SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

L.1. GENERAL INSTRUCTIONS. These instructions are a guide for preparing proposals in response to solicitation W560MY-16-R-0003. The instructions describe the extent of information the Offeror should provide and emphasize the significant topic areas the Offeror should address in its proposal. Each Offeror shall submit a maximum of one proposal.

NOTE: THE UNITED STATES GOVERNMENT (USG) WILL NOT REIMBURSE THE OFFEROR FOR COSTS INCURRED IN ASSOCIATION WITH THE PREPARATION OF

ITS PROPOSAL.

The Offeror is expected to review the Performance Work Statement (PWS) of this Request for Proposal (RFP) for further insight into the areas that the proposal must address. The Offeror should include in its proposal sufficient information to enable the USG to determine the Offeror's understanding of the requirements in each of the evaluated areas. Government facilities and Government Furnished Equipment

(FGE) (Attachment 0005) are to be considered when preparing proposals. OFFERORS ARE CAUTIONED THAT REPEATING LANGUAGE OF THE PWS WITH A

STATEMENT OF INTENT TO PERFORM DOES NOT REFLECT UNDERSTANDING OF THE REQUIREMENT.

Clarity and completeness are essential. Data not submitted with the proposal, but submitted previously or presumed to be known, will not be considered as part of the proposal. Proposals lacking such data or information may be considered technically unacceptable and eliminated from any further consideration. In other words, it is incumbent upon the Offeror to provide sufficient and detailed information that allows the USG to make an assessment of the Offeror's understanding and ability to successfully execute the FMP advisory effort.

L.2. POINT OF CONTACT. The Procuring Contracting Officer (PCO) is the point of contact for this acquisition. Any questions or concerns shall be addressed, in English, to the PCO and a copy provided to the Contract Specialist. E-mail is the preferred method of communication.

PCO for this acquisition: Mr. Thomas A. Petkunas

E-mail: thomas.a.petkunas.civ@mail.mil

Contract Specialist: Ms. Nancy DeBo

E-mail: nancy.b.debo.civ@mail.mil

L.3. STANDARD PROPOSAL INSTRUCTIONS. This section specifies the format each Offeror shall use in preparing their proposal. The intent is not to restrict the manner in which proposals are prepared, but rather to ensure a certain degree of uniformity in proposal format for evaluation purposes.

Four separate volumes shall be submitted. These volumes shall be self-contained and shall not be cross referenced, with the exception of the Price Volume. The Government prefers the use of blank pages as the Tabs/Dividers. Unless specifically requested, pricing information shall not be contained in any volume except the Price Volume. Proposals not structured In Accordance With (IAW) these instructions may be considered incomplete and may not be evaluated. The USG will not assume the duty to search for data or information to cure problems discovered in any proposal submitted. The burden of providing complete and thorough information to address the elements below remains with the Offeror. The proposal shall include the following volumes subject to the limitations discussed below:

Volume______ Title_____ Page Limit__________

I - Supplemental Documents No Limit

- Facility Clearance/Executive Summary 10 Pages

L.3.1. Offers shall be submitted via email to nancy.b.debo.civ@mail.mil and thomas.a.petkunas.civ@mail.mil. L.3.2. Each page is defined as one sheet, one-side. Excess pages will NOT be read or evaluated. Page limitations do not prohibit the USG from requesting additional supporting data.

L.3.3. Offerors shall use a 12 point or greater, Times New Roman font. Font requirements apply to bullets and other special text formatting, including tables and graphic displays. Landscaped pages are acceptable for tables/graphic representations;

however, each landscaped page counts as two pages.

L.3.4. Proposal Organization. No classified material shall appear anywhere in the proposal.

L.3.4.1 All proposal volumes shall include:

L.3.5. THE FREEDOM OF INFORMATION ACT (FOIA). FOIA and its amendment have resulted in an increasing number of requests from outside the USG for copies of contractors' proposals and other documents submitted to federal agencies. If an Offeror's submission contains information that it believes should be withheld from such requestors under FOIA on the grounds that it contains trade secrets and commercial or financial information [5 USC 552(b) (4)], the Offeror should mark its submissions in the following manner:

The following notice should be placed on the title page:

Some parts of this document, as identified on individual pages, are considered by the offeror to be privileged or confidential trade secret or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act.

Material considered privileged or confidential on such grounds is contained on page(s) ___.

Each individual item considered privileged or confidential under FOIA should be marked by placing the text within {brackets} with the following notice placed in the right margin: Privileged or Confidential.

Failure to do so may result in an involuntary release via a FOIA request.

Untimely submitted questionnaires may not be considered.

The Offeror is reminded that both independent data and data provided by the Offeror in its proposal may be used by the Government to evaluate past performance. One method the Government uses to investigate past performance is to read the questionnaires submitted by the Offeror and, if it chooses, to interview the points of contact provided by Offeror, and to consult the Governments past performance information computer systems listed below. The Government does not assume a duty to conduct deeper investigations, but reserves the right to do so if it chooses.

Offeror and/or references, and any other information available to determine the quality and relevance of the Offerors past performance.

However, the burden of providing thorough, complete, and current information as requested herein remains with the Offeror. Proposals that do not contain the information requested within this solicitation risk rejection or a less than acceptable performance rating by the Government. In the event that an Offeror has no past performance history, the Offeror may submit past performance information for key personnel proposed to perform the contract requirements, if available.

7 14

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

Recent, relevant past performance will be used as an indicator of the Offerors ability to perform the contract successfully. For the purpose of submitting proposals, recent is defined as occurring within the past three (3) years prior to the solicitations initial closing date. Relevant is defined as same or similar actions in terms of size, complexity, scope, and contract type performed under previously awarded contracts. Offerors shall provide a brief narrative explanation of how/why past performance is relevant; however, the Government reserves the right to determine whether an item/service is the same or similar. The Offeror will also provide any records from previous customers relating to their service performance.

Accordingly, the Offeror must propose a Fixed Unit Rate for Billeting, which must include the monthly housing cost per person, in the event that Government provided billeting is not available.

L.7.5. Any significant inconsistency between promised performance and proposed prices should be explained in the proposal. The Price

Matrix is supplied. All other information to support pricing shall be provided in the narrative of Price Volume IAW Section L. For example, if the use of new and innovative techniques has an impact on the proposed price, the offeror shall explain the impact on price.

If a management decision has been made to absorb a portion of the program costs that have not been included in the proposed pricing, that decision should be stated and quantified in the proposal. Any significant inconsistency, if not explained, raises a fundamental issue of the offerors understanding of the nature and scope of the work required. The burden of proof as to price credibility rests with the offeror.
