Section A - Solicitation/Contract Form
NARRATIVE
A.1 Description of the Action.
A.1.1 The Build-to-Print solicitation is issued for the build and fabrication of parts, components, and assemblies based on Government-provided drawings, models, technical data packages or Indented Bills of Material. A component part number will be included on each Request for Delivery Order Proposal (RFDOP) and a technical data package will be provided as needed. The resulting contract awards will be for hardware components only, no services.
A.1.2 The solicitation will be set-aside for Women Owned Small Businesses (WOSB) certified through the Small Business Administration.
A.1.3 Pursuant to FAR 19.1503(b)(3), offerors must have all required WOSB eligibility documents in the WOSB Program Repository currently available at Certify.SBA.gov (Certify), at the time of their initial offer. The list of required documents is provided in Certify.SBA.gov/prepare. Please note that offerors are no longer required to complete and upload SBA Form 2413, 2414 or 413 to certify as these forms are completed online at Certify.SBA.gov. If the apparent successful offeror does not have all documents in Certify.SBA.gov, it will be referred to the U.S. Small Business Administration (SBA).
Offerors that need assistance in submitting the documents through Certify are advised to contact the SBA Office of Government Contracting at wosb@sba.gov.
A.2 The resulting contracts will be five year Multiple Award, Indefinite Delivery, Indefinite Quantity (MA IDIQ) Contracts. The parts, components and electrical assemblies will be Firm Fixed Price (FFP).
A.3 IAW FAR 16.504(a)(4)(ii), the contractor will be required to submit a priced Quality Assurance Program Plan (CDRL A003) to meet the $500 minimum contractual requirements for each base IDIQ awardee. The Government will pay $500 for the Quality Assurance Program Plan, to meet the minimum contractual requirement for this effort. The minimum contractual requirement will be ordered in Delivery Order 0001. After the minimum contractual requirement has been ordered by the Government, the Government will not have any obligation to purchase further quantities. The maximum ceiling amount for the combined base contracts over five ordering years is $19M.
A.4 Solicitation Structure
A.4.1 The Government will utilize the North American Industry Classification System (NAICS) codes listed below:
Small Business Size Standard (employees)
332999, All Other Miscellaneous Fabricated Metal Product Manufacturing 750 336992, Military Armored Vehicle, Tank, and Tank Component Manufacturing 1,500
These NAICS codes will also be assigned to each base IDIQ contract and all subsequently awarded delivery orders, based on contractor eligibility.
A.4.2 System for Award Management (SAM). Failure to register in SAM for the corresponding NAICS code identified in paragraph A.4.1 prior to submitting a proposal against the Build to Print solicitation may preclude an award from being made to your company. Offerors should be aware of how U.S. Small Business Concerns are defined in FAR Part 19, Defense Federal Acquisition Regulation Supplement (DFARS) Part 19, and 13 CFR 121, Small Business Size Regulations. Offerors are advised to review 13 CFR
121.103 “How Does SBA Determine Affiliation.”
A.4.3 This solicitation will be set aside for WOSB only. Each new requirement will be competed among the WOSB’s awarded an IDIQ contract.
A.4.4 Each NAICS code identified in A.4.1 will have an assigned CLIN. Each MA IDIQ base contract award will include only the CLINS for which the awardee is eligible to compete.
A.4.5 Multiple IDIQ awards will be made as a result of this solicitation. Contractors that meet the criteria beginning in Section L.4 and are awarded an IDIQ contract will be eligible to compete for individual requirements. Notification of a requirement will be made to eligible contractors using a Request for Delivery Order Proposal (RFDOP). Delivery Orders will be awarded based on a Lowest Price Technically Acceptable (LPTA) basis.
A.5 The fair opportunity provisions within FAR 16.505(b) – Ordering-Orders under multiple-award contracts, will apply to all delivery orders issued against the contract, unless an exception applies IAW FAR 16.505(b)(2).
A.6 Each Delivery Order Proposal (DOP) will be evaluated In Accordance With (IAW) the evaluation criteria as described in Section A.4.5 above and as set forth in the Request for Delivery Order Proposal (RFDOP) to determine the contractor awardee. Technical support to assist in the evaluation process will be provided by the requiring activity, if required. The Contracting Officer will control all exchanges with contractors.
A.7 Delivery orders will be solicited, negotiated, and awarded as bilateral orders, unless a unilateral delivery order is in the Government’s best interest.
A.8 The contractor is not authorized to commence performance without a signed delivery order. The Contracting Officer shall be the only individual authorized on behalf of the Government to accept non-conforming work, waive any requirement of the RFDOP, or, modify or waive any term or condition of the RFDOP.
A.9 Ordering Periods. See H.1.1.4 below. IAW Section H.2.3 – Off-Ramping, Contractors that have not submitted any delivery order proposals during the base year period after winning an award as a prime contractor at the IDIQ level will not be eligible for future delivery order awards.

(5) For additional information on submitting electronic bid responses via the FBO system see the FBO Vendor Guide – Section 4.3.1 “Submitting an Electronic Response” (https://www.fbo.gov/downloads/FBO_Vendor_Guide.pdf).
Note to offerors:
(d) Please pay close attention to the Issued By block location on the cover page of the solicitation for closing date and time. The closing date and time is based on the local time of the listed location of the Issued By office. In accordance with FAR 15.208(a), offerors are responsible for submitting proposals, and any revisions, and modifications, so as to be received by the Government office designated in the solicitation by the time specified.
(e) It is the responsibility of the Offeror to ensure the proposal/quote is received by the date and time specified on the cover page of this solicitation. In accordance with FAR 15.208, if the proposal/quote was not received at the initial point of entry to the Government infrastructure (in this case, received through FBO) by the exact date and time specified on the cover page of this solicitation, it will be determined late. Proposal/quote is defined to mean ALL volumes or parts required in the solicitation are included in the electronic submission.
Note: There is no "expected" or "target" length of time for proposal submission; size and content may be factors, therefore offerors are strongly cautioned when submitting proposals to allow adequate time for submission.
(f) Solicitations may remain posted on the FBO after the solicitation closing date. If the response deadline has passed for the solicitation, vendors will no longer be able to submit electronic responses.
(g) Any award issued as a result of this solicitation will be distributed electronically. In the event of a FOIA request for a copy of any award issued as a result of this solicitation, or any subsequent modifications to the contract, the contract and modifications will be released, including the awarded unit price. This is the notice required by Executive Order 12600 (June 23, 1987) of the Government’s intention to release unit prices in response to any request under the Freedom of Information Act (FOIA), 5 USC 552. Unit price is defined as the contract price per unit or item purchased as it appears in Section B of the contract and is NOT referring to nor does it include Cost or Pricing data/information. If an Offeror objects to such release in the base contract or contract modifications, the Offeror must notify the contracting officer in writing prior to the closing date identified in this solicitation and include the rationale for the objection consistent with the provisions of FOIA. A release determination will be made based on rationale given.
(h) Questions pertaining to this solicitation should be directed to the Contract Specialist identified on the cover page of this solicitation. For technical assistance in doing business with the Government, and doing business electronically, please visit the Procurement Technical Assistance Center (PTAC) website at http://www.aptac- us.org/ to locate a regional center.
