Q1. Bonding - Page 1 of 54 (Standard Form (SF) 1442 Section 12A) indicates performance and payment bonds are not required, but Section 52.228-13 (page 25 of 54) states a payment bond or an irrevocable letter of credit is required. Does this mean a payment bond or irrevocable letter of credit is required and the contractor will be reimbursed for actual costs upon proof of payment as discussed in Item 0002 page 5 of 54?

A1. Yes, cost to contractor for type of payment protection provided in accordance with FAR clause 52.228-13 will be reimbursed at actual cost to contractor upon proof of payment, not to exceed amount of line item.

Please reference 52.228-13 Alternative Payment Protections which states in part “(a) The Contractor shall submit one of the following payment protections:

A payment bond

An irrevocable letter of credit

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 10 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

Q2. Section 11.4 Demo - Sections 11.4.2 and 11.4.3 - Page 46 of 54. Can you confirm that piping will not need to be removed or replaced between inlets I-2, I-3, I-4 and I-5.

A2. There are no known issues with piping between inlets I-2, I-3, I-4, I-5 to indicate replacement is necessary. If damage is discovered upon execution of the contract it can be addressed at that time.

Q3. Section 11.5 Install - Section 11.5.2 - Page 46 of 54. If applicable, can the contractor upgrade “patch” areas that are currently asphalt covered and convert to concrete covering?

A3. Yes, patches can be made with concrete provided finished surface is flush with surrounding.

See Revised Specification of Work (SOW) dated 8 August 2019, para. 11.5.2

Q4. 1. Drawing F-441-90-05 shows downspout 7 to be installed at a location currently occupied by a communication/electric conduit (see picture below).

A4. Downspout 7 can be in the same location as current downspout.

See Attachment WV009-_Clarksburg_-_C09-_CSS_9242_ _Proposed_Downspout__ground_drain_locations.

Q5. Downspout 6 ties in to the downspout 7 location. Is the intent of the line between 6 & 7 of the downspout storm line to go close to the building and under A/C unit with pipe bollards removed and reinstalled, or should we step out from building to miss this (see picture below)?

A5. Line between 6 and 7 can step out to avoid A/C unit and bollards.

See Revised SOW dated 8 August 2019, para. 11.4.2

Q6. Can a detail for the 8” downspout connection turn-up at base of building to new storm line be provided?

A6. A detail cannot be provided. It is the contractor's choice, to be approved by Regional Facility Operations Specialist/Contracting Officer Representative.

Q7. Can the downspout connection at the base of the building be reduced from an 8” to a 6”?

A7. A 6" connection to the 8" pipe at the building base may be used.

See Revised SOW dated 8 August 2019, para. 11.5.4

Q8. Are the old drain lines to be abandoned in place and sealed with grout or dug up and removed?

Some are in line with bollards that would have to be removed and reinstalled in addition.

A8. Old drain lines that are not in interference with new work may be abandoned in place and sealed.

See Revised SOW dated 8 August 2019, para 11.4.3

Q9. The main storm drain line to MH-1 according to appendix B appears to be plugged (identified on overhead satellite photo). Is this line to be replaced?

A9. There are no known issues with the main storm drain line indicating that it needs to be replaced.

Q10. Can a detail be provided for the asphalt and concrete repair?

A10. Please reference the Revised SOW dated 8 August 2019, which states any asphalt or concrete that is cut in the execution of this project is to be patched to match. However, it is acceptable to make all repairs with concrete provided finished repaired surface is flush with surrounding.

Q11. At the site visit it was noticed that multiple bollards run close and adjacent to the building. Is the intent to run the new drain lines close to the building which will require the bollards to be removed and reinstalled, or can the lines be kicked out to avoid the bollards?

A11. Lines can be "kicked out" to avoid bollards.
