1.0 INTRODUCTION

1.1 This SOW establishes the requirements for the production and delivery of 466 each M121 rocket motors, 248 each M250 warheads, 450 each PS419 thermal batteries, and 150 each M145 safety & arming devices.

2.0 APPLICABLE DOCUMENTS

2.1 The documents listed in this SOW form a part of the contract to the extent invoked by specific reference in the paragraphs of the SOW. Revision letters, amendment indicators, notices, supplements, tailoring, and dates are omitted within the SOW and are listed on the document summary list (DSL).

2.2 Where a specific version of a document is called out as a reference on the DSL, no other version shall be used without prior written consent of the procuring contracting officer (PCO). The applicable version of subsidiary (second-tier) documents referenced in the documents listed in this SOW shall be that version dated either concurrent with or just prior to the date of the listed documents.

2.3 Documents appearing in other parts of this solicitation/contract form a part of the contract invoked by that specific reference.

3.0 PERFORMANCE REQUIREMENTS

3.1 The contractor shall provide 466 each new production M121 rocket motors IAW the Drawings for Army Part Number (APN) 13007205.

3.2 The contractor shall provide 450 each new production PS419 batteries IAW the Drawings for APN 11743216.

3.3 The contractor shall provide 150 each new production M145 safety & arming devices IAW the Drawings for APN 10234569.

3.4 The contractor shall provide 248 each new production M250 warheads IAW the Drawings for APN 9256709.

3.5 Any deviations or changes for any part or component of the USG TDP revision for any item delivered under this SOW shall be submitted to the USG for review and concurrence prior to its implementation.

3.5.1 All deviation or changes in materials, processes, and specifications shall meet the requirements of the top assembly drawing and performance specification for that item.

The contractor shall provide written certification concurrently with the deviation/change request stating that the requested deviation or change meets those requirements.

3.5.2 Justification for requested deviations or changes in materials, processes, and specifications shall be submitted with the request for deviation. Requests for Deviation shall be IAW DI-CMAN-80640C (CDRL A007)

3.6 No U.S. markings shall be placed on the material delivered under this SOW.

3.7 The contractor shall be responsible for all purchase costs of any capital type equipment necessary to perform this contract.

3.8. Residual material generated as a result of this effort shall be disposed of by the contractor IAW applicable federal, state and local regulations and procedures.

3.9 First Article Testing shall be done on the above items IAW Federal Acquisition Regulation 52.209-3. Testing requirements will be waived if sufficient data is submitted PRIOR TO BIDDING to this office showing proof of sales of exact or similar units to any US Government agency with the past (5) years.

4.0 SPECIFIC CRITERIA

4.1 M121Rocket Motors

4.1.1 The contractor shall provide 466 each M121 rocket motors IAW the Drawings and technical data requirements for APN 13007205, 36 months after receipt of order

(ARO).

4.1.2 The contractor shall submit to the Non-Standard Missile Systems Management Branch, Security Assistance Management Directorate (SAMD), IAW DI-NDTI-80566, a test plan (CDRL A001) and subsequent test report IAW DI-NDTI-80809 (CDRL A002) for test and acceptance of rocket motors produced under this SOW. The test plan shall be submitted to the USG no less than 45 days prior to the start of the testing for review and concurrence. The test report shall be submitted to the USG no later than 30 days following the completion of testing.

4.1.3 Inspection and acceptance shall be performed by a joint USG/SAMD team at the contractor’s facility IAW a USG approved test plan. Deficiencies noted during the inspection and inventory shall be corrected prior to the material being accepted.

4.1.4 After USG acceptance, the rocket motors shall be packaged and marked by the contractor IAW the requirements specified in paragraph 6.1 of this SOW and its corresponding subparagraphs. A Notice of Availability (NOA) shall be sent by the contractor to the Taiwan Freight Forwarder IAW the Transportation Plan for Taiwan (TW) Foreign Military Sales Case: TW-B-ZBD.

4.1.4.1 The Rocket Motors shall receive level A packing, Method 55 preservation, and the applicable hazardous materials markings IAW MIL-STD-2073-1E.

4.2 MK70/PS419 Battery

4.2.1 The contractor shall provide 450 each MK70/PS419 Batteries IAW the Drawings and technical data requirements for APN 11743216, 24 months ARO.

4.2.2 The contractor shall develop and submit to the Non-Standard Missile Systems Management Branch, SAMD, IAW DI-NDTI-80566, a test plan (CDRL A008) and subsequent test report IAW DI-NDTI-80809 (CDRL A009) for test and acceptance of batteries produced under this SOW. The test plan shall be submitted to the USG no less than 45 days prior to the start of the testing for USG review and concurrence. The test report shall be submitted to the USG no later than 30 days following the completion of testing.

4.2.3 Inspection and acceptance shall be performed by a joint USG/SAMD team at the contractor’s facility IAW a USG approved test plan. Deficiencies noted during the inspection and inventory shall be corrected prior to the material being accepted.

4.2.4 After USG acceptance, the batteries shall be packaged and marked by the contractor IAW the requirements specified in paragraph 6.2 of this SOW and its corresponding subparagraphs and shipped to McAlester Army Ammunition Plant (MCAPP) at the address below:

4.3 M145 Safety & Arming (S&A) Devices

4.3.1 The contractor shall provide 150 each S&A Devices IAW the Drawings and technical data requirements for APN10234569 36 months ARO.

4.3.2 The contractor shall develop and submit to the Non-Standard Missile Systems Management Branch, SAMD, IAW DI-NDTI-80566, a test plan (CDRL A0010) and subsequent test report IAW DI-NDTI-80809 (CDRL A0011) for test and acceptance of S&A Devices produced under this SOW. The test plan shall be submitted to the USG no less than 45 days prior to the start of the testing for USG review and concurrence. The test report shall be submitted to the USG no later than 30 days following the completion of testing.

4.3.3 Inspection and acceptance shall be performed by a joint USG/SAMD team at the contractor’s facility in IAW a USG approved test plan. Deficiencies noted during the inspection and inventory shall be corrected prior to the material being accepted.

4.3.4 After USG acceptance, the contractor shall package and mark the S&A Devices IAW the requirements specified in paragraph 6.3 of this SOW and its corresponding subparagraphs. A Notice of Availability (NOA) shall be sent by the contractor to the Taiwan Freight Forwarder IAW the Transportation Plan for Taiwan (TW) Foreign Military Sales Case: TW-B-ZBD.

4.3.4.1 The S&A’s shall pack level A packing, Method 55 preservation, and the applicable hazardous materials markings IAW MIL-STD-2073-1E

4.4 M250 Warheads

4.4.1 The contractor shall provide 248 each warheads IAW the Drawings and technical data requirements for APN 9256709, 36 months ARO.

4.4.2 The contractor shall develop and submit to the Non-Standard Missile Systems Management Branch, SAMD, IAW DI-NDTI-80566, a test plan (CDRL A0012) and subsequent test report IAW DI-NDTI-80809 (CDRL A0013) for test and acceptance of warheads produced under this SOW. The test plan shall be submitted to the USG no less than 45 days prior to the start of the testing for USG review and concurrence. The test report shall be submitted to the USG no later than 30 days following the completion of testing.

4.4.4 Inspection and acceptance shall be performed by a joint USG/SAMD team at the contractor’s facility in IAW a USG approved test plan. Deficiencies noted during the inspection and inventory shall be corrected prior to the material being accepted.

4.4.5 After USG acceptance, the warheads shall be packaged and marked by the contractor IAW the requirements specified in paragraph 6.4 of this SOW and its corresponding subparagraphs. A Notice of Availability (NOA) shall be sent by the contractor to the Taiwan Freight Forwarder IAW the Transportation Plan for Taiwan (TW) Foreign Military Sales Case: TW-B-ZBD.

4.4.5.1 The contractor shall pack the warheads with a level A packing, Method 55 preservation, and the applicable hazardous materials markings IAW MIL-STD-2073-1E.

5. GOVERNMENT FURNISHED EQUIPMENT (GFE)

5.1 Should GFE be required, the contractor shall maintain a current and updated list of GFE IAW DI-MGMT-80269 (CDRL A003). All GFE is the property of the USG and shall not be transferred to any individual or agency, public or private, without the express written consent of the PCO. The contractor shall remain accountable for all GFE items from receipt of the items until they are returned to the USG. Any GFE that is purchased by the USG for this requirement shall be added to the GFE lists and reports. The contractor shall return the GFE in the same condition as received unless it has been documented and reported otherwise to the USG. The contractor shall inform the USG of any damage or loss of GFE as soon as possible.

6. PACKAGING, PRESERVATION AND MARKING

6.1 The M121 rocket motors shall be painted and marked IAW the requirements of Drawing 13007206.

6.1.1 The rocket motor color coded squares and data marking shall be IAW the requirements of Drawing 8035258, Table 1.

6.1.2 The M121 rocket motors shall be packaged in shipping container 13142938.

F.1.2.1 The rocket motor shipping container shall be painted and marked IAW the requirements of Drawing 13060332.

6.2 The MK70/PS419 batteries shall be painted and marked IAW the requirements of Drawing 11743216.

6.2.1 The MK70/PS419 batteries shall be packaged in shipping container 11724972.

6.3 The M145 S&A device exterior color, color coding and data marking shall be IAW the requirements of Drawing 8035258, Table 1.

6.3.1 The M145 S&A devices shall be packaged in shipping container 1817888.

6.3.1.1 M145 S&A device shipping container shall be painted and marked IAW the requirements of Drawing 1817888.

6.4 The M250 warhead color coding and data marking shall be IAW the requirements of Drawing 8035258, Table 1.

6.4.1 The contractor shall ship the warheads utilizing the two warhead shipping container, APN 1569757.

6.4.2 The M250 warhead shipping container shall be marked IAW the requirements of Drawing 1569757.

7.0 QUALITY ASSURANCE

7.1 The contractor shall develop, implement, and maintain an effective and economical quality system IAW ANSI/ISO/ASQ Q9001 (or equivalent systems as agreed between the contractor and the US Government). The system shall provide controls for process and product characteristics and include criteria and methodology that are used to validate conformance to performance specifications, as applicable, and achieve continuous improvement. The quality system shall develop and implement control measure necessary to comply with contract quality requirements contained within this SOW and the contract. The quality system shall be integrated with other functional disciplines. The contractor shall make available, for in-plant quality review by the USG, quality system procedures, planning and all other documentation and data that comprise the contractor’s quality system (both hardware and software).

8.0 HAZARDOUS MATERIALS MANAGEMENT

8.1 All contractor and subcontractor activities shall be in compliance with applicable federal, state, and local environmental laws and regulations. The contractor shall ensure that design, maintenance, operation, manufacturing, programmatic decisions and trade-off studies strive to eliminate or reduce hazardous materials and waste. The contractor shall implement a Hazardous Material Management Program (HMMP) IAW National Aerospace Standard (NAS) 411. The contractor shall prepare a HMMP Plan IAW DI-MGMT-81398 (CDRL A004). The contractor shall not use any Class I Ozone Depleting Chemical/Ozone Depleting Substance (ODC/ODS) (identified at http://www.epa.gov/ozone/ods.html) or any ODC/ODS solvents listed as Being Replaced and/or having an Acceptable Substitute (identified at http://www.epa.gov/ozone/snap/lists/index.html) in the manufacture or support of items required by this SOW unless a waiver is obtained from the Army Acquisition Executive.

Any ODC/ODS refrigerant alternatives used must appear in the EPA’s Significant New Alternatives Policy (SNAP) list (identified at http://www.epa.gov/ozone/snap/lists/index.html) and have received a toxicity clearance from the US Army Public Health Command (USAPHC). The Contractor shall prepare annual HMMP Reports IAW DI-MISC-81397 (CDRL A005). The HMMP Reports shall provide the following information: (1) Any of the following materials that are contained within a user end item: EPA 17 List materials (identified at http://www.epa.gov/ozone/science/ods/classone.html ), beryllium, coatings (identified by MIL SPEC), functional fluids (e.g. coolant, hydraulic fluid, petroleum products), energetic/solid rocket motor components (including Explosives Class Number), advanced composite materials (e.g. fabricated from silica, graphite, carbon, boron, fiberglass), batteries, Class I/Class II ODS/ODC materials, and asbestos; (2) A general description (to include a graphic or Drawing) of where these materials are located within the end item; (3) Required maintenance/repair/support materials to include: EPA 17 List materials, sealants, adhesives, coatings (identified by MIL SPEC), and Class I/Class II ODS/ODC materials; and (4) any EPCRA 302/313 materials (identified at http://www.epa.gov/emergencies/docs/chem/title3_Oct_2006.pdf) utilized in the manufacturing process. The Contractor shall provide immediate notification of any proposed hazardous material mitigation/elimination efforts that may adversely impact schedules, cost and/or performance.

9.0 COUNTERFEIT PARTS PREVENTION

9.1 The contractor shall have a counterfeit parts prevention program for all electronic system parts for both the prime contractor and sub-vendor areas of responsibility. This applies when original configuration controlled system electronic circuit cards, sub-assemblies or assemblies are replaced due to obsolescence or changes in suppliers, to include below-prime sub-vendors. Parts with high risk counterfeit potential shall have additional oversight tracking and safeguards. The contractor shall establish testing and verification requirements for items not received from an original equipment/component manufacturer or authorized distributor. Suspect parts or incidents shall be reported to the MSMB SAMD technical representative for this effort. Should a counterfeit incident occur, the contractor shall track it using a risk mitigation plan or countermeasure to eliminate the problem.

10.0 PERFORMANCE REPORTS

10.1 The contractor shall prepare Program Management Status Reports IAW DI-

MGMT-80368 (CDRL A006).

11.0 SECURITY

11.1 The Contractor shall comply with FAR 52.204-2, Security Requirements and DD 254, Contract Security Classification Specification. This clause involves access to information classified "Confidential," "Secret," or "Top Secret", and requires contractors to comply with-(1) The Security Agreement (DD Form 441), including the National Industrial Security Program Operating Manual(DoD 5220.22-M); any revisions to DOD 5220.22-M, notice of which has been furnished to the contractor."

11.2 All contractors shall have security training in accordance with the NISPOM.
