ADDENDUM
1. This solicitation, W51AA1-24-Q-0022 is for the services associated with the Pest
Control Services at Tobyhanna Army Depot, Tobyhanna PA 18466, in accordance with (IAW) the attached Performance Work Statement (PWS). The contract will be for a period of one year, the government will have the option to extend the term of the contract for an additional one year.
2. This will be a Firm Fixed Price type Contract. Solicitation will be conducted on a competitive basis and pursued in accordance with Federal Acquisition Regulations, (FAR) Part 13, (Simplified Acquisition Procedures).
3. BASIS OF AWARD: See 52.212-2 Evaluation – Commercial Items.
4. As part of the price evaluation, the Government will evaluate the Option to Extend
Services under FAR Clause 52.217-8 by adding one-half of the offeror's final Option period price to the offeror's total price.
5. Any amendments issued to this solicitation will be synopsized in the same manner as this solicitation. All Offerors are advised to acknowledge all amendments issued to the solicitation with their proposal by completing and signing page one (1) and including one
(1) copy of each Solicitation amendment with their quotation.
6. CONTRACTOR SUBMITTED QUESTIONS: Offerors are advised to submit any questions regarding this solicitation in writing to the purchasing agent via email:
forrest.l.green8.civ@army.mil. Any and all questions shall be submitted in writing via email to the purchasing agent identified in the solicitation.” Answers to questions will be posted in the same manner in which the solicitation is posted and be incorporated into the resultant award. Questions will not be accepted within two (2) business days of the solicitation closing date.
7. Government is not responsible for any costs incurred for contractor’s time or materials expended in preparing a proposal for this solicitation.
8. Offers are only solicited on SAM.GOV website. Bids are emailed before deadline to Forrest.L.green8.civ@army.mil.
9. QUOTATION SUBMISSION: Parties interested in responding to this RFQ
A. Submit their offer on a completed standard form (SF) 1449 http://www.forms.gov,BLOCK Numbers 17a, 19 thru 24, 30a, 30b, and 30c. The offer, (SF1449), must be signed by a company official authorized to contractually bind the company.
B. Include all, (if any), signed amendments, as noted above in 5.
C. The complete offer, including any/all applicable attachments, must be received before the closing date and time, see BLOCK # 8 of the SF1449); offerors should anticipate delays in transmission and are advised to plan ahead and to begin transmitting their offer in enough time to ensure successful delivery prior to the close of the solicitation
D. Submit two Past Performance references (within last five years) of same or similar work that must include date of contract, contract number information of reference and description and location of the work performed.
E. Each offer must be submitted electronically before closing date and time to the purchasing agent, Forrest Green at email address: Forrest.L.Green8.civ@army.mil. The email size must not exceed 9MB.
F. If a complete offer, including any/all applicable attachments, does not appear in the email inbox of the purchasing agent identified in this solicitation before the closing date and time, then it is considered as not received and the offeror’s entire offer is late and will not be considered for award.
G. If the offeror does not receive written confirmation of receipt from the purchasing agent before the closing date and time, it is the responsibility of the offeror prior to the closing of the solicitation to contact the purchasing agent, to confirm that their complete offer has been received; The Government will not consider offers that were delayed, or otherwise not timely delivered to the Purchasing Agent’s email inbox due to complications with the offeror’s or the Government’s service providers, to include email maintenance, firewall, delivery to any other email inbox, (e.g. junk folder, spam folder, etc.), or that the purchasing agent’s email inbox has reached maximum capacity; offerors should anticipate delays in transmission and are advised to plan ahead and to begin transmitting their offer in enough time to ensure successful delivery prior to the close of the solicitation.
10. DISCUSSIONS: The Government intends to award a purchase order without discussions.
11. To receive an award, the company must have an active registration in the System for
Award Management (SAM) https://www.sam.gov. Prospective offerors must be found to be responsible in accordance with FAR 9.1 and have no delinquent federal debt.

SECTION C-1
GENERAL
1. SCOPE OF WORK. The contractor will furnish all labor, tools, materials, equipment and transportation necessary to provide a comprehensive Integrated Pest Management (IPM) program for indoor and outdoor pests at Tobyhanna Army Depot (TYAD) as required by the contract and described herein. IPM is a sustainable approach to managing pests by combining biological, cultural, mechanical and chemical tools in a way that minimizes economic, health and environmental risks. Federal agencies are mandated to use IPM by Public Law (PL 104-170, Section 303). An IPM program should emphasize the following:
Structural and procedural modifications to reduce food, water, harborage and access used by pests.
Pesticide compounds, formulations and application methods that present the lowest potential hazard to humans and the environment.
Non-pesticide technologies such as trapping and monitoring devices.
Coordination among all facilities management programs, including facility use lessees, which has a bearing on the pest control effort.
1.1 Service will be performed in accordance with the specifications and directions provided, and the best standard practice for this type of work. The work will be conducted under the general direction of the Chief, Environmental Branch, Risk Management Division (RMD), D/Installation Services (D/IS) and is subject to inspection by the Installation Pest Management Coordinator or designated alternate to ensure strict compliance with the terms of the contract. The contractor shall have a minimum of three years’ experience in commercial pest control.
1.1.2 Service must meet the performance standards contained herein and shall be in compliance with the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), as amended in 1972, the Installation Pest Management Plan, the requirements of the Department of Defense (DoD) Directive 4150.7, Army Regulation 200-1, the Pennsylvania Pesticide Control Act of 1973 as amended, and all other applicable regulations.
1.1.2.1 The contractor must be licensed by the Commonwealth of Pennsylvania and all employees who provide services on TYAD will be certified as commercial applicators by the Commonwealth of Pennsylvania in the following categories as appropriate:
Household/Health Related (category 11) Wood Destroying Pests (category 12) Public Health - Vertebrate (category 15) Public Health - Invertebrate (category 16)
Parks/Schools Pest Control (category 23)
1.1.2.1.1 The contractor must, at no expense to the government, obtain all appointments, licenses and permits required for the execution of the work and compliance of all applicable federal, state and local laws and regulations. Photocopies of such permits must be provided to the Contracting Officer before work commences.
2. CONTRACTOR'S RESPONSIBILITIES.
2.1 The contractor must commence work within five days after the date of receipt of award, and service shall continue for one year (365 days).
2.2 The contractor must develop and submit a work plan to the Pest Manager, within 10 days after award. This work plan will include: a proposed schedule for the surveillance and control services specified in Appendix A; a proposed list of the pesticides that may be used in control services; a Safety Data Sheet (SDS) and label for each pesticide proposed for use; and the date and time during which the Pre-Performance Conference specified in section C-4, paragraph 1, will be held.
2.3 The contractor must maintain a commercial telephone at which the contractor can be reached day or night, including weekends and holidays. The contractor must provide the Contracting Officer with mailing address and telephone number on the contract start date, and immediately thereafter in the event of a change.
2.4 CONTRACTOR PERSONNEL. Every contractor's employee applying pesticides must be certified as commercial applicators and licensed by the Commonwealth of Pennsylvania for each category required.
2.4.1 Photocopies of licensing and certification for each worker will be submitted to the Integrated Pest Manager or designated representative within 10 days after award and must be maintained current thereafter.
2.5 Each contractor employee will wear distinctive clothing bearing the contractor's trade name in a prominent place on the outer garment. In addition, each employee must wear a visible, contractor-furnished identification badge which will include, as a minimum, a picture of the employee, the full name and signature of the employee, the employee's identification number and the legal name under which the contractor is doing business under this contract.
2.6 The contractor must provide the Integrated Pest Manager with a roster of all employees who will perform work under this contract containing the employee's full name, home address, citizenship status, social security number, employment date, certification number, certification categories, extent of training in pest control procedures and badge identification number.
2.6.1 After the initial roster has been accepted by the Integrated Pest Manager, new employees added to the roster will not be permitted to work on the installation until their qualifications have been approved by the Pest Manager.
2.7 The contractor must ensure that all contractor employees observe and comply with all applicable federal, state and local rules, regulations and procedures concerning fire, safety, environmental protection, sanitation, security, vehicle safety, hazardous material handling, pesticide usage and possession of firearms or other lethal weapons while on government property.
2.8 The contractor will not allow any employee who is under the influence of alcohol, drugs or incapacitating agents to perform any work under this contract. The Contracting Officer or designated representative may require the contractor to remove and bar from the job site any employee found to be under the influence of alcohol, drugs or any other incapacitating agents, or who is determined by the government to be a security risk or who is in violation of any safety directive identified in this contract. The removal or barring of such a person will not relieve the contractor of the requirement to perform all work described in the contract. Off-duty contract personnel will not be present on TYAD unless on official business or authorized to be on the installation.
2.9 The contractor must not employ any person who is employed by the DoD, unless such person seeks and receives approval according to applicable regulations. In addition, the contractor must not employ any person when said employment would result in a conflict of interest as specified in DoD Directive 500.7, Standards of Conduct.
2.10 Compliance with the provisions of these specifications by subcontractors will be the responsibility of the contractor.
3. SAFETY.

4. ENVIRONMENTAL PROTECTION
4.1 Refer to National Environmental Policy Act (NEPA Standards).
5. SCHEDULING. All work must be scheduled through the Contracting Officer's Representative (COR) and will be coordinated with government supervisors in the areas to be serviced in order to avoid interference with normal operations. Contractor will be on site for a minimum of two hours daily between Monday and Friday. The areas and facilities identified in Appendix A must receive the surveillance and control services described according to the frequency prescribed. However, chemical control services will be provided only when warranted by the surveillance findings. Other services provided to these same areas and facilities, i.e., services not identified in Appendix A, will be provided as on-call routine control services. All other areas on the installation must receive service in the form of "on-call" routine or emergency service requests and will be provided only when requested by the government. Unless otherwise approved by the Contracting Officer, all services must be performed during normal duty hours
(MONDAY -FRIDAY 0730-1530).
5.1 When surveillance results warrant control services, these surveillance results must be made available to the COR within 24 hours of completion.
6. BIDDING, BID PRICES AND PAYMENT. Bid prices must include one firm fixed price for all pest surveillance and control services depicted in Appendix A and yearly mosquito services, to include the pesticides necessary to complete the service. The estimated quantities of services to be ordered annually are shown on the contract solicitation bidding schedule. Facility data and building categories are located in Appendix I.
7. GOVERNMENT OPTIONS.
7.1 As technology improves, regulations change and new materials and methods are made available, it may become necessary to alter the specifications of this contract to accommodate such changes in order to reduce the reliance on chemicals or to utilize safer methods and/or materials.
7.1.1 The contractor will recommend specification changes to the Contracting Officer whenever-
- newer, safer and more effective methods become available.
- more selective pesticides become available.
- less toxic or persistent pesticides become available.
7.2 The contractor will provide the Integrated Pest Manager with a contingency plan in the event of a work stoppage due to personnel problems, issues and/or strikes which shall include procedures to-
- notify the government of a strike or intent to strike,
- use supervisory personnel to perform services outlined in the contract,
- use other personnel presently employed by the contractor, or
- use other sources of personnel to perform services outlined in the contract.
7.2.1 The government reserves the right to obtain services from different sources including the use of government personnel in the event of a work stoppage.

SECTION C-2
OPERATIONS
1. OVERVIEW. The contractor must utilize IPM techniques in the overall performance of this contract, consistent with the Installation Pest Management Plan. This IPM approach will utilize a variety of techniques including, predators and parasites, genetically resistant hosts, natural environmental modifications and, when necessary and appropriate, chemical pesticides. However, mechanical measures such as mowing, brush cutting and tree trimming and/or removal shall remain a grounds maintenance activity, outside the scope of work for this contract.
1.1 Each time pest surveillance services are rendered, the contractor will:
1.1.1 Completely inspect the treatment site for suspected causes of damage and/or infestation and harborage sites.
1.1.2 Identify the pest(s) involved, the extent or potential for damage and/or infestation and determine the actual extent of the problem as well as any possible causes.
1.2 CHEMICAL TREATMENTS. If treatments are directed or required, chemical treatments and/or control methods may be utilized only when satisfactory non-chemical methods or treatments do not exist, or when the use of non-chemical methods/treatments would not provide the degree of control required. Control services must be scheduled and performed in accordance with the requirements of Section C-1, paragraph 5.
1.2.1 When chemical controls are used, pesticide application effectiveness will be evaluated five working days after the treatment. If an acceptable level of control is not achieved and if permitted by the pesticide label, the contractor will retreat the area until the acceptable level of control, as specified herein or determined by the Contracting Officer in consultation with the IPMC and Preventive Medicine, is achieved. Minimum acceptable levels of control are specified in paragraph 4.1.7.
1.3 GOVERNMENT INSPECTIONS. Each phase of service rendered is subject to government inspection during the contractor's operations and/or after the completion of the task.
1.3.1 The government may sample the contractor's pesticides and inspect the contractor's equipment and materials at any time.
1.3.2 Defective or unaccomplished work must be immediately brought to the attention of the contractor, who will meet with the Contracting Officer to discuss the work in question without delay. Work determined unsatisfactory as a result of such discussions, or the contractor's failure to discuss the work in question will be cause for adjustments in the contract price, which will be based on the information gathered from section C-1, paragraph 6.
1.3.3 When an inspection reveals inadequate control and when permitted by the pesticide label, the contractor must retreat previously treated areas within 24 hours after receiving notice from the Pest Manager, at no additional charge to the government unless an exception is granted by the COR. There are no limits to the number of call-backs for retreating control failures unless conditions exist that render chemical treatments ineffective and are beyond the contractor’s control; see paragraph 4.1.7.
1.4 Work shall be performed in a way that allows the passage of traffic at all times.
Where only one lane or the equivalent is open to traffic, adequate warning signs will be used.
1.5 EQUIPMENT INSPECTIONS. The contractor will make a daily safety inspection of all equipment to be used to ensure it is operating properly and within OSHA and Commonwealth of Pennsylvania standards. Noted equipment defects will be repaired by the contractor prior to use in order to ensure proper operation and to comply with OSHA standards, without cost to the government. Operations being performed with poorly performing equipment must be stopped until the causes have been identified and repaired.
1.6 Upon completion of all work, or the termination of this contract, the contractor must remove all debris from the site, and the entire job site will be left clean and acceptable to the Pest Manager.
2. PESTICIDE USAGE. All pesticides must be procured, processed, handled and applied in strict accordance with the manufacturer's label which must be registered with the U.S. Environmental Protection Agency (EPA) and the Pennsylvania Department of Agriculture for enforcement of the FIFRA.
2.1 Pesticide misuse which includes use inconsistent with the label is a violation of Federal Law. In accordance with DoD policy, TYAD personnel will record and report any instances of pesticide misuse and falsification of records by contractors to the Commonwealth of Pennsylvania. Furthermore, TYAD personnel will cooperate with the Commonwealth of Pennsylvania and the U.S. EPA in any subsequent investigation or actions.
2.2 All pesticides proposed for use on the installation must be approved for use by the Pest Manager in conjunction with consultation with the IPMC, and must be registered with the U.S. EPA and Commonwealth of Pennsylvania for the intended use. The contractor will not apply any chemical pesticide or fumigant without prior written approval from the Contracting Officer for each chemical pesticide or fumigant.
2.2.1 Legible copies of container labels and SDS for the pesticides proposed for use will be submitted to the Pest Manager for approval prior to use/acquisition.
2.2.2 Pesticides that have been suspended or canceled by the U.S. EPA must be used only as described in the suspension or cancellation order and will not be used after the date indicated on that order.
2.2.3 Chemical measures will not be performed on or near federal or state protected or endangered species.
2.3 In the event of a spill or pesticide/herbicide incident, the contractor must immediately notify the Fire Department at X911.
2.4 All pesticides must be mixed prior to entering onto government property. In addition, pesticides, pesticide mixtures and contractor equipment and supplies will not be stored overnight on the installation. Mixing operations will not be performed on the installation.
2.5 The contractor will dispose of all pesticides, pesticide contaminated residues and pesticide containers in accordance with the appropriate label directions and regulatory requirements, and may reuse rinse water from pesticide equipment and containers in follow-on pest control operations. Pesticide contaminated materials will not be disposed of on the installation. Pesticide contaminated rinse water will not be emptied into the sewer system, nor disposed of on government property.
2.6 The contractor will apply pesticides in a manner that prevents exposure of personnel, pets, wildlife, ornamental plants and grasses, bees and other non-target environmental components to toxic materials. Pesticides will not be applied outdoors during or immediately following rain, or when the threat of inclement weather exists, unless required by the application procedures. If pesticide application is creating or may pose a hazard or threat to personnel or the environment, the contractor must stop work.
3. SCHEDULING OF WORK. As indicated in Section C-1, paragraph 5, Scheduling, the majority of all pest control services must be performed by the contractor during normal duty hours. When the nature of the target pest or the facility to be treated does not allow for this, the contractor will receive prior approval from the Integrated Pest Manager to treat facilities outside of normal duty hours.
3.1 When required, the contractor will provide building occupants/custodians written notice of pest control services to be performed five days prior to performing such services, and written instructions to the occupants concerning pre-treatment preparations, i.e., removing contents from cupboards, removing food materials, etc.
Areas that have not been prepared will not be treated by the contractor.
4. PEST CONTROL WORK. The contractor must perform the specific functions/tasks described below, and as prescribed in Appendix I or requested by the government. The contractor will also report any evidence of pests or conditions conducive to pest infestation that are not covered in this contract to the COR at the time such conditions are first noticed.
4.1 HOUSEHOLD PESTS AND PESTS OF MEDICAL IMPORTANCE. These pests include roaches, rodents, mosquitoes and biting flies, filth flies and venomous and/or stinging or biting pests.
4.1.1 Roaches: The contractor must provide pest surveillance and control services for roaches. Utilizing sticky traps for the bi-weekly surveillance of roaches, chemical control measures shall be initiated when surveillance counts equal or exceed one roach per sticky trap. A minimum of ten sticky traps shall be used in each food handling area of 10,000 square feet or larger listed in Appendix I. A minimum of five sticky traps shall be used in all other buildings listed in Appendix I. Traps shall be placed in areas roaches are likely to inhabit.
4.1.1.2 Portable vacuums rather than pesticide sprays shall be the standard method for initial cleanouts of cockroach infestations. When pesticides are necessary, bait and gel formulations shall be used with alternate formulations restricted to unique situations where baits and gels are not practical. When control operations are conducted in response to a complaint in family housing, multi-family dwellings shall be treated as a whole when ordered by the Contracting Officer/COR.
4.1.2 Rodents. The contractor must provide pest surveillance and control services on a weekly basis for the control of rodents. Surveillance activities will include visual inspection for harborage/nesting areas, commodity damage and droppings, and may include the use of traps. Control measures will be initiated when there are two or more visible sightings per month or when customer complaints are received for specific areas.
The use of non-poisonous methods including glueboards and snap traps will be emphasized by the contractor. Trapping will not be performed during periods when maintenance will be delayed by holidays or weekends, and traps shall be placed out of the general view and in protected areas so as not to be affected by routine cleaning or other operations. All rodenticides, regardless of packaging, must be placed either in locations that are not accessible to children, pets, wildlife and domestic animals or in U.S. EPA-approved tamper-resistant bait boxes. The Commissary (Bldg. 816) will have a minimum of 18 exterior bait boxes and will be serviced once a month. Frequency of other bait box servicing will depend upon the level of rodent infestation, and at a minimum, must be in accordance with U.S. EPA regulations with emphasis on the safety of non-target organisms.
4.1.3 Mosquitoes and biting flies. Surveillance activities will be conducted by the government. Control services will be performed by the contractor as directed by the Integrated Pest Manager, with emphasis upon non-poisonous methods. Control services will normally be performed as routine on-call service requests. Mosquito larvaciding will be conducted for storm drains and low-lying areas. There are 200 storm drains and the low-lying areas encompassing 25 acres that will be treated once a year and if needed.
4.1.4 Filth flies. The contractor will provide pest surveillance and control services when warranted for the control of filth flies. Control measures must be initiated when surveillance counts exceed ten adult filth flies on a standard fly grid left for one minute adjacent to a breeding site. Controls must be in accordance with U.S. EPA standards and will be performed in accordance with the best standard practice for this type of work, with emphasis on non-toxic methods.
4.1.5 Venomous and stinging or biting pests. The contractor will perform control services on venomous, and/or stinging or biting arthropods as directed by the Contracting Officer/COR. IPM control methods will primarily involve vacuuming of pests and the removal of nests.
4.1.6 Other nuisance pests. The contractor must provide regularly scheduled surveillance and control services as warranted for occasional invasions of nuisance pests, i.e., ants, earwigs, flies, spiders, silverfish, etc. Control measures will be initiated when surveillance counts equal or exceed five pests or there is evidence that the pests are becoming established as inhabitants of the dwelling/building. Services for the control of these pests in areas other than those already detailed in Appendix I will be requested as warranted or when the situation is more than an isolated occurrence.
4.1.7 Minimum acceptable levels of control. The minimum levels of control for all services are specified below. However, in the event sanitation, harborage and/or pest access conditions are such that chemical controls provided by the contractor would be ineffective, the IPMC will direct changes to be made in those affected areas before chemical controls are employed or allowed to continue.
4.1.7.1 Scheduled services. Unless otherwise approved by the Contracting Officer, pest control shall be as follows:
4.1.7.1.1 In buildings scheduled for monthly or bi-weekly service:
4.1.7.1.1.1 Control of arthropods other than cockroaches and ants, will be achieved within two treatments. "Control" is defined as less than two sightings of the pest during a 30-day period.
4.1.7.1.1.2 Controls measures for cockroaches must be initiated per the requirements of paragraph 4.1.1, and these facilities shall remain virtually free of cockroaches. In the event controls are needed, they must be initiated by the contractor as directed by the
COR.
4.1.7.1.1.3 Ant control must be established within 30 days and the site will remain virtually free of any infestation. If an infestation is located by contractor personnel during regularly scheduled inspections, and treatment or follow up is required, such treatment will be scheduled with the Contracting Officer or his representative and a copy of the schedule will be provided to the Contracting Officer by the contractor.
4.1.7.1.1.4 Rodent control must be established within 30 days and the site will remain free of any infestation for the remainder of the contract.
4.1.7.1.2 For all other buildings and facilities, including family housing:
4.1.7.1.2.1 For arthropods other than cockroaches and ants, elimination will be established in one visit. If retreatments are necessary, they will not be considered as additional service calls and will be accomplished at no additional cost to the government.
4.1.7.1.2.2 Elimination of rodents shall be established in a 10-day treatment period.
This period may be modified in certain areas where only traps are used, when approved by the Contracting Officer.
4.1.7.1.2.3 Elimination of cockroaches and ants will be established within 30 days and the site will remain free of any infestation for at least 30 days thereafter.
4.2 MISCELLANEOUS PESTS.
4.2.1 Vertebrate pests. The contractor must issue provided services, i.e., trapping, netting, etc., for the control and/or removal of vertebrate pests in and around buildings as ordered by the Contracting Officer/COR. These services will be performed as on-call service requests. The contractor must have all applicable state and local licenses and permits for trapping and control of vertebrate pests.
4.2.1.1 The trapping and disposal of trapped animals must be at the direction of the Contracting Officer/COR. Trap sizes and bait types will be approved by the IPMC and the Contracting Officer. Once set, traps will be checked not less than every 24 hours, and shall be set for a maximum of five consecutive working days for each request.
Traps will not be set to catch animals during weekends or holidays unless without prior approval.
4.2.1.2 Carcass disposal. The contractor must remove and dispose of all dead or dying animals from all areas or structures on the installation when notified by the COR or the Contracting Officer. Response to these service requests will be made within four hours of notification. Carcass disposal will include the application of an effective deodorizer or disinfectant to the area from which the animal was removed.
4.2.1.2.1 The contractor will not dispose of any suspected rabid animal without prior approval of the IPMC.
4.2.1.2.2 Non-rabid carcasses must be disposed of at an approved sanitary landfill or at the direction of the Contracting Officer.
4.3 STRUCTURAL AND WOOD DESTROYING PESTS. The contractor must perform an in-depth inspection of facilities when directed by the Contracting Officer or the COR for termites, wood destroying fungi, carpenter ants and powder post beetles. The findings of each inspection shall be recorded on DD Form 1070, Termite and Wood Decay Inspection Report and provided to the COR. These inspections will include a description of the locations, nature and extent of both damage and wood destroying pest infestations, if found. In the event control services are required, these inspection records will be submitted to the Contracting Officer/COR within five work days following the completion of the inspection. Any follow-on control services for termites or other pests must also be recorded on DD Form 1070, as defined in paragraph 5.3.
5. REPORTING AND RECORDKEEPING. Unless otherwise indicated by the COR, the contractor must submit to the COR, a completed and accurate DD Form 1070, for each facility inspected, unless otherwise indicated by the COR (see Technical Exhibit Number 1). For each pest control operation or pesticide treatment, the contractor must submit to the COR, a completed and accurate DD Form 1532-1, Pest Management Maintenance Record or equivalent. These reports will include descriptions of the locations, nature and extent of both damage and wood destroying pest(s) infestations, and will be submitted to the Contracting Officer within five work days following the completion of any inspection or control service. The contractor will also provide the COR with a report detailing the types of operations performed each day and the amounts and types of all chemical pesticides used during control operations through an internet-based reporting system, unless otherwise indicated by the COR.

SECTION C-3
CONTRACTOR FURNISHED EQUIPMENT
1. VEHICLES AND EQUIPMENT. The contractor must furnish all vehicles, equipment, tools, pesticides, materials, traps, personnel and supplies to perform the specific functions or tasks of this contract. Except for building drawings and the services depicted in section C-5, the government will not furnish any material, personnel, equipment, storage space or mixing space for the implementation of this contract.
Building drawings may be obtained by contacting the COR. When requested by the contractor, drawings will be provided within 48 hours.
1.1 The contractor will maintain all vehicles and equipment in a clean and orderly appearance, free from observable deterioration, leaks, pesticide spills, scum or build-up.
Equipment must be operated and calibrated in accordance with the manufacturer's instructions at the recommended rates and pressures.
1.1.1 Screens, strainers and filters will be used and maintained in accordance with the manufacturer's instructions.
1.1.2 Spray nozzles will deliver spray patterns as specified by the nozzle manufacturer and must be repaired or replaced when they become clogged or eroded.
1.1.3 Damage caused by defective equipment will be corrected by the contractor at no expense to the government.
1.1.4 The contractor's vehicles and equipment will not be cleaned or washed on government property.
1.2 Ultra-Low Volume equipment used in the performance of this contract must be calibrated prior to use and every 50 hours thereafter, or as per the manufacturer's recommendations.
1.3 All contractor vehicles must have the contractor's name/logo clearly visible and will, at all times, display a valid state license plate and safety inspection sticker, as required.
1.4 All contractor vehicles used to transport pesticides must be labeled for pesticide use, dedicated only for pest control use while on the installation and be equipped with a fire extinguisher, spill and decontamination kits, an emergency wash water and an eye lavage. Contractor vehicles must not be left unattended at any time unless properly locked and secured. Transportation of all pesticides must be in accordance with 49 Code of Federal Regulations, Department of Transportation (DOT) training requirements (Hazard Material, HM-126F) and all other applicable rules and regulations.
1.4.1 All pesticide dispersal equipment, including bait stations and trays, must be clearly and plainly marked with the terms "DANGER" and "PESTICIDES", and with the name and concentration of the pesticide/herbicide enclosed, or as otherwise required by applicable regulations.
1.4.2 All pesticides carried on vehicles must be secured in locked compartments at all times while on government property, and will not be carried in the vehicle cab.
1.4.3 Decontamination kits will, at a minimum, contain a broom, a dustpan, enough absorbent material to absorb 10% of either the chemical load or the contents of the largest container and an empty DOT approved container for the collection of used absorbent and spilled material.
2. PESTICIDES. All pesticides procured for use in the performance of this contract must be registered with the U.S. EPA and the Pennsylvania Department of Agriculture for the intended use, and be approved for use by the Contracting Officer in conjunction with consultation with the IPMC. The contractor will not apply any chemical, pesticide or fumigant without prior written approval from the Contracting Officer for each chemical, pesticide or fumigant.
2.1 Legible copies of container labels and SDS for the pesticides proposed for use must be submitted to the Contracting Officer for approval prior to use/acquisition.
Usage requirements will be as specified in section C-2, paragraph 2.
3. PERSONAL PROTECTIVE CLOTHING AND EQUIPMENT (PPE). The contractor must provide and enforce the use of all safety equipment and PPE required by the pesticide's manufacturer on the label. A spill kit must be available at all times as required by the Installation Spill Contingency Plan and the Installation Pest Management Plan.

SECTION C-4
QUALITY CONTROL/QUALITY ASSURANCE
1. PRE-PERFORMANCE CONFERENCE. Prior to commencing work, the contractor must meet with the Contracting Officer, or his representative and the IPMC to discuss and develop mutual understandings relative to the scheduling and administration of work. Methods of pest control, chemical application, types of equipment used to apply chemicals, types of PPE to be worn, the number of personnel, provisions for weather delays and mechanical breakdowns and spill contingency plans and other mutual concerns will be discussed. This conference shall be scheduled by the contractor, as approved by the Contracting Officer, and shall be listed in the Contractors Start Plan, see section C-1, paragraph 2.2.1.
2. QUALITY CONTROL. The contractor must establish a complete Quality Control Program (QCP) to assure the requirements of the contract are provided for as specified.
One copy of the contractor's QCP will be provided to the Contracting Officer at the Pre- Award Survey or the Pre-Performance Conference when a Pre-Award Survey is not held. An updated copy must be provided to the Contracting Officer on the contract start date and as changes occur. This program will include, but not be limited to:
2.1 A quality control inspection system covering all services included in the contract. It must specify areas to be inspected on both a scheduled or unscheduled basis and how inspections are to be conducted.
2.2 A file of all quality control inspections, inspection results and any corrective actions required. This file will be maintained by the contractor throughout the term of the contract, will be the property of the government and be made available to the Contracting Officer during regular hours. This file will be turned over to the Contracting Officer within seven days after completion or termination of the contract.
2.3 The name(s) of the individual(s) tasked to perform quality control inspections, their qualifications, and the extent of their authority.
3. QUALITY ASSURANCE. The government will monitor and inspect the contractor’s performance under this contract using DoD personnel trained and accredited as pest management quality assurance evaluators in accordance with DoD Manual 4150.7-M.
This monitoring and inspection will follow procedures developed by the government or referenced in the contractor’s QCP.
4. PERFORMANCE EVALUATION MEETINGS. The contractor's representative will meet with the Contracting Officer as deemed necessary by the Contracting Officer to mutually resolve all identified problems.
The written minutes of the meeting, prepared by the government, will be signed by the contractor's representative and the Contracting Officer. Should the contractor not concur with the minutes, the contractor must state so in writing to the Contracting Officer within 72 hours.
5. WARRANTY. The contractor must provide the government with a written warranty, in acceptable form, for each building or building unit treated for subterranean termites and good for a period of not less than five years, guaranteeing retreatment of any subsequent subterranean termite infestation found within five years after the initial treatment. Any structural damage due to a termite infestation found within five years after the initial treatment will be repaired at the expense of the contractor and at no additional cost to the government.
5.1 This warranty must be covered by an insurance policy with an insurance company permitted to do business in the Commonwealth of Pennsylvania.
5.2 Prior to initially treating any building, the contractor and the IPMC will inspect the premises to identify any existing termite damage so that subsequent damage can be verified.

GOVERNMENT FURNISHED PROPERTY AND SERVICES
