STATEMENT (PWS)

FOR

HAWK FAIR SHARE SUSTAINMENT PROGRAM (FSSP)

1.0 Scope

1.1 The objective of this PWS is to require contractor support services for the HAWK Missile System to the Non-Standard Missile Systems Management Branch (MSMB) of the Security Assistance Management Directorate (SAMD), US Army Aviation & Missile Command (USAAMCOM). This PWS provides for the engineering, test, product assurance, configuration management, technical documentation, and logistics services necessary to perform effort in the areas of supply, maintenance, and field use of the HAWK Missile System and Depot Maintenance Plant Equipment. The man-hours, supplies, and other incidental services will not be expended under this PWS to provide any engineering support to production efforts. The above work will be documented for the HAWK Missile System as defined herein.

1.2 The terms HAWK and HAWK Missile System are used throughout this PWS. Their use encompasses HAWK Phases II, III, IV, V, and the HAWK XXI Missile System.

2.0 Applicable Documents

2.1 The documents listed in this PWS form a part of the contract to the extent invoked by specific reference in paragraphs of this PWS. Revision letters, amendment indicators, notices, supplements, tailoring, and dates are omitted within the PWS and are listed on the Document Summary List (DSL).

2.2 Where a specific version of a document is called out as a reference, on the DSL no other version will be used without prior written consent of the Procuring Contracting Officer (PCO). The applicable version of subsidiary (second-tier) documents referenced in the documents listed below is that version dated either concurrent with or just prior to the date of the listed documents.

3.0 Requirements

3.1 The contractor shall perform a level of effort for engineering, engineering prototype fabricating, testing, documenting, and associated services to accomplish the objectives of this PWS. The contractor shall, throughout the life of the contract, provide all materials, personnel, equipment, and incidental supplies to perform the work required herein. All work accomplished under this PWS will be covered by ESMs or Technical Task Authorizations (TTAs).

3.2 The contractor shall not duplicate effort required under the terms of any existing or completed contract with the U.S. Government (USG) in the performance of this PWS.

3.3 The contractor shall appoint a technical manager counterpart to the USG FSSP manager and an individual with responsibility for each Engineering Services Memorandum (ESM) within the scope of this PWS; i.e. General Engineering (ESM 10), Logistics, Publications, and Provisioning (ESM 20), Configuration Management (ESM 30), Test Bed Support (ESM 40), FSSP Conference Support (ESM 50), Country Unique Tasks (ESM 60), and Program Management (ESM 70).

3.3.1 The contractor shall prepare each ESM/TTA IAW DI-MISC-80748 (CDRL A001).

3.3.2 TTAs shall contain both time-phase technical milestones and budgetary estimates for task completion.

3.3.3 TTAs shall convert man-hours effort to a dollar value.

3.4 TTAs shall identify with contract line items or work breakdown structure elements, wherever possible.

3.4 ESM and TTA Structure.

3.4.1 ESM - The contractor shall submit, IAW paragraph 3.2, an ESM for each major area of effort to be performed under this PWS, and the contractor shall submit a TTA for each specific task to be performed under the ESMs.

3.4.2 The contractor shall allocate to each base TTA the total contract funds received for that task through the contract period. Engineering support, which includes all general engineering efforts of a support nature furnished to SAMD, shall be included under ESM 10. This effort includes the initial general investigative effort to define the specific task requirements, which shall be generated under the appropriate ESM. The contractor shall provide a cost and schedule estimate when directed by SAMD.

3.4.3 TTA- TTAs shall be submitted by the contractor to describe each specific effort under the appropriate ESM. No effort shall be expended unless it is covered under a written TTA which has been approved and funded by the USG.

3.4.4 The contractor shall deliver a funding estimate for each TTA. The total of all expenditures for a TTA shall at no time exceed the funds approved for that TTA.

3.4.5 At the completion of each TTA the contractor shall prepare and deliver an

Engineering and Technical Services Accomplishment Report IAW DI-MGMT-80061 (CDRL A002) on that effort.

3.5 ESM Areas of Effort.

3.5.1 Areas of effort for ESM submittal shall consist of the following: ESM-10 for general engineering for radars, fire control hardware, software, tactical software, launcher and miscellaneous Ground Support Equipment (GSE), product assurance;

ESM-20 for logistics, publications, and provisioning; ESM-30 for configuration management; ESM-40 for test bed support; ESM-50 for FSSP conference support, ESM-60 for country unique tasks: ESM-70 for program management.

3.5.2 TTAs shall not be submitted by the contractor for tasks previously disapproved unless specifically requested by the FSSP manager, or when additional data or information relevant to the TTA becomes available warranting a second submittal.

3.5.3 The contractor shall not submit a TTA to cover the preparation of TTAs.

3.5.4 The contractor shall not submit TTAs to duplicate any work or portion of work that has been performed under any other USG contract for the HAWK Missile System.

3.5.5 The contractor shall not submit TTAs to duplicate any work or portion of work that has been or is being performed under another TTA. Duplication of an area of work will be sufficient basis for disapproval of a TTA.

3.6 Submittal of TTAs – Recommended TTAs may be submitted at any time during the performance of this PWS, either by contractor initiation or at the request of the USG FSSP manager. TTAs and any revisions thereto will be signed by the Contracting Officer’s Representative (COR) and sent to the contractor. The contractor shall not perform work under a TTA until it has been duly approved by the

USG.

4.0 Product Engineering Requirements

4.1 The contractor shall perform the engineering and associated work required to maintain the existing HAWK Missile System configurations, minimize obsolescence, and correct deficiencies that the USG determines adversely affects field use.

4.2 The contractor shall ensure that all material, test equipment, methods and processes resulting from effort under this PWS meet the following requirements:

4.2.1 Only components/material/parts that meet the requirements of the applicable drawings, Missile Specifications, Technical Manuals (TMs), shall be used by the contractor with the HAWK Missile System.

4.2.2 The contractor shall maximize the use of equipment that is readily available through the USG or commercial channels. The contractor shall make every effort to ensure work performed under this PWS facilitates end results that provide ease of reproducibility by or for the USG utilizing standardized equipment and manufacturing methods.

4.2.3 Interchangeability - All like items of equipment (same part number) throughout the system shall be mechanically and electrically interchangeable (form/fit/function compliant) without modification. Components or parts that are required to be fitted or finished in place, or permanently joined, need not be interchangeable.

4.2.4 Corrosion Prevention - Corrosion prevention and control shall be implemented IAW MIL-HDBK-1861 and using the guidance of MIL-HDBK-1250 (for reference and information purposes only).

4.3 Project Engineering - The contractor shall furnish engineering representatives to coordinate activities required by this PWS between the contractor, SAMD, other SAMD contractors, and other USG agencies.

4.4 Use of Funds - The contractor shall use funds obligated by any resulting contract for parts, special tools, and equipment to include computer equipment, and maintenance thereof provided that the requirements for these items arc peculiar to the engineering services program. Any such item shall be the property of the USG and its use is authorized hereunder.

5.0 Test

5.1 Maintenance of HAWK Major Items – The contractor shall provide the services necessary to maintain the HAWK equipment assigned as a test base at the contractor’s locations, primarily at Pelham Test Facility (PTF), NH and White Sands Missile Range (WSMR), NM. The HAWK equipment shall be maintained in a condition to support HAWK related testing and validation programs, provided funding is in place per applicable TTAs.

5.1.1 The contractor shall provide software maintenance for all tactical and non-tactical HAWK software. The scope of software maintenance for this PWS shall include the following: maintaining the software code for the system, maintaining, and updating as necessary, the software documentation and requirements, and maintaining the development environment.

5.2 The contractor shall support or conduct engineering investigations, the validation of hardware and software modifications in support of product improvements and Engineering Change Proposal (ECP) activities, and support or conduct of tests tasked by the MSMB. The Army Test and Evaluation Command (ATEC) is responsible for the independent assessment of changes to the HAWK system as requested by MSMB and other tests as tasked by MSMB. The tasks described in the WSMR Test Support TTAs shall provide for the contractor technical support to testing conducted at the WSMR and other test locations, technical assistance and support to ATEC testing and testing performed by and for other customers, coordination with MSMB operation and maintenance of HAWK GSE, instrumentation and data collection, reduction, handling, and analysis.

5.3 Logistics Support for the HAWK Test Bed – The contractor shall provide a specific system of logistics support for HAWK equipment for use under this PWS. It is the objective of this requirement to provide for the operation of repair parts centers at the PTF, Pelham, NH; WSMR, NM; and Andover, MA; inventory control and accounting for the repair parts, distribution of parts as required, and for the repair and return to inventory of repairable failed items. This is limited to providing only HAWK peculiar repair parts and repairing those HAWK peculiar assemblies which are part of the HAWK test bed at PTF, Andover, and WSMR.

6.0 Product Assurance

6.1 Objective – The contractor shall develop, implement and maintain an effective and economical quality assurance system as described in paragraph 6.4 of this PWS. All quality assurance program documentation plans and procedures prepared under previous HAWK/USG contracts in compliance with the established quality system described above shall be utilized to the maximum extent possible to provide product assurance services to the MSMB. The product assurance program requirements are based on an integrated program for reliability, quality, maintainability, and testing which is planned and implemented in a manner to assure that mission material conforms to established requirements at a realistic cost.

6.2 Non-Conforming Material – The contractor shall implement an effective system for evaluating and dispositioning nonconforming material, including material furnished by suppliers, against the contractor’s product baseline and applicable performance specifications. The USG shall have access to all use-as-is and repair data. Non-conforming material that does not meet performance specifications shall require a USG approved waiver IAW the Configuration and Production Management section of this

PWS.

6.3 Product Assurance Documentation – Product Assurance Documentation, as described in this section, shall be released and controlled as a part of the overall configuration management program. The contractor shall provide the services and materials to review, maintain, revise, and if necessary, generate documentation as required for the product assurance of HAWK system production, supply, maintenance, and fielding. The types of documents shall include drawings, electrical schematics and wiring lists, specifications, provisioning, engineering lists and TMs.

6.4 Quality Program/Inspection System – The contractor shall assure that a procedure is developed and implemented that provides for the technical review and approval by the quality engineering element of all specifications, drawings and special inspection equipment (SIE) documentation IAW the International Organization for Standardization (ISO) 9001. The review shall assure all documentation is complete, adequate, and stated in a clear, understandable manner prior to submittal to the USG for acceptance.

6.5 Inspection Equipment – The contractor shall prepare, maintain, and update SIE requirements and equipment lists IAW DI-SESS-81004 (CDRL A003).

6.6 Fabrication of Electronic Assemblies – Any fabrication of electrical and electronic assemblies by the contractor in the performance of this PWS, shall be IAW the USG approved contractor’s plan. The contractor shall utilize IPC J-STD-001 (for reference and information purposes only).

6.7 Electrostatic Discharge (ESD) Control – The contractor shall ensure electronic and electrical assemblies are protected from the effects of ESD using JESD 625.

7.0 Quality Support

7.1 The contractor shall provide quality and inspection support for the HAWK program in the areas of Modification Work Order (MWO) validations, product improvement efforts, field deployment, USG furnished equipment, and secondary items.

7.2 The USG, and its authorized representatives, have the right at all reasonable times, to inspect, or otherwise evaluate the work performed or being performed hereunder, and the premises of the contractor or subcontractor. The contractor shall provide and shall require subcontractors to provide facilities and assistance for the safety and convenience of the USG representatives in the performance of their duties IAW MIL- STD 882. All inspections and evaluations will be performed by the USG or its representatives on a non-interference basis.

7.3 Notwithstanding the requirements of any USG inspection and test contained in any specification applicable to this PWS, except where specialized inspections or tests are specified for performance solely by the USG, the contractor shall perform or have performed the inspections and tests required to substantiate that the materials and services provided under this PWS conform to the drawings, specifications, and PWS requirements listed herein.

7.4 Environmental Stress Screening (ESS) – The contractor shall review the Technical Data Package (TDP) associated with each ECP to assure the adequacy and applicability of ESS requirements. The contractor shall recommend ESS requirements or revisions to existing ESS requirements on all printed wiring assemblies and electronic assemblies.

7.5 Quality requirements for HAWK tactical and support software for this PWS shall conform to Section 8.0.

8.0 Software Quality Assurance (SQA)

8.1 The contractor shall provide SQA to maintain a software quality program. The procedures, practices, configuration, design, documentation, programming, reporting, testing, and overall contract requirements shall be applicable to the configuration of the HAWK FSSP customer IAW the individual country Retrofit Visibility Guide (RVG). The contractor shall deliver a Software Quality Assurance Report IAW DI-QCIC-81795 (CDRL A004). The USG reserves the right to validate the SQA process by conducting an evaluation of the contractor’s organization and subcontractors using commonly accepted industry/USG validation practices. The software/SQA program at a minimum shall include the following:

8.1.1 The contractor shall implement and maintain a software metrics program. Metrics collection shall continue until the end of the contract. The contractor shall present an analysis or interpretation of the data collected at all design and in-process reviews. The metrics data shall be documented IAW DI-QCIC-81795 (CDRL A004).

8.1.2 The tools, techniques, methodologies and records which will be used toward accomplishing SQA objectives and detail how their use will satisfy these objectives.

8.1.2.1 Procedures by which design documentation are to be evaluated to ensure fulfillment of requirements, completeness and compliance with applicable design standards.

8.1.2.2 Procedures for computer library controls, to include the handling of source and object code in their different versions, from initial approval until incorporation into the final media.

8.1.2.3 Referenced or documented procedures for software documentation standards and programming conversions.

8.1.2.4 Procedures for conducting reviews and audits for the purpose of verifying requirements traceability throughout the software development process.

8.1.2.5 Software test plans and procedures shall be prepared and delivered IAW DI-

IPSC-81438 (CDRL A005).

8.1.2.6 Procedures for the implementation of a software corrective action and reporting system to ensure prompt reporting, analysis, problem resolution, and follow-up.

9.0 Human Factors Engineering (HFE)

9.1 The contractor shall analyze the user system interfaces of any proposed change to deliverable hardware to assure that HFE features are enhanced or, if the proposed change is not directed toward the user system interface, that the established HAWK system HFE features are maintained or improved and are not adversely affected. The contractor shall perform analysis using MIL-STD-46855 (for reference and information purposes only), to the proposed change. The results of this analysis shall be included with the ECP. If the change does not involve user system interfaces, the statement "No HFE Changes" is acceptable. If the change does involve the user system interface the analysis shall contain the following information:

(a) Effects of change on HFE - This may be limited to the statement, "No human factors engineering changes," if such is the case

(b) Evaluations performed to determine the effects of the change in HFE features.

10.0 Safety

10.1 The contractor shall ensure the inherent safety originally designed into the system shall be maintained at all times. All studies performed under this PWS shall include an analysis of potential safety impacts.

10.2 The contractor shall perform a safety analysis of each ECP developed under this

PWS.

10.3 The contractor shall ensure that no radioactive, carcinogenic or highly toxic materials are incorporated into the system without prior USG approval.

11.0 Configuration and Production Engineering Management

11.1 The contractor shall provide a system of configuration and engineering management to assure that technical drawing and documentation records are maintained; that the USG is notified of any changes to the hardware and software;

and that design prototypes result in configuration items meeting the requirements of the USG approved Technical Data Package (TDP). The contractor shall maintain the base HAWK TDP using ECPs. The contractor shall develop, implement, and manage a program for control of all time, materials, software and hardware documentation defining the configuration of the items being developed/produced under this PWS.

11.2 Configuration Management (CM).

11.2.1 Status Accounting - The contractor shall update and maintain the configuration status accounting information provided as the TDP under this PWS IAW DI-SESS- 81253 (CDRL A006). The accounting system shall accurately define the TDP for the current configuration of the items developed and produced under this contract at all times.

11.2.2 Engineering Documentation Change Procedures.

11.2.3 All Class I and Class II ECPs, and all Request for Waiver (RFW) written against the documentation used to describe the contractual technical data baseline shall be supported by approved ECPs and RFWs. Class I ECPs also require a contract modification approved by the PCO.

11.2.4 All unclassified Class I ECPs shall be prepared IAW the current edition of DI-SESS-80639 (CDRL A007) and processed using the WEB-Multi-user ECP Approval and Review System (WEB-MEARS). Class II ECPs shall be prepared in Contractor format utilizing Change Notices. Class II concurrence, classification and approval shall be the responsibility of the contractor.

11.2.5 The contractor shall incorporate modification kit release or changes resulting from an approved ECP (Class I or Class II) into the affected documentation IAW the approved Notice(s) of Revision (NORs) in the Document Update Matrix provided with the ECP. The NOR documentation shall be submitted IAW DI-SESS-80642 (CDRL A008). The incorporation of this data and documentation shall be accomplished using WEB-MEARS and shall be completed within 30 days after the receipt of the approved ECP and receipt of funds. All other documentation (i.e., ground-up documentation) shall have ECPs incorporated into the TDP only when funded and specifically authorized in writing by the USG.

11.2.6 Procedures, Responsibilities, and Functions.

11.2.6.1 The contractor shall assign ECP numbers, furnished by the USG Configuration Manager through the PCO to all ECPs prepared under this PWS/contract. All Class I and Class II ECPs shall be submitted using WEB-MEARS.

11.2.6.2 The MSMB will review all proposed Class I ECPs utilizing WEB-MEARS and approve, disapprove, or recommend revision, as necessary. USG ECP approval will be indicated by signing the block provided on the WEB-MEARS ECP status sheet.

Disapproved ECPs will be returned to the originating contractor with reasons for disapproval.

11.2.6.3 The contractor shall incorporate approved ECPs into the HAWK TDP.

11.2.6.4 Request for Waiver (RFW) - All major waivers to the released technical documentation (both Government and contractor controlled drawings and specifications) and contract requirements (including process specifications and DOD/MIL specifications and standards) shall be submitted to the MSMB for approval/disapproval. Minor waivers shall be dispositioned through the appropriate Plant Material Review Board unless otherwise directed by MSMB. Prior to implementation of an approved RFW, the contractor shall have a PCO approved contract modification placing the change into the contract. All proposed RFWs shall be prepared IAW DI-SESS-81732 (CDRL A009).

11.2.7 Configuration Change Control

11.2.7.1 Changes to common usage (common item) documentation: i.e., documentation not under the custodianship of the prime contractor and used by other systems, commands, or services, shall be initiated as separate change proposals and submitted to the MSMB for coordination with other users of the documentation.

11.2.7.2 All ECPs affecting documentation under USG control require MSMB approval.

Class II ECPs shall be processed in contractor format as Change Notices and shall be reviewed for concurrence in classification and approved by the contractor.

11.2.7.3 Engineering Release of Documentation - The contractor shall prepare an Engineering Release Record (ERR) IAW DI-SESS-80463 (CDRL A010) to officially release Class I ECPs that will be placed under USG control.

11.3 Configuration Documentation (CD).

11.3.1 Existing Data - The contractor shall use existing data to the maximum extent possible to satisfy the CD requirements stated herein. Existing data used shall be such that every line, number, letter, and character is clearly legible and readable IAW MIL-

STD-1472.

11.3.2 Government Furnished Material (GFM) – The contractor shall not prepare configuration documentation for items identified as GFM.

11.3.3 CD Forms -The contractor shall prepare CD Forms IAW the requirements of this PWS. CD includes performance based product/process specifications and engineering drawings and associated lists.

11.3.3.1 Performance-Based Product Process Specifications - The contractor shall prepare performance-based specifications IAW DI-SDMP-81465 (CDRL A011).

Specifications shall be prepared to the lowest level of the work breakdown structure necessary to adequately define the system or equipment.

11.3.3.2 Engineering Drawings and Associated Lists -The contractor shall prepare engineering drawings and associated lists IAW DI-SESS-81000 (CDRL A012) and

11.3.3.3 Configuration Documentation Numbering - All CD designated for delivery by the contractor to the USG shall contain the AMCOM Commercial and Government Entity (CAGE) Code 18876, and shall be numbered from a block of numbers provided by the AMCOM contract technical monitor.

11.4 Units of Measure - Units of measurements (Metric (SI) Units of US Customary Units) shown in the CD shall be consistent with material design requirements found elsewhere in the PWS.

11.5 Standardized Military Drawings - The contractor shall prepare standardized military drawings in lieu of control drawings for microcircuits only.

11.6 Classified Information - The contractor shall mark all configuration documentation containing classified information and handle it IAW DOD 5220.22-M. The contractor shall have and maintain a "SECRET'' facility clearance. Contractor personnel requiring access to classified or sensitive material shall maintain a "SECRET'' security clearance to work on this contract. Contractor personnel ONLY requiring access to unclassified information systems must have, at the minimum, a NACI completed and favorably adjudicated in order to access to the systems.

11.7 Radioactive Materials - All CD pertaining to items using radioactive materials shall have the requirement correctly marked by the contractor with a "Caution" note.

11.8 Contractor Certification - The contractor shall certify that:

11.8.1 All CD prepared as a result of this PWS shall contain information with which the USG can procure from other sources, identical items, components, and processes which are functionally and physically interchangeable.

11.8.2 The hardware has been produced (or acquired) to the CD. Contractor certification shall be made available for all CD at the time the USG assumes control or ownership. Certification shall be in writing and shall accompany the CD.

11.9 Media for Delivery of Engineering Data.

11.9.1 The media delivery requirements of engineering data; i.e., drawings, associated lists, missile specifications, quality assurance provisions, engineering operating instructions, equipment descriptions, calibration procedures, ECPs, NORs, ERRs, and all other data that forms a part of the functional, allocated, or product baseline shall be

IAW MIS-STD-52406A-IS.

11.9.2 Classified engineering documents and limited rights documents shall not be delivered in raster image media on magnetic tape. Classified engineering documents and limited rights documents shall be delivered on digital media.

11.9.3 The media for engineering data that are unclassified or that contain no limited rights legends shall be delivered via digital media.

12.0 Hawk System Logistics

12.1 The contractor shall provide Integrated Logistic System (ILS) management interface between the USG and contractor engineering and CM groups in matters related to field implementation of ECPs, Product Improvement Phases (PIPs), and modification/conversion programs.

12.2 The contractor shall interface with all engineering groups, both USG and contractor, to assure that all logistics information needed to develop and implement a modification program is provided as part of ECPs and activity reports.

12.3 The contractor shall provide ILS guidance to contractor engineering departments, logistics disciplines, and management organizations in matters related to integrated logistics.

12.4 The contractor shall develop and maintain the HAWK system logistics database and retrieval systems to provide traceability and history of all significant HAWK maintenance items. This includes modification kits and MWO procedure identification.

12.5. The contractor shall provide logistics metrics using MIL-HDBK-260 for reference and guidance.

13.0 Technical Manuals (TMs)

13.1 The contractor shall prepare and deliver HAWK Weapon System TMs IAW MIL- STD-40051-2, and Standard Agreements for Preparation of HAWK DATM Material.

Changes or revisions to HAWK TMs shall be delivered IAW DI-ADMN-80925 (CDRL A013). COTS technical documentation shall be delivered DI-TMSS-80527 (CDRL A014).

14.0 Modification Work Orders (MWOs)

14.1 The contractor shall prepare a MWO manuscript IAW DI-CMAN-80529 (CDRL A015). The contractor may refer to MlL-PRF-63002 for reference and information purposes only.

14.2 The MWO and MWO kit drawings and supporting technical documentation are to be provided by the contractor as part of the ECP submittal.

14.3 The contractor shall identify the kit drawing by an Army part number furnished by AMCOM. It shall consist of a list of all parts required for accomplishing the modification.

14.4 If the contractor requires special tools, jigs or fixtures, they shall be listed on a separate kit drawing.

14.5 The preliminary and final kit drawings shall be prepared and delivered IAW DI- SESS-81000 (A012). The contractor may refer to ASME Y14.24M-1999 and M1L-STD- 31000 for reference and information purposes only.

14.5.1 The contractor shall manufacture, assemble, and deliver a quantity of trial kits consistent with the requirements of kit validation to accomplish the modification described in the MWO manuscript, per the direction of SAMD.

14.5.2 The contractor shall furnish personnel, facilities, and technical expertise to support the MWO validation, per the direction of SAMD.

14.5.3 Preliminary Maintenance Allocation Chart (PMAC).

14.5.3.1 The PMAC submittal to USG by the contractor shall be hard copy to the MSMB. Class I ECP package submittals shall list the PMACs affected and include all drawings. PMAC changes as a result of Class II ECPs shall be maintained in the PMAC database. Comments and recommended changes to the PMAC revisions will be provided to the contractor by the MSMB. Completion of database PMAC files shall be prior to ECP package submittal to AMCOM, or prior to ECP validation of hardware by AMCOM personnel.

14.5.3.2. The contractor PMAC status file shall reflect partial status for non-approved ECP packages or packages in development prior to contractor submittal to AMCOM.

AMCOM approval of the ECP will change the status code to active status.

14.6 Provisioning Requirements

14.6.1 The contractor shall provide a provisioning parts list IAW DI-SESS-81715 (CDRL A016).

15.0 Packaging and Transportability Requirements

15.1 Packaging - The contractor shall develop packaging data for AMCOM managed equipment/parts subjected to storage and transportation IAW MIL-STD-2073-1.

15.2 Transportability - The contractor shall follow procedures contained in MIL-STD- 2073-l when the potential need for specialized containers is identified during course of item engineering, development or production.

16.0 Hazardous Material Management: All Contractor and subcontractor activities shall be in compliance with applicable federal, state, and local environmental laws and regulations. The Contractor shall ensure that design, maintenance, operation, manufacturing, programmatic decisions and trade-off studies strive to eliminate or reduce hazardous materials and waste. The contractor shall implement a Hazardous Material Management Program (HMMP) IAW National Aerospace Standard (NAS) 411.

The contractor shall prepare and deliver a HMMP Plan IAW DI-MGMT-81398 (CDRL A017). The contractor shall not use any Class I Ozone Depleting Chemical/Ozone Depleting Substance (ODC/ODS) (identified at http://www.epa.gov/ozone/ods.html) or any unacceptable ODC/ODS solvents (identified at http://www.epa.gov/ozone/snap/lists/index.html) in the manufacture or support of items required by this PWS unless a waiver is obtained from the Army Acquisition Executive.

Any ODC/ODS refrigerant alternatives used must appear in the EPA’s Significant New Alternatives Policy (SNAP) list (identified at http://www.epa.gov/ozone/snap/lists/index.html) and have received a toxicity clearance from the U.S. Army Public Health Command (USAPHC). The Contractor shall prepare and deliver an annual HMMP Report IAW DI-MISC-81397 (CDRL A018). The HMMP Report shall provide the following information: (1) Any of the following materials that are contained within a user end item: EPA 17 List materials (identified at http://www.epa.gov/opptintr/3350/33finb1.htm), beryllium, coatings (identified by MIL SPEC), functional fluids (e.g. coolant, hydraulic fluid, petroleum products), energetics/solid rocket motor components (including Explosives Class Number), advanced composite materials (e.g. fabricated from silica, graphite, carbon, boron, fiberglass), batteries, Class I/Class II ODS/ODC materials, and asbestos; (2) A general description (to include a graphic or drawing) of where these materials are located within the end item; (3) Required maintenance/repair/support materials to include: EPA 17 List materials, sealants, adhesives, coatings (identified by MIL SPEC), and Class I/Class II ODS/ODC materials; and (4) any EPCRA 302/313 materials (identified at http://www.epa.gov/emergencies/docs/chem/list_of_lists.pdf) utilized in the manufacturing process. The Contractor shall provide immediate notification of any proposed hazardous material mitigation/elimination efforts that may adversely impact schedules, cost and/or performance.

17.0 COST REPORTS

17.1 The contractor shall prepare a performance and cost report to include schedule IAW DI- FNCL-80912 (CDRL A019) for all effort required by this PWS.

18.0 COUNTERFEIT PARTS

18.1 The contractor shall have a counterfeit parts prevention program for all electronic system parts for both the prime contractor and sub-vendor areas of responsibility. This applies when original configuration controlled system electronic circuit cards, sub-assemblies or assemblies are replaced due to obsolescence or changes in suppliers, to include below-prime sub-vendors. Parts with high risk counterfeit potential shall have additional oversight tracking and safeguards. The contractor shall establish testing and verification requirements for items not received from an original equipment/component manufacturer or authorized distributor. Suspect parts or incidents shall be reported to the KO and COR by e-mail within three working days of the discovery. Should a counterfeit incident occur, the contractor shall manage it using a risk mitigation plan or countermeasure to eliminate the problem.

19.0 SECURITY REQUIREMENTS: Contractor personnel working with classified or sensitive information are required to maintain, at the minimum, a SECRET level security clearance to work on this contract. Contractor personnel ONLY requiring access to computer systems shall have, at the minimum, a National Agency check with Written Inquiries (NACI) completed, with no derogatory information note upon review of the SF86, or equivalent, or discovered during the investigation, to be employed on this contract."

19.1 AT Level I Training: This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access to government installations, facilities and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit a list of employees and certificates of completion for each affected contractor employee and subcontractor employee to the COR or to the contracting officer, if a COR is not signed, within 30 calendar days after completion of training of all employees and subcontractor personnel for each. 19.2 iWATCH Training. This standard language is for contractor employees with an area of performance within an Army controlled installation, facility, or area. The contractor and all associated subcontractors shall brief all employees on the local iWATCH program (training standards provided by the requiring ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the CO. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 30 calendar days after contract award. 19.3 Formal OPSEC Program. The contractor shall develop an OPSEC Standing Operating Procedure (SOP)/Plan within 90 calendar days of contract award to be reviewed and approved by the responsible government OPSEC officer. This plan will include a process to identify critical information, where it is located, who is responsible for it, how to protect it and why it needs to be protected. The contractor shall implement OPSEC measures as ordered by the commander. In addition, the contractor shall have an identified certified Level II OPSEC coordinator per AR 530-1.

19.4 OPSEC Training. Per AR-530-1, the contractor employees must complete Level I OPSEC Awareness training. New employees must be trained within 30 calendar days of their reporting for duty and annually thereafter.

19.5 Access and General Protection/Security Policy and Procedures. This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). Contractor and all associated subcontractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

19.6 For Contractors that do not require a CAC, but require Access to DoD Facility or Installation: Contractor and all associated subcontractors employees requiring access to Government facilities but do not require a CAC card shall comply with adjudication standards and processes using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by Government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

19.7 For Contracts That Require Handling or Access to Classified Information.

Contractor shall comply with Federal Acquisition Regulation 52.204-2, Security Requirements and DD Form 254, Contract Security Classification Specification. This clause involves access to information classified “Confidential,” “Secret” and requires contractors to comply with-(1) The Security Agreement (DD Form 441), including the NISPOM (DoD 5220.22-M); any revisions to DOD 5220.22-M, notice of which has been furnished to the contractor.

19.8 Threat Awareness Reporting Program (TARP). For all contractors with security clearances. Per AR 381-12 TARP, all contractors with security clearances must receive annual TARP training by a CI agent or other trainer as specified in 2-4b.

20.0 GOVERNMENT FURNISHED EQUIPMENT (GFE)

a. Government Furnished Property (GFP) Reporting Requirements. The provisions of this paragraph are only applicable if Government Furnished Property (GFP) is provided in the course of execution of this contract. GFP consists of Government Furnished Equipment and Materials as defined in FAR 45.101.

b. The contractor shall maintain and account for all Government furnished equipment under this contract. Upon Government direction, the contractor shall take steps required to transfer GFE to another contractor or Government facility as designated by the Government.

c. The inventory accounting system must specify, at a minimum, product description (make and model), Government tag number, date of receipt, name of recipient, location of receipt, current location, purchase cost (if CAP), and contract/order number under which the equipment is being used. The contractor shall either attach an updated inventory report to each monthly status report IAW DI-MGMT-80269 (CDRL A020) or certify that the inventory has been updated and is available for Government review. In either case, the contractor's inventory listing must be available for Government review within one business day of Procuring Contracting Officer (PCO) or COR request.

d. Physical Inventory Plan/Schedule and Reports for GFP IAW DI-MGMT-80269 (CDRL A020). The contractor shall deliver this report within 30 days of completion of the contractor's periodic inventory of GFP in accordance with the contractor's approved Property Management System.

e. Final Government Property Inventory Report IAW DI-MGMT-80269 (CDRL A020).

The contractor shall deliver this report within 30 days of completion of the final physical inventory of all Government Property (Government Furnished Property and Contractor Acquired Property), unless waived by the Government Property Administrator, must be available for Government review within one business day of Procuring Contracting Officer (PCO) or COR request.
