About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition under FAR 13.5 for the procurement of Kongsberg Geospatial TerraLens software. The J&A outlines the government's rationale for a sole-source award to Kongsberg Geospatial, citing the software's ability to meet specific technical requirements and the lack of viable alternative products.
The J&A provides details on the TerraLens software's capabilities, including the ability to create 2D and 3D views, plot up to 100,000 simultaneous tracks/objects, and display symbology in accordance with military standards. The estimated total price for the 5-year subscription period is provided. Market research efforts to identify alternative products and authorized resellers are documented, but only one authorized reseller, Lyme Computer Systems, was found. The J&A concludes that the anticipated cost is fair and reasonable, and the Contracting Officer approves the sole-source procurement.
The related federal contract opportunity is a Request for Quote (RFQ) for the Kongsberg Geospatial software, with a solicitation release date of May 8, 2024 and points of contact provided.

The above quantities and pricing were specified in the independent Government estimate (IGE). The IGE quantity was determined based upon the Government’s verified need. The contract options will cover the continuation of the current software maintenance support purchased during the base in yearly increments in accordance with the quantities that are projected by the program office to be exceed the cost of software maintenance and is not in the best interest of the Government.
Alternatives: Alternatives were considered/researched as described below; however, they were found unsuitable for SEC's requirements.
Environmental Systems Research Institute (ESRI) Aeronautical Reconnaissance Coverage Geographic Information System (ArcGIS) was considered; however, it requires access to a server and a bandwidth of 85,000 connections to render maps, which is not currently part of the baseline and would require extensive re-engineering to accommodate.
Additionally, Tactical Assault Kit (TAK) Maps was considered; however, it is not a viable solution for because it requires the TAK Software Environment which is a self-contained operating system and would require reconfiguring the baseline into that environment. This would necessitate changes to the application, Graphical User Interface (GUIs), and updates to the training materials.
At this time, it is determined that only Kongsberg Geospatial TerraLens software would be able to function within the Army’s current architecture and meet the Government’s requirements. If the required TerraLens software is not purchased, the fielded systems will no longer have the critical mapping capabilities provided by TerraLens.
Failure to procure Kongsberg Geospatial TerraLens software will result in unacceptable delays and duplicative costs that cannot be recovered through competition. Introducing another manufacturer’s products provides no cost savings or technological benefit to the Government and would cause a complete loss of the current investment in NRE, training, training materials, and other related costs to the program. Furthermore, introducing another manufacturer’s products would affect the ATO. Failure to renew this software may result in revocation of the ATO by the Authorizing Official (AO), resulting in impacted systems to be disconnected from the DoD Information Network (DODIN).
Furthermore, if the required Kongsberg Geospatial TerraLens software are not purchased, the fielded systems will experience licensing violations and the system will not operate in the field. Fielded systems will lose the ability to address security related patches impacting the ATO; as well as jeopardizing the system resulting in being removed from the network.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any quotes received will be considered. A Combined Synopsis/Solicitation will be posted to SAM.gov to satisfy the synopsis requirement at FAR 5.201. Market research was conducted 16 – 22 January 2024, details of which are outlined in paragraph 8. Request for Information (RFI) # 477957 was posted to Army Computer Hardware Enterprise Software Solutions (CHESS).
a. Request for Information (RFI) documents were posted to the following sites:
The software publisher was encouraged to license the sale of TerraLens software products to additional authorized resellers. Upon receipt of the requirement, an authorized list of distributors for the TerraLens software was immediately requested from the software publisher. The Software Publisher stated they have only one (1) authorized reseller, Lyme Computer Systems, Inc. The Government encouraged the software publisher to pursue distribution and support services of their COTS software product lines through Small Business, Service-Disabled Veteran Owned Small Business (SDVOSB), Woman Owned Small Business (WOSB), Economically Disadvantaged Women Owned Small Business (EDWOSB), Minority Owned Small Business (MOSB), certified 8(a), and Historically Underutilized Business Zone (HUBZone) small businesses.
Market research will be conducted annually on the current baseline to determine if changes occurred in the marketplace that would enable greater competition.
8. Market Research: Market research was performed by the SEC Software License Acquisition Branch 16 – 22 January 2024. The intent was to increase competition by:
(1) identifying alternative COTS products
(2) identifying authorized resellers and
(3) increasing small businesses participation. Of particular interest were WOSB, EDWOSB, SDVOSB, HUBZONE Small Businesses.
Furthermore, the market research was performed to identify companies that could provide the TerraLens software products, maintenance, and technical support. The SEC searched Government Wide Acquisition Contracts (GWAC), and multi-agency contracts, including blanket purchase agreements (BPAs) under Federal Supply Schedules for potential sources of TerraLens software products or alternates products. The TerraLens software products are not available on the CHESS. The TerraLens software is available on GSA eBuy on a Multiple Award Schedule; however, per communication with the OEM, vendors identified as resellers on GSA eBuy are not authorized resellers.
Kongsberg confirmed via email that its only authorized reseller is Lyme Computer Systems. The TerraLens software is available through NASA SEWP through its authorized reseller.
RFIs were posted to the following websites:
a. CHESS Information Technology Enterprise Solutions-Software 2 (ITES-SW2).
The RFI number is 477957. No vendors responded to the RFI.
b. GSA eBuy. The RFI number is 1673947. Two (2) vendors responded to the RFI
(Vinsys Information Technology, Inc. and FSR Consulting, LLC), however they are not authorized resellers.
c. NASA SEWP. The RFI number is 296282. One (1) vendor responded to the RFI
(Lyme Computer Systems, Inc.).
13. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
As a part of this basis, pursuant to FAR 15.403, certified cost or pricing data is not required because the item and/or services being acquired was determined to be commercial product(s). Price analysis of received quotes will be used to determine the price fair and reasonable.
