52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
BASIS OF AWARD
A). Award will be made based on Lowest PriceTechnically Acceptable (LPTA) process. Award of this requirement will be made on a competitive best value basis using the “lowest price, technically acceptable” approach. Evaluation will be made to identify all Offerors whose proposals are technically acceptable in accordance with the PWS and the evaluation criteria set forth below. Award will be made to the Offeror from the pool of technically acceptable proposals, whose cost/price is lowest.
Technical acceptability will be determined by evaluating the following non-cost/price factors:
Factor 1. Technical Approach Factor 2. Experience Factor 3. Past Performance
Government evaluators will not assume that the Offeror possesses any capability or knowledge unless it is specified in the proposal.
After each of the above non-cost/price factors is rated individually, an overall rating will be assigned collectively to these factors. If any of the above non-cost/price evaluation factors receives an individual rating of “Unacceptable”, the collective overall rating will also be “Unacceptable”. Only proposals receiving an overall rating of “Acceptable” or higher will be considered for award.
Evaluation Criteria: Each Offeror’s proposal will be evaluated using the following criteria. An evaluation for technical acceptability will be made to ensure satisfactory responsiveness to the requirements as set forth in this solicitation. Each non-cost/price factor will be rated “Acceptable” or “Unacceptable” using the following rating standards:
Factor 1 Technical Approach and Factor 2 Experience:
Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 3 Past Performance:
Technical Acceptable/Unacceptable Offeror’s Ratings Rating Description Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
The non –price factors combined are significantly more important than the price factor.
(1) Technical Approach: The Offeror shall provide a written narrative that effectively demonstrates how they intend to meet the Government requirements outlined in the performance work statement (PWS) with specific emphasis on:
(i) An understanding of all the tasks required to be performed.
(ii) The methodology and flexibility they will use in performing the requirement.
(iii) How the approach is likely to yield the required results within the required time frame.
(2) Experience: The Offeror shall submit written information which effectively demonstrates the Offeror’s relevant experience identical to, similar to ore related to performing services contained within the PWS. The proposal shall provide evidence of the Offeror’s experience (for this purpose, experience refers to what an Offeror has done, not how well it was accomplished) in performing proposed processes and procedures; shall demonstrate the amount of relevant corporate experience the Offeror possesses, and shall provide evidence that the organization has current capabilities for assuring performance of this requirement
(3) Past Performance:
Evaluation of Past Performance is assessment of the Offeror’s capability to provide the product(s) as specified in the solicitation. This determination is based on Offeror’s record of relevant and recent past performance information that pertain the product(s) outlined in the solicitation.
Past performance information may be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and the Defense Contract Management Agency (DCMA).
In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonable assigned Offeror may not be evaluated favorably or unfavorably on at performance. Therefore, the Offeror shall be determined to have an unknown past performance.
In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.
(a) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
