STATEMENT OF WORK

PROVISION OF MOBILE ENVIRONMENTAL

CONTROL UNIT (ECU)

SPECIFICATION

1.0 General Scope

1.1 This specification is to establish minimum requirements for the provision of a turn-key Commercial Off-The-Shelf (COTS) packaged Environmental Control Unit (aka Heating, Ventilating and Air-Conditioning; HVAC unit) with modifications to make mobile for use at TPS-75 test site. Vendor shall provide turn-key unit and any associated design, fabrication and modifications necessary to meet specifications. Vendor shall deliver, install, start-up, test and balance the unit while connected to a government asset located at Tobyhanna Army Depot (TYAD) in Tobyhanna, PA. Intention of the project is to replace Government issued “Tactical ECU” with “Modified Commercial ECU”; primarily for the quick availability of parts as well as multiple local sources or repair. The COTS portion of the system shall be an exact match to three preexisting units currently in use at the test site. The system shall be designed for continuous outdoor use and shall be mobile to be pushed between existing test pads and connected to existing Government RADAR Assets. The Vendor shall supply the COTS ECU and modify for mobility which shall include any design, materials, supplies, freight, delivery, tools, equipment, consumables, labor, and supervision for the turn-key fabrication, delivery, installation, supply and testing for the Mobile ECU.

1.2 A site visit may be scheduled and Vendors interested in proposal submittal are encouraged to request though the ACC-TYAD contracting office. The site visit is for the purpose of interested Vendors to view existing mobile systems, consider the modification of COTS that will be required as well as asses the layout, terrain and configuration of the project area and to enable viewing of the delivery, utility and installation sites. Vendors shall be responsible for providing their own personal protective equipment (PPE) for the site visit. At a minimum, PPE for the site visit includes safety footwear. RESTRICTIONS.

1.3 The Building 54 Outdoor Test Pads are the point of use of the Mobile ECUs. The Contractor shall be responsible to ensure that the final packaged and assembled ECU is deliverable and accessible to this site location. It shall be the responsibility of the Vendor to verify all dimensions for delivery and shipment as well as deliver, uncrate, install/connect and start-up.

1.4 For the purpose of this Contract, the KO (Contracting Officer) shall be synonymous with Contract Administrator/Buyer. AFTER THE CONTRACT IS AWARDED, the KO shall assign a representative to oversee the project/work and this authorized representative (CPOC— Contracting Officer’s Point of Contact) shall be the Contractor’s main point of contact. Only AFTER Government KO has issued a contract shall the Contractor communicate with the CPOC.

Prior to award all communication shall be through the KO. The CPOC shall coordinate authorizations with the KO. All equipment reviews and technical aspects of the SOW shall be referred to the CPOC.

1.5 This contract shall consist of the following Contract Line Item Number (CLINs) or SUB- CLINs:

1.5.1 LINE ITEM: Provision of ONE Mobile ECU (this shall be a Lump Sum, Firm Fixed Price Effort).

2.0 Proposal Submittal Information

2.1 Price: The Contractor shall submit a Firm-Fixed-Price (FFP) proposal.

2.2 Contractor Data/Qualifications: Accompanying proposal, vendor shall submit the following data demonstrating the contractor has successfully done this type of work as specified herein, or that the contractor has a subcontractor having such required experience: Data shall

2.2.1. One reference letter including name and location of at least one similar installation, fixed or mobile.

2.2.2. NEBB or AABC Balancing Certification of vendor or vendor’s subcontractor.

2.2.3. Shop Drawing/Submittal Package of item proposed. The Vendor shall provide a to-scale full-assembly layout drawing package in hardcopy and electronic media (.dxf format) with full dimensioning representing the Mobile ECU along with all OEM submittal data from COTS components such as the core HVAC unit, balancing dampers, thermostat, cord reel, casters etc. Include data on insulating materials, exterior jacketing and coatings used on field fabricated items.

3.0 Period of Performance/Work Hour Limitations

3.1 The Contractor shall have a Period of Performance (PoP) for the design, fabrication, delivery, installation and testing of the Mobile ECU of 14 weeks or sooner After Receipt of Order (ARO).

3.2 The Contractor may deliver and perform all work at TYAD during normal 1st-shift working hours of Monday—Thursday, 8:00 AM—4:00 PM. The Contractor’s equipment, personnel, and work efforts shall not interfere with normal production operations that will be ongoing by Government personnel.

3.3 Coordinate delivery at least 5 days in advance with the CPOC.

4.0 Minimum Mobile ECU Specifications, Characteristics and Features

4.1 Government drawings supplied with this Specification along with the attached Product submittals from previous mobile unit provisions shall be basis for ECU provision.

4.1.1Contractor shall modify the COTS unit for mobility and for interface with Government Radar asset including flexible ductwork connections and power provision.

4.1.2 Basis of COTS unit shall be YORK MODEL AS INCLUDED IN ATTACHED SUBMITTAL ALONG WITH REQUIRED ACCESSORIES. Any vendor/contractor may prepare offer but solution MUST INCLUDE YORK COTS (exact model) for component interchangeability with existing systems and repair parts/swap availability and stock.

4.1.3 Design of the Mobile ECU System shall be the full responsibility of the Contractor.

See attached “Mobile ECU Concept Sketch” for Government CONCEPT of Mobile ECU as well as submittals of existing systems which shall be emulated in this project.

4.1.4 It shall be the responsibility of the Contractor to supply all labor, materials, supervision, tools and equipment to deliver, off-load, transport, place, and test the Mobile ECU at the designated site. Only electric-powered material handling equipment and only electric-powered tools shall be used by the Contractor inside all Government buildings. Restrictions do NOT apply outdoors. Delivery date and time shall be coordinated with the CPOC a minimum 5 calendar days in advance of delivery at TYAD.

4.1.5 The Contractor shall be responsible to remove all packaging, packing and crating material from the delivered pieces and remove all of the packaging, packing and crating materials from TYAD. It shall be the responsibility of the Contractor to completely and thoroughly clean all delivered pieces. The Contractor shall thoroughly clean the delivery and installation sites prior to departure.

4.1.6 As part of the provision and start-up effort, the Contractor shall field measure air flow, temperatures and pressures of the existing mobile ECUs as in operation and connected to the radar asset. The unit supplied and delivered by the Contractor shall be commissioned and balanced to meet parameters measured.

4.1.7 The Contractor shall deliver the ECU’s to the site, make final connections to the Government “Base” power provision at the site and make final connections to the RADAR asset at the site. Contractor shall provide NEW flexible insulated ductwork for connection to government radar asset then start-up, commission and balance Mobile ECU to match parameters of existing.

4.1.8 Existing 480 VOLT/3 Phase- 60 Hz; 30 AMP NEMA 4X disconnect switch exists for the Mobile ECU to receive power from. The disconnect switch is within 30 feet of the final Mobile ECU use location. The Contractor shall supply both the male and female portions of the HOCC (Heavy Outdoor Circular Connector) for connection of the Mobile ECU to the Government power supply/disconnect switch. The Mobile ECU shall be complete with appropriately sized retractable cord reel and power cable rated for outdoor direct ground contact.

4.1.8.1 Power Cable shall meet M3432 Specifications equivalent to UL 62 and be rated “Heavy” duty. Cable shall be designed for use in electrical applications designed to withstand physical abuse. Heavy duty cables may be run over by heavy vehicles and are designed to withstand severe flexing. Cables must resist temperature extremes. Cable Corporation of America or Similar.

4.1.8.2 HOCC, shall be Class “L” waterproof rugged construction and either Military Spec or Commercial type. Contractor shall provide both the female connection and style for permanent mounted to the underside of the disconnect switch and the male connector at the power cable. Provide strain relief at HOCC. Amphenol or similar product.

4.1.8.3 SEE ATTACHMENTS for submittal information of existing systems.

4.2 At the core of the Mobile ECU design shall be a Commercial Off The Shelf (COTS) HVAC (Heating Ventilation and Air-Conditioning) unit. Contractor shall provide manufacture and model to match existing for parts interchangeability and local repair sourcing

4.2.1 York/ JCI

4.2.2 Provide aftermarket Cambridge Coil Guards. OEM coil guards are not sufficient.

4.9 The Mobile ECU HVAC unit shall have the following salient characteristics at a minimum:

4.9.1 Nominal 36,000 Btuh Cooling

4.9.2 SCR Control 10 KW Electric Heat

4. 9.3 High External Static Drive Fan with Adjustable Sheave.

4.9.4 MERV 8 disposable filters (provide 2 extra sets with each Mobile ECU)

4.9.5 Foam insulated panel construction, perforated liner or foil lined-fiberglass liner prohibited.

4.9.6 Adiabatic Proportioning Valve (Rawal or equal) for refrigerant control at part load condition.

4.9.7 Integral controls with weatherproof temperature adjustment setting. Integral digital controls to modulate supply air temperature based on return air measured at unit.

Additionally controls shall have high and low limit to prevent operation above 95 F supply air temp and below 53 F supply air temp. Set T-stat for (65F adjustable).

4.9.8 Integral weatherproof disconnect switch and additional integral weatherproof high use rated switch to enable/disable unit.

4.9.9 Unit designed to operate on 480V/ 3 Phase -60 Hz. See power cable requirements above.

4.10 The Mobile ECU cart and ancillary systems shall meet the following minimum requirements:

4.11.1 The Mobile ECU shall be designed and constructed to permit fork truck accessibility and transport on 2 sides. Center of gravity shall be taken into consideration when orienting the tube steel fork slots. Orientation shown on the sketch if for concept and may be altered by the contractor to protect ancillary equipment on the ECU from being damaged during a lift. There shall be no fork truck accessibility or transportability from the duct plenum side of the Mobile

ECU.

4.11.2 The frame shall be constructed of welded steel, minim 4 x 3 x 3/8” channel frame (short leg vertical and down to prevent water collection). Frame shall be full perimeter of mobile ECU including the plenum box. Provide intermediate bisecting frame member at the perimeter of the COTS HVAC unit. To support the ECU to the frame weld 2 x 2 x ¼” angle clips at no further than 36” on center spacing. Mechanically fasten HVAC unit frame to angle clips. Frame shall have intermediate 12 x 6 x 1/4” tube steel horizontal support members on the underside of the channel for the purpose of fork truck lifting. Spacing of tube steel to be 40” centerline. The Contractor shall use welded construction. Welding shall be per

ANSI/AWS D1.1-98. All frame components shall be primed and painted with two finish coats (color to match commercial HVAC housing) per MIL-F-14072. All workmanship shall be in accordance with (IAW) requirement 9 per MIL-STD- 454.

4.11.3 Provide 10” diameter casters at the bottom of the frame (mounted approximately 12” from the corners of the frame). All bearings, casters and wheels shall be sealed against dust, debris, and paint intrusion. Casters shall be designed and rated for exterior application and for the weight of the application. Stainless or hot dipped galvanized construction of exposed components for corrosion resistance.

Casters shall be locking for stationary placement once Mobile ECU is set into position.

4.11.4 The supply and return plenum boxes shall be constructed of G90 galvanized sheet metal in accordance with SMACNA standards. The plenums shall be lined with 1.5” think ‘Armaflex AP” or equal (fiberglass prohibited). Entire exterior of all sheet metal components hall be jacketed with self sealing aluminum foil jacket “Alumaguard” or equal.

4.11.5 Duct collars shall be 6” minim for field attachment of flexible exterior ductwork to RADAR assets. Existing Government exterior flexible ductwork used on the “tactical” ECUs may be used by the contractor to connect to the RADAR asset.

Contractor shall disconnect from “tactical” and install on the Mobile ECUs as necessary. Contractor may also be required to collar more than one section of “tactical” existing flexible exterior ductwork together if required.

4.11.6 Duct collars shall be supplied with opposed blade manual balancing dampers.

“Greenheck VCDRM” or equal.

4.11.7 Additionally a by-pass collar/damper shall be supplied internal between the supply and return plenum to bypass RADAR asset during balancing effort if required.

The adjustment of this damper shall be made initially at commissioning along with ALL other dampers and shall be locked and marked for normal operation.

Provide access door (weather sealed and insulated) for adjustment.

5.0 Record Documentation

5.1 The Contractor shall provide to the CPOC 3 ea. hardcopies of the Operation and Maintenance (O&M) Manuals and the O&M Manuals shall include data sheets for the components used to fabricate the Mobile ECU. The O&M Manuals shall contain a complete spare parts list and operator and maintenance instructions for operating and maintaining the entire Mobile ECU. The O&M Manuals shall contain complete detailed instructions and schedules for Mobile ECU PM. All documentation shall be provided to the CPOC prior to final acceptance being given.

5.2 Following testing completion and prior to Final Acceptance the Contractor shall furnish to the CPOC a computer-aided design and drafting (CADD) fabrication drawings of the frame unit.

The drawings shall be furnished in PDF format; in .dxf format; and in hardcopy, 11”x 17” paper size, in triplicate.

6.0 General Acceptance

6.1 The Contractor shall demonstrate and test the Mobile ECU with the CPOC as witness to the testing.

6.2 All defects encountered prior to or during the demonstration and testing shall be corrected by the Contractor. Only upon correction of the defect will the demonstration and testing be allowed to continue.

6.3 Only following the successful demonstration and testing of the Mobile ECU and the furnishing of all drawings and manuals to the CPOC will General Acceptance be granted to the Contractor.

7.0 Final Acceptance

7.1 Final Acceptance will occur upon acceptance in Wide Area Workflow (WAWF) of the Contractor’s submitted invoice by the CPOC. Final acceptance will be granted only after General Acceptance has been given to the Contractor and all terms of the contract have been successfully completed to the satisfaction of the CPOC.

8.0 Warranty

8.1 The Contractor shall warrant the Mobile ECU, all installation parts and all workmanship for a period of one (1) calendar year following Final Acceptance by the CPOC. During this warranty period all parts costs, labor costs, transportation and shipping costs, travel costs, tool costs and per diem for all Contractor personnel shall be the responsibility of the Contractor. The Contractor field repair technician shall arrive on-site within 72 hours after being contacted by TYAD personnel to make warranty repairs during the warranty period. The Contractor shall supply to the CPOC Contact Telephone Numbers and Points of Contact (POCs) for use by TYAD personnel for warranty, operations and maintenance questions and support.

9.0 Safety

9.1 See the attached Contractor Safety Standards for TYAD for additional information and requirements.

9.2 Coordinate installation with CPOC presence and follow general radiation hazard safety procedures for the installation. If unescorted, the Contractor will be required to attend an radiation Hazard safety briefing presented by the Government’s’ Health Physicist when working at the installation site. This briefing shall be coordinated through the CPOC.

9.3 The entire Mobile ECU shall meet all requirements set forth in OSHA General Industry Standards, current edition.

9.4 Prior to soldering, welding, torch cutting, and all forms of burning and use of open flame the Contractor shall be responsible to obtain a Burn Permit from the TYAD Fire Department. The Contractor shall use safety screens that offer the required level of protection for the type of work being performed and to provide protection for all personnel in the surrounding area.

10.0 Environmental

10.1 See the attached Standard Specifications for Projects Under the National Environmental Policy Act for additional information and requirements.

10.2 Use same refrigerant type as in existing mobile ECUs being emulated.

11.0 Additional TYAD Requirements

11.1 Removal of Contractor Materials. The Contractor shall remove from the work site prior to the acceptance of work by the Government, all materials not identified to remain in place, including excess paints, building materials, and equipment purchased by the Contractor for the execution of this project.

11.2 Storage of Materials and Equipment. Government furnished storage facilities are not available to the Contractor in the vicinity of the work site. The Contractor shall provide suitable storage facilities as required, located as approved by the COR, if the Contractor intends to leave materials and equipment in the work area overnight or on weekends. The security of the Contractor's property or his personnel's property shall be the full responsibility of the Contractor.

The Government will accept no liability in case of loss due to fire or theft.

11.3 Availability of Utility Services. The Government will furnish water and power in the quantity not to exceed the amount necessary for the normal execution of the work, at the nearest available outlet. The Contractor shall make all piping and wiring connections thereto and shall extend the services to the site of the work. On completion of the work, the Contractor shall remove all such temporary connections and any removed or damaged portions of the Government services at the points of connection shall be repaired or replaced.

A. Other Utilities: The Contractor shall make arrangements to obtain all utilities not furnished by the Government, at the Contractor’s expense.

B. The Government will not provide refuse facilities. The Contractor will be required to dispose of all garbage and other waste materials generated by his work at a licensed off-site landfill.

12.0 Security Requirements

12.1 A TYAD Local 648-C form for all personnel to include sub-contractors working under this contract shall be completed and submitted within 7 workings days prior to requiring access to TYAD in order to allow sufficient time to process security information. No Contractor personnel or Contractor’s subcontractor personnel will be permitted access to TYAD unless prior written approval is received from the TYAD Security. Background security approval shall remain in place throughout contract period of performance up to two years. Once individual is approved for access, daily temporary access badges will be assigned by security.

13.0 Depot Access

13.1 A background check and approval from TYAD Security Branch is required for all contractor and subcontractor personnel prior to on-site access at TYAD. All persons seeking entrance to TYAD shall submit to and comply with all security standards and requirements in force at the time such persons are seeking entry. All contractors, regardless of resident status or citizenship, will be subject to vehicle search and intense in-processing by TYAD security personnel prior to being granted access to TYAD. This security screening process may be time consuming and access may be delayed or denied. The contractor shall ensure ELTY Form 648-C is completed for all contractor and subcontractor personnel requiring depot access to include warranty services. The TYAD point of contact (POC) will provide ELTY Form 648-C, Request Access to Tobyhanna Army Depot, to the contractor/vendor at least ten days prior to the expected visit date for completion. The contractor/vendor shall return the completed ELTY Form 648-C to the TYAD POC in a timely manner so the same may be submitted to Security for processing no later than seven days prior to the visit. All of the required fields on the form shall be complete and accurate by the contractor/vendor for timely processing. This requirement is inclusive of on-site supervisory or managerial personnel and sub-contractor personnel that the Contractor anticipates will be performing work or visiting on-site. This security screening does not relieve the contractor of any responsibilities to conduct thorough pre-employment background checks and drug screening. Contractor workers will not be granted access to the work site until security screening is completed and access is approved. Any contractor personnel on-site who fail screening will not be permitted further access to TYAD. Submit the completed ELTY Forms 648-C form(s) to the CPOC.

14.0Antiterrorism (AT) / Operations Security (OPSEC) Requirements

14.1All security training certificates shall be provided to the Contracting Officer’s Representative (COR)/Point of Contact (POC) and the Contract Specialist/Purchasing Agent.

14.2Antiterrorism (AT) Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level I awareness training prior to contract report date. This training is required for any additional or new contractor employees, who start after that period. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR/POC within 10 calendar days after completion of training by all employees and subcontractor personnel. AT level I awareness training is available at the following website: https://jkodirect.jten.mil for CAC holders. Non-CAC holders may go to http://jko.jten.mil/courses/atl1/launch.html for their training. Upon request, the contractor will be provided one copy of the AT level I training slides for use with employees who may not have computer access. TYAD will not be responsible for printing copies of slides for training purposes. TYAD reserves the right to provide instructor led training and will so advise the contractor within one week of the start of performance or at the time of annual training, if that will be the training approach to be utilized. Completion of contractor employee training will be documented on ELTY form 583, TYAD On-Post Training Record, or contractor equivalent. As applicable, contractor employees must complete annual AT awareness training as it pertains the length of the contract.

14.3iWATCH Army Training. The contractor and all associated sub-contractors shall brief all employees on the local iWATCH Army Program. This will consist of utilizing the tools and media products on the informational iWATCH Army website to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR/POC. Additional guidance and support can be provided by the TYAD Antiterrorism Officer (ATO) at the contractor’s request. The contractor shall notify the COR/POC within 10 calendar days of the completed training for any new employees or subcontractor personnel to assure the ELTY form 583 or contractor equivalent is properly documented.

TYAD reserves the right to provide instructor led training and will so advise the contractor within one week of the start of performance or at the time of annual training, if that will be the training approach to be utilized. Completion of contractor employee training will be documented on ELTY form 583, TYAD On-Post Training Record or contractor equivalent.

14.4Operations Security (OPSEC) Training. Per AR 530-1, Operations Security, contractor employees must complete Level I OPSEC training prior to the contract report date and for any additional or new contractor employees, who start after that period. All contractor employees must also complete annual OPSEC awareness training available at the following website:

14.5Access and General Protection/Security Policy and Procedures.

Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by TYAD Security Branch. Contractor workforce must comply with all personal identity verification requirements as directed by DoD, HQDA, and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

14.6Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by the government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

It [ ] does, [ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(e) Disclosures.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

(a) Definitions. As used in this clause--

Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered foreign country means The People's Republic of China.

Covered telecommunications equipment or services means--

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means--

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:

(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.
