SECTION H - SPECIAL CONTRACT REQUIREMENTS

H.1 OPTION

This contract provides 557,285 hours over the contract term (see Section F.2) The Government is not obligated to exercise all of these hours, and if exercised, can be exercised in one or more increments. The current balance of available hours under this contract is set forth in Section H.1.3 below.

Hours will be exercised for Work Directive(s), which can be either Level-of-Effort (LOE) or Completion. The Government has the unilateral right to exercise LOE work directives. The Government and the Contractor may bilaterally exercise Completion work directives.

LOE describes the work in general terms and obligates the contractor to devote a specified level of effort for a stated time period. At its discretion, the Government may exercise additional LOE hours to complete the effort. The contractor is not authorized to incur effort in excess of the specified LOE hours. Any costs incurred for excess effort are unallowable.

Completion Scope describes a Work Directive that states a definite goal or target and specifies an end product. Completion Scope requires the contractor to complete and deliver the specified end product (e.g., a final report of research accomplishing the goal or target) regardless of the number of hours awarded and/or performed. In the event the contractor cannot complete the scope within the estimated cost, the Government may require more effort without increase in fixed fee, provided that the Government increases the estimated cost.

H.1.1 LEVEL-OF-EFFORT (LOE) OPTIONS AND SCHEDULE

For the purposes of LOE, an hour is defined as a deliverable labor hour, which can consist of subcontracted labor hour provided the subcontract is LOE.

H.1.1.1 The Government has the unilateral right to award hours for LOE Work Directive(s) under a new LOE CLIN, or exercise hours against an existing LOE CLIN utilizing the Schedule(s) for estimated cost and fixed fee.

H.1.1.2 Schedule(s)

The below rates includes all direct and indirect costs for establishing the estimated cost associated with the WD LOE. The labor category applicable to an individual WD is based on the preponderance of effort. The labor raate applicable to an individual WD is the price for the ordering year in which the order is issued. The period of performance does not determine the ordering year.

The estimated costs are separate categories. (Labor) and (Material, Travel & ODCs). These costs reflect a fully burdened rate including direct costs, applicable overhead, and General and Administrative costs. The two cost categories added together equal the

Total Estimated Cost Per Hour. The Fixed Fee Per Hour is added to the Total Estimated Cost Per Hour giving the Total Per Hour.
