RFP EXECUTIVE SUMMARY

1. The United States Army Contracting Command – Rock Island (ACC-RI) requests a proposal on behalf of Rock Island Garrison (USAG – RIA) consisting of a design-build to replace existing overhead 13.8kV primary power circuits with new underground electrical infrastructure located at the U.S. Army Garrison, Rock Island Arsenal, Rock Island, Illinois. All work is to be done in accordance with the Scope of Work (SOW) for project 2019- 4350, i.e. Attachment 0001.

2. This requirement will be competed on SAM.gov at https://www.sam.gov/SAM/ and will allow for full and open competition.

3. The North American Industry Classification System (NAICS) code is 238210, Electrical Contractors and Other Wiring Installation Contractors. The Product Service Code Z2QA, Repair or Alteration of Restoration of Real Property (Public or Private).

4. All Offerors MUST be registered in the System for Award Management (SAM) database in accordance with Federal Acquisition Regulation (FAR) 52.204-7 and Defense Federal Acquisition Regulation Supplement (DFARS) 252.204-7004 when submitting an offer, and shall continue to be registered until time of award, during performance, and through final payment of any contract resulting from this solicitation. Lack of registration in SAM will make an Offeror ineligible for award. Contractors may obtain information on registration and annual confirmation requirements via the SAM website at https://www.sam.gov/SAM/ or by calling 866-606-8220.

5. The Government will award a single Firm-Fixed Price (FFP) type contract from this solicitation to the responsive, responsible Offeror with the lowest price and an acceptable past performance rating as outlined in paragraph 6. This Request for Proposal (RFP) contains three contract line-item numbers (CLINs): CLIN 0001 which represents one firm-fixed price base bid; CLIN 0002 which represents one firm-fixed price option bid; and time and material (T&M) CLIN 0003 for dirt and rock excavation. Contractor is to provide: a firm-fixed price to execute all work associated with CLIN 0001; a firm-fixed price to execute all work associated with CLIN 0002;

and a firm-fixed unit price per cubic yard for excavation of an estimated 1,944 cubic yards. The quantity associated with CLIN 0003 is an estimate only and may fluctuate. Note that the unit price proposed for CLIN 0003 will be applicable for entire contract duration. Also note that excavation should not be included in the prices proposed for CLINs 0001 and 0002. Contractor shall insert proposed unit price on page eight, in CLIN 0003.

6. The contractor shall submit a total of three past performance references for similar projects that are within the last five years and may include subcontractor references.

a. Each reference shall include the information bulleted below:

Contracting agency/company and technical points of contact with their phone numbers, electronic-mail addresses, and titles.

Contract number and delivery/task order number, as applicable.

The original contract award date (for the base period of performance) and the completion (or estimated completion) date (shall reflect all option periods).

Contract value (value of each performance period shall be identified).

Scope of work.

b. If applicable, the submittal in this section shall also list any contract or purchase order under which either a cure notice or show cause letter was received, or any contract or purchase order that was terminated for cause by the Government within the past three years. The contractor must briefly explain the facts and circumstances in each such instance.

The Government will evaluate past performance as acceptable/unacceptable. The Government will contact all contract references provided and conduct research into Government Databases on past performance (PPIRs, CPARs, etc.) to determine past performance to be relevant and recent and to determine that past performance to be satisfactory or above.

Relevant past performance efforts involve similar scope and magnitude of effort and complexities this RFP requires.

Recent past performance is within the past 5 years.

Past Performance Acceptable/Unacceptable Rating Method is as follows:

Adjectival Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above)

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

In the case of an offeror without a record of recent/relevant past performance no meaningful confidence assessment rating can be reasonably assigned. The Offeror will be given an acceptable rating.

7. The Government anticipates price competition, therefore, certified cost or pricing data is not required to be submitted with the Offeror’s proposal. However, the Government reserves the right to request certified cost or pricing data in the event price competition does not exist.

8. A Notice to Proceed (NTP) will be issued at time of contract award and the awardee shall prepare and submit a practicable schedule and Quality Control Plan (QCP) to the Contracting Officer for approval within 15 days. The remaining pre-submittals are due within 30 days after issuance of the NTP, with commencement of work to begin 45 days after NTP. Per allowance provided within FAR clause 52.236-15, titled “Schedules for Construction Contracts (APR 1984)”, the Contracting Officer has authorized a revision to paragraph (a) of the clause. FAR clause 52.236-15 as revised is included in its entirety below.

52.236-15 SCHEDULES for CONSTRUCTION CONTRACTS (APR 1984)

(a) The Contractor shall, within 15 days after issuance of the notice to proceed, submit three copies of a practicable schedule to the Contracting Officer and Contracting Officer Representative for approval. The schedule shall show the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (including acquiring materials, plant, and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.

(b) The Contractor shall enter the actual progress on the chart as directed by the Contracting Officer, and upon doing so shall immediately deliver three copies of the annotated schedule to the Contracting Officer. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, the Contractor shall take steps necessary to improve its progress, including those that may be required by the Contracting officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.

(c) Failure of the Contractor to comply with the requirements of the Contracting Officer under this clause shall be grounds for a determination by the Contracting Officer that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified within the contract. Upon making this determination, the Contracting Officer may terminate the Contractor’s right to proceed with the work, or any separable part of it, in accordance with the default terms of this contract.

9. The Government reserves the right to reject any or all proposals and make no award if such action is in the best interest of the Government.

10. Notice to potential Offerors: In order to align with current requirements of Department of Defense (DoD) DFARS 201.304 and Army Federal Acquisition Regulations Supplemental (AFARS) 5101.304 there has been a change to the format of ACC-RI solicitations (and resultants contracts). (d) Alternate offers.
