ADDENDUM

INSTRUCTIONS TO OFFERORS

1. This acquisition for one Firm Fixed Price purchase order/contract (PO) will be conducted as a Small Business

Set-Aside (SBSA) and a Brand Name or Equal, which will be pursued in accordance with (IAW) Federal Acquisition Regulation (FAR) Parts 12 (Acquisition of Commercial Products and Commercial Services) and 13 (Simplified Acquisition Procedures). The Government is not responsible for any costs incurred for the contractors’ time or materials expended in preparing an offer for this solicitation. To receive an award, the contractor must have an active registration in the System for Award Management (SAM), https://www.sam.gov Prospective offerors must be found to be responsible in accordance with (IAW) FAR 9.1 and have no delinquent federal debt.

Quotes/Offers will be evaluated IAW FAR 52.212-2, as it is contained within this SF1449 document.

Quotes/Offers submitted on a basis other than F.O.B. Destination will be rejected as nonresponsive.

2. Though not physically attached to this SF1449 document, all documents listed in the Table of Contents section of this SF1449 document, are hereby incorporated as part of this RFQ and resultant award, as applicable.

3. SUBMISSION OF OFFERS/QUOTES: Only electronic offers will be accepted. Hardcopy offers will not be accepted. Parties interested in responding to this RFQ shall submit their complete offer electronically before the closing date and time through email by including the RFQ number, (W51AA1-24-Q-0095) in the email subject line and send to the purchasing agent, Megan.Jones5.civ@army.mil .

Vendors Submitting a Quote Shall:

Include their SAM UEID Number, and, Complete and submit with the quote, page 1 of this Standard Form (SF) 1449 document, with Block 17 filled in, and Blocks 30a, 30b, and 30c filled in and SIGNED by a company official that is authorized to contractually bind the company, and, Include the specifications for the offered items, as described in paragraph (para) 1.3 of Attachment 2, and, Provide unit price, extended total, and delivery time for each line item in the order of which they are listed on this RFQ, and, Complete and submit with the quote, (as applicable), FAR provisions 52.223-22 and 52.225-18, and clause 52.223-11, as well as any applicable provision or clause listed under para 6 of this addendum, and, Acknowledge all, (if any), amendments to this RFQ by completing and signing page 1 of the SF30 document and including 1 copy of the signed amendment with the offer.

If an amendment is executed and posted after an offer is submitted, the contractor need not resubmit the entire package again. Only the signed SF30 amendment to show acknowledgement is required. If additional documents and/or information is required to be submitted as a result of the amendment, it will be stated within the SF30 amendment and shall be submitted by the offeror accordingly. Offerors are advised to use the “Follow” feature in sam.gov to ensure receipt of notification in the event that an amendment is posted.

4. EMAIL TRANSMISSIONS – (Quotes & Questions): The Government will not consider submissions that were delayed, or otherwise not timely delivered to the Purchasing Agent’s email inbox, due to complications with the contractor’s or the Government’s service providers, to include email maintenance, firewall, delivery to any other email inbox, (i.e., junk folder, spam folder, etc.). Contractors should anticipate delays in transmission and are advised to plan ahead and begin transmitting their submission in enough time to ensure successful delivery prior to the submission deadline. If the contractor does not receive written confirmation of receipt from the purchasing agent, (via “Read Receipt” or manual reply to acknowledge receipt), before the established deadline, it is the responsibility of the contractor to contact the purchasing agent), to confirm that their email submission was received.

5. QUESTIONS – All questions and requests for clarification shall be submitted in writing, via email by including the RFQ number, (W51AA1-24-Q-0095) in the email subject line and send to the purchasing agent, identified in para 3 of this addendum. The open period for submitting questions firmly ends at 4:00 PM (EST), 3 calendar days prior to the closing date of this RFQ. If received after this time and date, questions may remain as unanswered.

Answers will be consolidated and posted ONLY to https://www.sam.gov in the form of Questions and Answers (Q&A), and/or, if required, an amendment to the RFQ. Offerors are advised to use the “Follow” feature in sam.gov to ensure receipt of notification in the event that

52.223-11 OZONE-DEPLETING SUBSTANCES AND HIGH GLOBAL WARMING POTENTIAL

HYDROFLUOROCARBONS (MAY 2024)

(a) Definitions. As used in this clause--

Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.

High global warming potential hydrofluorocarbons means any hydrofluorocarbons in a particular end use for which EPA's Significant New Alternatives Policy (SNAP) program has identified other acceptable alternatives that have lower global warming potential. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables of alternatives available at (https://www.epa.gov/snap/).

Hydrofluorocarbons means compounds that only contain hydrogen, fluorine, and carbon.

Ozone-depleting substance means any substance the Environmental Protection Agency designates in 40 CFR part 82 as--

(1) Class I, including, but not limited to, chlorofluorocarbons, halons, carbon tetrachloride, and methyl chloroform;

or

(2) Class II, including, but not limited to, hydrochlorofluorocarbons.

(b) The Contractor shall label products that contain or are manufactured with ozone-depleting substances in the manner and to the extent required by 42 U.S.C. 7671j (b), (c), (d), and (e) and 40 CFR part 82, subpart E, as follows:

(a) This representation shall be completed if the Offeror received $7.5 million or more in Federal contract awards in the prior Federal fiscal year. The representation is optional if the Offeror received less than $7.5 million in Federal contract awards in the prior Federal fiscal year.

DELIVERIES TO TOBYHANNA ARMY DEPOT (TYAD)

CONTRACTING OFFICER’S INSTRUCTIONS:

1. HOURS OF OPERATION – Standard hours for Shipping and Receiving are from 0730 hours to 1500 hours, Monday through Friday, except on Federal Holidays.

2. ALL DELIVERY DRIVERS MUST POSSESS – Valid vehicle insurance, registration, driver's license with proper endorsement for the size vehicle they are driving, bill of lading/purchase order that shows the contractor/vendor company name, telephone number, point of contact, type of goods and where the delivery is being made at TYAD.

3. MULTI-AXLE VEHICLES – Must enter and exit via the TRUCK GATE, located on Squire Street. Hours of operation for the truck gate are 0730 through 1530, Monday through Friday, except Federal holidays.

4. STANDARD-SIZED (NOT EXCEEDING 10 FEET IN HEIGHT) – May use the MAIN GATE, however, the driver must obtain, both a visitor’s pass, and a vehicle pass from the Security Office, Building 20.
