1. We are currently preparing our proposal for this opportunity and would appreciate your clarification regarding the Superintendent requirement under FAR 52.236-6. Would it be acceptable for the designated Superintendent to remain under our subcontractor’s payroll, while being formally designated and fully authorized by Springfield Solutions, LLC, as the prime contractor, through an official letter appointing them as our on-site representative? The designated Superintendent would be present on-site at all times during contract performance, as required, and would be fully empowered to act on behalf of the prime contractor in all matters relating to contract performance and administration, in accordance with the contract requirements
ANSWER:
Yes, your firm must issue a formal delegation of authority letter to the Contracting Officer (CO).
This letter must explicitly state that the named individual is fully empowered to act on your behalf in all matters concerning contract performance and administration. Satisfactory to the CO under FAR 52.236-6, the designated superintendent must be "satisfactory to the Contracting Officer."
You must submit their resume/qualifications to the CO for approval prior to commencing work.
Additionally prime contractor shall ensure the following:
Constant Physical Presence: The individual must remain physically on the worksite at all times during the performance of the contract. They cannot split time between this and other projects unless explicitly allowed by the contract specifications.
Certified Payroll Reporting: Since the superintendent is on the subcontractor’s payroll, their hours and wages must be properly recorded and submitted via weekly certified payrolls through the prime contractor to the CO, in compliance with Davis-Bacon Act / labor requirements.
Maintained Prime Responsibility: The prime contractor remains 100% contractually and legally responsible for the subcontractor's performance, safety compliance, and overall contract execution.
2. Is the hard ceiling in the mechanical room considered to be demoed?
ANSWER: The Contractor is authorized to open the gypsum board to replace the insulation, provided the impacted area is fully restored to its original condition.
3. Is the project going to be performed in phases or is the 2nd floor going to be vacated for the project?
ANSWER: Project phasing or 2nd-floor vacancy will depend on coordination between the contractor and Government needs to ensure work continuity.
4. Are the diffusers and flexible ductwork taps to be considered as part of the removal and replacement scope?
ANSWER: Only repair to existing connections, diffusers cleaning and replacing any missing diffuser is required.
5. Is insulation and cleaning for all ducts required for the scope of the project?
ANSWER: Refer to SOW section 5
6. Can the government share the existing “as-built” of the building for the purposes of having precise measurements.
ANSWER: Refer to plan included in the SOW.
Clarification: Exhausts ductworks system not included in this contract.
7. Section 2.4.13-Please clarify the required level of detail for the Waste Management Plan. Should the plan include:

ANSWER: Refer to SOW.
9. Section 5.2.1-Will existing equipment and furniture in the project area such as computers, desks, tables, and other office items be removed by the Government prior to the start of construction activities? If not, please confirm whether the Contractor is responsible for relocating, storing, and protecting these items.
ANSWER: Yes. The Government will coordinate with awarded Contractor prior to construction to identify and relocate furniture and equipment that interferes with the work.
10. Section 5.4.2-If the scope exceeds the 25 LF referenced, what is the required process to notify the Government of the change in quantity and request a cost adjustment? Please confirm whether a formal Request for Equitable Adjustment (REA) or Contract Modification is required.
ANSWER: In the event of a scope change, either by differing site conditions or a constructive change, the contractor must clearly outline the cause of the increase through a Request for a Contract Modification/equitable adjustment(REA) addressed to the Contracting Officer/CO (only agency representative authorized) through your Contracting Officer Representative (COR) (technical representative from the agency) This proposal should include your segregable costs for the added work, such as extra labor and material costs. This request shall be approved prior to commencing any work, otherwise the contractor is at risk of assuming the involved costs.
Once the CO receives your REA, evaluates the cost data, and negotiates the equitable adjustment, he will issue a bilateral Contract Modification (usually via Standard Form 30) to definitize the change, formally adjust the contract terms, and obligate the additional funds.
