If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

EVALUATION CRITERIA AND BASIS FOR AWARD

The evaluation criteria are being submitted as an addendum to FAR 52.212-2, which is hereby incorporated by reference.

The Government intends to award a single purchase order from this solicitation. The Government reserves the right not to award a purchase order, or award a purchase order without discussions.

Award will be made, if at all, to the responsible Offeror whose quote, conforming to the requirements of the solicitation, represents the lowest price technically acceptable solution to the Government. An “unacceptable” rating in any factor will result in an overall “unacceptable” rating unless corrected through discussions. An offeror receiving an overall rating of “unacceptable” shall not be eligible for contract award.

The Government intends to evaluate offeror’s technical quote using the following criteria:

1. Technical Approach and Capabilities

2. Past Performance

3. Price

Acceptability Rating Standards:

Each non-cost/price factor will be rated as “Acceptable” or “Unacceptable” using the following rating standards:

For Factor 1 – Technical Approach and Capabilities, the standards will be:

· Acceptable: Quote meets the minimum requirements of the solicitation.

· Unacceptable: Quote does not meet the minimum requirements of the solicitation.

For Factor 2 – Past Performance standards will be:

· Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

· Unacceptable: Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Technical Approach and Capabilities will be evaluated as follows:

1. The non-price quote cover sheet contains the following information:

· Offeror Name and mailing address

· Point of Contact name, active phone number and email address

· Offeror and Subcontractor(s) DUNS and CAGE Codes

2. The Offeror’s repair technician(s) are OEM certified.

3. The Offeror provided evidence of their ability to purchase orginal equipment manufactured (OEM) certified parts, or OEM refurbished parts.

4. The Offeror provided a response plan which demonstrated how the Offeror would provide annual preventative maintenance and respond and/or resolution to emergency/unscheduled maintenance calls/notifications within 48 business hours.

5. The offeror has provided a copy of the completed clauses and provisions.

6. The offeror has submitted a signed OCI certification form.

Past Performance will be evaluated as follows:

The offeror’s past performance will be evaluated to determine whether the past performance is recent (completed within the last two years), and relevant or not relevant to the required services. Offeror’s performance will be evaluated to determine if the offeror’s past performance shows satisfactory experience in providing the types of analyses required by the PWS in the estimated volumes by reviewing the past performance rating and interviewing the provided references.

Offeror’s having no record of past performance will be evaluated as “neutral” which will be considered as “acceptable”.

Price

The price evaluation will determine whether the quoted prices are fair and reasonable in relation to the solicitation requirements. Quoted prices shall be entirely compatible with the technical quotations.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Services would be characterized as having access to Command Wide procurement sensitive information, or work that could likely have an influence over follow-on awards or contracts within subordinate directorates/Commands.

Category 2 - Program and/or Administrative Support. Services which assist in planning and managing an organization’s activities and programs. These include, for example: requirements analysis, acquisition support, budget planning and management, business, process reengineering, program planning and execution support, and independent technical management support. Services would be characterized as having access to only Directorate or Subordinate Command level procurement sensitive information or work that would have little influence on follow-on requirements or requirements of other directorates/Subordinate Commands.

Category 3 - Product Support. Services or end items required to meet the mission requirements of the organization’s activities and programs. These include, for example: concept exploration and development, system design, system development and integration, COTS Procurement and integration, internal development testing, deployment, installation, operations, and maintenance. Services can be characterized as having little or no access to procurement sensitive information other than the immediate requirement and little chances of follow-on work that can be influenced by the immediate requirement.

1.5.19.1. OCI Certification. This requirement may be used to acquire any USAMRMC OCI Category 2: Program and/or Administrative Support requirement that falls within the scope of the PWS. This requirement specifically excludes – Category 1 – Program and/or Administrative Support and Category 2 Product Support. Government rules, regulations, laws, directives, and requirements issued during the term of the performance period relating to law and order, installation administration, and security shall be applicable to all Contractor employees and representatives who enter the installation. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site or installation. Removal of employee does not relieve the Contractor from the responsibility for the work defined in this contract.

a. Removal by Installation Commander: The Installation Commander may, at their discretion, bar an individual from the installation under the authority of 18 USC 1382 (1972), for conduct that is determined to be contrary to good order, discipline, or installation security and safety.

The skill level of the staff provided shall be current and consistent with new technologies.

1.5.23. Force Protection Condition (FPCON) impact on work levels. The Contractor employees must comply with all personal identity verification requirements as directed by DoD, and local policy. In addition to the changes otherwise authorized by the changes clauses of this CONTRACT, should the FPCON at any individual facility or installation change, the Government may require changes in Contractor security matters or process. IAW DoDI 2000.16, the FPCON is defined as follows:

This condition applies when there is a general threat of possible terrorist activity against personnel and facilities, the nature and extent of which are unpredictable, and circumstances do not justify full implementation of FPCON BRAVO measures. However, it may be necessary to implement certain measures from higher THREATCONS resulting from intelligence received or as a deterrent. The measures in this THREATCON must be capable of being maintained indefinitely.

FPCON BRAVO. This condition applies when an increased and more predictable threat of terrorist activity exists. The measures in this THREATCON must be capable of being maintained for weeks without causing undue hardship, affecting operational capability, and aggravating relations with local authorities.

FPCON CHARLIE. This condition applies when an incident occurs or intelligence received indicating some form of terrorist action against personnel and facilities is imminent. FPCON DELTA. This condition applies in the immediate area where a terrorist attack has occurred or when intelligence has been received that terrorist action against a specific location or person is likely. Normally, this THREATCON is declared as a localized condition.

1.5.23.1. During FCONs Charlie and Delta, non-essential services are placed under a stop work order. Designated essential service will resume when the FPCON level is reduced to level Bravo or lower.

1.5.23.2. When Contractor employees are considered mission essential, all Contractor employees are required to report for duty and remain on duty during declared emergencies or elevated FPCON levels unless otherwise directed by the KO via the COR or COR-TO.
