Questions and Answers (Q/A)
Q/A #1
Question:
Question 2 asks for bonding capability. Is that required by an A/E firm, since this sources sought appears to only be for design services at this time?
Answer:
No, it is not required. The Sources Sought Notice, under section #3, requests the following:
Sources Sought Response Form (attached): Provide company profile to include name of your firm, point of contact, phone number, email address, CAGE code, and Unique Entity Identifier (UEI) number. Respondents must also indicate whether they qualify as a Small Business, SOB, 8(a), EDWOSB, WOSB, HUBZone, or SDVOSB. Confirm SAMS registration is current and correctly identifies the Firms Point of Contact: Name, Number and Email for government contracts.
Question #2 of the Sources Sought Response Form applies to construction projects as mentioned below. In this situation, question #2 would not apply as this requirement is only for “Design Services”.
2. Bonding Capability (both single project and aggregate amounts) By responding to this Sources Sought Notice, I confirm that my firm, individually or through association with joint ventures or teaming partners, has bonding capability of at least $ (fill in estimate of $1M, $5M, $10M, $25M or $50M delete this instruction in red) for individual construction projects.
Q/A #2
Question:
The sources sought states “Evaluation/Selection Criteria (1-6): The criteria are listed below in descending order of importance. IAW FAR 36.602-1(a), Agencies shall evaluate each potential firm in terms of its- “
I see Four Factors below, did the Government mean to include Factors 5 and 6 as well?
Answer:
No, criteria of 5 and 6 as shown in the FAR “Evaluation/Selection Criteria (1-6)” are still utilized as guidance in formulating and prioritizing our four evaluation factors to properly evaluate each potential firm. The Sources Sought Notice four factors are based upon, but do not align numerically with the FAR “Evaluation/Selection Criteria.”
FAR 36.602-1 Selection Criteria
(a) Agencies shall evaluate each potential contractor in terms of its-
(1) Professional qualifications necessary for satisfactory performance of required services;
(2) Specialized experience and technical competence in the type of work required, including, where appropriate, experience in energy conservation, pollution prevention, waste reduction, and the use of recovered materials;
(3) Capacity to accomplish the work in the required time;
(4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules;
(5) Location in the general geographical area of the project and knowledge of the locality of the project; provided, that application of this criterion leaves an appropriate number of qualified firms, given the nature and size of the project; and
(6) Acceptability under other appropriate evaluation criteria.
Q/A #3
Question:
Factor 2: Specialized Experience and Technical Competence:
· May a subcontractor provide a sample project for this Factor 2?
Answer:
No, subcontractors may not provide a sample project for Factor 2.
As stated in Factor 2 “Provide examples of work that your company has performed as the Prime Contractor” “Detail what work was self-performed and what percentage of work was subcontracted.”
Q/A #4
Question:
Factor 2: Specialized Experience and Technical Competence:
· Is the Government requiring that each of the projects have a CPARS?
Answer:
No, the evaluation of Specialized Experience and Technical Competence does not involve CPARS and is not the same as evaluation of Past Performance. Past Performance will be based on information provided through CPARS and include other information provided by the Firm, customer inquiries, Government databases, and other information available to the Government, including information from the points of contact provided by the Firm.
Q/A #5 Question:
Factor 4: Past Performance:
· Will the Government consider the past performance of subcontractors for this section?
Answer:
No, the Government will not consider the past performance of subcontractors for this sources sought notice evaluation.
Q/A #6
Question:
Would the Government consider changing the NAICS to 541330 (Engineering Services) in the Sources Sought? This would benefit the Government by expanding the number of qualified responding firms since the Engineering NAICS has a higher size standard ($25.5M) than Architectural (which is half the Engineering NAICS standard).
Answer:
Thank you for the suggestion. We will take that into consideration.
Q/A #7
Question:
1) In Factor 1, the current wording states “All key personnel shall be licensed in New Mexico.” Would the Government consider changing this to “shall be licensed in any U.S. State.”? This would benefit the Government by expanding the number of qualified licensed key personnel. Our understanding is that individuals must have a U.S. Professional license to stamp drawings for Federal projects, but a license in that state is not required.
2) “Factor 1 – Professional Qualifications: All key personnel shall be licensed in New Mexico.” Specifically, would the government consider removing the onerous restriction that all personnel be licensed in New Mexico? That is a difficult requirement, limiting competition. Would it be acceptable to show personnel who are licensed in any US state?
Answer:
If the license is transferable between states, there is no restriction or within the western alliance. For example, if you’re licensed in Colorado you can perform in New Mexico, but if you’re licensed in California, you would not be able to perform work in New Mexico.
Q/A #8
The Sources Sought is currently asking for a full SF330 Part 1 & 2. This requires extensive effort of the small business firm to respond. Would the Government consider reducing the response effort required for this Sources Sought? We often see a 5-10 page capability statement as the typical Sources Sought deliverable, making it easier for the Government to evaluate, and for contractors to prepare a response.
Answer:
The New Mexico Air National Guard is seeking qualified A-E firms. The SF 330 is required as it will assist the government in determining the proper qualifications necessary for the performance of the required A-E services.
Q/A #9
“Factor 1 – Professional Qualifications” lists several disciplines, some of which aren’t necessary for the SOW outlined in the “MHMV172601..” document.
1. Are you looking for a complete design team at this point in the process?
0. If so, can we list only relevant consultants as they pertain to the SOW provided for the Deployment Center?
Answer:
A full design team will be required, at this time the relevant team with primary functions will be sufficient.
Q/A #10
Question:
“Factor 4 – Past Performance: Describe past work experience showing all or more than one of the areas listed that were performed…”
1. Is the bolded “...of the areas listed…” language referring to the “Areas of work involving characteristics…” bullet list that’s part of Factor 2?
Answer:
Factor 2 is asking for you to provide 3 projects that demonstrate Specialized Experience and Technical Competence. Provide examples of the work that your company performed as the Prime Contractor for those 3 projects.
Factor 4 as asking for Past Performance: Describe past work experience showing all or more than one of the areas listed that were performed under one contract. Past Performance during the past five years from date of the pre-solicitation notification on similar contracts with respect to cost control, quality of work, compliance with performance/design schedules, customer satisfaction, management, and safety/security as determined from Contractor Performance Assessment Rating System (CPARS) and other sources such as past performance questionnaires.
