W52P1J-18-R-ELEC AMENDMENT 0004

Issued AUGUST 7, 2018

1. Solicitation W52P1J-18-R-ELEC is hereby amended to clarify that requirements regarding the First Article Test and to incorporate pricing-related revisions.

2. Although a First Article Test sample is still required, CLIN 0002, and all references to CLIN 0002, have been removed from solicitation W52P2J-18-R- ELEC (to include the Price Matrix). The required First Article Test sample quantity will be subtracted from the total delivery order production quantity.

3. First Article Test item(s) should be delivered 30 days after date of contract award. Once the Government approves the First Article Test item(s), the awardee will then have 30 days to begin delivering the remaining order quantity.

The Government may request that the awardee delivery three to five kits per month. Delivery schedule may be negotiated. Initial delivery for the first delivery order is needed no later than March 2019.

4. Paragraph 3(c)(iv) in FAR clause 52.212-1, Instructions to Offerors – Commercial has been changed to now read “The Government reserves the right to request data other than certified cost and pricing data. If this data is requested, it shall be submitted in accordance with the instructions found at FAR 15.408, table 15-2, and shall be submitted electronically in a formula/algorithm-driven, fully calculating Microsoft EXCEL file with working formulas. This data shall be necessary to determine the reasonableness of offerors proposals as it corresponds to the Price Matrix.”

The section used to read as follows: “The Government reserves the right to request the submission of any additional data (i.e. cost or pricing data) necessary to validate the reasonableness of an offer.”

5. Steps 1, 2, and 3 in FAR clause 52.212-2, Evaluation – Commercial Items, have been revised and now read as follows:

“STEP 1: All proposals will be evaluated against the Technical subfactors. Should a proposal be determined “Technically Unacceptable” under any of the subfactors, the proposal will not be considered further for award.

STEP 2: Each proposal that is determined “Acceptable” in each of the four Technical subfactors will be evaluated to determine the total evaluated price, to include price reasonableness and completeness as follows:

Price Reasonableness: The Government will evaluate the price reasonableness of the offeror’s proposed price. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

Completeness: Since exchanges are not intended or desired, the Government requires complete proposals with respect to price. A complete proposal will include all information required by the Price Matrix, and must include pricing for the base period and each ordering period and must be consistent with the instructions contained in this solicitation.

The Government will identify the proposal with the lowest Total Evaluated Price.

STEP 3: The proposal with all four Technical subfactors determined to be “Technically Acceptable”, and with the lowest total evaluated price, will be evaluated against the Past Performance Factor. If a proposal is determined to be “Unacceptable” under the Past Performance Factor, the proposal will not be further considered for award. The proposal that is determined “Acceptable” in all Technical subfactors, has the lowest total evaluated price, and is also determined “Acceptable” in the Past Performance Factor will be selected for award.

The Procuring Contracting Officer reserves the right to contact Offerors for clarification, without opening discussions. The Government intends to award a contract without opening discussions (except for clarifications as described in FAR 15.306(a) and FAR 52.215-1). However, the Government reserves the right to conduct discussions and permit offerors to revise their proposals.

The Government reserves the right to make no award as a result of this solicitation if, upon evaluation, none of the proposals are deemed technically acceptable, and there is no reasonable expectation that opening discussions would result in technically acceptable proposals, or if the prices cannot be determined fair and reasonable.”

6. The following sentence has been removed from paragraph 2a of the “PRICE

EVALUATION FACTOR” section of FAR clause 52.212-2 - Evaluation – Commercial Items: “The Weighted Evaluation Price is then added to CLIN 0002, i.e. the proposed First Article Test price, to create the Proposed Ordering Period Price.”

7. Paragraph 2b of the “PRICE EVALUATION FACTOR” section of FAR clause

52.212-2 - Evaluation – Commercial Items has been revised to read as follows:

“The Government anticipates utilizing Price Analysis techniques to determine price reasonableness. The FAR requires that contracts be awarded at prices that are determined fair and reasonable. The Government will evaluate price reasonableness in accordance with FAR 15.404-1(b), relying primarily on competition; the Government may use any one, or a combination of techniques listed at FAR 15.404-1(b)(2) to determine the price fair and reasonable for Firm- Fixed-Price CLINs. Additional analysis techniques may be used as determined necessary by the Procuring Contracting Officer. These methods of evaluation may include the use of information/input from sources such as (but not limited to) other Government agencies and personnel. The Government reserves the right to required submission of any data other than certified cost or pricing data necessary to determine the reasonableness of an offer.”

Paragraph 2b used to read as follows:

“Price Analysis shall be used to determine price reasonableness. The FAR requires that contracts be awarded at prices that are determined fair and reasonable. The Government will evaluate price reasonableness in accordance with FAR 15.404-1(b), relying primarily on competition; the Government may use any one, or a combination of techniques listed at FAR 15.404-1(b)(2) to determine the price fair and reasonable for Firm-Fixed-Price CLINs. Additional analysis techniques may be used as determined necessary by the Procuring Contracting Officer. These methods of evaluation may include the use of information/input from sources such as (but not limited to) other Government agencies and personnel. The Government reserves the right to require the submission of any cost or pricing data necessary to validate the reasonableness of an offer.”

8. The solicitation is also hereby amended to instruct interested offerors to submit their delivery schedule in narrative form and to include the following:

1) the number of days after date of contract award until first article test quantity will be delivered to Pine Bluff Arsenal; and

2) the number of days after first article test approval until the remaining production quantity will be delivered to Pine Bluff Arsenal.
