(vi) Description of Requirements See attached Statement of Objectives dated 25 July 2023. The Government’s budget for this acquisition (not including options) is $75,000.00. It is anticipated the quantity of licenses needed may change over the course of any resultant contract from this solicitation if additional members join the unit. As such, it is the Government’s intent to acquire additional licenses as necessary via contract modification(s) to ensure all members are provided access to the same training to facilitate unit training plans and team exercises.

(vii) The Government requests virtual delivery of platform access within five calendar days of contract award. Emails to the using organization’s points of contact to be provided at contract award.

(viii) The provision at FAR 52.212-1, Instructions to Offerors – Commercial Items, applies to this acquisition.

Addendum to FAR 52.212-1:

All references to “offer” or “offeror” are replaced with “quotation” or “quoter” respectively. The following paragraphs of FAR 52-212-1 are replaced in their entirety and have been tailored in accordance with FAR 12.302(a).

(b) Submission of quotations. Submit signed and dated quotations to the points of contact identified above at or before the exact time specified in this solicitation. Quotations shall include the following information.

(1) Reference to the solicitation number: W50S8K23Q0003, the quoter’s SAM Unique Entity Identifier, and point of contact information.

(2) Price and any discount terms. If the CLIN structure on page 1 of this solicitation does not conform to the quoter’s customary commercial pricing terms (e.g., separate licenses for training platform access that correspond to different elements of the Statement of Objectives), quoters are encouraged to use their own CLIN structure provided it meets the requirements of DFARS PGI subpart 204.71. If quoting a different CLIN structure, ensure prices for one option year of licenses are included for all line items.

(3) Technical description of the training platform being quoted in sufficient detail to evaluate its technical capabilities against the Government’s requirements in the solicitation. Technical information shall be organized by objective (#1 – 12) from the Statement of Objectives and may include cross-references to existing product literature attached to the quotation, or links to product information available online in lieu of creating a unique technical description document.

(4) Copy of the quoter’s commercial software license agreement with terms that are customarily provided to the public.

(5) Acknowledgement of Solicitation Amendments, if applicable.

(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Quotation expiration. Quotations should be valid for 60 days following submission unless otherwise specified in the quotation.

(d) Vendor Demonstration. If requested during the evaluation of quotations, quoters shall provide a virtual demonstration of their quoted product/services and/or a short-term (e.g., 1 week) trial license at no expense to the Government. Demonstrations and/or trials will only be requested from quoters that the Government determines are sufficiently competitive for award as part of the phased evaluation process and will not be requested from all quoters.

(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items/services for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.

(f) Late submissions. Quoters are responsible for submitting quotations by the due date and time specified in the solicitation. Any quotation received after the exact time specified for receipt of quotations is late. Late quotations may be considered at the Government’s discretion and if it is determined to be in the best interest of the Government.

(g) Issuance of the purchase order. Quotations should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures in FAR part 15.

(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations.

Quotations may not be submitted for quantities less than those specified; however, the Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.

(l) Request for information on basis of contract award. In accordance with FAR 13.106-3(d), quoters may request information on purchase order(s) resulting from this solicitation from the points of contact above.

(end of Addendum to FAR 52.212-1)

(ix) The provision at FAR 52.212-2, Evaluation – Commercial Items, as tailored below, applies to this acquisition.

(a) The Government may award a contract resulting from this solicitation to the responsible vendor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotations: price, technical capability of the item/services being quoted to meet the agency need, and an evaluation of the quoter’s performance using the Supplier Performance Risk Assessment System (SPRS). See provision at DFARS 252.204-7024 for more information on the use of

SPRS.

(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) The Government will evaluate quotations in phases and progressively reduce the number being considered for contract award. The purpose of this procedure is to reduce the time and cost of evaluations, both for the Government, and competing quoters. The procedures used for evaluating quotations is:

(1) The Government will first evaluate quotations using the factors in para. (a) above eliminating any that are not sufficiently competitive to be considered for award.

(2) The Government will then request a virtual demonstration and/or trial from the remaining quoters as necessary to evaluate the technical capabilities of the quoted product/service, and then select the contractor for award based on a comparative evaluation of quotations considering the evaluation factors in para. (a) above.

Note: If multiple quoters provide quotations for the same brand name product/service as a reseller without quoting any differentiating value-added services that they intend to self-perform, a demonstration and/or trial may only be requested from one quoter of the Government’s choosing to evaluate the technical capabilities of the product/service.

(End of provision)

(x) Quoters must include with their quotation a completed copy of the provision at FAR 52.212- 3, Offeror Representations and Certifications – Commercial Items Alternate I (Deviation 2023-
