DEPARTMENT OF THE AIR FORCE
184TH MISSION SUPPORT GROUP
MCCONNELL AIR FORCE BASE KANSAS
9 December 2019
MEMORANDUM FOR 184 MSG/MSC
FROM: 184th Civil Engineering Squadron 53260 Jayhawk Drive, Building 3 McConnell AFB KS 67221-9000
SUBJECT: Limited Source Justification for Utility Services for 184 Wing
1. The 184th Civil Engineer Squadron (184 CES) has a mission requirement to have an underground electrical feed brought into the 184 Wing base as a Limited Source.
2. The 184 CES proposes to procure by means of other than full and open competition, a firm fixed price contract written against the GSA Areawide contract for utility services.
3. The 184 IW is home to multiple critical cyber and intelligence missions with high electricity dependence. Power disruption has the possibility to disrupt the entire ANG network and intelligence and cyber missions worldwide. The existing electrical feed contains approximately 8,600 LF of above ground power line. This feed is susceptible to Kansas weather, vehicle accidents and potential sabotage. In order to improve the resiliency of the 184 IW, a secondary/redundant electrical feed would mitigate much of the existing risk in the current electrical system. The local electric utility provider (Westar) has a long-term plan to tie the feeds from the two substations using above ground wiring to allow them to back feed a portion of their grid in the event of a failure. The ANG funding would place the entire run underground and move their tie in point to the base feed entrance in such a way that the ANG point load could be fed directly from either feed and additionally allow Westar to back feed if the capacity is there. This acquisition, by the 184th Contracting Office, will be under the authority of the FAR Part 41.203 (c) with a total estimated cost of $695,000.00.
4. The statutory authority permitting other than full and open competition is:
a. FAR 6.302-1 (a)(b)(3) Only one responsible source and no other supplies or service will satisfy agency requirements.
b. FAR Part 41.204 (c) (1) GSA area wide contracts. Any Federal agency having a requirement for utility services within an area covered by an area wide contract SHALL acquire services under that area wide contract.
5. This acquisition is cost sharing for the burial of 8,600 LF of underground electric wire to the 184 Wing. This type of work is expressly authorized in Article 5.6 Rate, Charges and Public Regulation of the GSA Areawide Contract # 47PA0417G0007. The Article reads in part “any necessary extension, alteration, relocation or reinforcement of the Contractor’s transmission or distribution lines”. This is exactly the type of work that will be performed under this proposed utility contract. Additionally, under FAR Part 6.302-1 (a)(b)(3) it recognizes the need to sole source to a utility contractor for “construction of a part of a utility system and the utility company itself is the only source available to work on the system”.
6. The contracting office and the Supervisory Contract Specialist, to determine if a GSA areawide contract covered this area of Kansas, conducted market research. Working with the local Westar/Evergy representatives, we located the GSA contract subject to our area. Once it was determined that no other company provides electrical power in the area, no additional market research was required.
7. During discussions, we requested the contractor provide pricing for the outlined scope of work. The original pricing was $15K over our IGE. We were able to negotiate the price to our independent government estimate.
We believe our estimate to be a fair and reasonable price for the scope of work.
8. Due to the nature of the service and its sole source requirement no market surveys were required nor would any other contractor have any interest in providing this requirement. Any future plans that would involve utility service would be through the same GSA areawide contract.
9. Delivery will be in accordance with the construction schedule under the control of the utility contractor. The government will have an active role in determining invoicing is accurate based upon progress of the contractor.
