AMENDMENT SUMMARY
1. The purpose of this amendment is to incorporate the following questions and answers:
Q-1 Reference PWS 1.6.6 - Contractor Personnel Qualifications. Does the contractor have to provide the "Prime for Life Instructor Certificate" at the time the proposal is submitted? Will the Government accept obtaining the certificate on or before contract start date?
A-1 The Prime for Life Instructor Certificate is required to be submitted at the time the proposal is submitted.
Please see paragraph (b)(4) of the Addendum to FAR 52.212-1 entitled “Instructions to Offerors – Commercial Items” which states -
“(b)(4) Volume 1: A staffing plan to include the proposed number of personnel, skills, experience, copies of diplomas and certifications, and letters of availability signed by the resources to be employed on the contract;”
Q-2 Provision FAR 52.212-3. If an offeror has completed the representations and certifications in their SAM.gov profile, do they also have to submit the completed section (b) of 52.212-3?
A-2 Please see the first paragraph of FAR 52.212-3 entitled “Offeror Representations and Certifications— Commercial Items” which states –
“The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.”
Q-3 Provision FAR 52.212-2. Can you please clarify what the award decision criteria will be? Sentence one says "the most advantageous" proposal will be selected. However, sentence two says the lowest priced technically acceptable (LPTA) will be accepted. There are two concerns. First the language is ambiguous. Second, the National Defense Authorization Act of 2017 severely restricted the DOD use of LPTA. If so, this RFQ may not be in compliance with DFARS requirements with the use of LPTA source selection procedures.
A-3 The award will be made to the lowest price technically acceptable proposal. The LPTA source selection method was determined to be appropriate for this acquisition and is in compliance with acquisition regulations.
Q-4 PWS 1.6.2 - Hours of Operation. Can the Government clarify exactly how many hours per year the contractor will be required to provide support?
A-4 No, the Government cannot determine exactly how many hours per year it will take the contractor to perform the tasks in the PWS. However, the estimated workload data based upon previous history is presented in Technical Exhibit 3 of the PWS. In addition, paragraph (a)(i) of the Addendum to FAR 52.212-2 entitled “Evaluation – Commercial Items” states -
(i) Volume 1: Technical Proposal – The staffing plan will be evaluated to determine if it contains at least one contractor employee that is available to work at least 40 hours per week (combined - not individually) beginning 30 Sep 2017. In addition, the staffing plan will be evaluated to determine if the individuals proposed possess the qualifications listed in PWS Paragraph 1.6.6 entitled “Contract Personnel Qualifications”.
2. The date and time for receipt of proposals remains unchanged.
