Q&A One

Question NumberRFP / PWS / Attachment / CDRL Reference and TextPage #, Paragraph #Question/CommentAnswer
11.6.1 Phase-In /Phase-Out Periodp2 PWSAs there is no is no requirement for a Phase-In or Phase-Out period, can the Gov't advise when the base contract award will be made in relation to Start Date of 1 October 2019 - i.e. would there be a period to support mobilizationWhen award is made, a task order for a post-award conference will also be awarded. This is the only guaranteed performance under this Indefinite Delviery/Indefinite Quantity contract. There is no requirement for a phase in period under this contract.
23.2 Facilitiesp10 PWSIn our experience, base access is a delaying factor if driver details are not held on a database for multiple events/missions. Where Installation Access is required, will this be for each and every mission, or will a driver and asset be granted access if returning to the same installation within a given period? The information for each driver will need to be updated for each mission. If the same driver is completing multiple trips on the same mission, then driver information will not need to be updated. Each mission is an individual task order and will need driver and truck information for each mission.
34.3 Materials and 5.6 Cancellationp11;p17 PWSWhere Missions are cancelled after Permits and other Clearance expenses have been incurred by the contractor, what type of reimbursement can be expected from the Gov'tThe Government will pay 100% of the permit & clearances on a cost reimbursable basis but only with the invoice from the Road Administration office of the country(ies) from each individual task order. The contractor must submit the invoice for the reimbursement and only the cost of the permit & Clearance shall be covered.
45.2.2p13 PWSWhere the Contractor shall furnish details of Driver, Asset - will this be required on excel sheet, or will actual copies of documents be requiredThe Government requires the needed information on an Excel spread sheet. A copy of each drivers' passport are the only documents that need to be provided with the excel spread sheet when submitting the packet.
55.2.2.1p13 PWSIf Driver and Asset Details are provided 20 days ahead of time for normal missions - would it be possible for the contractor to provide additional back-up assets as a contingency if one or more dropped out in the 20 day lead -timeIf there multiple drivers for the mission, the same information shall still be required for all drivers and assets. It is possible to plan for contingencies on a non-reimbursable basis.
65.2.8.1p15 PWSRDD is mentioned through the PWS, but what is the Governments process to advise the contractor of RLD's, and expectation to meet the RLD windowIf you are referring to the loading date, the Government will always provide the movement window for the mission including the loading date and the required delivery date.
752.212-2p16 RFPThe PWS states “this 3PL contract is for the transportation of equipment, cargo, and passengers within the European Command (EUCOM) Area of Operations. The EUCOM Area of Operations includes all European nations, with the exceptions of: Iceland, Malta, Holy See, Monaco, San Marino, Malta, Kazakhstan, Republic of Ireland, Belarus, and Russia”. Question – the PWS shows service throughout EUCOM but the Cargo Price List only shows Vlissingen Port, Netherlands to Poland. Is this only for pricing comparison? What about pricing for all other city pairs? There was no Attachment 1 on the website FBO.Please refer to the solicitation, page 19, FAR Clause 52.212-1 Addendum, which states: "The Government will evaluate the priced effort of the equipment movement from the

Netherlands to Drawsko Pomorskie, Poland that is given in the solicitation Attachment 01. Cap rates for ceiling prices for the future movement of the set amount of equipment between Vlissingen Port, Netherlands, and Drawsko Pomorskie, Poland, in Attachment 01 will be set for awardees, based on proposed rates." While these rates are set as a ceiling for this route only, all other routes will be competed at the task order level, amongst contract holders. Please refer to 52.216-22 on questions regarding the contract type which will be awarded, an Indefinite Delivery/Indefinite Quantity (IDIQ) contract.

8 52.225-17 RFP We note that it is possible to quote in foreign currency and the US Government will convert to US Dollars basis posted exchange rates. However if quoting in US Dollars and the currency fluctuates between offer and movement, what is the contingency or contractor recourse? The exchange rate used for evaluation of offers will be pulled from xe.com on the date the proposal are due, per FAR 52.225-17. Differences in exchange rates between Prime Contractor and subcontractor are the responsibility of the Prime Contractor and shall be accounted for at the time of the task order proposal.

9 52.228-3 RFP We note Defense Base Act cover is required. Will ACC support an exemption to use local supplied workers compensation insurance? While an exemption to the entire DBA is not possible, please note that most of the countries within the operating area of this contract is waived per the Department of Labor (https://www.dol.gov/owcp/dlhwc/dbawaivers/dbawaivers.htm).

10 52.228-9 RFP We note the requirement for third party cargo insurance. Can the ACC declare the value of the goods being transported? Does ACC have a minimum acceptable deductible? Does ACC have a minimum insurance provider rating? ACC does not have a minimum deductible, nor does it have a minimum insurance provider rating. Insurance shall be in accordance with best commercial practice, as this is a commercial based contract.

11 In the RFP - The validity of the offer in page 10 is 30 days, and in page 12 it is 90 days.

Can this be clarified? The offer validity shall be for 90 days. The solicitation has been amended to update page 10.

12 252.247-7003 RFP Will ACC consider a fuel adjustment? Per reference 252.247-7003 directs a pass thought of any fuel adjustment to the bearer of the fuel expense. However nothing in the contract further addresses how any fuel adjustment would be

applied or collected for the bearer of this expense. The contractor must take into account the possible fluctuations in fuel prices. However, any significant change, either increase or decrease, the contractor or Government may request an equitable adjustment.
1352.212-2RFPWe note that the rates offered will be converted

into ceiling rate for the specified route only. Can ACC guide how it might handle smaller quantities on this route? Acquisition costs for conveyances are dependent on the total number of conveyances needed. Are these Not to exceed prices or ceiling prices applicable on a line item basis? Further MHE cost is a per hour cost with minimum hours. Basis the full cargo list the cost of MHE per piece is significantly different than if the shipper was moving only one or two pieces. This cargo list shall be priced as if that entire lot of equipment is moving from Vlissingen Port, Netherlands to Drawsko Pomorskie, Poland. The contractor will only be held to this ceiling price if every single item on this list is moved at the same time. Outside of this list, for other movements (even larger or smaller movements to these locations), the task orders will be competed amongst the Contract holders. As a reminder, this is expected to be a multiple award IDIQ contract, where more than one vendor will receive a contract. These contract holders will compete for movements at the task order level.

1452.212-1 ADDENDUMRFPWould the Government please clarify the submittal requirement for major subcontractors? Five pages describing recent and relevant experience? Five pages with five contracts containing Section 1 requirements? Five pages with five contracts containing Section 1 and Section 2 requirements? OtherThe Government has removed the requirement to include major subcontractor information in the proposal. Refer to Amendment 0002 to the soliciation for the changed clauses FAR 52.212-1 and 52.212-2.
15Will this project be a full and
open competitive procurement? This procurement will use full and open competition.
16Can we submit our offer for afformentioned project? All interested parties may submit an offer for this procurement.
17Is it limted only US located companies? This procurement is NOT limited to US located companies.
18CLIN ITEM NO 0005 Surge T&M - The Government may require surge support during the task order period. If the Government determined that an increased quantity for support is required for the task areas defined in the PWS, the Government reserves the right to exercise the Surge CLIN unilaterally. Surge will be provided at the same time and material rates proposed and found fair and reasonable at time of task order award for the applicable ordering period. Would the Government please explain how the Contractor is to develop and propose a Surge T&M rate for the task areas defined in the PWS (Part 5 Specific Tasks), when all other CLINS are FFP and notime and material rates are proposed at time of task order award for the applicable ordering period? Would the Government please provide a Surge example to be priced to include hours, locations, personnel numbers and skill sets, equipment, and destination? Please be aware that we are not establishing a T&M rate at this point in the procurement process. As stated in CLIN 0005 and also on pg. 17 under Factor 2, “Due to the nature of this procurement, with unknown factors at the level of base award, the T&M/LH portion of this acquisition will be competed at the task order level.”
19FAR 52.212-1RFPWhere can the Past Performance Questionnaire Forms be found? We have deleted this requirement. Please see amendment 0001 that was posted on FBO.gov on 17 July.
201.6.2PWSPWS 1.6.2 – The Project Manager must be available from 0800 to 1700, Monday through Saturday. What time zone are these times referencing.Central European Time
21PWS 5.7.120Please clarify the not to exceed 10 hours statement. For example, if unloading is delayed for 20 hours after a designated RDD time, will the contractor be entitled to 16 hours of delay time fees (20 hours less the 4 hours free time) or will delay time be capped at 10 hours?5.7.1 refers to waiting time caused by the Government and the time is capped at 10 hours as the Government anticpates that after 10 hours we will have canceled the order.

5.7.2 refers to the wait time caused by the contractor. The Government will provide a 2-day delay window for the contractor to upload or download assests or passengers. If the delay will exceed 2-days then the Government will decide the next course of action, e.g. cancelation or extend the RDD date.

We will provide an amendment to change the language in the PWS.

22PWS 8.1.123Please confirm the USG's intent to issue notice of FOPRs using FedBizOpps, or will the notices for these delivery order requirements be sent only to 3PLEWM ID/IQ contract holders via email?Solicitations for T.O. will be conducted via email. Solicitations for T.O. will not be posted on FedBizOpps.
23RFP 52.212-1(3) c13Proposal Submission Requirements states that “each file of the proposal shall consist of a Table of Contents, Summary Section, and the Narrative discussion.” Will the Government please confirm that the Summary Section requirement does not apply to Volume IV?that is correct, a summary section is not required for Volume IV.
24RFP 52.212-1(2)c13Proposal Submission Requirements state that Manpower charts are excluded from the page count; however, 52.212-1 makes no other reference to a Manpower chart being required with the proposal submission. Will the Government please clarify if a Manpower chart is required with submission and where offerors should address such requirement? We will remove "manpower charts" from the requirement.
25RFP 52.212-1(3)(c)(ii)14The RFP states that “The offeror shall ensure that the information submitted in this volume is consistent with and fully supports the amounts set forth in the SF1449 and continuation sheets.” Should offerors submit completed SF 1149 Continuation Sheets with the Volume II submission? No, the SF1449 continuation sheets shall be submitted with Volume IV as perscribed in the solicitation. The cost/price spreadsheet shall be submitted under Volume II as perscribed in the solicitation. If you are referring to pricing information shown on the continuation sheets, pgs. 3-6, this is only to establish CLINS and an total amount of value to each CLIN. No pricing shall be filled out on the continuation sheet of the SF 1449.
26PWS 4.3.211The PWS sates at 4.3.2 that "The contractor shall provide the application number for War Weapons Control Act permits to the U. S. Government in order to provide a letter of support to the transiting countries, if needed." Our understanding is that the U.S. government submits the original application to the German government for approval to move cargo covered by the War Weapons Act through Germany. Please clarify the discrepancy between our understanding and the wording of the PWS.For Weapons of War permits in Germany, we endorse the contractor as our agent to move the specified cargo. This can either be for a set unit move from origin to destination or time based to move specific cargo over a period of time. The contractor takes this information to the Minister of Economics and obtains the permit. This process has worked successfully many times over the last 18 months. With the award of the contract we will attempt to endorse the awarded companies for a blanket permit over the year to eliminate the need to process event permits
27Could you clarify the HAZMET category, quantity and UN No. for lines #69 and #76 in doc 3PLEWM_Cargo_PriceList.xlsx. Please provide material data safety sheets (MSDS) for all dangerous goods contained in this shipment. We have decided to change lines #69 and #76 to NO (not HAZMAT). A new cargo list will be posted on FBO.
28Would the Government please explain how the Contractor is to develop and propose a Surge T&M rate for the task areas defined in the PWS (Part 5 Specific Tasks), when all other CLINS are FFP and no time and material rates are proposed at time of task order award for the applicable ordering period? Would the Government please provide a Surge example to be priced to include hours, locations, personnel numbers and skill sets, equipment, and destination? Please be aware that we are not establishing a T&M rate at this point in the procurement process. As stated in CLIN 0005 and also on pg. 17 under Factor 2, “Due to the nature of this procurement, with unknown factors at the level of base award, the T&M/LH portion of this acquisition will be competed at the task order level.”
291. Reference: Sol p14 - Vol 1 - Technical Section 2 states “"How does the offeror coordinate and obtain 60 buses with trailers per day at the rate of 20 buses per 3 locations within Europe for 45 days? Location of pickup are Brussels, Belgium, Nurnberg, Germany, and Warsaw, Poland."

Comment: From the text we understand that the Contractor is required to provide 60 Buses with pick-up locations in Brussels, Nurnburg and Warsaw - we assume the troops will be going to the destination of Drawsko Poland. However, the solicitation does not make that clear, and if other destinations will be travelled to during the 45 day period.

Question: Will the buses collect troops from the three locations mentioned, and take them (one-way) to Drawsko Poland, or what other journeys and distances will the buses be expected to make.

The goal of the question is to ascertain a company’s ability to provide this amount of busses at these location. There is no destination for these busses.
29Solicitation page 3 ITEM NO 0001 is titled Pre-Award Conference. Should this CLIN be titled Post Award Conference?Correct. This will be corrected by amendment 0004.
30As the Government has previously used One Time Only (OTO) Tenders to accomplish this work, can the Government please share historic workload data on dedicated support personnel to help calculate ceiling / CAP rates?Based on the requirements being contracted (3PL vs Truck Transportation), this contract is materially different than the OTO/Tender program. There is no workload data available.
31Will the Major Subcontractors need to be registered on the Joint Contingency Contracting System (JCCS) portal? This requirement is not a Contingency acquisition, therefore, registration is not required.
321. Solicitation page 6 ITEM NO 7501 eCMR - The Contractor shall report all Contractor manpower employed for the performance of this contract. The contractor shall complete all required fields in the reporting system using the web address: https://cmra.army.mil. The requiring activity will assist the Contractor with the reporting requirement as necessary. If the contractor is experiencing difficulties registering in the eCMR website, an Excel spreadsheet can be obtained from contractormanpower@hqda.army.mil and the data will be put into the application. Question: Per the instructions to register or request excel sheet - We have been unable to access the URL https://cmra.army.mil and also have received undeliverable messages when emailing contractormanpower@hqda.army.mil. Would the Gov't consider posting the relevant excel attachment on FBO so Offerors may download it from FBO?The website address was recently updated to www.ecmra.mil . This will be updated in an amendment.
33To help calculate through put and MHE requirements, will the Cargo at Vlissingen be loaded direct from Ship to Asset or will the 150 pieces of equipment be free on Dock for the Required Loading Date?Material will be on dock for pickup.
34What capacity area will the Gov't make available at the destination facility in Drawsko, Poland? This information is not known until time of delivery of material outlined in the task order.
358. Reference: Price Sheet - Line 108 Cargo - AVLB-70.

Comment: The pricing sheet mentions a number of armored vehicle-launched bridge (AVLB-70) vehicles. Within some European Countries, Cargo of this nature has to be dismantled.

Question 8a: Can the Government confirm if the vehicle is complete with bridges. If so, will the Government dismantle this equipment prior to being made available for loading? Question 8b: Can the Government provide weight and dimensions for the bridges and vehicle separately?

8a: For the purposes of pricing the cargo list, Government will dismantle the folding portable bridge from the vehicle.

8b: Bridge weight: 13.3 Tons Tank Vehicle weight: 44.7 Tons

36 9. Reference: PWS 3.1.4 p10 and Pricing Sheet Lines 69 & 76

3.1.4 Any Government transportation request shall state amount and type of cargo, metric dimensions and weight by item, origin, destination, spotting date/time, Required Delivery Date (RDD) and, if applicable, all hazardous cargo information including UN numbers, nomenclature, or any other cargo characteristics required by a Contractor to plan adequate asset(s).

3.1.4 of the PWS state that all Hazardous Cargo information will be provided in advance of the order.

Question: Two lines in the pricing sheets are listed as hazmat - Can the Government please advise the nature and class of this hazard?

Answer: The hazardous material has been removed from the Cargo List. No pricing for HAZMAT is required.
37RFP, page 18, Section C, 3 Cost/Price Factor references Attachment 01. Would the Government please confirm that Attachment 01 and the 3PLEWM_Cargo_Price_List are one and the same document?3PLEWM Cargo List is Attachment 0001.
3811. Reference: Amendment #0002 was issued to remove the requirement for submission of major subcontractor contract and performance information. Please refer to 52.212-1 and 52.212-2 for the change in requirement. Comment: 52.212-1 for Volume III Past Performance (3) Section 3 – Subcontractors still contains the following language “Offerors shall provide an outline of how the effort required by the RFP will be assigned for performance within the offeror's corporate entity, including its procedures for hiring subcontractors. The information provided for the prime offeror and each proposed major subcontractor must include the entire company name, company address, CAGE Code, DUNS Number and type of work to be performed by citing the applicable Government PWS subparagraph number. This includes all subcontractors who will be providing critical hardware/services or whose subcontract is for more than 10% of the total proposed cost/price. This section will further include written consent of major subcontractors to allow the disclosure of their past performance information to the Offeror. In addition, letters of commitment shall be included for all major subcontractors”.

Question: Is Volume III Past Performance (3) Section 3 – Subcontractors requirement to be removed or addressed?

While we are not requiring the submittal of subcontractor information, if subcontractor information is submitted, their past performance will be evaluated the same as the contractor.
39PWS 1.2.2 Administrative Responsibility: The Contractor shall provide and maintain accurate and complete records, files, and libraries of documents to include: European regulations, standards, provisions, codes, laws, and manufacturers’ instructions and recommendations that are necessary and related to the functions being performed. Manuals and regulation books change annually or bi-annually, for instance the 3ea ADR books cost 3000 Euros and need to be replaced every 2ea years or when a change happens. We would need 4ea copies, 3ea used on the ground and 1ea in the office as a backup. Some regulations can be digital but the rest need to be hard copies. Would the Government be open to changing these documents/manuals/ regulations in a different way? This requirement will be deleted by

amendment.

40 PWES 1.4 Scope - The contractor is responsible for recovering their disabled equipment and the loads, and repair / replace disabled equipment per requirements of delivery. Please provide clarification in regard to the timeframe for the recovery and any expectations by the Government. The Government expectation is that the delivery will be by the required delivery date, regardless of contractor disabled vehicle/equipment.

41 1.6.1 Phase-In /Phase-Out Period: There is no requirement for a Phase-In or Phase-Out period. The Contractor shall be responsible to ensure that services are fully available for execution on the first day of contract performance. Since all personnel will require MFAST and other Government owned software authorization and profiles made, which can take a month before they are allowed access if they have a CAC. Would the Government consider sponsoring personnel with a CAC 30 - 60 days prior in order to be granted access to required systems? Task orders will not exceed 6 months, and will only require sporadic installation access. Therefore a CAC or non-CAC installation access card is not needed.

421.6.6 Recognized Holidays: ….The Contractor must coordinate with the specified COR and/or U.S. Government Movement Control Elements to ensure that commercial truck transportation needs are fulfilled prior to or immediately following the holiday and that timely transportation delivery are maintained.Would the Government provide clarification on the holidays recognized?
435.2.1 The Contractor shall not post any U.S. Government intended transport on a commercial electronic platform/Internet in order to obtain a subcontractor. Please provide more clarification regarding the restrictions on posting on a bulletin board, etc. Without posting on a bulletin board is the contractor allowed to contact other vendors/subcontractors in reference to the job?The contractor may contact other

vendors/subcontractors via any method that does not put the information in a place that can be reached by adversaries. The purpose of not-allowing the access on the internet is for the Operational Security of the personnel/mission.

44 PWS 5.2.2 The Contractor shall furnish driver(s) name, nationality, passport number, trucking and trailer license number, make and model (and company’s name, if a sub-Contractor is used), for each scheduled transport within twenty (20) calendar days of mission execution. For short notice missions, the information shall be provided within forty-eight (48) hours of task order issuance. Would the Government consider changing the requirement for information being provided within 48 hours of TO issuance to 12 hours for short missions? Based on the requirements for documentation for travel within Europe, 48 hours is the least amount of time that can be given.

451. Please clarify if the Government is using Holland as a guide for costing due to the recent EDRE?No.
462. Some of the equipment listed requires High/Wide/Heavy paperwork submitted. This takes more time to process through each country which increases costs and can cause issues with tight timeframes. Is this the Government’s intent? No. The Government's intent is to receive a

priced list for evaluation purposes to cap rates for this movement only.

47 3. Some equipment listed falls into the ADR category which requires special drivers, truck and trailers or purge certificates. This would involve additional costs involved for ADR trucks and issues with purge. Please provide clarification if this is the Government’s intent. No. The Government's intent is to receive a priced list for evaluation purposes to cap rates for this movement only.

484. There are only 2ea HAZMAT items listed and, the category is not stated. Please provide clarification on the categories intended.HAZMAT has been removed from the requirement.
495. MHE requirements depend on Origin/Destination capabilities. Will this information be provided in in advance? Otherwise, if we have to deliver RTCH, special permits need to be submitted for transport which is an incurred cost. This information will be provided at the

task order level.

506. Some equipment could be classed as "War Material" which means it would need to be on Green Fleet not civilian transport to cross international borders. Would the Contractor be considered Green Fleet?A contractor will not be classified as green fleet. However, war material may be moved by commercial carriers, per the War Weapons Control Act. Please see section 4.3.2 of the PWS for further clarification.
5152.212--1RFPThe government has requested, “This volume shall not exceed 25 pages plus five pages for each major subcontractor, excluding Past Performance Questionnaire Forms. Offerors shall submit five (5) Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past three years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation.” Is it the government’s intent to receive five (5) contracts total, to include prime and major subcontractors, OR five (5) contracts from the prime, and five (5) contracts for each major subcontractor?Amendment 0002 removes the requirement

for the five (5) contracts from the subcontractor.

5252.212-1RFPThe government has requested, “The Offeror shall also submit the written consent of its major subcontractors to allow the disclosure of its subcontractor’s past performance information to the Offeror. In addition, letters of commitment shall be included for all major subcontractors for their past performance to be considered.” Can the government please exclude the Letters of Consent and Letters of Commitment, from major subcontractors, from the overall 25 page count?Yes. This removal will be included by amendment.
5352.212-1RFPAmendment 0002 has removed the requirement to submit major subcontractor contract and performance information. If the subcontracting is a major part of the overall contract performance, past performance of the subecontractor may be submitted.
5452.212-1RFPThe government has requested the offeror submit evidence of five (5) Government and/or commercial contracts. Is this requirement UP TO five contracts, or must the offeror submit five contracts to be compliant with the instructions?Five (5) contracts is the maximum number of contracts to submit. The proposal may include fewer than 5. Please refer to FAR 52.212-2 for evaluation of past performance.
55RFPRFP Ref Sec C…20 buses at 3 different locations amounting to 60 buses per day for 45 days = 2,700 buses or around 108,000 - 120,000 personnel. Can the Government provide the destination for the PAX? Are they all the same locations or different? The goal of this question is to assertain the contractors ability to maintain the daily number of vehicles at the locations without a destination.
