AMENDMENT 0002
1. The purpose of amendment 0002 is the following:
a. Extend the closing date of RFP W9098S19R0005.
b. Provide answers to vendors questions.
2. The revised closing date for W9098S19R0005 is 09 July 2019 at 3:00pm CDT.
QUESTIONS AND ANSWERS
1. One of the requirements is to be ISO 9001-2008 certified. Would it be acceptable to be CWB A660 certified in lieu of ISO?
Answer: Yes, A CWB A660 may be used in lieu of ISO 9001-2008 certification. In addition, Modification W9098S19R0005P0001 corrects the ISO certification requirements to the current ISO standard 9001-2015.
Therefore, vendors must be certified to ISO 9001-2015 or equivalent.
2. First Article: There is no CLIN for First Article Unit. Since we are required to provide a specific FA test unit price, should a FA unit CLIN be established against which the FA test unit can be ordered?
Answer: CLIN0001 will be the only CLIN under the resulting contract. The FA quantity will be issued under CLIN0001, at the FA price provided on the Price matrix (Attachment0001) and will serve as the Government’s Minimum guaranteed quantity upon acceptable FAT testing.
3. The proposal instructions provide conflicting information on proposal structure. Page 9 (para 2 at bottom) states the “proposal shall consist of one (1) set of two (2) separate volumes.” Page 10 states “the proposal shall consist of three parts (a) executed solicitation and amendments, (b) volume I –Technical, and
(c) Volume II – Price”. Then Page 19 instructs us to submit various administrative information under Far 52.212-1 ‘Instructions To Offerors – Commercial Items”, along with copies of the Solicitation and other administrative info. It is recommended that the Government establish a Volume III – Administrative, for the solicitation and all amendments, and for the remaining information called for under FAR 52.212-1.
Answer: Volumes I and II are created to assist in the Governments technical and price evaluation process.
Each of the volumes contain specific evaluation factors which will be used to determine award under this solicitation. All other ‘administrative’ documents and information required by 52.212-1 are considered general/standard proposal information, which is required to be included in all proposal submission under FAR Part 12. As such, no additional Administrative Volume is incorporated.
4. On page 4 of 72, it states “Offerors that have previously manufactured and supplied shelters identifical or similar to those called for in this RFP may request a waiver as part of their initial proposal submission”.
A. What criteria will the Government use to determine if a waiver will be granted?
Answer: A FAT waiver will only be granted to a manufacturer who has previously produced identical or similar shelters successfully, as described by this RFP and its associated TDP.
Contractors interested in requesting a waiver must submit evidence to support their request as part of their initial proposal. The Government will review the evidence provided and make a determination of whether or not a FAT waiver is appropriate.
B. Will determination of a waiver request acceptance be done during the technical evaluation and how will it be weighed into the “go” or “no-go” rating?
Answer: The FAT waiver determination is not included in the technical evaluation of Offerors.
The determination to waive FAT will be made consecutively with issuance of contract award.
5. Are the containers going to be rated to the latest ISO standards of 213,000kg stacking? Currently they are rated at 192,000kg.
Answer: Per Drawing 03441-CP.1-05, the requirement states 192,000kg stacking. Anything under 192,000kg is unacceptable.
6. Do the containers need to meet STANAG 2413 MH Standards, NATO?
Answer: Per Drawing 11B5091286, “TRANSPORTATION: THE CONTAINER MUST INCLUDE A BAIL
HOOK ON THE FRONT SO THAT THE CONTAINER CAN BE LOADED ONTO THE PALLETIZED
LOADING SYSTEM (PLS) AND LOAD HANDLING SYSTEM (LHS) WITHOUT ADDITIONAL
EQUIPMENT. THE FLATRACK AND BAIL HOOK SHALL MEET THE SUGGESTED SOURCE OF
SUPPLY REQUIREMENTS OF STANAG 2413.”
7. Will Milestone or Progress Payments be allowed on Production units?
Answer: Per the RFP Narrative, paragraph 9 (Page 6), Payments will be made 100% upon final acceptance by The USG. Payment will be provided for only those units that are delivered complete and determined acceptable.
8. Page 50 of 72 in the SOL its states “(e) Unless otherwise provided in the contract, the contractor (1) may deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and (2) shall remove and dispose of any first article from the Government test facility at the contractor’s expense.”
8.a Please clarify if the First Article Test units are part of the contract quantity or not?
Answer: The FAT unit will serve as the Government’s Minimum guaranteed quantity upon acceptable FAT testing. If in the event that the unit fails FAT, the contract is subject to termination.
9. Can an extension of the closing date be allowed?
Answer: The revised RFP closing date is 09 July 2019. See above. (Amendment 0002).
10. In the package, the Government provided drawings that were either controlled or open source. From the vendor day (site visit) we understood the different to be COTS vs Manufactured parts. Given that the Government is soliciting all items, without manufacturing any components of the data package themselves – wouldn’t all components now be considered COTS, and as such, are unrestricted?
Answer: For this requirement, Commercially-Off-the-Shelf (COTS) items mean; items commonly found on store shelves or are regularly available from a supplier (i.e. cotter pins, door hinges, screws, nuts, bolts, latches, etc.) COTS items, in general, are Distro-A. Manufactured parts are items that the Government has the technical data necessary for anyone to manufacturer from scratch. Manufactured parts generally carry a Distro-C classification.
Distribution Statements are a derivative from the Top level drawing for a system and flow down to all sub-drawings. In the case of this TDP, the top-level requirements are Distro-C, therefore, the entire TDP package carries the Distro-C classification.
11. It is our understanding that the Price Matrix allows for annual price changes. Given the volatility of steel pricing and tariff changes would the Government consider clauses that specifically address and allow for changes based upon market factors and tariff changes in addition to the cost changes reflected in the Price Matrix?
Answer: This RFP is solicited as a 5-year IDIQ contract with five, 1-year ordering periods. The ordering periods are respectfully weighted (for evaluation purposes only) to reflect the likelihood of how orders will be placed against the contract. It is the responsibility of the contractor to ensure that their pricing includes any adjustments necessary for market fluctuations (up or down) over the five ordering periods.
12. Has the current units being produced been First Article Tested?
Answer: There was no formal FAT performed on the current contract.
13. Is it possible to provide additional information regarding the First Article specific testing?
a. The rolling cabinet test is not defined; has this been tested before? Please provide details of the test including caster diameter, durometer, etc.
b. The Tactical Vehicle Transport test is not specific. Is this a payloaded test? If so, please provide the payload details.
c. The Transit Drop Test is not specific. Is this a payloaded test? If so, please provide the payload details.
Answer: Yes, these tests have been performed on the prototype units.
a. The Rolling Cabinet Test: The test consists of rolling a 1,800 cabinet with the caster specified on drawing 11B5091023 (11B5042120 & 11B5042121) across the floor 50 times. To pass, the floor should show no deformation or damage after. For reference, see attached caster drawings.
b. The Tactical Vehicle Transport Test: The government plans to “dummy” load the shelter to 26,000 ponds and test it to no more than 400 mi over paved roadways (RMS roughness range, in ,0.2) and 600 mi over secondary roadways (0.2 </= RMS roughness range, in </= 0.6) on the back of a PLS. To pass, the shelter shall show no signs of damage or functional degradation.
c. The Transit Drop Test: The Government plans to “dummy” load the shelter to 26,000 pounds and subject the shelter to 6in transit drops, one on each of the four bottom edges and once as a free body onto a flat, hard surface in accordance with ASTM E1925-04. To pass, the shelter shall show no signs of damage or functional degradation.
14. What is the different between a Type I MWMSS shelter and a Type II MWMSS shelter unit?
Answer: There is no difference between a Type I and Type II MWMSS shelter for this RFP. All differences are in the tooling contained within each type. See attached entitled “Type differences”.
15. Is it possible to provide pictures or video of the unit opened and closed?
Answer: See attached “Open-Close Instructions”
16. How do we get drawings changes for things like source supply?
Answer: Upon award, there will be a post award conference (see Solicitation Narrative, page 5, paragraph 6). The post award conference shall include the contractors complete TDP Review Report (CDRL 0006) for Government review and approval/disapproval. Requests for TDP changes shall be part of the contractors TDP Review Report.
17. What is the expiration of the current contract and is pricing history available?
Answer: The current contract for the MWMSS shelter expires 30 July 2019. The contract was a 5-year IDIQ, firm fixed-price contract with five, 1-year ordering periods. The total max value of the IDIQ was $22,338,770.93.
18. Per the top-level drawing #11B5010000 Note 7, it states:
“AFTER WELDING, ALL SURFACES TO BE PAINTED AS FOLLOWS: A. INTERIOR SURFACES,
EXCLUDING THE REAR GENERATOR BAY, SHALL BE FINISHED PER 5.1.1 OF MIL-STD-171,

BOTTOM OF SHELTERS SHOULD NOT BE PAINTED UNTIL WELD NUTS HAVE BEEN INSTALLED
ACCORDING TO DRAWINGS 11B5000001, 11B5100001, AND 11B5020021.”
Does the Government just want the units to be primed upon delivery or CARC painted upon delivery.
Answer: The note allows the contractor to paint the interior/exterior using two different paint methods. The interior can be painted using either "Finish 5.1.1 of MIL-STD-171, followed by 24.17 of MIL-STD-171" or "Finish 4.1 and 4.2 or 4.3 of MIL-STD-171, followed by Finish TT-C-490, Type VIII zinc rich coating meeting CID A-A-59745, followed by 24.17 of MIL-STD-171" and the exterior can be painted using either "Finish 5.1.1 of MIL-STD-171, followed by 20.24 of MIL-STD-171" or "Finish 4.1 and 4.2 or 4.3 of MIL-STD-171, followed by finish TT-C-490, Type VIII zinc rich coating meeting CID A-A-59745, followed by 20.24 of MIL-STD-171."
All 4 callouts are a complete paint system with top coat included. The statement "GOVERNMENT WILL SPECIFY AT TIME OF ORDER" on the exterior paint callout is only in reference to the color callout, which specifies both Tan (33446) and Green (34094). This callout is intended to allow the Government the flexibility to order either Tan or Green shelters.
All units shall be primed and CARC painted IAW with the TDP upon delivery.
19. Has the current unit that is being produced been tested to the CSC requirement (section 6.4/CDRL 0005)?
If so, was this design tested after all cutouts, doors, and openings were added? To what version of ISO 1496-1 was it tested (1990 or 2013)? The 2013 version requires a significantly higher stacking load.
Answer: Yes, The current units have been tested to CSC requirements identified in the RFP solicitation narrative, paragraph 6.4 (page 6) and CDRL 0005. The design was tested after all cutouts, doors, and openings were added. As stated in questions #5.
20. Can the Government share a excel or other editable version of the complete Bill of material (BOM) for this unit?
Answer: The Bill of Material (BOM) is listed on the last three pages of print 11B5010000.
21. Does the Government believe that this is a build to print program? If so, how will the government reconcile the potential that the product will be built to print and not meet the performance requirements?
Answer: Yes, This is a build to print requirement with the Government being the owner of the TDP. In regards to how the Government plans to reconcile the potential that product will be built to the print and not meet the performance requirements. This is considered a contracual matter for which no contract has been issued under this RFP yet. Any other answer would be premature at this time.
22. Can the Government provide the CSC certification and CSC Test report, showing dimensions, loads, and deflections, for the deisgn shown in the TDP?
Answer: This is a build to print requirement. The TDP provides the requirments for CSC certification.
23. The description for CLIN0001 is a “Metal Working and Machine Shop Set Shelter IAW Drawing 11B5010000” while the evaluation factor criteria is for “10 shelters per month”. Is the delivery for 10 units acutally 20 shelters per month?
Answer: The CLIN0001 description “Metal Working and Machine Shop Set” is a reference to the overall program only. The anticipated delivery rate for this RFP is 10 each/units (shelters) per month. CLIN 0001 will equal 1 each.
1 each = 1 shelter (not a shelter set). The Government will not be ordering sets of shelters.

On time delivery is very critical. Therefore, the contractor must adhere to the delivery requirements indicated in each individual delivery order issued under the awarded IDIQ contract. Failure to comply with the contractual delivery schedule after issuance of a delivery order may result in termination of the order or require consideration if the Government elects to extend the schedule. The Government is not required to extend your delivery should you encounter delays. The non-availability of raw materials, subcontractor issues, scheduling conflicts, etc., are not considered acceptable delays/excuses for failing to meet the contractual delivery schedule. If there is going to be a delay in delivery, the contractor is required to notify the Contract Specialist/Contracting Officer designated in the delivery order prior to being late. The contractors notice shall include the contractor’s complete reasons for delay(s), corrective action(s) taken or to be taken, and the contractor’s offered consideration for the identified delay for Government consideration.
It is the responsibility of the contractor to ensure that they are providing quality product(s) that conform to the Contract/Delivery Order terms and conditions as well as meet the required delivery dates. Delivery of non-conforming products results in delivery/acceptance delays and increased cost to the Government.
6. Post Award Conference: A post award conference will be held approximately 10 business days after award. The contractor shall perform a complete review of the Government provided TDP and submit a TDP Review Report IAW Contract Data Requirements List 0006 (Attachment 0007_CDRL 0006) for discussion at the scheduled Post Award Conference. The Offerors TDP Review Report shall include (but not limited to) identifying outdated /obsolete/ changed specifications and parts, a comprehensive and detailed evaluation of the safety risk through operations and maintenance of a shelter unit produced by the provided TDP, and identification of any hazardous materials used in the design/operations/maintenance of a shelter unit produced by the provided TDP. All risks associated with safety or hazardous materials shall be reported IAW MIL-STD-882E.
The government will provide a response to the submitted TDP Review Report within 10 business days of the Post Award Conference.
6.1 ADDITIONAL INFORMAITON FOR CONFIGURATION MANAGEMENT DOCUMENTATION: The contractor may submit Engineering Change Proposals (ECPs) (Attachment 0008_CDRL 0007) and Requests for Variance (RFVs) (Attachment 0009_CDRL 0008) for the requirements in the Government provided Technical Data Package (TDP) as part of their TDP Review Report. The contractor shall prepare and submit ECPs, Notices of Revision (NORs) (Attachment 0010_CDRL 0009), and RFVs IAW the corresponding CDRLs. If a Value Engineering Change Proposal (VECP) clause is included on this contract, VECPs shall be submitted in the same manner as ECPs.
(a) ECPs - The contractor may request a permanent change to the requirements specified in the TDP or any other baseline documentation by submitting an ECP. ECPs shall be submitted to include all NORs necessary to completely define the requested change. Each ECP shall be accompanied with at least one NOR per affected document. The contractor shall not present any production items for acceptance incorporating any change to the TDP or other baseline documentation until notified by the Government the ECP has been approved and incorporated in the contract.
(i) Page 1 of DD Form 1692 (or equivalent) shall be submitted for all ECPs. Pages 2-7 of DD Form 1692 shall be submitted when required to properly explain all the potential logistics and technical impacts of the proposed change. DD Form 1695 NOR (or equivalent) shall be submitted to completely describe the desired change on each affected document.
(ii) All ECPs submitted by the contractor will be routine priority unless otherwise justified. If the contractor considers the ECP to be emergency or urgent, they shall include justification within 48 hours of submittal of the ECP.
(2) RFVs - The contractor may request to temporarily depart from a requirement specified in the TDP or any other baseline documentation, by submitting an RFV. RFVs may be submitted either pre-production (formerly known as Request for Deviation (RFD)) or post-production and prior to acceptance by the Government (formerly known as Request for Waiver (RFW)). DD Form 1694 (or equivalent) shall be submitted for all RFVs. The contractor shall not present any production items for acceptance with any nonconformance to the requirements in the TDP or other baseline documentation until notified by the Government the RFV has been approved and incorporated in the contract.
(b) Submission of requested changes - The submission of an ECP or RFV by the Contractor does not affect the required delivery dates specified within the contract, shall not constitute excusable delay in the performance of this Contract by the Contractor or in any way relieve the contractor from compliance with the contract delivery schedule. If a delivery date change is needed, it must be negotiated with the Contracting Officer and documented via modification to the contract. The submission of an ECP and/or
RFV by the Contractor shall not preclude the Government from exercising its rights under any clause of the Contract.
(c) Specifications - Permanent proposed changes to specifications which are part of the TDP or baseline documentation shall be requested with an ECP and NOR (i.e. Specification Change Notices (SCNs) are not required).
6.2. FUTURE PRODUCT IMPROVEMENTS: Future improvements are encouraged during the contract term through engineering change proposals (ECPs). Improvements may be proposed by the contractor or the Government, to eliminate operational shortcomings, insert advanced technologies to improve operational effectiveness or provide savings to the Government.
6.3 ADDITIONAL INFORMATION FOR SYSTEM SAFETY AND HAZARDOU MATERIALS: The Contractor shall provide with their TDP Review Report a comprehensive and detailed evaluation of the safety risk through operation and maintenance of the design and build of MWMSS Shelters IAW the provided TDP.
The contractor shall establish system safety processes and procedures to integrate hazard identification, assessment, and elimination or control into the product design and production effort required by the resulting contract. MIL-STD-882E may be used as guidance. The contractor’s evaluation shall identify all safety features and any procedural or design related hazards that may be present in the ISO shelters being procured by the resulting contract. The contractor shall also identify all hazardous materials that are used in the design, operation, or maintenance of the ISO shelters procured by the resulting contract.
