For security reasons, all potential offerors, plan rooms and printing companies are required to be registered in the GSA System for Award Management (SAM) database. Firms can register via the SAM internet site at https://www.sam.gov/portal/public/SAM/. Interested offerors are required to submit their representations and certifications at the same site.

(c) ONLY APPLICABLE IF OFFEROR PROPOSAL IS OVER $150,000:
1. A Bid Bond and Power of Attorney is required along with the RFP on the due date, only if offeror’s proposal price is over $150,000.
2. A copy of the bond, in whole (front and back), and POA may be submitted with the proposal, with the original signed copy with Seal to be submitted no later than 5 Business Days after the Bid Due Date. The bid bond must be on a SF24 form. Rejection of a bid bond shall be in accordance with FAR 28.101-4 Noncompliance with bid guarantee requirements.

8. Joint Venture Requirements - Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database. Applicable to set-aside solicitations: Joint Ventures must meet applicable size standards (See FAR Subpart 19.1). Submit with the proposal any size determination for the Joint Venture entity received from the Small Business Administration. A Joint Venture where-in one party is not a small business may be referred to the Small Business Administration (IAW FAR 19.302 (b)) to determine eligibility. All questions regarding Joint Ventures must be directed to the Small Business Administration (SBA) and not the Contracting Officer.

Section 00100 - Bidding Schedule/Instructions to Bidders
INSTRUCTIONS TO OFFERORS
SECTION 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
1. Description of the Project: Install MAC Pad Lightning Protection, Selfridge ANGB, MI. (See SOW)
2. Instructions to Offerors:
2.1. You are invited to submit a proposal in response to our Request for Proposal entitled W50S85-21-R-0008
Project Number: VGLZ212017_Install MAC Pad Lightning Protection, at Selfirdge ANGB, MI
2.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible offeror whose offer, conforming to the RFP, will be most advantageous to the Government.
2.3. This solicitation is set-aside 100% for small businesses.
3. BOND REQUIREMENTS:
3.1. Pre-Award, a Bid-Bond is only required if Proposal Price is Greater than $150,000 (See Section 00010)
3.2. Post-Award, awardee shall provide a Performance Bond if award price is greater than $150,000
3.3. Post-Award, awardee shall provide a Payment Bond or Alternative Payment Protections, if award price is greater than $35,000
4. NOTICE OF PRE-PROPOSAL CONFERENCE AND SITE VISIT:
4.1. A pre-proposal conference will be conducted (See Clause “52.236-27 Site Visit” for Date and Time) for the purposes of briefing on the PROPOSAL requirements and answering questions regarding this solicitation.
This conference will be held at 43200 Maple Street, Bldg 105, Selfirdge ANGB, MI Interested Contractors are highly encouraged to attend the pre-proposal conference. The site visit will be held following the conference.
4.2. Due to security conditions, all offerors must register to attend this conference and site visit. Email the PDF titled, “010000_Sup01 SANG Vetting (new)” that can be found on SAM.gov to BOTH of the following Email Addresses michael.kitchell.1@us.af.mil, Steven.stocking@us.af.mil, AND 127.WG.MSC.Construction.Org@us.af.mil to be processed for vetting.
4.3. This information must be provided in advance, 3 business days prior to the meeting, in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government’s denial of your access to the pre-proposal conference. This information will be provided to the Base Security Forces who will authorize your entrance to the site.
4.4. All Federal, State, and Local COVID-19 guidances shall be followed. In an effort to minimize the number of people, we ask that no more than two personnel attend the Site Visit and Conference, Per Proposal.
4.5. Visitors must pick up their passes at the “Visitors Center”, Located outside the Selfridge ANGB Main Gate located on M-59 (Hall Rd) and Jefferson Ave, prior to arrival. You will be required to present the following information upon arrival: (1) Official documentation of a social security number, (2) Valid Drivers License or State ID, (3) Proof of Insurance/Registration for Vehicle, (4) Safety Inspection and Car Rental agreement if applicable. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.
4.6. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.
4.7. A record of the conference shall be made and furnished to all prospective offerors via posting at www.SAM.gov. The record will include minutes of the meeting.
5. FORMAL COMMUNICATION, OFFEROR EXPLANATIONS:

5.2 Any explanation desired by an offeror regarding the meaning or interpretation of the solicitation, or proposals, drawings, specifications, etc. must be requested in writing and with sufficient time allowed for a reply to reach offeror before the submission of their proposal.
5.3 All questions and requests for information (RFI) must be received NOT LATER THAN the fifth working day prior to porposal due date. OFFERORS ARE STRONGLY ENCOURAGED TO SUBMIT QUESTIONS
EARLY IN THIS PROCESS.
5.4 Any changes to the drawings, specifications, etc. will be issued in the form of an amendment. However, any answers that clarify or provide an interpretation to the drawings, specifications, etc. will NOT be posted via amendment but rather as a response to the RFI on SAM.gov at https://www.SAM.gov.
5.5 Receipt by the offeror must be acknowledged in the space provided on the SF 1442 or by returning a signed copy of the amendment by the time set for receipt of proposals.
5.6 For security reasons, all technical and engineering data related to this solicitation will be distributed using the Contract Opportunities (SAM.gov) system. SAM.gov is a web-based dissemination tool designed to safeguard acquisition-related information for all Federal agencies. Interested offerors must register with SAM.gov before accessing the system.
5.7 Amendments, if/when issued will be posted to https://www.SAM.gov for electronic downloading. This will normally be the only method of distributing amendments prior to closing; therefore, it is the offerors responsibility to check the website periodically for any amendments to the solicitation. Websites are occasionally inaccessible due to various reasons.
6. PROPOSAL REPOSITORY:

6.2. Proposals may be hand deliverd to SELFRIDGE ANGB, MI. They will not be accepted at Battle Creek ANGB, MI or Alpena CRTC.
6.3. A proposal repository is provided for hand carried proposals and is located at 43200 Maple Street, Bldg 105, Selfridge ANGB, MI 48045-5213. (Proceed to Building 105, West Parking Lot, North West Entrance of Bldg 105.) Proposals must be deposited in the repository prior to the time established for proposal response.
Offerors are cautioned that they are required to be vetted, sign-in, and obtain a visitor’s pass to enter the facility and should allow time to accomplish this, if they choose to hand deliver a proposal.
6.4. Follow same procedures as those gaining access to the site visit.
6.5. Late receipt of proposals due to entry delays may not be deemed excusable and the Contracting Officer may declare the proposal “late” in accordance with FAR 14.304.
6.6. All Mailed / Hand Carreid Proposals shall arrive prior to the Due Date and Time. If mailing your Proposal, please utlize the following address: 127th MSC – Contracting, 43200 Maple Street, Bldg 105, Selfridge ANGB, MI 48045-5213 Please use caution when mailing proposals, as it often takes more time for carriers to make delivery.
6.7. All proposals shall be Identified, at a minimum, with the Contractors Name, Solicitation # , and Title.

7. WAGE DETERMINATION:
7.1. Construction Wage Rates are applicable to this project are Michigan – Macomb County – Building as shown in Section 00800. (www.sam.gov “Wage Determinations”)
8. PROPOSAL PREPARATION EXPENSES AND PRE-CONTRACT COSTS: This RFP does not commit the Government to pay costs incurred in preparation and submission of proposals or for other costs incurred prior to award of a formal contract.
9. CLAUSES:
9.1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.
10. DISPOSITION OF UNSUCCESSFUL PROPOSALS:
In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposasls including the bid bond. (The Bid Bond, only if required.)
11. OFFERORS QUALIFICATIONS:
To establish its responsibility, the apparent low offeror may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work. This action may be requested to determine if the contractor is responsible.

SECTION 110 / 120
SECTION 00110 SUBMISSION REQUIREMENTS AND INSTRUCTIONS
1. PROPOSAL PREPARATION INSTRUCTIONS
1.1. These instructions prescribe the format of proposals, and describe the approach for the development and presentation of the proposal data. They are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals. Carefully review this section prior to commencing proposal preparation. All solicitation amendments must be acknowledged in accordance with Section 00100.
1.2. Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and eliminated from consideration for award.
2. PROPOSAL CONTENT
2.1 Prospective offerors shall submit the proposal in two separate sections.
Section 1:
Part 1-Introductory Page/ (SF) 1442 Part 2-Price Proposal
Section 2:
Part 1-Technical Solution Part 2-Past Performance
3. SECTION
3.1 Provide an introductory page to include CAGE Code, DUNS Number, and Tax Identification Number (TIN), points of contact, authorized negotiators, contact phone, facsimile numbers, and email addresses.
3.2 Complete in its entirety the “Offeror” portion of the Standard Form (SF) 1442. An official having the authority to contractually bind your company must sign the SF 1442 in accordance with FAR 4.102.
3.3 Offeror shall provide all price/cost information necessary to provide a meaningful basis for Government's analysis and evaluation of price/cost for the project.
4. SECTION 2
4.1 The Technical Solution consists of one factor: Construction Schedule/Work Plan. Provide a construction schedule/ work plan with a period of performance (POP) not to exceed 120 days after NTP, with all “Fast Tracking” areas clearly identified if proposed. (Use 15 Sep 2021 for proposal schedule NTP). The schedule/work plan shall be task oriented, capturing all Statement of Work (SOW) requirements and indicate dates by which milestones are to be achieved. The offeror shall use either the AF Form 3064 or a critical path scheduling approach and the schedules shall be graphically represented.
4.2 Past Performance- Submit no more than three (3) references for projects with similar scope/magnitude completed within the last 5 years. The references are to assist the Contracting Officer in the evaluation of past performance. Provide the following information requested in this format for each of the projects/contracts being submitted as a reference project. Projects may be on going and cannot have been completed any earlier than 5 years prior to the solicitation issue date.

SECTION 00120 PROPOSAL EVALUATIONS AND BASIS FOR AWARD
1. GENERAL INFORMATION
1.1 This solicitation is for a Firm Fixed Price Contract. The Government intends to award a single contract to a qualified Small Business Offeror deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to all the RFP's requirements and is judged to represent the Best Value to the Government in accordance with the evaluation scheme set out in this solicitation.
1.2 The evaluation process will be conducted in accordance with FAR 13.106-2(b). Offers will be evaluated using the criteria listed in “Evaluation Factors for Award.” Noncompliance with the RFP requirements may raise serious questions regarding an offeror’ s technical ability, past performance and/or pricing and may be grounds to eliminate the proposal from consideration for contract award. Failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP will be considered unawardable. A proposal that is orderly and sufficiently documented will be easy for the Government to understand and will enable the Government to perform a thorough and fair evaluation.
1.3 The Contracting Officer will begin the evaluation process by conducting a proposal compliance review for all timely-received proposals for determination of basic proposal adequacy prior to providing the proposals to the evaluators. All compliant proposals will be considered for award IAW FAR 13.106-2(a)(3). Failure to provide a complete proposal may result in the proposal being removed from further consideration for award.
1.4 Although the assessment of Past Performance as a specific evaluation factor is separate and distinct from the
Determination of Responsibility required by FAR Part 9, Past Performance information obtained herein will be used during the Government’s responsibility determination. The Government also reserves the right to obtain additional information solely for the purpose of making a responsibility determination from all offerors after receipt of proposals.
2. EVALUATION FACTORS FOR AWARD
2.1 The award will be made based on the best overall (i.e. best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the three (3) evaluation factors:
Technical, Price, and Past Performance. To arrive at a Best Value decision, the Contracting Officer will integrate the evaluation of Past/Present Performance, Technical and Price as set out in the solicitation. The government may award to other than the low priced offeror based on this evaluation.
2.2 Non-Priced Evaluation Factors listed below will be evaluated based on the terms and conditions set forth in this request for proposal and are as follows:

2.3 TECHNICAL
2.3.1 The Technical Solution Evaluation consists of one factor: Construction Schedule/Work Plan.
2.3.2 The technical evaluation will assess the offeror’s proposed execution of the construction schedule, outlining project completion within the desired POP and the offeror’s understanding of the project, as detailed in their work plan. The schedule shall capture all SOW requirements, execution timelines, and critical path items. The work plan must include a brief (no more than one page) narrative overview of how the project will be completed in accordance with the Statement of Work.
2.3.3 Ratings: An adjective/color descriptor will be assigned by the evaluators’ to the Technical Factor. It represents their conclusions as to the quality of the proposal and the offeror’s ability to meet project requirements.
2.3.4 ADJECTIVAL RATING DESCRIPTION:
BLUE
(Outstanding) Construction Schedule/Work Plan meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
PURPLE
(Good) Construction Schedule/Work Plan meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
GREEN
(Acceptable) Construction Schedule/Work Plan Meets requirements and indicates an adequate approach and understand ng of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
YELLOW
(Marginal) Construction Schedule/Work Plan does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
RED
(Unacceptable) Construction Schedule/Work Plan does not meet requirements and contains one or more deficiencies. Proposal is not awardable.
2.4 PAST PERFORMANCE
2.4.1 The Government will evaluate responses from submitted references and/or any other record available, for the quality, timeliness, and management of the offeror's past performance considering, relevancy, context, and trends on recent projects (within the last 5 years). If there is information which deems past performance as less than acceptable for ongoing projects, the offeror will either have been already afforded an opportunity to offer a rebuttal of this information or will be provided such an opportunity in order for the information to be evaluated. The government may contact an offeror for questions on past performance. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance and their record will be considered unknown.
2.4.2 IAW FAR 13.106-2(b) (3) (ii), evaluation of past performance will be based on one or more of the following:
• The contracting officer’s knowledge;
• Customer surveys, and past performance questionnaire replies;
• The Government wide Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov; or
• Any other reasonable basis
2.4.3 In performing the past performance factor evaluation, evaluators will apply the following relevance levels to assess the relevance of the prior contract effort(s) of offerors.
RELEVANT: Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
NOT RELEVANT: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
2.4.4 Ratings: Each proposal will be evaluated in accordance with the information set forth in the RFP, utilizing adjectival ratings as shown below for the past performance rating:
Satisfactory Confidence Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unsatisfactory Confidence Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort
2.5 PRICE
The proposed price will be evaluated per FAR 13.106-3(a). IAW FAR 4.102. One copy of the SF 1442 is required to have an original signature. Section 00010 – Insert the price/cost associated with the project in the line items. All line items (CLINs) must be priced.
3. AWARD
3.1 A written award or acceptance of offer furnished to the successful offeror within the time for acceptance specified in the offer shall be deemed to result in a binding contract without further action by either party.
3.1.1 To establish its responsibility, the apparent low offeror may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work.
This action may be requested to determine if the contractor is responsible.

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,00.00, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995)
(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items.
