(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the

Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the

Contractors date of receipt of the contract or notice of award by adding

(1) five calendar days for delivery of the award through the ordinary mails, or

(2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term working day excludes weekends and U.S. Federal holidays.) SECTION M - EVALUATION FACTORS FOR AWARD

M.1. BASIS OF AWARD: The Government plans to award a single Firm-Fixed Price Contract for W56HZV-19-R-0173 as a result of this solicitation. The Government reserves the right to choose not to award a contract, if such action is in the Government's best interest.

M.1.1.1 There are two evaluation factors:

(a) Technical Factor

(b) Price Factor

M.1.1.2 Its the Governments intent to award a single contract. Award will be made using a Lowest Price Technically Acceptable (LPTA) in accordance with FAR 12.6, which states award will be made on the basis of the lowest total evaluated priced proposal meeting the acceptability standards for non-cost factors, to an offeror that is eligible for award. The Government will follow the process set forth in Section M.3 below.

M.1.1.3 AWARD WITHOUT DISCUSSIONS: In accordance with FAR clause 52.212-1(g), the Government intends to evaluate proposals and award a contract without discussions with Offerors (this excludes clarifications, as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical capability standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, the Government reserves the right, without entering discussions, to request additional information necessary to support the offerors price in order to determine price reasonable. If discussions are held, they will be conducted with all offerors included in the competitive range.

M.2 REJECTION OF OFFERS

M.2.1 The Government may reject any proposal if doing so is in the Government's best interest at any time after receipt of proposal.

Examples include, but are not limited to, the following proposal conditions:

(a) The proposal fails to meaningfully respond to the instructions in Section L of this solicitation (e.g.. fails to respond to all items in the Specification (Attachment 0001) and Technical Information Questionnaire (Attachment 0002); fails to provide the required substantiating data outlined in the Spec and TIQ, fails to submit pricing information in accordance with the instructions, fails to follow key proposal instructions or format requirements in Section L; or fails to provide data and information required in Section L);

or

(b) When an offerors proposal offers a product or service that does not meet all stated material requirements of the solicitation; or

(c) The proposal proposes exceptions to the solicitation requirements, attachments, exhibits, enclosures, or solicitation terms and conditions; or

(d) The proposal contains one or more Organizational Conflict of Interest (OCI) OCIs that cannot be avoided or mitigated; or

(e) The proposal fails to include clause fill-ins ________

M.3 EVALUATION PROCESS:

M.3.1 The evaluation will be conducted in accordance with FAR 12 Acquisition of Commercial Items. There are two factors: (1) Technical

Capability and (2) Price.

M.3.1.1 Unless otherwise rejected, proposals will first be sorted by lowest proposed price to highest proposed price. The Government will then conduct transportation evaluations starting with the lowest proposed price. The Government will continue to conduct transportation evaluations until the total evaluated price of an offerors proposal is lower than the next offerors proposed price. Once this point is reached, the Government will stop conducting transportation evaluations.

M.3.1.2 Unless otherwise rejected, each proposal RFP will first be evaluated to determine a Total Evaluated Price. The Government will then conduct an evaluation of the Technical Factor on an Acceptable/Unacceptable basis on the offeror with the lowest Total Evaluated

Price. If the lowest total evaluated priced proposal is determined to be Unacceptable or is otherwise ineligible for award, then the

Government will conduct a technical evaluation on the next lowest total evaluated priced offeror's proposal. Unless the Government determines it is in its best interests to conduct discussions, the Government will follow this process until the lowest total evaluated price, technically acceptable proposal is identified.

M.4 CONTRACTOR RESPONSIBILITY AND ELIGIBILITY FOR AWARD

(a) The Government will award a contract to the offeror that:

(1) Submits the lowest total evaluated price to the Government,

(2) Submits a technically acceptable bid or proposal,

(3) Submits a bid or proposal that meets all the material requirements of this solicitation, and

(4) Meets all the responsibility criteria at FAR 9.104.

11 13

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

(b) To make sure that an offeror meets the responsibility criteria at FAR 9.104 the Government may:

(1) arrange a visit to the offerors plant and perform a preaward survey;

(2) ask the offeror to provide financial, technical, production, or managerial background information.

(c) If the offeror does not provide the Government with the data requested within 7 days from the date the requested is received, or if the offeror refuses to have an onsite visit to the offerors facility, the Government may determine the offeror to be nonresponsible.

(d) If the Government visits the offerors facility, please make sure that current certified financial statements and other data relevant to the bid or proposal available for Government personnel to review.

M.5 EVALUATION CRITERIA:

M.5.1 TECHNICAL CAPABILITY FACTOR: For an offeror to be eligible for award, its proposal must be assessed as Acceptable under each section of the Technical Information Questionnaire (TIQ) (Attachment 0002). Offerors found to be unacceptable under any section of the

TIQ will not be considered for award. To determine Acceptability,

(1) the offerors response must indicate it can meet each requirement on the TIQ; and

(2) where supporting documentation is required, the Government will review the information submitted to confirm that the offeror is capable of meeting the requirement.

An acceptable proposal is one which clearly meets the minimum requirements of the solicitation. An unacceptable proposal is one which does not clearly meet the minimum requirements of the solicitation.

M.5.2 PRICE FACTOR: The Price Factor evaluation will consist of the following:

M.5.2.1 Total Evaluated Price: The Price Factor evaluation will result in a determination of the Total Evaluated Price. The Total

Evaluated Price equals the sum of (a) the proposed prices for all CLINs 0001AA thru 0001AC and (b) the transportation costs determined by the ACC-Warren Transportation Office for all FOB Origin CLINs.

M.5.2.2 Price Reasonableness: The Government will assess the reasonableness of the offerors proposed price. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

The Government may make a determination of price reasonableness by any means allowable under FAR 15.404-1.

M.5.2.3 Unbalanced Pricing: Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items or ranges is significantly over- or understated as indicated by the application of cost and price analysis techniques. Offerors are cautioned that a proposal the Government assesses to be unbalanced as to price, may either be rejected or determined unacceptable for award. See FAR 15.404-1(g) for more information on unbalanced pricing.

*M.6 METHOD OF EVALUATION FOR F.O.B. ORIGIN TRANSPORTATION OFFERS

For the evaluation of this offer, we will use the lowest freight rates from the Transportation Officer that are:

(a) On file or published with the Transportation Officer at the time of evaluation

(b) For the Government selected method of shipment, and
