3.4.2.3. Installation or base operating support (BOS) contractor personnel must meet the state (in which the installation is located) (or local, if delegated authority by the state) qualification and licensing requirements. Where some form of licensing, certification, or approval is required, it shall be current in accordance with the state or local requirements, as applicable. All ITM and repair tasks will be accomplished under the supervision of a licensed craftsperson.

3.4.2.4. Other contractors performing ITM and repair tasks must meet the state (in which the installation is located, or local, if delegated authority by the state) qualification and licensing requirements. Where some form of licensing, certification, or approval is required, it shall be current in accordance with the state or local requirements, as applicable. The contractor must have at least one licensed supervisory employee present on the installation when contractor personnel are executing ITM and repair tasks.

3.4.2.5. General or equipment-specific qualification/endorsement provided by an equipment manufacturer for the manufacturer’s equipment.

3.4.3. Labor Standards. FAR 37.107 and 41 USC Chapter 67, Service Contract Labor Standards, provides for minimum wages and fringe benefits as well as other conditions of work under certain types of service contracts. Service Contract Labor Standards are applicable to this acquisition. Prevailing wage rates may be referenced at the following link: https://wdol.gov , Wage Determination 15-5797 (dated 01/16/2018) or the latest version, whichever is most recent.

3.4.4. In processing. Prior to the commencement of performance under the contract and within seven (7) workdays of contract award, the Contractor shall submit through the COR to the Chief, Security Division, TYAD, a roster of all Contractor personnel, inclusive of on-site supervisory or managerial personnel and sub-contractor personnel, that the Contractor anticipates will be performing work on-site.

3.4.4.1. Roster. The roster shall indicate which individuals are U.S.

citizens and which are resident aliens (immigrants). Due to limited availability of Government personnel, Contractors shall not be permitted to employ non-resident/non-immigrant aliens as part of the Contractor’s on-site workforce. The COR will forward an ELTY Form 648-C, “Request for Access to Tobyhanna Army Depot”, to be completed by each contractor employee seeking to gain access. Upon completing the forms, the contractor shall return them to the COR for processing and obtaining access to TYAD.

3.4.4.2 Non Resident/Non Immigrant Personnel. All non-

resident/non-immigrant aliens must have approval prior to being permitted access to TYAD. Such approval must be obtained by requesting access through the following:

apply at the alien-resident’s embassy; proceed to the U.S. Embassy; proceed to the Department of the Army; proceed to Army Materiel Command; proceed to U.S.

Communications-Electronics Command (CECOM); proceed to TYAD. All non-resident/non-immigrant aliens granted access to TYAD or assigned duty location are required to be escorted by Government personnel. One Government escort can accommodate a maximum of two non-resident/non-immigrant aliens. Due to limited availability of Government personnel, visitors requiring escort may not be permitted access, or access may be limited to a certain time and duration. The following documentation shall accompany the roster for each individual named on the roster as a resident alien (immigrant): a) a copy of a verifiable form of identification, such as a driver’s license or a passport; and b) a copy of a valid Department of Justice Immigration and Naturalization Service Form I-551, Alien Registration Receipt Card (“Green Card”). Contractors who fail to identify any and all resident aliens (immigrants) who will be used for onsite performance and who will seek access to TYAD or assigned duty location as a worker for or through the Contractor, inclusive of managerial and subcontractor personnel, may be subject to civil and criminal penalties and sanctions as well as contract remedies.

3.4.4.3. ELTY 648-C Processing. After the ELTY Form 648-C and required documentation have been processed (usually five days), the Government will notify the contractor of the personnel permitted to work on-site. However, actual access to TYAD will remain contingent upon being cleared. Resident alien (immigrant) individuals must present two (2) forms of identification in order to process into the Depot through the Security building: a valid Form I-551, Alien Registration Receipt Card (“Green Card”) in addition to at least one other verifiable form of identification.

3.4.4.4. Planning. It is understood that there is a strong likelihood that personnel changes may be necessitated. As a result, it is recommended that the contractor include access requests for those who may require access as a contingency or “backup” in order to avoid a processing delay and negative impact performance.

Security screening shall be completed on all contractor and all subcontractor personnel requesting access TYAD. No contractor personnel will be granted access to the worksite until security screening is completed and access approved. Personnel who the fail the screening will not be permitted further access to TYAD. Badges will not be issued to personnel unless they have been adequately vetted through the security screening process.

CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Award will be made on a best value basis using a hybrid source selection methodology with three (3) evaluation factors: Technical, Past Performance, and Price.

The Technical factor will include Planning, Scheduling and Reporting elements and will be evaluated on an acceptable/unacceptable basis. The Government reserves the right to eliminate any offer whose proposal is rated unacceptable under the Technical factor without further consideration.

If deemed Technically acceptable, Past Performance, with consideration given to Recency and Relevancy, will be considered more important than the Price factor. In the case of equal ratings, Price will be the deciding factor for the award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
