About this file
This document is a Bid Inquiry Contractor Report containing 170 inquiries related to an Architect-Engineer (A/E) Indefinite Delivery/Indefinite Quantity (IDIQ) contract for the U.S. Army Corps of Engineers (USACE) Caribbean District. The solicitation seeks architectural and engineering services for civil works and military projects, with an anticipated 70-80% focus on civil works and 20-30% on military construction. Key requirements include having at least one key staff member in several disciplines professionally licensed in Puerto Rico, including Civil, Mechanical, Structural, Geotechnical, Electrical, Hydrologic and Hydraulic, Environmental, Architect, and Landscape Architect.
The document includes numerous clarifications and responses to vendor questions, covering topics such as professional licensing, resume requirements, project experience, small business participation, and submission guidelines. Notable details include a $5,000,000 threshold for small business set-aside task orders, a 125-page limit for the SF330 submission (with Section H limited to 10 pages), and a submission deadline of September 29, 2025 at 2:00 PM AST. The solicitation will use a secondary selection process in accordance with FAR 36.6 and allows for joint ventures, with firms required to specify whether they are submitting as a small business or other than small business.

1. Professional Licensing Requirement for Program and Project Managers:
The RFP states that at least one key personnel per discipline must hold a professional license to practice in Puerto Rico, including the program and project manager positions. While we understand the importance of licensure for technical disciplines directly responsible for sealing designs and meeting jurisdictional requirements, program and project managers typically serve in oversight and coordination roles that do not require licensure within the local jurisdiction. These roles have been performed successfully on USACE projects in Puerto Rico without requiring a local license. Requiring both program and project managers to be licensed in Puerto Rico may unnecessarily limit competition. Would the Government consider revising this requirement to either:
• Not require the program manager and project manager to hold a professional license in Puerto Rico, or
• Allow for demonstration of relevant experience managing projects in Puerto Rico in lieu of licensure for these specific positions?

In reviewing the requirements under Factor 2: Professional Qualifications, the solicitation specifies, "At least one key personnel from the prime firm must hold a professional engineering license in Puerto Rico and one key personnel from the team (sub-consultant) must also hold an Engineering license in Puerto Rico."
However, under Factor 2, top of page 4, it states, "at least one key personnel per discipline must have a professional license to practice architecture, engineering or surveying in Puerto Rico." Additionally, the solicitation provides role-specific requirements for the Program Manager and Project Manager stating that they must be licensed in Puerto Rico whereas the Senior Architect/Engineer states only "Current professional registration is required."
Please clarify that the requirement is only for two Professional Engineer licenses in Puerto Rico – one from the prime and one from the subconsultant – and the remainder of the Senior Architect/Engineer disciplines just need the required professional registration as stated on page 5 item (3).

2. Timing of Licensing Requirement for Key Personnel:
Would the Government consider clarifying whether the requirement for the program and project managers to hold a professional license in Puerto Rico must be met at the time of proposal submission, or whether it can be satisfied by the time of contract award? Allowing licensure to be in place by the time of award would provide offerors with additional flexibility while ensuring compliance with local regulations during execution.

RADISE, a certified Small Business, is keen on submitting a response to the referenced solicitation.
We seek clarification regarding Factor 2 – Professional Qualifications of the Individual Design Team Members (Pages 4–5), which states that at least one key personnel per discipline must hold a valid professional license to practice architecture, engineering, or surveying in Puerto Rico. The required disciplines include, but are not limited to: Civil; Mechanical; Structural; Geotechnical;
Electrical; Hydrologic and Hydraulic; Fire Protection; Architecture; Landscape Architecture; Environmental; IT Systems / Network/ Communication/ Controls; and Surveying--all within the Prime firm.
We anticipate that many Small Business firms meeting the applicable size standard may face challenges in fully satisfying this requirement, particularly those without an established presence in the Caribbean District.
We find the language highly restrictive for Small Businesses and appears to be exclusive to various organizations and unnecessary compared to past procurement history.
In this context, we respectfully request clarification on whether the District would consider any flexibility or waiver of this licensing requirement for certified Small Business Enterprises (SBEs), in order to promote broader participation and ensure equitable opportunities.

Our firm has a large number of Registered Professionals throughout the United States who are eligible to obtain Puerto Rico professional licensure by comity. However this process takes time. While the "Universal Recognition of Occupational and Professional Licenses in Puerto Rico Act" recently signed by the Governor of Puerto Rico will likely streamline the reciprocity process, it will also take time for the Department of State to update processes and procedures. 11476515 General Factor 8. Volume of DoD
Comment Classification: UNCLASSIFIED (U)
For Factor 8. Volume of Department of Defense (DoD) in Section H, the RFP states on page 6 "Offerors shall provide the volume of work awarded by DoD agencies during the previous 12 months. Volume of work shall be demonstrated in a table format and be categorized by contract, task order, project award, completion dates, and dollar amount." If an offeror is submitting as a joint venture, is the expectation that each firm that makes up the joint venture provides this information or the offeror only shows awards made to the joint venture? If the requirement is to show awards made to each firm, this table may take up a disproportionate amount of space in Section H. May we submit this table as an appendix to Section H that does not count towards the 10 page limit?

The Government's request for numerous staff (minimum of 14) to be registered professionals in Puerto Rico is a very high bar for many firms to achieve on short notice. This is also a significant departure from the requirements from most USACE A-E solicitations. Our firm has performed many USACE task orders in Puerto Rico and the USVI over the past 6-years for multiple USACE Districts (Jacksonville, Savannah, St. Louis, etc.) and professional licensure from mainland US states has always been acceptable for on-island work. We respectfully request that the Government eliminate the requirement for Puerto Rico licensed professionals and maintain the more traditional requirement of licensure in the United States.

Solicitation Announcement Deadline Extension
The solicitation's conflicting requirements for Puerto Rico professional licensure, which range from one license for the prime firm and subconsultants to potentially more than ten to cover each required discipline, have created a lot of confusion for submitting firms. Many firms are unsure whether they can even pursue this solicitation until further guidance is offered. Until this and several other substantial clarifications are addressed, we cannot finalize our teaming arrangements. Depending on the government's responses, we may also need to reconsider our pursuit as the prime contractor. We respectfully request that the government consider granting a one-month extension from the date answers to all questions are posted to allow firms adequate time to make informed teaming decisions and prepare a complete, compliant submission.
On: Aug 12 2025.
Government Response. . No extension will be granted at this time. Professional licensure has been answered in previous questions and the language change will also be in Amendment 001. On: Aug 14 2025 Current Request Status: Request Closed

Solicitation Announcement Project Relevance
Clarification Comment Classification: UNCLASSIFIED (U)
The solicitation states that projects should be listed in order of relevance to the type of work anticipated under this contract. It states that engineering and design services will be primarily for civil works projects, with limited military work. However, the scope includes demonstrating experience and competence in all phases of civil engineering for flood control, environmental restoration, coastal, and navigation projects as well as engineering for MILCON.
Given the breadth of these requirements, the 10-project limit in Section F, and the additional 10-page limit of Section H, could you please clarify how we should prioritize Section F to best reflect relevance--for example, emphasising civil works and flood control projects vs. one or two examples of MILCON engineering?
On: Aug 12 2025.
Government Response. . It is anticipated that this MATOC will be utilized for approximately 70–80% Civil Works projects and 20–30% Military (MILCON) projects. On: Aug 14 2025 Current Request Status: Request Closed
