Justification for Other Than Full and Open Competition (J&A) for USASOC Sewing Machines
Authority: (10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 (a)(2)
Project/Program Name: Sewing Machine Purchase Component/PEO/Other: REDACTED & Changed to USASOC Estimated Contract Cost (including options) : REDACTED Type J&A: (Individual |X| or Class |_|)
J&A No.
12-012
1. Agency and Contracting Activity: (FAR 6.303-2(a)(1))
U.S. Army Special Operations Command (USASOC), DCS Acquisitions & Contracting (AOCO)
2. Description of Action: (FAR 6.303-2(a)(2))
The anticipated result of this action is the purchase of fourteen (14) highly specialized sewing machines for the Yuma, AZ rigger facility which supports the REDACTED. The purchase order will use FY12 O&M funds. The Government’s Independent Cost Estimate is REDACTED which provides the 14 sewing machines, installation/set-up and training. Of the 14 sewing machines, there are 9 different models.
3. Description of Supplies/Services: (FAR 6.303-2(a)(3))
These sewing machines are needed to support four new parachute systems (T-11, T11R, MC-6, and JPADS); the sewing machines are also needed to support the MC-4 military freefall parachute system and in the future the Advance Ram-Air Parachute (ARAP) system, as well as the military freefall instructor parachute rigs. This will allow this command to standardize the sewing machines across the command and ensure stability by reducing sustainment costs in the future.
A. The military freefall school was not included in the initial buy or the first increases under modification for the following reasons:
1) The initial Staff Assistance Visit (SAV) determined that the Yuma MFF maintenance operations facility (rigger shed) was limited due to space, number of parachute riggers and much of the maintenance was being conducted at Fort Bragg.
REDACTED
B. Currently, funds are available for the purchase and building improvements have allowed for additional space for the sewing machines.
REDACTED
4. Authority Cited: (FAR 6.303-2(a)(4))
|X| 10 USC 2304(c) (1), as implemented by FAR 6.302-1 (a) (2) (ii)
5. Reason for Authority Cited: (FAR 6.303-2(a)(5))
A. In accordance with FAR 6.302-1 (a) (2) (ii) this item is determined to be peculiar to one manufacturer and not available from any other sources.
B. Supplies may be deemed to be available only from the original source in the case of a follow-on contract for highly specialized equipment when it is likely that award to any other source would result in --
i. Substantial duplication of cost to the Government that is not expected to be recovered through competition, or
ii. Unacceptable delays in fulfilling the agency’s requirements. (See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).)
C. These highly specialized sewing machines are authorized by the Army's technical manuals and tables: TM 10-1670-326-23&P (T-11), TM 10-1670-327-23&P (MC-6), TM 10-1670-287-23&P (MC-4), TM 10-1670-328-13&P (JPADS).
D. The current vendor has a qualified training plan already approved by USASOC and currently under contract. USASOC competitively awarded the Fox Company the sewing machine contract in FY 2010 (H92239-10-C-0016), and their current performance is excellent. Awarding to another vendor would lose the benefit of maintaining the 14 machines under the current maintenance option.
E. REDACTED
F. Duplication of effort and additional cost would be commensurate with: REDACTED
6. Efforts/Actions to Increase Competition: (FAR 6.303-2(a)(6))
A special notice was |X| or was not |_| publicized as required by FAR 5.2 on Federal Business Opportunities from 29 February – 12 March 2012. There have been no inquiries from other vendors.
7. Market Research: (FAR 6.303-2(a)(8))
A. Market research has been conducted on the Internet via open source searches to include reviewing publicized commercial price lists. There have not been substantial changes in the market to lead the Government to believe, re-competing this action would create a greater benefit.
B. With the onsite installation and training requirement, market research does not indicate USASOC will receive reasonable offers from 2 or more responsible SBs capable of providing 14 sewing machines and on-site training.
8. Interested Sources: (FAR 6.303-2(a)(10)&(11))
A. Dynamic searches done by NAICS Codes: 333292 (Textile Machinery Manufacturing) and key word "sewing machines" list only six (6) SDB concerns (1 SDVOSB, 3 VOSB, and 2 WOSB) with industrial sewing machine information.
REDACTED
9. Other Facts: (FAR 6.303-2(a)(9))
A. The sewing machines that are stated within the technical manuals have been tested and certified by Natick Labs and the U.S. Army Center of Excellence. The two name brands are the models currently being used at the parachute rigger facility to teach Advance Individual Training (AIT) students, to be parachute riggers.
B. These sewing machines are needed to ensure consistencey across not only USASOC but the Army as a whole.
