About this file

This draft solicitation (W51AA125R0028) is for a Multiple Award Indefinite Delivery/Indefinite Quantity (MA/IDIQ) contract for refinishing services at Tobyhanna Army Depot. The five-year contract will have a maximum value of $9,800,000, with individual task orders ranging from $1,500 to $500,000. The requirement is a 100% small business set-aside, and the government intends to make multiple awards to qualifying offerors.

The solicitation requires contractors to provide refinishing operations for parts following military specifications, with key evaluation criteria including: (1) ability to complete work at the prime contractor level, (2) being located within a 4.5-hour driving distance from Tobyhanna Army Depot, (3) having ISO AS9100/AS9110 certification or equivalent, and (4) demonstrating a flexible capacity plan. Proposals will be evaluated on technical approach and past performance, which are considered equal in importance. Contractors must submit a technical proposal, past performance documentation, and complete the required certifications and representations. A pre-solicitation meeting is scheduled for May 13, 2025, via Microsoft Teams to review the requirements and allow for questions.

ARMY CONTRACT WRITING SYSTEM

The Army Contracting Enterprise (ACE) is in the process of deploying new solicitation and contract writing software to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this Solicitation.

During this transition period, Offerors are hereby advised:

The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation (e.g. solicitation amendments and awards, if any). Due to this:

This solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office (e.g. requiring offer submission via the PIEE Solicitation Module vs. e-mail). Offerors should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the Contract Specialist or Contracting Officer.

If the Contracting Office switches contract writing systems prior to award, documents you receive from the Contracting Officer or view on SAM.gov or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.

A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the Contract Specialist or Contracting Officer.

The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, you, as the Offeror, may still be the first to spot such errors. Therefore, Offerors shall:

Notify the Contracting Officer immediately if any observed changes, removals, or additions affect your award eligibility, violate or alter existing quote/proposal terms, or could affect Contract performance post-award.

Take special care to ensure all fill-in Clauses are populated and remain populated across documents received from the Contracting Office throughout the Solicitation and Award process.

Contact the Contracting Officer listed on the first page of the solicitation or solicitation amendment for guidance if you notice or suspect any inadvertent change has occurred between document issuances.

The Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the Contractor. Any such modification will reconcile the award with the latest version of this solicitation reflecting deliberate action by the Contracting Officer (e.g. the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental offer terms.

In the unlikely event a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this solicitation, the Contracting Officer:

May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.

Will incorporate the latest version of this Solicitation into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.

Will ensure any action taken does not conflict with the stated offer evaluation and award methodology of this requirement.

Will issue a complete, properly-formatted award accurately reflecting this requirement and all applicable terms and conditions once systems return to normal.

Section H - Special Contract Requirements

MA/IDIQ REQUIREMENTS

1 PURPOSE AND SCOPE

1.1.The purpose of this Multiple Award (MA), five (5) year Indefinite Delivery/Indefinite Quantity (IDIQ) Contract is for a refinishing surge requirement to provide refinishing operations for parts following military specifications (MIL-SPEC), military details (MIL-DTL), and/or other provided documentation, in accordance with the Performance Work Statement (PWS).

1.2.As requirements develop, Requests for Proposals (RFP) for Task Orders will be issued on a competitive basis, at the Government's discretion. Task Orders will vary in size from $1,500.00 to $500,000.00 and will be awarded and issued by the individual Task Orders awarded and administered by duly appointed federal Contracting officers.

1.3.The minimum guaranteed amount is $100.00 for the Contractor’s Quality Control Plan and will be awarded promptly at award of this MA/IDIQ Contract.

1.4.While within the confines of Tobyhanna Army Depot, contractor employees will adhere to and be governed by all rules, regulations, policies, procedures and directives issued by the Commanding Officer, Tobyhanna Army Depot, and said employees will be required to conduct themselves in the same manner required of Government employees.

1.5.This Section contains significant information pertaining to the rules, regulations, policies, and procedures of this MA/IDIQ contract.

2 ORDERING PERIODS

2.1 Ordering Periods: 2.1.1 Each contract awarded under the MA/IDIQ will have a five (5) year ordering period.

2.1.2 The minimum guaranteed amount is $100.00; the maximum value of all requirements ordered under this MA/IDIQ contract will not exceed $9,800,000.00 over the five-year ordering period.

3 TASK ORDER LIMITATIONS (Reference FAR 52.216-19)

3.1 Minimum Order. When the Government requires services covered by this contract in an amount less than the minimum Task Order limitation of $1,500.00 the Government is not obligated to purchase, nor is the contractor obligated to furnish, those services under the contract.

3.2 Maximum Order. The maximum Task Order limitation is limited to $500,000.00. The Government may combine several requirements, as indicated by separate PWS and individual line items, in one Task Order, as required. The contractor is not obligated to honor:

(a) Any order for a single Task Order less than $1,500.00;

(b) Any order for a single Task Order in excess of $500,000.00;

(c) A series of orders totaling more than $1,500,000.00.

3.3 This is not a requirements contract.

4 ORDERING PROCEDURES FOR COMPETITIVE TASK ORDERS

4.1 Requests for Proposals (RFP) / NOTICE OF PROPOSED REQUIREMENT

4.1.1 When the Government requires work under the MA/IDIQ, an RFP will be issued, as appropriate, normally in the form of a letter “NOTICE OF PROPOSED REQUIREMENT,” sent electronically to all MA/IDIQ contractors.

Requirements will be of varying size and complexity. The request will include information such as drawings and any other requirements for submission (e.g. proposal requirements, delivery schedule, etc.).

4.1.2 The basis for award for each Task Order will be stated in each RFP. Each Task Order will be awarded based on either Lowest Price Technically Acceptable (LPTA) or Trade-off. The following evaluation criteria will be considered: Price, Past Performance or Delivery Schedule.

4.2 Response to NOTICE OF PROPOSED REQUIREMENT

4.2.1 Notification will be through email. MA/IDIQ contractors shall keep an up-to-date email address on file with the Contracting Officer at all times. Backup addresses are encouraged. Upon receipt of the notification, the MA/IDIQ contractors shall acknowledge receipt of the offering by a return email. A Contracting Officer may make only one attempt to email a proposal offering to a MA/IDIQ contractor. No other means of notification will normally be used. The Government will not be responsible for lack of notification(s) for contractors who fail to maintain current email addresses, or acknowledge offerings.

4.2.2 MA/IDIQ contractors are expected to submit an offer on all requirements offered. In the event a contractor is unable to submit an offer in response to a “NOTICE OF PROPOSED RQUIREMENT”, hereafter referred to as RFP, the contractor shall notify the Contracting Officer electronically via e-mail, normally within 5 days.

4.2.3 In the event a contractor fails to submit an offer on a reasonable number of requirements offered, as determined by the Contracting officer, the Contracting Officer will notify the contractor when their offer record indicates an unacceptable number of offerings. In the event the contractor fails to correct this situation, the Government reserves the right to unilaterally cancel the contractor’s MA/IDIQ basic contract without further obligation.

4.2.4 At no time will the contractor be reimbursed for proposal preparation costs.

4.3 Task Order Competition.

4.3.1 A wide variety of refinishing surge requirements, determined by the Contracting officer to be within the scope of this contract, will be offered to MA/IDIQ contractors for the purpose of providing a price or best value proposal.

Individual Task Order awards on those projects will be based on competitive proposals received exclusively from MA/IDIQ contractors.

4.3.2 To satisfy the contracting agency’s Small Business Administration contracting goals/targets, the Contracting Officer may consider such factors as achievement of Section 8(a), Service Disabled Veteran Owned Business and HUB Zone goals/targets. Individual requirements may be further set-aside for participation exclusively by all awardees in the specified socio-economic group.

4.3.3 All eligible MA/IDIQ contractors, unless a Task Order is set-aside for a specified socio-economic group, will be provided a fair opportunity to compete for each requirement offered under this contract unless the following (FAR 16.505(b) (2)) exceptions apply.

1) The agency’s need for the services is of such urgency that providing such opportunity to all such contractors would result in unacceptable delays;

2) Only one such contractor is capable of providing the servicess at the level of quality required because the services needed are unique or highly specialized;

3) The Task Order should be issued on a sole source basis in the interest of economy or efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity pursuant to the procedures in this clause to be considered for the original order; or

4) It is necessary to place an order to satisfy a minimum guarantee.

5) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

6) In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply.

4.3.4 The Contracting Officer may consider such factors that the Contracting Officer, in the exercise of sound business judgment, believes are relevant to the placement of orders.

4.3.5 Timely performance by a MA/IDIQ contractor is very important. Failure to prosecute the work diligently on a currently awarded Task Order may be cause for the Contracting Officer not to include the contractor in the competitive fair-opportunity pool for future Task Orders. When the contractor’s delinquency has been cured, it will be considered for competition in future Task Orders.

4.3.6 In the event the contractor has been determined to have unsatisfactory past performance, under the MA/IDIQ contract, the Contracting officer will notify the contractor of the unsatisfactory performance. Unsatisfactory past performance may result in the contractor not receiving future awards under the MA/IDIQ contract.

4.4 Proposal Contents.

4.4.1 The basis of award of each Task Order will be stated in the RFP. Depending upon the requirements of each Task Order, the contractor will be required to provide a price proposal in response to the RFP in addition to any other information required in the RFP. Contractors shall respond within the number of calendar days stated in the RFP by submitting a proposal to the Contracting Officer in accordance with requirements stated in the RFP.

4.4.2 Deviations and Alternate Proposals. Offerors shall specifically identify all deviations from the minimum RFP requirements in a cover letter in a section entitled "Alternate Proposal” or “Deviations." This requirement applies for all proposal revisions and Final Proposal Revisions. Proposed alternates/deviations shall specifically address in detail the alternate and rationale for proposing. Alternate solutions and deviations shall include separate pricing information. If an alternate/deviation is proposed, the work as specified in the solicitation must also be priced.

4.4.3 The non-cost factors and price factors will vary depending on the unique requirements for each Task Order. In addition to price, the RFP may indicate, in the offering, other factors (Past Performance and/or Delivery schedule considerations) that will be considered in the evaluation of offers.

4.4.3.1 Past Performance, within a three (3) year period, on previously awarded Task Orders under the MA/IDIQ or work on any awards completed for Tobyhanna Army Depot will be considered as well as relevant performance evaluations at any location accessible in Government Performance databases. Past performance will be evaluated in terms of quality, timeliness, management effectiveness or other factors that the Contracting Officer determines to be relevant to award on a particular Task Order

4.4.3.2 Delivery Schedule will be evaluated as meeting or exceeding the required delivery schedule for each Task Order.

4.5 Task Order Evaluation Method and Procedures

4.5.1 The Government intends to select the most advantageous, responsive, and responsible proposal, price and other factors considered. Each RFP will describe the criteria to be utilized in evaluating Task Order proposals.

4.5.2 Discrepancies in the Evaluation of Offers Submitted in Response to RFPs for Individual Task Orders.

4.5.2.1 For the purpose of initial evaluations of offers proposed for individual Task Order, the following will be utilized in resolving arithmetic discrepancies found on the face of pricing schedule as submitted by the Offeror: (1) Obviously misplaced decimal points will be corrected; (2) Discrepancy between unit price and extended price, the unit price will govern; (3) Apparent errors in extension of unit prices will be corrected.

4.5.2.1.1For purposes of price evaluation, the Government will proceed on the assumption that the Offeror intends the proposed price to be evaluated on basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above.

4.5.2.1.2These correction procedures shall not be used to resolve any ambiguity concerning which price is low.

4.5.3 The right is also reserved to reject any and all offers.

4.6 Award Decision

4.6.1 Whenever possible, award will be made without discussions.

4.6.2 If discussions are required, each MA/IDIQ contractor will be requested to provide a final proposal revision, unless eliminated from discussions through the establishment of a competitive range.

4.6.3 If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

4.6.4 The basis for award for each Task Order will be stated in each RFP. Each Task Order will be awarded based on either Lowest Price Technically Acceptable (LPTA) or Trade-off. The following evaluation criteria will be considered: Price, Past Performance or Delivery Schedule. The Government will examine price proposals. Offers found to be unreasonably high, unrealistically low, or unbalanced, may be considered unacceptable.

4.6.5 The award will be a firm fixed-priced Task Order with a specific delivery date.

4.7 Task Order Issuance

4.7.1 Task Orders will be issued on a SF-1449. Orders will be placed via email. No oral task orders are authorized.

The appropriate issuing, administration, and payment offices will be cited on each Task Order.

4.7.2 The contractor will be provided an electronic copy of the PWS (with specifications and drawings as applicable) upon issue of each Task Order. All further reproduction shall be at the contractor's expense. The Government will provide these as e-mail.

5 ORDERING (REFERENCE FAR 52.216-18)

5.1 Any services to be furnished under this contract will be ordered by issuance of Task Orders by the individuals or activities designated in this contract. Only Federal Contracting Officers, at ACC-APG, Tobyhanna Division, are authorized to issue orders under the MA/IDIQ contract within the individual’s warrant levels. A copy of each Task Order ((SF-1449), and modification (SF 30 only) with funding information) issued shall be provided to the successful contractor at time of execution.

5.2 Task orders may be issued from date of contract award until the last day of the basic contract ordering period.

The total term of the contract may not exceed five years. However, Task Orders issued during the contract period may be completed, in accordance with the terms of the Task Order, after the contract ordering period has expired.

5.3 All Task Orders are subject to the terms and conditions of this contract. In the event of conflict between a Task Order and this contract, the contract will control. The Government reserves the right to incorporate additional clauses, as appropriate, into individual Task Orders solicitations and awards.

5.4 Ombudsman. If the contractor believes it was not fairly considered for a particular Task Order, the contractor may present the matter to the Contracting Officer. The contractor may appeal the explanation or decision of the Contracting Officer to the Ombudsman. The Special Competition Advocate, Small Business Administration (SBA) office, ACC-APG (443) 861-4844) acts as the Ombudsman. The Ombudsman will review the contractor's complaint, and in coordination with the Contracting Officer, verify that the contractor was afforded a fair opportunity to be considered for the Task Order.

6 EVALUATION OF CONTRACTOR PERFORMANCE

6.1 The offeror must maintain a current and active registration in the System for Award management (SAM) website: https://www.sam.gov, and must have no “ Active Exclusions” or “Debt Subject to Offset” in order to receive an award of a Task Order.

7 ORDER OF PRECEDENCE

7.1 MA/IDIQ basic contract. Any inconsistency in this solicitation or contract will be resolved by giving precedence in the following order:

1) The Schedule (excluding the specifications)

2) Representations and other instructions,

3) Contract clauses,

4) Other documents, exhibits, and attachments,

5) The specifications

7.2 The MA/IDIQ basic contract includes the standard contract clauses, and the individual Task Orders include added specifics and schedules current at the time of Task Order award. The Task Order contract consists of:

1) The solicitation in its entirety, including all drawings and illustrations and any amendments, and

2) The successful offeror's accepted proposal. The Task Order constitutes and defines the agreement between the contractor and the Government. No documentation will be omitted which in any way bears upon the terms of that agreement.

52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Multiple Award IDIQ contract resulting from this solicitation.

(End of provision)

52.216-18 ORDERING. (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from time of award through the 5 year ordering period.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when--

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either--

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than (insert dollar figure or quantity), the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor -

(1) Any order for a single item in excess of (insert dollar figure or quantity);

(2) Any order for a combination of items in excess of (insert dollar figure or quantity); or

(3) A series of orders from the same ordering office within days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after the completion of the final task order issued under this Multiple Award Indefinite Delivery Indefinite Quantity Contract.

52.219-28 POSTAWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JAN 2025)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern--

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph

(d) of this clause.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13

CFR 121.103.

(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts--

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) If the Contractor represented its status as any of the small business concerns identified at 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, for the NAICS code assigned to an order (except that paragraphs (c)(1) through (3) of this clause do not apply to an order issued under a Federal Supply Schedule contract at subpart 8.4)--

(1) Set aside exclusively for a small business concern identified at 19.000(a)(3) that is issued under an unrestricted multiple-award contract, unless the order is issued under the reserved portion of an unrestricted multiple-award contract (e.g., an order set aside for a woman-owned small business under a multiple-award contract that is not set-aside, unless the order is issued under the reserved portion of the multiple-award contract);

(2) Issued under a multiple-award contract set aside for small businesses that is further set aside for a specific socioeconomic category that differs from the underlying multiple-award contract (e.g., an order set aside for a HUBZone small business concern under a multiple-award contract that is set aside for small businesses);

(3) Issued under the part of the multiple-award contract that is set aside for small businesses that is further set aside for a specific socioeconomic category that differs from the underlying set-aside part of the multiple-award contract (e.g., an order set aside for a WOSB concern under the part of the multiple-award contract that is partially set aside for small businesses); and

(4) When the Contracting Officer explicitly requires it for an order issued under a multiple-award contract, including for an order issued under a Federal Supply Schedule contract (see 8.405-5(b) and 19.301-2(b)(2)).

(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.

(e) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition--

(1) Was set aside for small business and has a value above the simplified acquisition threshold;

(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or

(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraphs (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting officer in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.

(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.

(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

(1) The Contractor represents that it [ ] is, [ ] is not a small business concern…
