, may be grounds for rejection of the quote. The Government will evaluate each quote strictly in accordance with its content and will not assume that performance will include areas not specified in the contractor’s quote.

3. Responsibility: The Government will determine responsibility by analyzing whether the apparent successful contractor complies with the requirements of FAR 9.1. The Government reserves the right to reject any quote that is unreasonably low or high in price. Unsuccessful Contractors will be notified in accordance with FAR 15.503.

4. Evaluation Factors - The following factors shall be used to evaluate offers:

Factor 1: Technical Subfactor 1: Experience Subfactor 2: Comply /Non-Comply Statement Factor 2: Price

Factor 1: Technical: Technical quotes for this solicitation will be evaluated on an acceptable/not acceptable basis using the following criteria.

Subfactor 1: Experience: Each Vendor shall provide information regarding your experience in manufacturing, supplying, and /or offering for sale in the regular course of business, three (3) years preceding this RFQ, the type of equipment requested in this solicitation. Each offeror shall provide the following as evidence:

Published Data: Each contractor shall provide a brochure, catalog, or published data describing the equipment offered.

References: Each contractor shall provide contact information including (but not limited to) Company name and address, contact name and email, phone number, and a brief description of the equipment purchased for a minimum of three (3) projects similar in scope and scale for projects within the past three (3) years. For a project to be considered similar in scope and scale, it means the work/equipment supplied must be for equipment of the same size or larger of the requested equipment in this solicitation.

Only information provided by the Offeror within its quote can be evaluated. The Government will evaluate the information provided by the Offeror within its quote and assign a rating of acceptable/not acceptable.

An acceptable rating will be given if you company has 3 years of relevant experience manufacturing, providing, and/or offering for sale the type of equipment requested in this solicitation. A not acceptable rating will be given if your company does not have 3 years of relevant experience manufacturing, providing and/or offering for sale the type of equipment requested in this solicitation.

Factor 2: Comply / Non-Comply Statement: Your proposal will be evaluated based on the line-by-line compliance statement submitted. A compliance statement that is fully compliant or has minor non-compliances as determined by the Government will be given an acceptable rating.

Compliance statements that are incomplete or non-compliance is determined a major non-compliance by the Government will be given a Not Acceptable rating.

5. Price: Only those quotes that receive an acceptable rating for the above two factors will be evaluated on price.

Those quotes that do not receive an acceptable rating for both Factor 1 and Factor 2 (including all subfactors), will not be further evaluated.

For each quote, the Government will calculate the Total evaluated price for CLIN0001.

The Total Evaluated Price is the sum base machine and all additional required tooling as described in the RIPD.

Contractor must submit a firm fixed-price for CLIN0001 to be considered for award. All pricing shall be submitted on a FOB- Destination basis.

Contractors shall make their quotes valid for 180 days from date of solicitation close.
