1.4. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful Contract Proposals.
1.5. If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer in writing with supporting rationale.

52.212-2 EVALUATION-COMMRCIAL
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a single contract resulting from this solicitation to the responsible contractor whose response is technically acceptable and the lowest price. Responses that fail to address all the requirements set forth in the Solicitation and PWS will be rejected.
(1) Evaluation Factors and Approach: The award will be based on the Lowest Priced Technically Acceptable evaluation process. Using the Lowest Priced Technically Acceptable (LPTA) process specified in FAR 15.101-2, the Government will evaluate price and the following non-price factors: Technical Capability and Past Performance. The LPTA process is done through the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor. Award will be made to the offeror who has the lowest priced technically acceptable offeror.
(2) Award: The Government intends to issue one contract as a result of this Solicitation. The Government intends to evaluate responses and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain their best terms from a price and technical standpoint. If revised responses are requested, they will be evaluated against the same criteria as were the initial responses.
FACTORS TO BE EVALUATED: Technical, Past Performance, and Price
Evaluation criteria consist of two (2) evaluation factors. The Proposals will be evaluated under the following evaluation factors:
Factor 1: Technical Capability Factor 1: Staffing Approach
Factor 2: Past Performance
Factor 3: Price
Factor 1: Technical Capability
a) The Government will evaluate the offeror’s technical capability to determine whether it satisfies the requirements of the PWS and is executable as proposed. In order to be considered for award, there must be an “acceptable” rating in every non-price factor. A determination will be rendered as to whether the technical proposal is evaluated as Acceptable or Unacceptable as follows:
Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation
b) The Government's technical evaluation team will evaluate responses to determine whether each response, exclusive of pricing considerations, is technically acceptable or technically unacceptable. In order to be technically acceptable, the response for each factor must be determined to be acceptable and must demonstrate a clear understanding of all requirements in this solicitation, including the PWS and any attachments. Responses must demonstrate a practical and functional technical approach that meets the needs described in the solicitation. Failure to meet these criteria will render the response technically unacceptable. All responses that are found technically acceptable will then be evaluated under Factor 2– Price.
i) Factor 1- Staffing Approach – The Government will evaluate the proposed staffing approach to assess the offeror’s understanding of the requirement to provide personnel with the required knowledge, skills, and qualifications to fulfill the requirements of the PWS to include the ability/capability of the personnel to support the designated position. To be rated technically acceptable, the staffing approach demonstrate the offeror’s ability to recruit and retain a workforce sufficient to satisfy the requirements stated in the solicitation and associated attachments and reduce performance risk.
Factor 2: Past Performance Past Performance shall be evaluated using the following ratings:
Past Performance Evaluation Ratings Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
a) The Performance Risk evaluation will be based on an “Acceptable” or “Unacceptable” basis. The information obtained from the Offeror and from other sources available to the Government will be the basis for evaluation of this factor.
b) The Government assessment will focus on contracts that meet the following conditions:
i) Recency Assessment. To be recent, the effort must be ongoing or must have been performed during the past three years from the date of issuance of this solicitation. Relevant experience information that fails this condition will not be evaluated.
ii) Relevancy – To be relevant, the effort must be similar to the nature of work, size, magnitude, complexity and scope to the work required by this solicitation. The Government will conduct an in-depth evaluation of all recent performance information provided to determine if it is the same or similar in nature, size, and complexity to the services/products being procured under this solicitation. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated.
iii) An evaluation to determine how well the contractor performed on the recent and relevant contracts. The past performance evaluation performed in support of this source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
c) Based on the past performance submittals received from the offeror, CPARS reports, and past performance information obtained from sources other than those identified by the offeror, to include Federal, State and local Government agencies, better business bureaus, published media, electronic data bases and personal knowledge, a determination will be made as to whether the offeror is assigned an “Acceptable” or “Unacceptable” rating as noted above. Note that no ranking is used for these criteria, only an “Acceptable” or “Unacceptable” determination.
d) The Government may reject a proposal if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.
e) Offerors may provide information on problems encountered on the contracts identified in their past performance submissions and the offerors’ corrective actions (FAR 15.305). The offeror will have the opportunity to respond to any adverse past performance through communications/discussions, unless the offeror has had an opportunity to respond to the adverse information previously (FAR 15.306(b)(1)(i)).
f) The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each teaming partner, and/or joint venture partner, authorizing release of past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.
g) In the event that an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Factor 3: Price
a) Only proposals determined to be technically acceptable will be evaluated for price. Total Evaluated Price consists of the sum of the total price offered, including the Option to Extend Services as described below. Evaluation of options shall not obligate the Government to exercise the option(s). The price evaluation will document reasonableness of the total evaluated price. Price proposals determined not to be considered reasonable will result in the offeror being deemed unacceptable for award.
i) Reasonableness: Competition usually establishes price reasonableness. In limited situations, the Government will be required to perform additional analysis to determine price reasonableness. The techniques and procedures described in FAR 15.404-1(b) will be the primary means of assessing price reasonableness. The evaluation techniques described under FAR 15.403-1(c)(1), as determined appropriate, may also be performed in further determining the price reasonableness of the proposal.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
Registered in the System for Award Management (SAM) database means that--
(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into the SAM database;
