About this file

This is a Standard Form 30 amendment to a solicitation for compound pharmaceutical products issued by the Department of Defense's Carl R. Darnall Army Medical Center (CRDAMC) in Fort Sam Houston, Texas. Amendment 0001, effective February 4, 2026, modifies solicitation W81K0026QA064 originally dated January 29, 2026. The amendment is not extended, meaning the receipt deadline remains unchanged, though offerors must acknowledge receipt of this amendment prior to the specified deadline through completion of items 8 and 15, acknowledgment on each offer copy, or separate written communication referencing the solicitation and amendment numbers.

The amendment makes three substantive changes: First, it adds FAR Clause 52.244-2 (Subcontracts) with language establishing the Prime Contractor as the single point of responsibility, requiring all requirements be met by either the Prime Contractor or a single subcontractor rather than through combined capabilities. Second, it adds requirements for submission of executed Teaming Agreements from all offerors proposing subcontractors, with failure to provide signed agreements rendering proposals non-responsive. Third, it removes "Subject to Availability of Funds" language from CLIN 0001. The contract period extends from April 1, 2026 to September 30, 2026. Award will be made on a Lowest Price Technically Acceptable (LPTA) basis. Offerors must provide all four specified compound pharmaceutical items in their entirety—Succinylcholine Chloride (2,640 units), Oxytocin (2,400 units), L.E.T. Solution (1,200 units), and Phenylephrine HCl (1,500 units)—meeting minimum shelf life requirements of 45 days at room temperature. Additional requirements include FDA or PCAB certification, USP Chapter compliance, quality control systems, 4-business-day delivery, minimum one-year manufacturing experience, Trade Agreements Act compliance, cGMP adherence, 24/7 customer service, and DEA licensing for controlled substances. Questions are due by February 3, 2026, at 8:00 AM Central Standard Time, with responses published by February 5, 2026. Quote submissions via email to sheryl.j.egans.civ@health.mil must occur by the deadline specified in the portal, with prices firm for 90 days from submission.

SUMMARY OF CHANGES

1. This amendment adds the FAR Block 14 (Description of Amendment/Modification):

Clause 52.244-2. Subcontracts and adds the following language:

Prime Contractor as Single Point of Responsibility: Pursuant to the principles outlined in FAR 52.244-2, Subcontracts, the Prime Contractor is and shall remain fully responsible for the performance of this entire contract. The Prime Contractor is liable for the acts and omissions of its subcontractors at any tier as if they were the acts and omissions of the Prime Contractor itself.

All requirements must be met by a single entity, either the Prime Contractor or a single subcontractor. A combination of capabilities between the Prime Contractor and a subcontractor to collectively meet a single requirement is not permissible. The Government's approval of any subcontract does not relieve the Prime Contractor of any responsibility for performing this contract.

2. This amendment also adds the following to the Addendum 52.212-1, Instructions to Offerors- Commercial Products and Commercial Services and Addendum 52.212-2 Evaluation- Commercial Products and Commercial Services:

Amendment Section: Prime Contractor and Subcontractor Requirements

Overall Responsibility for Performance: The Prime Contractor shall be fully responsible for all work performed under this contract, whether performed by the Prime Contractor's own forces or by subcontractors. The use of subcontractors shall not relieve the Prime Contractor of its responsibility to meet all requirements of the solicitation and the resulting contract. The Government will hold the Prime Contractor solely responsible for the complete and satisfactory performance of all work.

Submission of Teaming Agreement(s): All offerors proposing to use one or more subcontractors to perform substantive work under this contract must submit a copy of their executed Teaming Agreement(s) as part of their proposal package. The agreement(s) must clearly delineate the roles, responsibilities, and planned work allocation between the Prime Contractor and each respective subcontractor. The agreement must be signed by authorized representatives of all parties. Failure to provide a signed Teaming Agreement for any proposed subcontractor may render the proposal non-responsive and ineligible for award.

3. This amendment also removes the language " Subject to Availability of Funds" from CLIN 0001.

(C) The reason certified cost or pricing data were or were not required;

(D) The extent, if any, to which the Contractor did not rely on the subcontractor's certified cost or pricing data in determining the price objective and in negotiating the final price;

(E) The extent to which it was recognized in the negotiation that the subcontractor's certified cost or pricing data were not accurate, complete, or current; the action taken by the Contractor and the subcontractor; and the effect of any such defective data on the total price negotiated;

(G) A complete explanation of the incentive fee or profit plan when incentives are used. The explanation shall identify each critical performance element, management decisions used to quantify each incentive element, reasons for the incentives, and a summary of all trade-off possibilities considered.

(2) The Contractor is not required to notify the Contracting Officer in advance of entering into any subcontract for which consent is not required under paragraph (b), (c), or (d) of this clause.

(f) Unless the consent or approval specifically provides otherwise, neither consent by the Contracting Officer to any subcontract nor approval of the Contractor's purchasing system shall constitute a determination-

(1) Of the acceptability of any subcontract terms or conditions;

(2) Of the allowability of any cost under this contract; or

(3) To relieve the Contractor of any responsibility for performing this contract.

(g) No subcontract or modification thereof placed under this contract shall provide for payment on a cost-plus-a-percentage-of-cost basis, and any fee payable under cost-reimbursement type subcontracts shall not exceed the fee limitations in FAR 15.404-4(c)(4)(i).

If a quote is rated Technically Unacceptable, the Government will not evaluate any other factor.

USING THIS PROCEDURE, THE GOVERNMENT MIGHT NOT EVALUATE ALL QUOTES.
