EXECUTIVE SUMMARY

1. This Solicitation W52P1J-20-Q-3011 is a Total / 100% Small Business Set-Aside.

2. The NAICS Code for this procurement is 238290 – Other Building Equipment Contractors.

3. The Government intends to award a single Purchase Order to the lowest-price responsible vendor that meets the requirements presented in this solicitation and also in the sole solicitation attachment work description entitled

“Fire Training Facility General Requirements”.

4. Under Contract Line Item Number 0001 (CLIN) ahead, the vendor shall legibly enter a single Total Price roll-up quotation for One Each Firefighting Training Facility. The Total Price shall include all vendor costs identified by the vendor during its review of the “Fire Training Facility General Requirements” work description, as well as vendor review of the terms & conditions of this solicitation document. Note that both the two-day training course located at Additional Requirements Item #4 and also the operations & maintenance e-manual located at Additional Requirements Item #8 are not separately priced. Therefore, the vendor shall include the costs for the training course and operations & maintenance e-manual in its Total Price quotation.

5. When appropriate, the vendor should enter its Total Price under the “NET AMT” citation located in CLIN 0001 ahead. The Government will not recognize any vendor pricing past the hundredth decimal place (as in, $0.00).

For purposes of CLIN 0001 price evaluation, the Government will consider the vendor’s “NET AMT” entry to represent the vendor’s Total Price quotation for One Each.

6. Complete Quotation Submission

The Government intends to award without discussions. Therefore, the vendor’s initial quotation MUST be complete and responsive both to the requirements of the solicitation and also to the “Fire Training Facility

General Requirements” work description. Failure to submit a complete quotation may result in the vendor’s quotation being determined non-responsive and therefore not considered for award. In addition to the vendor’s submittal of a single roll-up Total Price, a complete and responsive quotation shall also include the following:

a. A FULL COPY of the solicitation and any solicitation amendments signed by an individual authorized to bind the vendor to the quotation and any subsequent award. See Paragraph 10 of this Executive

Summary for more details about what constitutes an authorized signature.

Note that vendor submittal of selected solicitation pages instead of a full-copy submittal will be deemed non-responsive.

b. A FULL COPY of the six-page solicitation work description attachment entitled, “Fire Training

Facility General Requirements”, TO INCLUDE vendor initials written into the lower right-hand corner of each of the 6 total pages. For the purposes of CLIN 0001 price evaluation, vendor initials on each page shall signify to this office that the vendor has read and understood the content of all 6 pages of the work description. Any questions about the content of the work description shall be as specifically and clearly pegged to the exact text contained in the “Fire Training Facility General Requirements” as possible. All questions about the solicitation and work description shall be submitted in writing so as to facilitate the Government’s CLIN 0001 technical and price evaluations.

Vendor failure to submit as outlined above will be deemed non-responsive.

c. Note the section entitled “Additional Requirements” that begins on Page 5 of the work description. In order for the vendor’s quotation submittal to be considered complete, the vendor must provide no less than three (3) of the experiential customer business references described under #1 of the Additional

Requirements listed on Page 5 of the work description attachment. As part of the vendor’s quotation submittal, the vendor is required to submit the following for each one of the required 3 customer business references:

- A specific contract number, project name and contract date and/or period of performance. The

Government buyer will reference your information when discussing the vendor’s performance with the vendor’s customer reference.

- The first and last name of each customer reference point of contact, to include the appropriate salutation (Mr., Ms., Mrs., etc.)

- The current job title of each customer reference

- The company name and business street address for each customer reference

- The customer reference’s specific business email address.

- The customer reference’s specific business office phone number

- A brief and concise description of the vendor’s business relationship with each customer reference is welcomed but not required.

d. With reference to Additional Requirements #2 and #5, the vendor is required to submit a graphical representation of its training facility solution and also layout drawings. For the purposes of CLIN

0001 technical and price evaluation, the vendor’s graphical representation and layout drawings will be reviewed by Government personnel qualified to conduct a technical review of the vendor’s submittal.

Vendor notations that specifically tie or peg the vendor’s technical representations to specific elements included in the “Fire Training Facility General Requirements” work description are welcomed but not required. Vendor submittals should be fashioned to facilitate Government technical review. The technical reviewer will provide its review findings to this contracting office, accordingly.

e. Note Item #4 of the Additional Requirements, namely the requirement for the vendor to schedule and then conduct a “Train the Trainer Course” at MCAAP for up to 12 students within two weeks of the training facility setup. As part of its quotation submittal, the vendor is required to specifically identify their intended certified fire instructor. The vendor must also submit documentation to verify that the vendor’s fire instructor certification credentials are full, current and up-to-date. This requirement shall also apply after award when the awardee shall -- in writing -- advise both the MCAAP customer and this contracting support office of the dates scheduled for the training course. Upon award, the

Government will identify the MCAAP point-of-contact who shall coordinate with the awardee about specific training course meeting space and any appropriate written agenda and instructional materials.

Arrangements for the 2-day training course shall facilitate the awardee’s efficient conduct of effective training course sessions for the MCAAP students.

Vendor failure to submit as outlined above will be deemed non-responsive.

f. The vendor is also required to submit no less than three (3) business references who can testify to the vendor’s financial capability and overall business integrity. Recommended examples include a bank manager who services the vendor’s corporate account(s) and/or an independent CPA who prepares the vendor’s financial statements and tax returns.

As part of the vendor’s quotation submittal, the vendor is required to submit the following for each business reference:

- A brief and concise description of the vendor’s professional relationship with each business reference

- The first and last name of each business reference point of contact

- The current job title of each business reference

- The company name and business address for each reference

- The reference’s specific business email address.

- The reference’s specific business office phone number

7. The Government intends to award without conducting discussions but reserves the right to conduct discussions if the Contracting Officer determines that discussions are necessary.

8. Payment Terms and Conditions

Payment shall be made in full upon delivery, installation, and formal acceptance of the awardee’s invoice. The invoice shall include the manufacture & installation of the facility, the training course and the operations & maintenance e-manual submittal. Discount terms shall be NET 30 Days. Note that the MCAAP’s formal e-

Acceptance of the invoice will transmit to the cognizant Government vendor pay office for payment processing.

Payment is not arranged through this contracting office. However, awardee copies of any invoice(s) and Bill(s) of Lading are welcomed for our contract file.

9. Quote Submissions can be submitted as follows:

a. Electronic (electronic submission via email is the preferred method for quote submittal)

Proposals/ bids/ quotes may be submitted electronically, and received by the Government procurement office provided in the solicitation. All emailed proposals/ bids/ quotes and attachments shall be in

Adobe Acrobat (.pdf) format and the solicitation shall be submitted and received in its entirety by the specified date and time in order to be considered for award. See email addresses below for submission.

This instruction takes precedence over any other direction for FBO Quote Submission. NOTE:

Proposals/ bids/ quotes will NOT be accepted for this solicitation through the FBO web site.

i. Electronic submission shall be emailed to Contract Specialist Mr. Mike Perez at michael.e.perez24.civ@mail.mil and also to Contracting Officer Ms. Elvia Jaggers at elvia.jaggers.civ@mail.mil. Note that Mr. Perez and Ms. Jaggers are located at this Rock

Island, Illinois contracting office. The customer where the training facility will be installed is located at the McAlester Army Ammunition Plant in McAlester, Oklahoma. Ms. Jaggers is also the team leader for this Rock Island, IL contracting support team. This team will manage this specific procurement on behalf of our customer’s McAlester, Oklahoma facility.

c. Hand-Delivered Bids, Quotes, or Proposal

i) Should a vendor elect to hand-deliver a bid, quote, or proposal, the vendor must arrive at the

Army Contracting Command, Rock Island Contracting Center (ACC-RI) Bid, Quote, and Proposal

Receiving Area prior to the time set for receipt of offers AND within regular staffing hours. If a vendor uses a delivery service, it is the vendor’s responsibility to ensure that its courier is provided these instructions.

ii) The ACC-RI Bid, Quote, and Proposal Receiving Area is located at the Rock Island Arsenal, Rock Island, IL, in the vestibule of the southwest entrance to Building 60 (first floor).

iii) The ACC-RI Bid, Quote, and Proposal Receiving Area is the ONLY area where hand-delivered bids, quotes, or proposals will be accepted.

iv) Staffing hours of the ACC-RI Bid, Quote, and Proposal Receiving Area are 8:00 a m. to 4:00 p.m. CT, Monday through Friday. No packages will be accepted on Federal Holidays.

v) The ACC-RI offices are located in a secure building; however, the Bid, Quote, and Proposal

Receiving Area is accessible to the public. When you arrive at the Receiving Area, you will need to use a personal phone to contact an ACC-RI point of contact (POC) who will log in your bid, quote, or proposal. 10. The Government intends to award one purchase order to the responsive offeror providing the Lowest Total

Evaluated Price and who is capable of being determined fair and reasonable by the contracting officer.

In the event that an award is granted to a vendor, that same vendor agrees to attend and/or participate in any

Post-Award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation subpart 42.5. The Vendor shall provide all design, materials, labor, transportation, Equipment and supervision required to manufacture and install a prefabricated, NFPA certified, Class A live fire training facility. The Facility will be used to support recurring training for firefighters.

See also the solicitation attachment entitled Fire Training Facility General

Requirements. The attachment is a work description.

Vendors must comply with the solicitation requirements covered in the Executive

Summary located in this solicitation document.

The Government intends to award one purchase order to the responsive vendor that quotes the lowest Total Evaluated Price. That vendor must also be determined by the Government to be a responsible contractor that is fully qualified to manufacture and install the required facility at the McAlester Army Ammunition Plant

(MCAAP) located in McAlester, Oklahoma, as well as to conduct the post-award

2-day training course at MCAAP.

MCAAP will supply a concrete pad that is sized to the awardee's specifications and located where the training facility will be erected / installed. MCAAP will also supply the necessary utility connections to use with the training facility.

It is noted that the SHIP-TO ADDRESS located in this solicitation's DELIVERY

INFORMATION is not the location where the training facility will be erected by the Contractor. The Contractor shall be fully responsible for all facility installation tasks at the agreed-upon location for installation of the training facility. MCAAP will not provide any personnel to assist in the facility installation.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

(50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term

“successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

“Veteran-owned small business concern” means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.
