(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

5. Reason for Authority Cited: Currently the Department of Logistics, Medical Maintenance Section at CRDAMC does not have the organic capabilities, specialized training or current personnel that can maintain and support the particular government owned specialty lasers. The particular specialty lasers are used in various departments within the Department of General Surgery, to include the Urology Department laser used for bladder obstruction and kidney stone removal, the Surgery Department laser for skin treatment to include burn scarring, ENT Department laser used to perform procedures in the correction of hearing loss and the Dermatology Department laser is used in the treatment of a variety of skin issues.
6. Actions to Increase Competition: On future requirements the Government will try to procure these items through full and open competition on the Government Point of Entry. When the current equipment reaches the end of its life cycle, becomes obsolete or when equivalent equipment becomes available every effort shall be made to increase competition. CRDAMC will continue to evaluate the capabilities of other vendor's products and re-procure the products that provide the best value to the Government. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries. Telephonic and world-wide-web inquiries resulted in no other vendors that could provide the maintenance and services for the specialized lasers.
7. Market Survey: A sources sought notice was posted to FedBizOpps from 29 August 2017 to 5 September 2017 with no responses to the notice and no interested vendors. An updated sources sought was posted to FedBizOpps from 6 September 2017 to 11 September 2017 with two responses to the notice to include the incumbent contractor. The second respondent was asked to provide the “documented proof and the certification from the Original Equipment Manufacturer (OEM) of each particular laser manufacturer that your personnel are trained” and the purchasing agent received no response. Initial market research revealed that the incumbent contractor, a small business, has been successfully providing the maintenance and services to appropriate standards and regulations that are required for the particular government owned equipment. The second vendor, a large business did not respond to inquiries to provide appropriate documentation for their personnel to work on the specialized lasers. The second vendor has previously responded to other requests with a response that shows that they are only able to engage the OEM or their equivalent on “most repairs”. Due to the specialized nature of the equipment in question it is imperative that the work performed must be a technically qualified system technician. Spectrum Laser Services has shown over the last five (5) years that they have the appropriate capability and skills to perform maintenance and services for the specialty lasers.
