1. Background/Terms and Conditions
1.1. Purpose
Army Contracting Command – Rock Island (ACC-RI), on behalf of Project Lead Joint Services (PLJS), plans to execute a facility construction, demolition and repair project directly relevant to enhancing mission effectiveness. This effort will be carried out pursuant to 10 United States Code (U.S.C.) § 2808a, Authority to carry out joint commander-urgent military construction projects, through an Other Transaction Agreement (OTA) for the development of a Contaminated Waste Plant.
For more information regarding Other Transaction (OT) regulations and policies, please refer to the DoW, Other Transactions Guide, Version 2.0, dated July 2023. A copy of the Guide can be obtained by contacting the RFS Points of Contact listed in Section 6.
Discussions:
Following government receipt of responses to this RFS, the USG will enter into discussions with offerors as determined necessary by the government in order to optimize solutions and select the preferred vendor and vendor solution. Upon selection a Guaranteed Maximum Price (GMP) will be set and funding will be obligated in that amount.
Phase I:
The selected vendor and the Government will collaboratively evaluate, validate, and refine the design. Duration of Phase I will be dependent upon the extent to which the offeror accepts and leverages the provided 100% design. The vendor will perform comprehensive constructability reviews, conduct site investigations, identify design-to-site gaps, and finalize the construction execution schedule. This phase concludes with the negotiation and locking of a firm-fixed-price milestone structure for the subsequent physical construction based on the validated design. Any modifications to the provided 100% design may require an explosive safety site plan revision and approval by the Department of War Explosives Safety Office (DWESO) or additional construction permitting, for which the contractor will be responsible for.
Phase II:
Following completion of phase I and establishment of a FFP, the Government will de obligate any excess funding and issue Notice to Proceed with physical construction.
The Government reserves the right to execute an "off-ramp" and terminate the transaction if a fair and reasonable FFP cannot be negotiated at the end of Phase 1.
1.2. Background
Requirement includes construction of a new decontamination facility, demolition and replacement of the pyrotechnic waste treatment facility, refurbishment of the neutralized explosive wastewater treatment facility, and demolition of and replacement of a neutralized explosive wastewater lift station at Lake City Army Ammunition Plant (LCAAP). These facilities are critical to LCAAP’s small caliber ammunition production capabilities. A 100% design for this work was completed by Burns & McDonnell. The goal is for offerors to propose solutions that take responsibility for the existing design and execute construction, modify the design and execute construction, or re design and execute construction of the aforementioned facilities in a way that maintains the uninterrupted ability to produce 1.6B rounds of small caliber ammunition a year.
Solutions that leverage existing design, are cost affordable, and meet all capacity, installation, and production requirements will be viewed more favorably.
1.3. Other Transaction Authority
In accordance with 10 U.S.C. § 2028a, (Facility construction or repair: transactions other than contracts and grants), an OTA may be used if at least one of the following conditions is met:
A. There is at least one non-traditional defense contractor or nonprofit research institution participating to a significant extent in the project.
B. All significant participants in the transaction other than the Federal Government are small businesses (including small businesses participating in a program described under Section 9 of the Small Business Act (15 U.S.C. § 638)) or nontraditional defense contractors.
C. At least one third of the total cost of the project is to be paid out of funds provided by sources other than the Federal Government.
D. The senior procurement executive for the agency determines in writing that exceptional circumstances justify the use of a transaction that provides for innovative business arrangements or structures that would not be feasible or appropriate under a contract, or would provide an opportunity to expand the defense supply base in a manner that would not be practical or feasible under a contract.
The eligibility of proposals under conditions (A) and (B) above is subject to a determination by the Government that the significance of the proposed nontraditional defense contractor and/or nonprofit research institution participation satisfies the requirements of 10 U.S.C. § 2028a. Offerors should refer to Attachment 0002 –
Representation & Certification, for guidance on developing a proposal that can satisfy conditions (A) and (B).
If the Government determines that an Offeror’s proposal does not meet conditions (A) or
(B) above, the Government may, at its sole discretion, request additional rationale and support or provide the Offeror with an opportunity to propose an alternative cost share arrangement that meets condition (C) above in accordance with 10 U.S.C. § 2028a.
In addition, Offerors must have a Dun and Bradstreet (DUNS) number and must register in the System for Award Management (SAM) to obtain a Commercial and Government Entity (CAGE) code. This system verifies identity and ensures that payment is sent to the right party. In general, to invoice and receive payment after award of an OTA, Offerors must register in Wide Area Work Flow (WAWF) through the Procurement Integrated Enterprise Environment (PIEE).
The Offeror is subject to a determination by the Agreements Officer that it is a responsible party that is not suspended or debarred by the Federal Government, and is not prohibited by Presidential Executive Order, or law from receiving such award.
Additionally, Offerors who attempt to circumvent the eligibility requirements/conditions may be excluded from consideration at the Agreements Officer’s discretion.
Throughout the period of performance of any OTA, the Government will actively monitor the award to ensure compliance with this provision in accordance with the implementation guidance from Headquarters – Department of the Army and/or the Office of the Secretary of Defense. Offerors will be given the opportunity to become compliant with the guidance should they be found non-compliant. Failure to comply may result in termination.
1.4. Agreement Type
Subject to availability of funds, the Government may award a Firm-Fixed Price OTA for one or both phases of the project. The Government may opt to make no awards, or re-open the RFS at a later period if the submissions are insufficient in quality or fail to meet the intent of the RFS.
1.5. Period of Performance (PoP)
The PoP is to be determined (TBD) at the time of award. The final PoP will be established based upon the awardee's proposed and accepted schedule. However, for planning purposes, the Government anticipates all effort and deliverables under this agreement to be completed no later than November 4, 2030.

3. Basis for Award
3.1. General Evaluation Process
Each Offeror’s proposal will be evaluated in a careful, full, and impartial manner pursuant to the stated criteria of this RFS. The Government’s selection decision will be based on an integrated assessment of the proposals submitted in response to this RFS, giving due consideration to all of the Evaluation Factors/Subfactors. The proposal that is determined to be the most beneficial to the Government will be eligible for award.
Offerors are cautioned that award may not necessarily be made to the Offeror that proposes the lowest evaluated cost or the Offeror whose proposal receives the highest rating.
The Government intends on making only one (1) award but reserves the right to make multiple awards or none based on an integrated assessment of the evaluation results.
The Government may contact Offerors during the source selection process to request clarifying information, in the form of Technical Exchanges. The Government reserves the right to conduct a Pre-Award Survey (Safety and Security) or similar, in order to determine the selected Offeror’s responsibility.
The basis for award of an OTA resulting from this RFS will be the result of the evaluation factors specified below.
Volume I, Performance and Pricing (Evaluation Factor 1)
The Offeror shall provide a portfolio of recent, relevant past performance that showcases their success in designing, constructing, and delivering critical facilities in complex, high pressure environments.
Price will be evaluated; however, it will not receive an adjectival rating. The Government will evaluate the offeror’s price proposal as part of the evaluation process to assess (1) whether the proposed price is within the available funding limits, and (2) the ability and/or likelihood of the offeror to successfully execute the proposed project with the financial resources proposed. The Government will use price and/or cost analysis techniques in determining the agreed to price is fair and reasonable and that the proposal provides the best value tradeoff. The Government reserves the right to reject proposals that are unreasonably low or high in price.
The total evaluated price will be the sum of all Contract Line Item Numbers (CLINs) shown in Table 2 below and will be used in the award determination. The Government will evaluate the Price Proposal submission to determine reasonableness, affordability, allowability, and allocability of the proposed price. Priced CLINs shall be proposed as follows and will be selected as determined by the Government during discussions:
Table 2 – Contract Line Item Numbers (CLINs)

The Government will evaluate proposals for acceptability based on whether they demonstrate specific knowledge, capability, and approach to perform all aspects of the Contaminated Waste Plant. The Government will assign an overall competitive evaluation merit rating for each eligible proposal. The overall competitive evaluation rating reflects the Government’s confidence in an offeror’s ability, as demonstrated in its proposal, to meet the stated objective and the potential technical benefit of the effort.
The overall competitive evaluation technical ratings are detailed below.
Offerors shall self-perform a minimum of 30% of the construction work. Higher self-performance percentages will be viewed favorably.
Offerors shall be qualified design and/or construction contractors.
Offerors shall be capable of obtaining a performance bond for the full award value and any modifications.
Solutions that closely mirror the information only 100% design or offer novel or new previously unconsidered changes to that design that increase performance or reduce cost or schedule will be viewed more favorably.
Solutions that include options, milestones, phasing or off ramps, particularly in the event of an affordability challenge, will be viewed more favorably.
Solutions that address the nuances of the GOCO environment and account for continuity of production operations will be viewed more favorably, however the USG project delivery team is willing to support a learning curve in the event solutions do not fully address this challenge. Unforeseen coordination challenges will be considered for no cost period of performance increases only.

3.3. Use of Artificial Intelligence (AI) tools in Proposal Evaluation
Use of AI tools in Support of Evaluations: The Government may employ AI as a tool to assist in the analysis and review of offeror proposals. AI tools may be used to support tasks such as summarizing proposal content, identifying compliance with request for task order proposal / solicitation requirements, and highlighting areas of potential strength, weakness, or risk.
Maintaining Inherently Governmental Functions: Notwithstanding the use of AI tools to support the evaluation process, all final evaluation judgements, including the assignment or assessment of adjectival ratings, best value determinations, and source selection decisions, will be made exclusively by duly appointed Government personnel.
The Government retains sole responsibility for all inherently governmental functions and will not delegate decision making authority to any AI tool.
Offeror Confidentiality and Data Protection: The AI tools utilized by the Government will be employed in a manner consistent with applicable regulations that govern the protection of proprietary and source selection sensitive information. The AI tool will be an output-only system. Any generated report data is not saved. No proposal data will be transmitted to or processed by external, non-Government systems without appropriate safeguards and authorizations in place.
