Regulation (FAR) 16.504.

4. Bid Samples for each caliber (5.56mm, 7.62mm, and Caliber .50) are required as part of proposal submission (See Sections L and M for details). The associated Bid Sample Test evaluation does not take the place of the Design Verification Test (DVT) outlined in the specification documents. The Government may require DVT to be completed after award. If required, Contractors may use the Armaments

Center to complete DVT.

5. The resulting contract may also be awarded with or without First Article Testing (FAT). FAT, if required, will be accomplished in accordance with Section E Narrative "FIRST ARTICLE TEST (CONTRACTOR TESTING)" and/or "FIRST ARTICLE TEST (GOVERNMENT TESTING)".

6. The guaranteed minimum quantity for this IDIQ contract is 400,000 cartridges. The guaranteed minimum quantity will be ordered in the first Delivery Order at the time the IDIQ contract is awarded. The guaranteed minimum quantity of 400,000 cartridges will be a combination of all DODICs. After the guaranteed minimum quantity of 400,000 has been ordered by the Government, the Government will not have any obligation to purchase further cartridges under this contract.

7. The Ordering Periods are as follows:

Ordering Period 1: Date of Award to 365 Days After Award (DAA)

Ordering Period 2: 366 DAA - 730 DAA

8. The proposed unit prices shall be submitted using Solicitation Attachment 0001 - Proposal Price Matrix (see Section J). Prices shall be proposed with no more than four (4) places to the right of the decimal point. Proposals shall include proposed prices for all

quantity ranges and FATs for all DODICs for all Ordering Periods. Offerors should not assume FAT will be waived at any point during performance of the resulting contract and must provide proposed FAT costs, as required to be considered for award. The Government reserves the right to require or waive FAT any time during the life of the contract.

9. The weights established in the price matrix are for evaluation purposes only. They are not a guarantee of quantities to be awarded.

The weights and quantities are not binding and shall not be relied upon for execution purposes. Not meeting or exceeding the evaluated quantity should be expected and will not constitute revision of the price matrix. If the Government's requirements do not result in orders for the estimated evaluated quantities, it shall not constitute the basis for an equitable price adjustment. All orders are subject to availability of funds.

10. The unit prices entered into Solicitation Attachment 0001 - Proposal Price Matrix will be used for each Delivery Order or Delivery

Order Modification under the resulting contract.

11. This is a negotiated procurement pursuant to FAR Part 15. Offerors are advised that a best value subjective trade-off approach shall be utilized to evaluate those proposals submitted in response to this Solicitation (see Sections L and M). Price and non-price related factors will be evaluated. Offerors are cautioned that award may be made to other than the highest rated Offeror or other than the lowest-priced Offeror.

12. The Government intends to award without discussions, therefore, each proposal should contain the Offeror's best terms for award of a contract under the Solicitation. The Contracting Officer may contact Offerors for clarification, as described in FAR 15.306(a) and

Section L, FAR 52.215-1, Instructions to Offerors - Competitive, without opening discussions. However, the Government reserves the right to conduct discussions and to permit Offerors to revise their proposals if determined necessary by the Contracting Officer. The

Government will not permit the Offeror to submit more samples than what is required in Section L or revisions to the Bid Sample portion of the proposal.

13. The Government anticipates receiving adequate price competition under this Solicitation; therefore, certified cost or pricing data is not required to be submitted with the proposal. In the event the Contracting Officer determines that adequate price competition does not exist, the Government reserves the right to require certified cost or pricing data to be submitted.

14. To obtain the Technical Data Package (TDP) for this Solicitation, the Offeror must request explicit access through the

"Attachments/Links" tab in beta.sam.gov under RFP W52P1J-20-R-0023. Request access to the document titled "TDP Request W52P1J-20-R-

0023". When prompted for "Reason for Request" the Offeror shall enter the following, "I am requesting access to the .zip file for the

TDP under Solicitation W52P1J-20-R-0023. My CAGE code is: XXXXX". There is currently a system issue and this step is required in order to receive the TDP. Successful completion of this will prompt a Government point of contact to send the TDP to the requesting data custodian via the DOD SAFE website.

An Offeror must have an approved DD Form 2345, Military Critical Technical Data Agreement, on file with the Joint Certification Program

(JCP) in order to be granted access to the TDP. Restricted technical data will not be available to an Offeror who has not been certified. NOTE: The requestor must be the data custodian in the JCP database or the request will be denied. To verify who your POC is, please log into //www.dlis.dla.mil/jcp/search.aspx and use the Cage Code search function.

20. All contractual provisions specified are obligatory for the prime contractor. The prime contractor is responsible for flowing down and enforcing contractual provisions upon all proposed suppliers/vendors/subcontractors.

21. The successful Offerors proposal in response to this Solicitation may be incorporated as a material term of the resultant contract and failure to fully implement it could result in termination. No revisions/changes to the contractors proposal may be made after award without prior approval by the Contracting Officer. The contract requirements take precedence over the incorporated proposal should a conflict exist.

22. The contract is F.O.B. Origin. The Government is only responsible for the costs associated with the shipment of the deliverable end item; the contractor is responsible for all other shipping.

25. Receipt of an Offerors proposal in response to this Solicitation is an affirmation that the Offeror has had access to and received adequate information to prepare a proposal.

26. Questions in regards to this Solicitation shall be submitted to the cognizant Contracting Officer and Contract Specialist via e-mail. Phone calls will not be accepted. Offerors shall submit in all questions pertaining to this immediate requirement by close of business on 14 April 2020.

SECTION C - DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

STATEMENT OF WORK: CONFIGURATION CHANGE MANAGEMENT DOCUMENTATION

(a) The contractor may submit Engineering Change Proposals (ECPs) and Requests for Variance (RFVs) for the requirements in the

Government provided Technical Data Package (TDP). The contractor shall prepare and submit ECPs, NORs, and RFVs as required by the accompanying DD Form 1423, Contract Data Requirements List (CDRL). If a Value Engineering Change Proposal (VECP) clause is included on this contract, VECPs shall be submitted in the same manner as ECPs.

(1) ECPs - The contractor may request a permanent change to the requirements specified in the TDP or any other baseline documentation by submitting an ECP. ECPs shall be submitted to include all Notices of Revision (NORs) necessary to completely define the requested change. Each ECP shall be accompanied with at least one NOR per affected document. The contractor shall not present any production items for acceptance incorporating any change to the TDP or other baseline documentation until notified by the

Government the ECP has been approved and incorporated in the contract.

(i) Page 1 of DD Form 1692 (or equivalent) shall be submitted for all ECPs. Pages 2-7 of DD Form 1692 shall be submitted when required to properly explain all the potential logistics and technical impacts of the proposed change. DD Form 1695 NOR or DD

Form 1695-1 Tabulated NOR (or equivalents) shall be submitted to completely describe the desired change on each affected document.

(ii) All ECPs submitted by the contractor will be routine priority unless otherwise justified. If the contractor considers the ECP to be emergency or urgent, they shall include justification within 48 hours of submittal of the ECP.

(2) RFVs - The contractor may request to temporarily depart from a requirement specified in the TDP or any other baseline documentation, by submitting an RFV. RFVs may be submitted either pre-production (formerly known as Request for Deviation (RFD)) or post-production and prior to acceptance by the Government (formerly known as Request for Waiver (RFW)). DD Form 1694 (or equivalent) shall be submitted for all RFVs. The contractor shall not present any production items for acceptance with any nonconformance to the requirements in the TDP or other baseline documentation until notified by the Government the RFV has been approved and incorporated in the contract.

(b) Submission of requested changes - The submission of an ECP or RFV by the Contractor does not affect the required delivery dates specified within the contract, shall not constitute excusable delay in the performance of this Contract by the Contractor or in any way relieve the contractor from compliance with the contract delivery schedule. If a delivery date change is needed, it must be negotiated with the Contracting Officer and documented via modification to the contract. The submission of an ECP and/or RFV by the Contractor shall not preclude the Government from exercising its rights under any clause of the Contract.

(c) Specifications - Permanent proposed changes to specifications which are part of the TDP or baseline documentation shall be requested with an ECP and NOR (i.e. Specification Change Notices (SCNs) are not required).
