Section A - Solicitation/Contract Form
ADDENDUM
1. This Solicitation is in accordance with FAR Part 36 and FAR Subpart 19.502.2, as applicable. This requirement is a Total 100% Small Business Set-Aside. The NAICS Code for this requirement is 238210.
2. MAGNITUDE OF CONSTRUCTION PROJECT: Pursuant to FAR 36.204, the estimated magnitude of construction is: Between $250,0000 to $500,000,000.
3. SITE VISIT: IAW FAR Clause 52.236-27, a single site visit will be conducted. The site visit will be held on on XXXX, XXX XX, 2024 @ 1:00PM EST. Attendance is recommended for Offerors. The meeting location will be Building 20 (Guard Shack/Security). Attendees are encouraged to arrive 15 minutes early to check in. If visitors do not possess a TYAD issued Contractor badge, they will be required to present a valid, Government issued photo I.D.
to gain access to the base (vehicle registration and insurance may also be required). Information provided at each site visit, as well as answers to any general questions, shall not affect the terms and conditions of the solicitation and/or specifications. Terms remain unchanged unless the solicitation is amended in writing. Please refer to clause 52.236-27 for Site Visit information.
4. QUESTIONS AND ANSWERS: Offerors are advised to submit any questions regarding this solicitation in writing to both the Contract Specialist, Dean Berkovics, via email only at DEAN.M.BERKOVICS.CIV@ARMY.MIL and the Contracting Officer, Stephanie Coleman, via email only at STEPHANIE.M.COLEMAN17.CIV@ARMY.MIL. Answers will be consolidated in the form of Questions and Answers and emailed to all vendors. If an Questions and Answers impact the SOW then an Amendment will be created where applicable, and posted in the same manner as the Solicitation.*QUESTIONS MUST BE RECEIVED NO LATER THAN THREE (3) DAYS AFTER SITE VISIT. NO QUESTIONS WILL BE ACCEPTED AFTER THIS TIME* Questions received after this time will not be answered.
5. PROPOSAL DUE DATE: Proposals shall be submitted no later than XXXXX, XXXX X, 2024 by 10:00 AM EST via email to the Contract Specialist, DEAN.M.BERKOVICS.CIV@ARMY.MIL. It is the responsibility of the offeror to confirm the proposal was received by this above date/time. Proposals received after the offer due date/time will not be considered for award. The Government shall not be held responsible for any technical issues that may arise.
6. The minimum acceptance period for offers is sixty (60) days from the proposal due date specified in this Solicitation.
7. Any resultant award will be a Firm Fixed Price Contract.
8. BASIS OF AWARD: The Government will award a Firm-Fixed-Price contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be the best value to the Government. Three
(3) evaluation factors: Technical, Price, and Past Performance will be used. Refer to Section L, Instructions to Offerors and Section M, Evaluation of Proposals for detailed information. The Government reserves the right to award to other than the lowest priced offer.
9. WAGE DETERMINATION: Department of Labor (DOL) Davis Bacon Act (DBA) Wage Determination No.
PA20240098, Modification Number 06, Dated: 06/07/2024 is currently applicable and provided as Attachment 2.
10. DISCUSSIONS: The Government intends to award without discussions. Offerors should provide their best, complete proposal upon initial submission. The Government reserves the right to hold discussions if deemed necessary by the Contracting Officer.
11. PERFORMANCE AND PAYMENT BONDS: Performance and Payment Bonds: In accordance with (IAW) FAR Clause 52.228-15 – Performance and Payment Bonds – Construction, offerors are to note that Performance and Payment Bonds are required for contracts over $150,000. All bonds are due no later than ten (10) days after award.
12. CONTRACTOR RESPONSIBILITY: In order to be considered for award, offerors must be found to be responsible IAW FAR Part 9.1. The Government may, at its discretion, require an offeror to submit additional information in order to determine Contractor responsibility. If an offeror is deemed to be NOT responsible IAW FAR 9.104-1, they may not be considered for award.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)
(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.
(ii) For fixed price line items—
(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 485 days after notice to proceed. The time stated for completion shall include final cleanup of the premises.
52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $690.12 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph
(d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representations.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--

Section L - Instructions, Conditions and Notices to Bidders
INSTRUCTIONS TO OFFEROR
1. PROPOSAL SUBMISSION REQUIREMENTS:
(a). Only electronic proposals will be accepted. No hardcopy proposals will be accepted. Electronic offers shall be submitted via e-mail to the Contract Specialist at dean.m.berkovics.civ@army.mil. The Offeror’s responses shall clearly address each factor listed below. Failure to address these factors, or to properly complete and submit a proposal, may result in the Offeror being rated unacceptable and being removed from consideration. Therefore, Offerors are urged to follow instructions and contact the Contract Specialist if instructions are not understood.
Offerors are cautioned to put forth their best efforts, and to furnish all information clearly in order to allow the Government to properly evaluate proposals. Offerors should not assume that they will have an opportunity to clarify or correct anything in their proposal after submission. Therefore, proposals should be submitted on the most favorable terms that the Offeror can submit to the Government.
The Offeror’s proposal shall include the following factors. These factors shall be clearly identified and labeled.
1. Technical Proposals: Offerors shall submit technical proposals, to include a complete description of how the Offeror will meet the Government’s SOW, Attachment 1. Offerors must not simply parrot the Government’s requirement. Any exceptions to any terms and conditions must be included in proposal and agreed upon by both parties before any award.
2. Price Proposals: Price Proposals shall include:
(a). Completed SF 1442 - Solicitation, Offer and Award. Offerors shall submit a completed SF1442, signed by an individual authorized to contractually bind the firm. All solicitation amendments must be acknowledged on SF 1442. The completed SF 1442 shall include the total proposed price in CLIN 0001. The price shall be Firm Fixed- Price. The Offeror shall take care not to include remarks that take exception to the Government’s SOW or pricing requirements, or otherwise preclude the Government from evaluating the offer, which will render the offer unacceptable.
(b). Completed Attachment 3 - Proposed Price Schedule, including all applicable data. This completed price schedule will be used in determination of price reasonableness. The Contractor shall provide a complete breakdown of item pricing with its offer including labor categories, hourly labor rates, number of labor hours, materials, supplies, equipment, other direct costs (quantity and unit price), profit, and indirect costs in sufficient detail to provide thorough evaluation per Federal Acquisition Regulation (FAR) clause 52.215-20 Alt I in electronic Excel spreadsheet format (submitted as separate attachment). When subcontractors are used, provide evidence of competitive award; if subcontract is not competitively awarded provide subcontractor’s detailed pricing as previously described. Lump Sum pricing is unacceptable.
3. Past Performance: Offeror shall include three references of past performance performed within the past three years, along with a point of contact and their contact information. Offeror’s submission shall include at a minimum:
(a). Project title, description, and location (physical address).
(b). Description of the scope of work, to include the work performed as the prime contractor.
(c). Start and completion dates (original vs actual) and a brief narrative for any differences between original and actual. Explain the steps the contractor took to successfully complete the project on time and with minimal impact to the customer.
(d). Project cost (original vs actual) and brief narrative for any differences between original and actual.
Other sources of past performance history shall be considered, such as information available from CPARS, PPIRS, FAPIIS, and OSHA.
2. SOLICITATION, OFFER AND AWARD DOCUMENT:
(a). Section A – Standard Form 1442 (SF 1442), Solicitation, Offer and Award - An authorized official of the firm shall sign the SF 1442 and all certifications requiring original signature. An Acrobat PDF file shall be created to capture the signatures for submission. All Amendments must be acknowledged on SF 1442.
