1.0 SCOPE

Scope: This Statement of Work (SOW) covers the manufacture, testing, packaging, and delivery of the following 5.56mm and 7.62mm SRTA cartridges:

5.56mm, M1037, SRTA, Clipped, NSN 1305-01-582-7499, DODIC AB67 (Lead free)

5.56mm, M1037, SRTA, Linked, NSN 1305-01-651-5896, DODIC AC10 (Lead Free)

7.62mm, M973 SRTA (Ball)Linked, NSN 1305-01-579-4056, DODIC AB60

7.62mm, M973 (Ball) SRTA/M974 (Tracer), 4B:1T Linked, NSN 1305-01-459-9535, DODIC AA37

The 5.56mm, M1037, SRTA are manufactured in linked and clipped configurations using Link, Cartridge, Metallic Belt M27 links. The 7.62mm

M973 (Ball) and M974 (Tracer) SRTA are manufactured and linked in a four (4) Ball to one (1) Tracer (4B:1T) (AA37) configuration as well as an all Ball configuration (AB60) using Link, Cartridge, Metallic Belt M13 links.

1.1 BACKGROUND

The 5.56mm, M1037 SRTA rounds shall provide a realistic training alternative to service ammunition in the M4/M16 and M249 family of weapons. The 7.62mm M973 SRTA and the 7.62mm M974 SRTA-T cartridges are fired from the M240B machine gun while being ballistically comparable to the M80 Ball service ammunition out to one hundred (100) meters (m) with a maximum range of six hundred (600) meters (m).

The 5.56mm and 7.62mm SRTA is used to conduct live fire training on scaled ranges, restricted maneuver areas, and Military Operations in

Urban Terrain (MOUT) scenarios.

3.0 REQUIREMENTS

The contractor shall deliver the 5.56mm Ball (M1037) SRTA Cartridges conforming to drawing 13028354 and U.S. Military Specification; MIL-

PRF- 32409 w/ AMENDMENT 1 dated 24 Oct 2016.

The contractor shall deliver the 7.62mm M973 (Ball) SRTA and M974 (Tracer) SRTA-T Cartridges conforming to drawings 12992286 and

12992285 and U.S. Military Specification, MIL-PRF-71167C w/ AMENDMENT 2 dated 01 Nov 2017. The contractor shall deliver the 7.62mm Ball

(M973) and Tracer (M974) SRTA in a linked 4 Ball to 1 Tracer configuration or All Ball linked configuration conforming to drawing

7268389 and U.S. Military Specification MIL-DTL-45403E, M13 Link, Cartridge, Metallic Belt, which will be specified in each individual delivery order.

Delivery dates and delivery locations will also be provided via contemplation letter prior to the time of award of each individual delivery order.

3.1 Manufacturing

3.1.1 First Article Testing (FAT)

The contractor shall fabricate a quantity of 5.56mm, M1037 SRTA ammunition IAW drawing number 13028354 and Performance Specification MIL-

PRF-32409 w/ AMENDMENT 1. The contractor shall manufacture a quantity of 7.62mm M973 (Ball) and M974 (Tracer) SRTA ammunition IAW drawing numbers 12992286 and 12992285 and U.S Military Performance Specification, MIL-PRF-71167C w/ AMENDMENT 2. The quantity to be produced shall be an amount that is a reflection of continual full rate production and sufficient to conduct First Article Testings

(FATs).

3.1.2 Lot Acceptance Test (LAT)

Upon successful completion and USG acceptance of the FAT, the contractor shall begin production and deliver the quantity as stated in the delivery order. A LAT shall be performed on each lot of ammunition IAW drawing number 13028354 and Performance Specification MIL-PRF-

32409 w/ AMENDMENT 1. A LAT shall be performed on each lot of ammunition IAW drawing numbers 12992286 and 12992285 and U.S. Military

Performance Specification, MIL-PRF-71167C w/ AMENDMENT 2. The quantities to be delivered shall be packaged and prepared IAW the terms of the contract. For Quality Conformance requirements see Section E of the contract. Lot Acceptance Testing shall be witnessed by U.S.

Government Representatives.

The contractor shall notify in writing the time and location of Lot Acceptance Test to the U.S. Government PCO a minimum of seventy-five

(75) calendar days prior to testing. If an unforeseen issue occurs and the Lot Acceptance Test must be delayed, the contractor shall submit an official letter to the PCO at least seven calendar (7) days in advanced acknowledging the cause for delay, in addition to the new Lot Acceptance Test date.

3.1.3 Ammunition Lot Numbering and Data Cards

Ammunition Lot Numbers and Ammunition Data Cards (ADC) shall be prepared and submitted IAW MIL-STD-1168C and DI-MISC-80043B and shall follow the format required by the worldwide web application identified as WARP or Worldwide Ammunition-data Repository Program at https://mhpwarp.redstone.army.mil . Prior to gaining access to WARP, the contractor/facility personnel involved in the preparation of ammunition data cards shall obtain a username and password for the Army Electronic Product Support (AEPS) network. You must click on

Access Request Form and continue through the steps until completion and click on SUBMIT. The individual is required to provide a supervisor name, email and phone number if the applicant is a Department of Defense (DOD) civilian or military. Government contractors are required to provide CAGE Code, Contract Number and Contracting Officers Representative (COR)/Contracting Officers Technical

Representative (COTR) with Government email address. All requestors must provide their Information Assurance Security Officers (IASO)

(formerly ISSO) name, e-mail, DSN phone and commercial phone. Contractor shall develop and submit sample ADC through WARP system 30 calendar days prior to First Article Testing or if initial FAT is waived, 30 calendar days prior to production.

3.2 Packaging

3.2.1 For the 5.56mm, M1037 SRTA, packaging shall be IAW Combination of Adopted Items (COAI) drawings 13028355 Rev D, 13028356 Rev A and

13061381 Rev -. Packaging shall be inspected IAW MIL-STD-644B as required. The contractor must use 5.56mm, M1037 SRTA M27 Links and clips. The Links shall be manufactured IAW drawing 11691287(Rev U) and the Clips shall be manufactured IAW drawing 11010483, 5.56mm, M1037 SRTA; DODIC AC10 (NSN 1305-01-651-5896): For Department of Defense Identification Code (DODIC) AC10 deliveries placed on contract by the USG, 5.56mm, M1037 SRTA cartridges linked with M27 links, which are manufactured IAW MIL-DTL-63532D, shall be packaged IAW COAI drawing 13061381. The contractor shall be responsible for all packaging materials required to meet the packaging configuration listed in drawing 13061381, as well as assembling them into the final configuration listed in drawing 13061381.

5.56mm, M1037 SRTA: DODIC AB67 (NSN 1305-01-582-7499): For DODIC AB67 deliveries placed on contract by the USG the M1037 SRTA cartridges shall be packaged IAW COAI drawing 13028355. The contractor shall be responsible for all packaging materials required to meet the packaging configuration listed in drawing 13028355, as well as assembling them into the final configuration listed in drawing 13028355.

For the 7.62mm M973/M974 SRTA 4B:1T, Linked, packaging shall be IAW COAI drawings 12982954 Rev C. For the 7.62mm M973 SRTA, Ball Linked, packaging shall be IAW COAI drawings 13025003 Rev -. 12991010 Rev B, 13025002 Rev -, and 13025003 Rev -. Packaging shall be inspected

IAW MIL-STD-644B as required. The contractor must use 7.62mm SRTA M973/M974 M13 links which shall be manufactured IAW drawing 7268389.

7.62mm M973/M974 SRTA; 4B:1T, Linked DODIC AA37 (NSN 1305-01-459-9535): For Department of Defense Identification Code (DODIC) AA37

deliveries placed on contract by the USG, M973/M974 SRTA cartridges linked with M13 links, which are manufactured IAW MIL-DTL-63532D

U.S. Military Specification MIL-DTL-45403E, M13 Link, shall be packaged IAW COAI drawing 12982954 Rev C. The contractor shall be responsible for all packaging materials required to meet the packaging configuration listed in drawing 12982954 Rev C, as well as assembling them into the final configuration listed in drawing 12982954 Rev C.

7.62mm SRTA; DODIC AB60 (NSN 1305-01-579-4056): For Department of Defense Identification Code (DODIC) AB60 deliveries placed on contract by the USG the M973 SRTA cartridges shall be packaged IAW COAI drawing 13025003. The contractor shall be responsible for all packaging materials required to meet the packaging configuration listed in drawing 13025003, as well as assembling them into the final configuration listed in drawings 13025003.

3.3 Quality Assurance Provisions

3.3.1 Quality System Plan

The contractor shall implement and maintain a quality system plan approved by the Government that meets or exceeds the standards established by International Organization for Standardization (ISO) 9001-2015 Quality Management.

Systems Requirements. The quality program shall encompass all technical and manufacturing aspects of production, related engineering designs and materials utilized. All supplies under this contracting action, whether manufactured, performed within the contractor's plant or from any other source, shall be controlled at all points necessary to assure conformance to contractual requirements.

3.3.2 Qualified Design Requirement

If a contractor has a design qualified by the U.S. Government IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2, then the contractor shall perform a First Article Test (FAT) and submit a FAT report within one hundred forty (140) calendar days of contract award. Upon receipt of USG approval of FAT results, the contractor shall start contract deliveries within ninety (90) calendar days.

3.3.3 Qualification of New Design

All new designs (designs which have not yet been qualified by the USG) shall be qualified IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-

71167C w/ AMENDMENT 2, Design Verification Test (DVT), at the expense of the contractor (See SOW section DVT). All test data and supporting documentation to verify compliance IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2, shall be submitted to the USG with the contractors proposal. If a contract is awarded, then the contractor shall perform a DVT IAW MIL-PRF-32409 w/ AMENDMENT

1 and MIL-PRF-71167C w/ AMENDMENT 2 and submit DVT report within ninety (90) calendar days of contract award.

3.3.4 Qualified Design Requirement

The cartridges to be delivered under this contract shall be of a design that has been confirmed by the US Government to be fully qualified IAW MIL-PRF-71167C w/ AMENDMENT 2. Any proposed changes to the previously qualified designs shall require approval by the USG prior to delivery under this contract. Approval shall require the contractor to submit data supporting the qualification of a modified design. All required test data and related documentation to support qualification of the new design IAW MIL-PRF-71167C w/ AMENDMENT 2 shall be submitted to the Government for review. The Government will review the submission of any supporting data and documentation and will provide a determination whether it is sufficient to warrant U.S. Government qualification.

3.3.5 Changes to a Qualified Design (during contract execution)

Any proposed changes to a qualified design, during contract execution shall require review and approval by the USG prior to production of the modified design. Additional qualification testing at the contractors expense may be required to qualify proposed changes. The USG will review the submission of any proposed changes and will provide a determination as to what additional qualification testing shall be required. All required test data and related documentation to support the change shall be submitted to the USG for review and approval.

The USG shall review the submitted information and shall determine if the modified design meets the qualification requirements.

3.4 Initial FAT

3.4.1 First Article Test (FAT)

The contractor shall produce a first article production lot IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2. Lot numbering shall be IAW MIL-STD-1168C. The contractor shall submit the first article test sample IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-

PRF-71167C w/ AMENDMENT 2. The contractor shall prepare and submit the results of first article tests and inspections IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2 and all applicable contract clauses. The contractor shall prepare for an Initial FAT-

Physical Configuration Audit (PCA). This PCA shall be performed in conjunction with the FAT and inspection to evaluate the degree to which the components and assemblies conform to the requirements of the drawings and specifications. Cartridges and components shall be produced by equipment and processes that will be utilized for full rate production.

The contractor shall perform a packaging specific FAT through presenting a static display to the USG of packed and marked cartons, ammunition containers and wirebound boxes. If a representative of the DEVCOM-AC Packaging Division cannot be present for the FAT than photographs of the display shall be submit for review and approval.

Inspection results shall validate 100% of all drawing dimensions and characteristics with actual variable data. The contractor shall identify and provide descriptions IAW DI-QCIC-81960, MSE of any special equipment used to perform the required inspections and tests of

MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2 for 5.56mm M1037 SRTA and 7.62mm SRTA. The contractor shall notify the

PCO seventy-five (75) calendar days prior to FAT testing. In addition, FAT testing shall be witnessed by USG Representatives. Approval of the FAT data shall be the responsibility of a USG Quality Assurance Representative via written notification from the PCO. The contractor shall supply the Quality Acceptance Data IAW Test/Inspection Report (DI-NDTI-80809B). If an unforeseen issue occurs and the

FAT must be delayed, the contractor shall submit an official letter to the PCO acknowledging the cause for delay no later than seven (7) calendar days prior to the scheduled start date of the delayed FAT in addition to proposing a new FAT date and schedule.

A FAT shall be conducted each time there is a change in manufacturing processes, equipment, manufacturing location, materials used in the fabrication of the ammunition, or a production shutdown of more than ninety (90) days. During the course of this contract, the contractor shall notify the USG of any other proposed changes to the manufacturing processes, equipment, manufacturing location, or materials. The USG will determine at that time if a FAT (or partial FAT) will be required to certify the change. Any USG determination shall be provided in writing from the PCO. The contractor shall provide certification of data IAW Certification Data Report DI-NDTI-

80809B. The contractor shall provide First Article Test Plan (DI-NDTI-81307A) and a First Article Test Report (DI-NDTI-80809B).

3.4.2 FAT-PCA

The contractor shall produce a first article production lot IAW MIL-PRF-71167C w/AMENDMENT 2 and MIL-PRF-32409 W/ AMENDMENT 1. The contractor shall submit the FAT sample IAW MIL-PRF-71167C w/AMENDMENT 2 and MIL-PRF-32409 w/ AMENDMENT 1. The contractor shall prepare and submit the results of first article tests and inspections IAW MIL-PRF-71167C w/ AMENDMENT 2 table III and MIL-PRF-32409 w/ AMENDMENT

1 table V. The contractor shall prepare for a PCA to be conducted for the Government. The PCA shall be performed in conjunction with the first article tests and inspections to evaluate the degree to which the components and assemblies conform to the requirements of the drawings and specifications. Inspection results shall validate 100% of all drawing dimensions and characteristics with actual variable data. Following the initial FAT-PCA, with Government approval, future PCAs shall be done when components or drawings have changed. The

Government reserves the right to request a PCA throughout the period of performance of the contract. The contractor shall identify and provide descriptions of any special equipment (DI-SESS-81004F) used to perform the required inspections and tests of MIL-PRF-71167C w/

AMENDMENT 2 and MIL-PRF-32409 w/ AMENDMENT 1. The contractor shall notify in writing to the U.S. Government Procurement Contracting

Officer (PCO) seventy-five (75) calendar days prior to FAT-PCA testing. FAT-PCA testing shall be witnessed by U.S. Government

Representatives. Approval of the FAT-PCA shall be the responsibility of the PCO. The contractor shall supply the Quality Acceptance data

IAW DI-NDTI-80809B (tailored). If an unforeseen issue occurs and the FAT-PCA must be delayed, the contractor shall submit an official letter to the PCO at least five (5) days in advanced acknowledging the cause for delay, in addition to the new FAT-PCA date. For FAT requirements, see Section E of the contract.

3.5 Physical Configuration Audit (PCA)

A Physical Configuration Audit (PCA) shall be performed to administer the development and refinement of the contractors initial

Technical Data Package (TDP). For offerors that were previously qualified by the USG, the PCA will be based on the TDP of the qualified design. For offerors submitting DVT results to obtain qualification, the PCA will be based on the TDP of the DVT sample.

The PCA shall be performed by examination and measurement using Standard Measurement Equipment (SME) to verify that the product baseline has been established and is complete. Objective evidence shall be provided to demonstrate that the material used is the same as the material qualified during DVT or previously qualified by the USG. There shall be no discrepancies between the samples and their corresponding configuration descriptions (drawings, specifications, etc.).

The PCA shall be performed on the following:

a. Ten (10) complete cartridges.

b. Ten (10) of each component used to produce a cartridge. If more than one (1) piece of equipment is used to produce a component, then five (5) components from each piece of equipment will be subject to a PCA evaluation. If mold or die has more than one (1) cavity, five

(5) pieces shall be evaluated from each cavity. At the conclusion of the PCA, a Configuration Audit Report shall be completed within 30 days IAW DI-SESS-81022D.

c. The Government reserves the right to perform a PCA of the contractor throughout the period of performance of the contract provided that the Government gives thirty (30) days notice on a non-interference basis.

d. Configuration Audit Plan (DI-SESS-81646) shall be provided to the US Government within 30 days of a planned PCA for approval.

3.6 Design Verification Testing (DVT)

Contractors submitting test data and supporting documentation to satisfy the Request for Proposal (RFP) requirements for qualification of a new design shall produce and test a DVT sample IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-71167C w/ AMENDMENT 2, at the contractors expense. Results of the DVT, to include all test data and supporting documentation to verify compliance IAW MIL-PRF-32409 w/

AMENDMENT 1 and MIL-PRF-71167C w/AMENDMENT 2, shall be submitted to the PCO to be reviewed and evaluated by the USG prior to close of the solicitation. Within forty-five (45) calendar days of receipt of all DVT data and supporting documentation, the PCO will provide a written determination concerning the qualification status of the contractors design.

Successful completion of DVT shall constitute the product baseline. Once the product baseline is established, any change of design, material, or manufacturing process shall require additional testing to establish a new product baseline. At this time, defects inherent to that particular design shall be established and defined as either a minor, major, or critical defect. There shall be no discrepancies between the samples and their corresponding configuration descriptors (drawings, specifications, etc.). For each key characteristic, establish tolerances (upper and lower limits) that do not exceed any of the measurements obtained from the samples. These tolerances shall be used for evaluating variability of key characteristics test conducted during conformance verification.

Key characteristics fall into two categories: (1) those relating to the product, and (2) those inherent in the manufacturing process.

They include performance, features, reliability, conformance, durability, serviceability, aesthetics, quality, and safety. The contractor shall provide a technical report IAW (DI-MISC-80508B) detailing the key characteristics and established tolerances to be submitted with their proposal. Following the sample meeting all requirements of the DVT IAW MIL-PRF-32409 w/ AMENDMENT 1 and MIL-PRF-

71167C w/AMENDMENT 2, a Physical Configuration Audit (PCA) and a Configuration Audit Plan shall be provided within 10 calendar days of a

PCA. Configuration Audit Plan (DI-SESS-81646) shall then be performed to administer the development and refinement of the contractors initial Technical Data Package (TDP). This PCA shall be performed by examination and measurement using Standard Measurement Equipment

(SME) to verify that the product baseline has been established and is complete. Evidence shall be provided to demonstrate that the material used is the same as the material qualified during DVT. There shall be no discrepancies between the samples and their corresponding configuration descriptions (drawings, specifications, etc.). Discrepancies may result in rejection of portions and possibly all DVT data. Additional testing may be required.

3.7 Lot Acceptance Test (LAT)

The contractor shall satisfactorily perform a LAT (DI-QCIC-80553A) each lot of ammunition manufactured. The contractor shall submit the

Quality Conformance sample IAW MIL-PRF-32409 w/ AMENDMENT 1. The contractor shall prepare and submit the results of LAT and inspections

IAW 5.56mm SRTA MIL-PRF-32409 w/ AMENDMENT 1 and 7.62mm SRTA MIL-PRF-71167C w/ AMENDMENT 2. Resulting test data including any anomalies encountered during the testing of any accepted product shall be provided in a test report and uploaded in the Worldwide Ammunition

Repository Program (WARP) (Test/Inspection Report) (DI-NDTI-80809B) Tailored. The LAT shall be witnessed by USG Representatives.

3.8 Engineering Change Proposals (ECP) & Value Engineering Change Proposals (VECP)

The contractor (or subcontractor) shall not make any changes to designs, drawings, specifications, or inspection plans without written approval from the PCO. The contractor shall submit all ECPs & VECPs IAW (DI-SESS-80639E). The contractor shall submit to the PCO for review and written approval any changes to the contractor or U.S. Government drawings, specifications, or inspection plans. Any submission shall address ozone depleting chemicals (ODCs), as required by Public Law 102-484, Section 326.

3.8.1 ECPs

The contractor shall perform and submit an analysis of all ECPs IAW (DI-SAFT-80103C). The contractor shall analyze each ECP (as specified by the managing activity) to determine the hazards associated with it, assess the associated risk, and predict the safety impact of the ECP on the existing item. The contractor shall notify the managing activity when an ECP will decrease the level of safety of the existing system.

3.8.2 Notice of Revision (NOR)

The contractor shall submit all NORs IAW (DI-SESS-80642E). The contractor shall submit to the Government for review and approval any changes to the contractor or Government drawings, specifications, or inspection plans as documented by a NOR. Written approval shall be obtained from the PCO prior to the implementation of proposed changes detailed in the NOR. Any submission shall address ozone depleting chemicals (ODCs), as required by Public Law 102-484, Section 326.

3.8.3 Request for Variance (RFV)

The contractor shall perform and submit an analysis of all RFVs IAW (DI-SESS-80640E). The contractor shall analyze each request for deviation/waiver to determine the hazards and assess the risk of the proposed deviation or waiver of a requirement, or a specified method or process. The change in the risk involved in accepting the deviation or waiver shall be identified. When the level of safety of the system will be reduced by deviation from, or waiver of the requirement, method, or process, the managing activity must be notified.

4.0 Certificate of Compliance

Each time a lot of cartridges are submitted for acceptance, the contractor shall provide records to indicate all materials for the

manufacturing of the munitions are in compliance with the materials, construction and design requirements specified in the TDP or specification. A Certificate of Compliance shall be prepared and submitted to the U.S. Government PCO an

DI-MISC-81356A.

4.1 Measurement System Evaluation (MSE) - See section E of contract

Measurement System Evaluation (MSE): To facilitate a Measurement System Evaluation, the contractor shall provide all Acceptance

Inspection Equipment (AIE) necessary to ensure conformance of components and end-items to contract requirements, Quality Assurance

Provisions, and all documents specified in Paragraph 2.0 above. The MSE package shall be submitted for approval and made available to the U.S. Government (DI-QCIC-81960) 60 days prior to commencement of the FAT and PCA.

4.2 Safety

4.2.1 Critical Characteristics

The Contractor shall submit a Critical Characteristics Control Plan (CCCP) (DI-MGMT-81986) and a Safety Critical Items/Characteristics report (DI-SAFT-80970A). The Contractor may submit a Critical Plan Of Action (CPOA) for Government approval (DI-MGMT-81996).

4.2.2 Accident/Incident Report

The contractor shall report immediately to the QAR, COR, and PCO any major accident/incident (including fire) resulting in any one or more of the following: causing one or more fatalities, or one or more disabling injuries; damage of USG property exceeding $10,000;

affecting program planning or production schedules; degrading the safety of equipment under contract, such that personal injury or property damage may be involved; identifying a potential hazard requiring corrective action. The contractor shall prepare the report IAW (DI-SAFT-81563) for each incident.

4.2.3 Safety Assessment Report (SAR)

If the item has NOT been previously fielded by the USG and the item is going to be tested at a USG facility, the contractor is required to perform a safety assessment of the item at no cost to the USG, IAW (DI-SAFT-80102C) and deliver a SAR to the USG. If any changes are made to the item and the USG will be performing additional testing, then the contractor shall draft a new safety assessment at the contractors expense. The SAR shall be submitted to the PCO, and approved by the USG prior to the shipment of any test articles. The SAR shall contain results from the contractors safety assessments, hazard analyses, and testing IAW (DI-SAFT-80102C) and (MIL-STD-882E).

4.2.4 System Safety and RFV Requirements

The contractor shall perform and submit an analysis of all ECPs IAW (DI-SAFT-80103C), the contractor shall analyze each ECP (as specified by the management activity) to determine the hazards associated with it, assess the associated risk, and predict the safety impact of the ECP on the existing item. The contractor shall notify the managing activity when an ECP will decrease the level of safety of the existing system.

RFVs that compromise system safety shall be submitted IAW (DI-SAFT-80104C). The contractor shall analyze each request for deviation/waiver to determine the hazards and assess the risk of the proposed deviation from or waiver of a requirement, or a specified method or process. The change in the risk involved in accepting the deviation or waiver shall be identified.

4.2.5 Final Hazard Classification

For energetic materials or energetic items from a foreign country, the foreign company shall provide a specific hazard classification.

This specific hazard classification information should include at minimum a letter from the competent authority. This letter shall be issued in accordance with Part 2, Chapter 2.0 and Chapter 2.1, paragraph 2.1.2 of United Nations -Transport of Dangerous Goods

ST/SG/AC.10/1/ (Latest Revision). The letter shall approve the hazard and compatibility group assignment and assign the appropriate shipping name to the energetic material or energetic item. If available, the test data from running UN Test series 4(a), 4(b) (ii), 6(a) or 6(b) and 6(c) shall be obtained. The above information and test data shall be provided to the U.S. Army DEVCOM-AC, ATTN: FCDD-ACE-

QSF, Picatinny Arsenal, NJ 07806-5000 (DI-MISC-80508B).

4.2.6 Interim Hazard Classification

The contractor may, at his option, utilize the capability of DEVCOM-AC to obtain Interim Hazard Classification (IHC) for shipment of R&D quantities of energetic materials/items in support of this contract. If the contractor elects to use DEVCOM-AC for this support, the contractor will need to provide technical data to DEVCOM-AC 60 days prior to shipment of the energetic materials/items. The necessary data is explained in Army Technical Bulletin (TB) 700-2, (DI-SAFT-81299C) and (DI-MISC-80508B). DOT and UN serial number information and packaging method is available in Title 49, Code of Federal Regulations.

4.2.7 Material Safety Data Sheet

1. The contractor shall send the Material Safety Data Sheets (MSDS) (DI-MISC-80508B) as required to the Contracting Officer and a copy with the first delivery of supplies to Commander, U.S. Army DEVCOM-AC, ATTN: System Safety Engineering, FCDD-ACE-QSC, Bldg. 62., Picatinny Arsenal, NJ 07806-5000 , required by FAR 52.223-3, Hazardous Material Identification and Material Safety Data.

2. Deliveries of any hazardous chemicals/materials will not be accepted when:

a. The applicable MSDS is not delivered with the first delivery of the supplies; and/or

b. The container label on the supplies is inadequate, unreadable, missing, or does not agree with the accompanying MSDS.

4.3 Environmental

4.3.1 The Contractor must conduct all activities in compliance with federal, state, and local environmental laws and regulations as well as international treaties and agreements. The Contractor shall use internal plans and processes to assure that all contract activities are performed in compliance with environmental laws, regulations, international treaties and agreements.

4.3.2 The Contractor shall establish, implement and maintain a HMMP Plan using Section 4 through Section 5.2.11 of NAS411 (Revision 4) as a guide. The HMMP Plan, at a minimum, shall identify and describe the organizational relationships and responsibilities for eliminating hazardous materials, define the process used to identify the hazardous materials utilized in the manufacturing process, and establish prioritization criteria for ranking the relative risks of these hazardous materials. Prohibited, restricted and tracked

Hazardous Materials are listed in NAS411-1. The HMMP (DI-MGMT-81398D) shall be electronically delivered to the Government one (1) month after contract award and updated upon any change in hazardous material use.

4.3.3 The contractor shall prepare an HMMP Report using Section 5.3 of NAS411 (Revision 4) as a guide. The HMMP Report, at a minimum, identifies all hazardous materials required for system production, provides a listing of prioritized hazardous materials for minimization/elimination per the criteria established in the HMMP, and identifies those hazardous materials/processes for which non-hazardous substitute materials/technologies may be available for implementation. Prohibited, restricted and tracked Hazardous Materials are listed in NAS411-1.The HMMP Report (DI-MISC-81397) shall be electronically delivered to the Government two (2) months after contract award and updated upon any change in hazardous material use.

4.3.4 Hazardous Waste Report. The contractor shall identify the specific types and amounts of hazardous waste being generated under this

Agreement. If it is determined by the contractor that hazardous waste will be generated under this Agreement, the contractor shall prepare a Hazardous Waste Report, in accordance with the CDRL requirements for DI-MGMT-82129. The first submission of the Hazardous

Waste Report will be 30 days after contract award. Updated Hazardous Waste Reports shall be submitted on a yearly basis thereafter until the end of the contract.

4.3.5 The contractor shall establish a Pollution Prevention Plan (DI-MISC-80508B Tailored) to minimize program environmental and cost impacts and ensure that all pollution that cannot be prevented will be recycled or disposed of in an environmentally safe manner. The contractor shall define the process they will use to identify the pollution prevention initiatives which will reduce or eliminate hazardous materials in the performance of the contract. The plan shall describe the analysis techniques that will be used to evaluate the risks associated with identified non-hazardous materials/process substitutes to ensure no detriment to performance. The plan shall include the contractors process for materials/process selection and evaluation. The contractor shall define their overall process for assigning responsibility to analyze and document the potential cost associated with trading a hazardous material for a less hazardous material over the life cycle of the product. The Pollution Prevention Plan (DI-MISC-80508B Tailored - other than the format requirements outlined in DI-MISC-80508B, the contractor may choose the format of the Report.) shall be electronically delivered to the Government two

(2) months after contract award.

4.3.6 Consideration should be given to alternative materials and processes in order to eliminate, reduce, or minimize hazardous materials usage and disposal. This is to be accomplished while minimizing item cost and risk to item performance.

4.3.7 The contractor shall not use Class I or Class II Ozone Depleting Chemicals (ODCs) in the execution of this contract. Any other use of ODCs shall be addressed, as required, by Public Law 102-484, Section 326.

4.4 Configuration Management

Both the 5.56mm M1037 SRTA and 7.62mm M973 (ball) and M974 (tracer) SRTA rounds shall meet all of the requirements of their respective technical drawings. The 7.62mm SRTA rounds shall meet technical drawings 12992286 and 12992285 and U.S. Military Performance

Specification, MIL-PRF-71167C w/ AMENDMENT 2 (dated, 01 Nov 2017). The 5.56mm M1037 SRTA shall meet all of the requirements of drawing

13028354 and U.S. Military Specification; MIL-PRF-32409 w/ AMEDNMENT 1 (dated, 24 Oct 2016). Any changes to the previously qualified designs that are on file with the USG shall require written approval from the PCO. Additional qualification testing at the contractors expense may be required to qualify design changes. A Configuration Management Plan shall be provided within 30 days of contract. It shall be in contractor format and in accordance of the contractors processes and procedures or as specified in the contract (DI-SESS-

80858D).

For the duration of the contract any proposed changes to a previously qualified design shall require review by the USG and written approval by the PCO prior to production of the modified design. Additional qualification testing at the contractors expense may be

required to qualify proposed changes. The USG will review the submission of any proposed changes and will provide a written determination from the PCO as to what additional qualification testing will be required. All required test data and related documentation to support the change shall be submitted to the PCO for review. If the modified design meets the qualification requirements, the PCO shall provide written approval.

Technical Data Package (TDP): The contractor shall provide the TDP of the item to the USG within forty-five (45) days after contract award. The complete TDP shall include detailed engineering drawings and specifications for all cartridge components, subcomponents, and critical interim process steps. These shall include, but are not limited to: material specifications, process descriptions, critical physical characteristics, chemical compositions, and sources of supply for critical items. If the initial contractor (or subcontractor) submission is deemed inadequate by the USG, the contractor (or subcontractor) shall deliver additional information as requested by the

USG. The contractor TDP shall be proprietary to the contractor and it shall be used solely for configuration verification purposes. The

TDP shall be submitted in accordance with MIL-STD-31000.

4.5. Technical Data Package (TDP) Data Rights

4.5.1 The contractor shall submit the terms under which the U.S. Government will obtain the rights to the complete TDP containing the information stated below. The negotiated price of the TDP shall have a unique Contract Line Item Number (CLIN). If the initial contractor TDP submission is deemed inadequate by the U.S. Government, within the terms of the license agreement, the contractor shall deliver additional information as requested by the U.S. Government.

4.5.2 If the U.S. Government exercises the CLIN to purchase the rights to the complete TDP, the contractor shall deliver to the U.S.

Government a copy of the complete TDP for the manufacture of this cartridge within one hundred twenty (120) days. The TDP shall consist of a comprehensive set of technical documents, which fully describe the cartridge in order to implement and sustain full-scale production of the item IAW (DI-SESS-80776B). It is required that all data be submitted in the U.S. English language using U.S. English foot-pound-inch measurements and converted to applicable American Society for Testing and Materials (ASTM) http://www.astm.org/ and other U.S. specifications and standards.

4.5.3 The complete TDP shall include detailed engineering drawings and specifications for all cartridge components, subcomponents, and critical interim process steps, see MIL-STD-31000. In addition, the contractor shall provide material specifications, critical physical characteristics, chemical compositions, quality assurance provisions and sources of supply for all items.

Configuration Control: Configuration control shall be maintained, by the USG, over the production of the ammunition. The contractor shall submit to the USG any proposed changes to the qualified design that successfully passed the DVT. If the contractor proposes a change to the product baseline, the contractor shall submit to the USG evidence demonstrating the item requirements continue to be met.

Contractors may be required to provide additional test data performed at their facility or at an approved USG facility at the contractors own expense. The USG reserves the right to witness and/or participate in any testing. For the duration of the contract any proposed changes to a previously qualified design shall require review and approval by the U.S. Government PCO prior to initiation of the production of the modified design. Additional qualification testing at the contractors expense may be required to qualify proposed changes. The Government will review the submission of any proposed changes and will provide a written determination from the PCO as to what additional qualification testing will be required. All required test data and related documentation to support the change shall be submitted to the Government PCO for review and approval. The Government shall review the submitted information and shall determine if the modified design meets the qualification requirements.

4.6 Physical And Transportation Security

The contractor shall provide adequate physical, transportation and informational security of Government Property including test hardware, weapons, ammunition, technical data and proprietary information. The contractor shall protect sensitive conventional arms, ammunition, and explosives (AA&E) manufactured for the Government or provided as Government Furnished Equipment/Government Furnished

Material (GFE/GFM) in accordance with the standards in DoDD 5100.76-M and AR 190-11. The contractor shall provide USG officials access to prime and subcontractor facilities so that regulatory surveys, inspections, and investigations can be conducted. This applies to all items being developed, produced, or manufactured for the USG and items furnished or released to the contractor as GFE/GFM for this contract.

4.7 Security Requirement
