Section 00 21 00 - Instructions
SECTION 00 21 00
PHASE I
Section 00 21 00 – Instructions, Conditions and Notices to Offerors
A. GENERAL INFORMATION
This solicitation pertains to a firm-fixed-price (FFP), contract for construction services in Syria using a two-phase design-build procurement process. USACE, Transatlantic Expeditionary District (TAE), has a requirement from the U.S. Army to construct new detention facility (Rumaylan Detention Facility) near the Rumaylan Landing Zone (RLZ) in Syria. The project will be constructed in accordance with current Syrian and U.S. building codes, safety, and security standards.
Failure to have an active and completed registration in any one of the following databases at the time of award may deem the offeror “nonresponsible” in accordance with FAR Part 9 and ineligible for award. Information contained within an offeror’s registration must be current and valid. The responsibility of maintaining current information contained in an offeror’s registration rests solely on the offeror.
a. System for Award Management (SAM): https://sam.gov. Unless an exemption applies, Government contractors must be registered in the SAM and complete required representations and certifications annually. FAR 52.204-7 requires offerors to be registered in SAM at the time of bid and to continue to be registered until time of award, during performance, and through final payment.
b. Joint Contingency Contracting System (JCCS): Offerors must demonstrate that they are registered in the JCCS. Offerors must provide evidence of an active JCCS registration in good standing, which is current as of the date of proposal receipt. Offerors must be registered in the JCCS to be considered eligible for award. Information on JCCS registration is available at the following web-site: https://www.jccs.gov. The Government may choose to search the JCCS database using the JCCS Company ID number supplied by the vendor to verify eligibility. An “Unacceptable” rating will be assigned to Offerors providing incomplete or incorrect information pertaining to JCCS registration.
If an offeror is a joint venture (JV), the JV entity must have a valid registration representing the JV as one business/firm/entity. This is applicable to SAM and JCCS. The Government will not accept separate registrations and licenses for each separate entity representing the JV.
Site Visit: The Government does not anticipate a site visit for this procurement. However, should the Government decide it’s in its best interest to conduct one, the information will be provided during the Phase II solicitation.
Qualification proposals are requested under Phase I. Following the evaluation of Phase I proposals, the most highly qualified offerors will be selected and requested to submit Phase II proposals. The Government intends to advance up to five (5) of the most highly qualified offerors to Phase II, from which it anticipates awarding one firm-fixed-price contract.
Magnitude of Construction: The estimated price range of this construction project is between $25 million and $100 million.
North American Industry Classification System (NAICS): The primary NAICS code is 236220 (Other Heavy and Civil Engineering Construction) with a small business size of $45 million.
Product Service Code (PSC): The PSC is Y1FF – Construction of Penal Facilities.
B. QUALIFICATION PROPOSAL REQUIREMENTS, CONTENT, AND FORMAT
The Government will not reimburse any costs incurred or associated with preparation and submission of any responses to this solicitation. Oral explanations or instructions to offerors are not binding. Any information given to an offeror, which impacts the solicitation, will be given in the form of a written amendment to the solicitation. Any and all amendments to the solicitation will be issued electronically at the System for Award Management (https://sam.gov) and will also be emailed to the vendors on the Syrian Monitoring and Evaluation Committee’s approved list. It is an offeror’s responsibility to continuously check for any amendments to this solicitation and acknowledge any and all amendments in its proposal submission.
Offerors shall not modify the terms and conditions of the solicitation in either the technical or price proposal or add conditions or qualifications to their offers. Should an offeror include terms and conditions that conflict with the terms and conditions of the solicitation, the offeror may be determined to be ineligible for award. Any questions related to specific terms and conditions contained within the solicitation shall be raised by the offeror and resolved prior to the closing date for receipt of proposals.
References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of an offeror’s technical proposal. Offerors that include information in their proposals that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall clearly mark their proposals in accordance with the instructions at FAR clause 52.215-1, Instructions to Offerors-Competitive Acquisition, paragraph (e), Restriction on Disclosure and Use of Data.
Use of the words “will”, “shall”, or “must” indicates a mandatory requirement for which failure to comply, at the time and date for submission of proposals, shall result in an offeror’s proposal being disqualified, unless the Government determined to conduct discussions in accordance with FAR 15.306, thereby providing a means by which appropriate corrections by the offeror(s) involved can be made. Failure to comply with non-pricing or pricing requirements that are annotated with the words “should” or “may” can result in a lowering of an offeror’s non-pricing ratings, and may have a significant effect upon an offeror being selected, or not being selected, for the contract award. Time periods, if stated as numbers of days, are calendar days unless otherwise specified.
1. PROPOSAL CONTENT
Offerors are required to submit proposals with at least the minimum content specified herein. A proposal without the minimum content may result in a determination that the proposal is unacceptable. The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of an offeror.
All information intended to be evaluated as part of the technical proposal shall be submitted within the technical proposal. Do not include references to material or information not found within the technical proposal. Referencing information not found within the qualification proposal could lead to an offeror’s proposal being determined unacceptable if materially incomplete in any aspect.
Pricing information is not required and shall not be submitted in Phase I.
a. COVER PAGE: A cover page shall appear at the beginning of each volume and, at a minimum, shall consist of the following information:

E. DEBRIEFING OF UNSUCCESSFUL OFFERORS
Unsuccessful offerors will be notified in accordance with FAR Subpart 15.5. An unsuccessful offeror may request a pre-award debriefing or a post-award debriefing after award by submitting a written request to the contracting officer within three (3) days after receipt of the notice excluding the offeror from the competition and award. Offerors are entitled to no more than one debriefing for each proposal.
F. BASIS OF PHASE I EVALUATION
1. Subject to the provisions contained herein, the Government will evaluate qualification proposals to identify those offerors whose proposals are responsive to the solicitation requirements, and judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, meet the technical standards for non-price factors.
The Government intends to advance up to five (5) of the most highly qualified offerors to Phase II from which it anticipates awarding one firm-fixed-price contract. It may advance fewer than five (5) offerors and will exercise discretion in determining the number of offerors to be advanced to Phase II, determining a reasonable cut-off between offerors advanced and offerors not advanced. The SSA will take into account the Government’s interest in competition and its interests in awarding to a highly qualified contractor, and in preventing avoidable expenditure on Phase II proposal preparation by offerors without realistic prospects of award.
2. The technical evaluation team, using reasoned judgment, shall evaluate qualification proposals by identifying significant strengths, strengths, significant weaknesses, weaknesses, uncertainties, and deficiencies in each offeror’s proposal and assigning a combined technical/risk rating to each proposal for each evaluation factor.
Definitions
Significant Strength is an aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
Strength is an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Significant Weakness is a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
Weakness is a flaw in the proposal that increases the risk of unsuccessful contract performance.
Uncertainty is any aspect of a non-cost/price factor proposal for which the intent of the offeror is unclear (e.g. more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).
Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
A risk as it pertains to source selection is the potential for unsuccessful contract performance.
The consideration of risk assesses the degree to which an offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, degradation of performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance.
3. There may be contained within the evaluation factors certain mandatory or minimum requirements to be met for evaluation. There are also contained within the described factors certain documents for submission. Failure to satisfy any mandatory or minimum requirement may result in a determination that a proposal is unacceptable. A final determination that a proposal is unacceptable means that the offeror will not be selected as a most highly qualified offeror and the Government will not request that the offeror submit a Phase II proposal. This does not limit the Government’s discretion to exclude offerors without any “unacceptable” ratings from Phase II because they were not found to be among the most highly qualified offerors.
4. The Government intends to select the most highly qualified offerors without discussions, but reserves the right to hold discussions if the Government determines that to do so would be in its best interest. Therefore, an offeror’s proposal should contain the offeror’s best terms from a technical standpoint. The Government reserves the right to conduct discussions if it is determined by the contracting officer to be necessary or requested by the source selection authority (SSA).
PHASE I
Section 00 22 00 – Supplementary Instructions
EVALUATION FACTORS (PHASE I)
All of the submission items to be evaluated shall pertain to the offeror and its major subcontractors. A minimum of twenty percent (20%) of the work associated with this project is required to be performed by the contract awardee.
Subcontractors: The Government recognizes that completion of a project is often a team effort.
An offeror that intends to utilize one or more major subcontractor(s), shall submit a firm, unequivocal letter of commitment signed by each major subcontractor. A major subcontractor is defined as a subcontractor that performs twenty percent (20%) or more of the total on-site management and construction efforts or one that performs twenty percent or more of the total dollar value of the project. Offerors that propose to use a designer of record (DOR) are also required to submit firm, unequivocal letters of commitment signed by their DORs. An offeror’s technical proposal will largely be diminished in the evaluation and selection process unless a required letter of commitment is provided which establishes the likelihood that the proposed subcontractor(s) will actually be available for this project.
If an offeror’s accepted proposal includes the use of any major subcontractors or DORs, the offeror shall not change major subcontractors or DORs without the contracting officer’s approval. If an offeror proposes to change major subcontractors or DORs after award, the offeror shall not change major subcontractors or DORs without the contracting officer’s approval. Approval will not be given unless the contracting officer considers the proposed substitute to be equal or better in all respects to the originally proposed major subcontractor or DOR and that the substitution is in the best interests of the Government.
Joint Ventures: A Joint Venture (JV) is defined as a legal business entity formed between two or more companies to undertake the performance activities of a contract together.
An offeror proposing as a JV shall provide evidence that the JV as a legal entity has been duly formed. A JV’s offeror shall include a copy of its legal JV agreement signed by an authorized representative who can bind the entity of each coventurer, with the chief executive of each entity identified. A prospective offeror that submits a proposal as a JV may not change either/any the joint venturers, if selected for award.

EVALUATION APPROACH FOR FACTOR 2
Specialized Experience will be rated as one factor; there are no sub-factors. The Government will evaluate the recency, depth, and the relevancy of the experience as submitted in the offeror’s proposal. Proposals will be evaluated to determine design-build experience of the Offeror for relevant contracts and/or projects of the similar scope and complexity of the project contained in the specifications. Offerors must demonstrate that the projects are same or similar to the project described in the solicitation. Offerors are encouraged to submit the maximum number of relevant projects to increase likelihood that the above requirements are met and elements warranting higher rating are included. A proposal providing fewer than three (3) projects could receive the highest rating available, to the extent that the projects submitted are fully relevant projects. Projects submitted that do not have the qualities considered most relevant may be considered but the offeror may receive a lower rating for this factor.
For the purposes of his evaluation, Recency, Relevant and Depth are defined below:
RECENCY: Projects considered recent shall be completed within the last six (6) years from the date of the solicitation or the projects must be at least 80% complete by the solicitation Phase I proposal submission due date.
RELEVANT: Relevant projects demonstrate examples of design and construction of infrastructure and facilities similar to those to be performed under this solicitation. Relevant projects are/were projects that meet one or more of the following criteria:
a. Design-Build Construction of new buildings;
b. Design-Build Construction of Barracks

DEPTH: Depth is demonstrated by providing a detailed explanation as to how the project meets the requirements of the category; and how the project demonstrates experience performing construction activities anticipated under this solicitation. The Government will evaluate the offeror’s depth of experience in the following categories.
a. Design-Build Construction of new buildings;
b. Design-Build Construction of Barracks
c. Design Build Construction of Dining Facilities
d. New Installation or replacement of major building systems such as electrical, mechanical, HVAC;
e. Design Build Construction of Sanitary Collection Systems; Water Distribution Systems;
and/or Electrical Distribution Systems
f. Design Build Construction that included providing Furniture, Fixtures and Equipment
(FF&E)

Where experience demonstrates the following, the proposal may be rated higher (the following list is not all encompassing and is in no order of importance):
Projects demonstrating experience working with USACE or the U.S. Government.
Experience managing multiple projects performed simultaneously (as demonstrated by the project dates) Projects that demonstrate experience working with proposed Key Subcontractors and/or the proposed Joint Venture Partners working together.
Design-Build Construction of Barracks Design Build Construction that included providing Furniture, Fixtures and Equipment
(FF&E)
Where experience does not demonstrate the following, the proposal may be rated lower (the following list is not all encompassing):
Offeror fails to submit at least one (1) project demonstrating experience in Design-Build
Construction.
Offeror fails to submit projects within the relevant timeline (completed within the last six
(6) years of the solicitation issue date or the projects must be at least 80% complete by the solicitation Phase I submission due date).
Projects which fail to explain the depth of experience for a category which it was submitted.
The adjectival ratings for Factor 2 - Experience are listed and defined below:
Combined Technical/Risk Ratings
Adjectival Rating Description
OUTSTANDING Proposal demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths, and/or at least one significant strength, and risk of unsuccessful performance is low.
GOOD Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength or significant strength, and risk of unsuccessful performance is low to moderate.
ACCEPTABLE Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
MARGINAL Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
UNACCEPTABLE Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies and is unawardable, and/or risk of performance is unacceptably high.
The adjectival ratings, defined below, are not separate ratings, but will be used to define the levels of risk in the aforementioned table.
Technical Risk Rating Method Adjectival Rating Description
Low Proposal may contain weakness/weaknesses which have low potential to cause disruption of schedule, increased cost, or degradation of performance. Normal contractor emphasis and normal Government monitoring will likely be able to overcome any difficulties.
Moderate Proposal contains a significant weakness or combination of weaknesses which may have a moderate potential to cause disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome any difficulties.
High Proposal contains a significant weakness or combination of weaknesses which is likely to have high potential to cause significant disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will unlikely be able to overcome any difficulties.
Unacceptable Proposal contains a deficiency or a combination of significant weaknesses that causes an unacceptable level of risk of unsuccessful performance.
To receive consideration for Phase II, an offeror must have an adjectival rating of no less than “Acceptable” for Factor 2.
FACTOR 3 - PAST PERFORMANCE
SUBMISSION REQUIREMENTS FOR FACTOR 3
a. For each project the Offeror includes in its proposal for Factor 1 – Experience, the Offeror shall submit an Attachment E - Past Performance Questionnaire (PPQ).
b. Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Attachment E), which will provide contract and client information for the respective project(s). Ensure correct phone numbers and email addresses are provided for the client point of contact.
i. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Contract Specialist Richard Bonnell, via email at richard.w.bonnell@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.
However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
ii. Offerors may provide a completed Department of Defense, DD2626 form or a Contractor Performance Assessment Report (CPAR), in lieu of Attachment E.
