Information Technology (IT) infrastructure and info-structure goals by leveraging Commercial Off The Shelf (COTS) software products and software maintenance. This acquisition further includes related incidental services and related incidental hardware to provide a total solution.
2. Section J, Attachment 0001 Statement Of Work (SOW)/Appendix A-Product Catalogs 1-14, identifies sub-catalogs and salient characteristics for each respective Product Catalog. The Product Catalogs are as follows: Audio & Visual; Business & Finance;
Communication; Database, Data Integration & Big Data; Education; Internet; Modeling & Simulation; Multimedia & Design; NetOps; Office

Any proposal that is submitted by an Offeror that is not under this NAICS code will not be considered for award.
4. In order to do Small Business Set-Asides at the order level, an Individual Waiver to the Non-Manufacturer Rule has been granted for
NAICS 511210. The waiver means that small businesses can provide the product of either a large or a small business. FAR Clause 52.219-
14, Limitation on Subcontracting, is not applicable when doing a small business set-aside due to the waiver to the Non-Manufacturer
Rule.
5. The Government is conducting the source selection for the ITES-SW2 acquisition under FAR Part 12, Acquisition of Commercial Items, in conjunction with the policies and procedures of FAR Part 15, Contracting by Negotiations. Solicitation Terms and Conditions are In

6. The Government anticipates this solicitation will result in the award of multiple ten year, Firm Fixed Price Indefinite Delivery
Indefinite Quantity (IDIQ) contracts consisting of one five-year base period and one five-year option period. The Government reserves the right to make none, one, or multiple awards. The Government may reject any or all proposals if such action is in the Government's interest.
7. During the conduct of this acquisition, the Acquisition Source Selection Interactive Support Tool (ASSIST) will be used by the
Government to support the proposal evaluation and source selection process. Reference RFP Section L.2.3.
8. Award under this solicitation in no way obligates the
Government to place any additional orders beyond this guaranteed minimum. Any subsequent Delivery Orders placed against this contract will be issued on a de-centralized basis from the Army, Department of Defense (DoD) community, all Federal Agencies, and authorized
Government Contractors supporting these agencies.
9. Delivery Order instructions will be provided in the ordering guide. The Ordering Guide will be located on the CHESS website at https://chess.army.mil/ within 60 days after award.

33 52.219-4 NOTICE OF PRICE EVALUATION PREFERENCE FOR HUBZONE SMALL BUSINESS DEC/2018
CONCERNS (DEVIATION 2019-O0003)
(a) Definitions. As used in this clause--
"HUBZone small business concern" means a small business concern, certified by the Small Business Administration (SBA), that appears on the List of Qualified HUBZone Small Business Concerns maintained by the SBA (13 CFR 126.103).
"Similarly situated entity" means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award; as is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform. An example of a similarly situated entity is a first-tier subcontractor that is a HUBZone small business concern for a HUBZone set-aside or sole source award under the HUBZone Program.
(b) Evaluation preference.
(1) Offers will be evaluated by adding a factor of 10 percent to the price of all offers, except--
(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and
(ii) Otherwise successful offers from small business concerns.
19 62
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.
(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the
HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.
(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraphs (d) and (e) of this clause do not apply if the offeror has waived the evaluation preference.
_____ Offeror elects to waive the evaluation preference.
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) Agreement. By submission of an offer and execution of a contract, a HUBZone small business concern agrees that, in the case of a contract for--
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 85 percent subcontract amount that cannot be exceeded; or
(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 75 percent subcontract amount that cannot be exceeded.
(f) A HUBZone joint venture agrees that the aggregate of the HUBZone small business concerns to the joint venture, not each concern separately, will perform the applicable requirements specified in paragraph (d) of this clause.
