About this file
This is a Solicitation, Offer, and Award (Standard Form 1442) for construction work issued by the U.S. Air Force on July 2, 2026, with solicitation number W50S9326QA007. The Government requires performance of HVAC ductwork insulation repair work at Building 19, 2nd floor, located at Muniz Air National Guard Base in Carolina, Puerto Rico. The contractor must provide supervision, transportation, labor, materials, equipment, fuel, and quality control necessary to replace degraded thermal insulation on existing HVAC ductwork using flexible wrap-around duct insulation to maintain energy efficiency, prevent condensation, and ensure optimal climate control.
The work is structured as a single firm-fixed-price contract line item (CLIN 0001) with a 60-calendar-day performance period from notice to proceed. Offers are due by July 27, 2026, at 10:00 AM local time, with a 90-calendar-day minimum acceptance period. The solicitation is a Total Small Business Set-Aside limited to eligible small businesses with average annual revenue of $19M or less (NAICS 238220). The Government will not furnish performance or payment bonds. Contractors must submit a completed Standard Form 1442, comprehensive equipment and materials list, and a realistic project schedule demonstrating completion within the stated performance period. Payment will be processed through the Wide Area Workflow (WAWF) system using construction payment invoices, with inspection and acceptance at DoDAAC F8C3CE. Applicable wage rates are per General Decision Number PR2026001, effective May 18, 2026. The solicitation incorporates numerous FAR and DFARS clauses including Construction Wage Rate Requirements, labor standards, safety, buy American provisions, and cybersecurity requirements.

(a) Definitions. As used in this provision-
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area of the United States.
United States person as defined in 26 U.S.C. 7701(a)(30) means
(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;
(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and
(5) Any trust if-
(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and
(ii) One or more United States persons have the authority to control all substantial decisions of the trust.
(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.
(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror may claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.
(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that

(2) Except as provided in paragraph (b) of this provision, if the acquisition exceeds the certified cost or pricing data threshold and an exception to the requirement for certified cost or pricing data at FAR 15.403-2(b)(2) through (5) does not apply, certify all cost or pricing data in accordance with paragraph (c) of DFARS provision 252.215-7994, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data, of this solicitation.

(c) Subcontracts. Unless the Offeror is the Canadian Commercial Corporation, the Offeror shall insert the substance of this provision, including this paragraph (c), in all subcontracts exceeding the simplified acquisition threshold defined in FAR part 2.
Section M - Evaluation Factors for Award
Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose quote is found to be the most advantageous to the Government, price and other factors considered. The following factors and process will be used to evaluate quotes:
(i) Submitted quotes that conform to the solicitation (e.g., stated terms, conditions, representations, certifications, timeliness, and response to all other required information) will be reviewed by the Contracting Officer to ensure the Offeror is not debarred, suspended, or proposed for debarment.
Offerors found to be debarred, suspended, or proposed for debarment shall be excluded from receiving a contract award and will be removed from the competition.
(ii) Quotes meeting the requirements of paragraph (i) will be evaluated in pursuit of the best value for the Government, considering price and all other factors of the solicitation. In accordance with RFO FAR 12.203(c)(2), a comparative evaluation of the quotes, without objective standards, will be conducted.
(iii) Past Performance: Information for past performance reviews may come from either an information system or personal knowledge of an Offeror. Information may be sourced from systems such as, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), the Supplier Performance Risk System (SPRS), or the Contracting Officer's personal knowledge of work performed on any previous federal contract. If unfavorable information is discovered or known regarding an Offeror, the Offeror may be removed from the competition and further evaluation.
(iv) Technical Review (other factor(s)): The Government will review the 1) list of equipment /materials/labor disciplines, and 2) project schedule--items described in the Instructions--to determine if the Offeror understands the scope of work and demonstrates a thorough knowledge and understanding of the requirement.
a. : The list of equipment, materials, and labor disciplines shall list those items Subfactor 1 necessary to accomplish the scope of work identified in the Statement of Work. This list will be used to evaluate the Offeror's understanding of the technical requirement through an analysis of the major work elements proposed.
b. The project schedule will be evaluated relative to the overall coordination of the Subfactor 2:
construction phase. This includes assessing the Offeror's ability to identify all necessary work elements of the specific project, schedule the activities in a logical sequence, and ensure the contract performance time required in this solicitation (or appropriately proposed by the Offeror) is met. (v)
The Government intends to award a contract, without negotiating, to the quote that represents the best value to the Government; however, the Government reserves the right to negotiate if deemed in its best interest. Examples as to why the Government may deem negotiations to be in its best interest include, but are not limited to: prices/costs are unreasonably low/high, or costs are found to be unbalanced. If the need to negotiate arises, the Government intends to only negotiate with the Offeror being considered for award that represents the anticipated best value to the Government. The Government reserves the right to consider a quote which offers more than the minimum and select that quote if it provides a benefit to the Government. The Government has the discretion to accept other than the lowest priced quote if determined to be the best value to the Government.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the Notice of award successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
