A. BASIS FOR AWARD (Section M)
Awards will be made to the offerors who provide the best proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to the following three (3) evaluation factors: Technical, Past Performance, and Price. The Government will complete its evaluation by performing a best value trade-off among Technical, Past Performance, and Price. Technical and Past Performance when combined are significantly more important than Price. Past Performance is the most important factor. Factors and sub-factors are not numerically weighted. Offerors must be rated as at least acceptable for all factors and subfactors to receive the award. Price will be evaluated in accordance with FAR 15.404-1. Offerors are cautioned that the awards may not necessarily be made to the offerors offering the lowest price. Price will be evaluated in accordance with FAR 15.404-1 for reasonableness. The Government will not conduct price realism.
The Government intends to evaluate proposals and make awards without discussions but reserves the right to conduct discussions. Offerors should ensure the completeness of their proposals and offer their best terms and conditions with their initial proposals. If discussions are considered necessary, they will be conducted with those offerors in a competitive range. The determination of the competitive range will be the responsibility of the Contracting Officer and the Source Selection Authority.
Approximately five (5) awards are anticipated, but the Government reserves the right to make greater than or fewer than five awards, if appropriate. If appropriate and necessary to reach the desired number of MATOC awards, the Government reserves the right to make initial awards to the most qualified offerors and then to establish a competitive range with additional unawarded offeror(s) who would be given an opportunity to submit a revised proposal for a Phase 2 evaluation and award. Any offeror receiving a Phase 2 award would be added to the MATOC.
Each MATOC contractor will receive a Minimum guaranteed amount of $10,000.00. The duration of the contract is five (5) years and there is a possibility of adding a six (6) month extension. Competition for award is restricted to certified 8(a) Set-Aside Small Business contractors.
Government’s Right to Terminate: While this contract has a five-year period of performance, the Government retains the right to terminate this contract at any time, in whole or in part, for its convenience, as outlined in the termination for convenience clause (FAR 52.249-5). This right is independent of the contractor’s performance.
Termination will be conducted in accordance with the procedures detailed in FAR 52.249-5. Potential contractors should review this clause carefully before submitting a proposal.
In order to be considered for award, offerors must be registered in the System for
Award Management (SAM) under NAICS 236220 (Size Standard $45.0M) prior to contract award.
B. FACTORS AND SUBFACTORS TO BE EVALUATED
Awards will be made to the offerors whose proposals are most advantageous to the Government based upon an integrated assessment of the evaluation factors and sub-factors described below.
Factor 1: Technical.
The Technical factor consists of the following subfactors:
a. Bonding Capacity and Rate
b. Safety Record
c. Selected Key Personnel
d. Contract Management Plan (CMP)
Proposals will be assessed on four Subfactors: A, B, C, and D. However, the evaluation process differs for each:
The Strengths, Weaknesses, and Deficiencies are the findings that will support the rating adjective/color for Subfactors A, B, and D. Subfactor C, Key Personnel, will only be evaluated for deficiencies and will be given an acceptable/unacceptable rating.
For the Technical Factor, each sub-factor will be evaluated to determine if the information provided and the proposed approach associated with each factor meets or does not meet the minimum performance or capability requirements.
To receive an overall “Acceptable” Technical factor rating, all sub-factors must not contain deficiencies. Numerous identified weaknesses, could cause the overall Technical Factor to be rated as Unacceptable. Based on the evaluations of the technical subfactors and noted strengths, weaknesses, and deficiencies, the Government will then assign an overall color/adjectival rating for the Technical Factor.
Factor 2: Past Performance. Each offeror’s past performance will be reviewed to determine relevancy and confidence assessment.
Factor 3: Price. The resulting award will be a Firm-Fixed Price. Price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort. FAR 31.201-3 describes as a price to be fair and reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business.
Examples of methods that may be used include a comparison to the other competitive pricing received in response to the solicitation, comparison to previous prices paid, and a comparison to the IGCE pricing. The resulting award will be an Indefinite Delivery requirement’s type contract with task orders issued on a FFP basis based on spreadsheet line-item pricing incorporated into the award. The Government will evaluate offers for award purposes by adding the total of all CLIN/SubCLIN prices, including spreadsheets included in the solicitation.
NOTE: The Government will establish the contract total ("ceiling") based on the total evaluated price from the successful offeror's proposal, or in an amount up to $121.3M, whichever is deemed appropriate by the Contracting Officer at time of award.
C. EVALUATION APPROACH
All proposals shall be subject to evaluation by the Source Selection Team (SST).
The SST will first evaluate Technical Subfactors a and b from below. Any proposal containing a deficiency for Subfactor a or Subfactor b may not be evaluated further.
1. The overarching evaluation approach for all factors and subfactors is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.
b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques.
The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.
2. TECHNICAL EVALUATION: The Technical factor is divided into the following sub-factors and will be evaluated on an overall basis using the following color/adjectival ratings:
Subfactor a: Bonding Capacity and Rate
In order to be considered for this construction contract, your company will be evaluated on its ability to provide evidence from your chosen Surety that you can obtain payment and performance bonds in the amount of $15 million per year of performance. This is a minimum requirement, and any amount lower than this will be considered a deficiency in your proposal. It is essential that you submit documentation with your proposal that demonstrates your Surety's commitment to providing bonds in this amount, specifically for this contract. Failure to provide this evidence may result in your proposal being deemed non-compliant and unawardable.
Subfactor b: Safety Record
The Government will evaluate the offeror’s (to include major subcontractors and both JV partners, if a JV is proposed) recent record of safe operations based on its Experience Modification Rate (EMR). NOTE: An EMR of greater than 1.0 during any portion of the previous three (3) year operating period will be considered unacceptable (a deficiency).
A major subcontractor is defined as a subcontractor which is expected to perform 15% or more of the total work on the contract.
Offerors who can demonstrate EMRs of less than 1.0 during the previous three (3) year operating period with an emphasis on the most recent operating years will be considered acceptable.
The Government will evaluate the offeror’s (to include major subcontractors and both JV partners, if a JV is proposed) recent record of safe and regulatory compliant operations based on its OSHA recordable injuries/illnesses reports and its Days Away Restricted or Transferred (DART) rate. The offeror’s DART rate shall be at or below the industry average for NAICS code 236220 for at least the previous three (3) year operating period. A major subcontractor for this subfactor is defined as a subcontractor which is expected to perform 15% or more of the total work on the contract.
Offerors who can demonstrate DART rates which are lower than industry average during the previous three (3) year operating period with an emphasis on the most recent operating years may earn evaluated strength(s) which could increase the Technical
Factor rating. Offerors who can demonstrate DART rates, which are lower than industry average for additional operating years beyond the required three (3) year period may also earn an evaluated strength which could increase the Technical Factor rating.
Subfactor c: Key Personnel (Reference PWS paragraph 1.6.11 and subparagraphs)
