1. It is the offeror’ s responsibility that all offers submitted, regardless of method of submission, are received in this office prior to the time and date for receipt of the offer. All quotes/offers are due no later than the date specified in the solicitation.
1. Basis of Award: The Government intends to award a firm fixed-price (FFP) contract resulting from this solicitation. Award will be made on all or none basis. Award shall be made to a single contractor. Quotes must include prices for each item listed in order that quotes may be properly evaluated. Failure to do so shall be cause for the offeror to be considered non-responsive. Award shall be made to that responsive, responsible offeror, and will be based on lowest price meeting technical specification.
1. FOB Destination, Vendors must include CAGE code, Duns number, TIN, GSA Contract/SIN/item number, warranty terms. Quote should include FOB Destination pricing; freight should not be listed separately. No Open Market Quotes.
1. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
1. Quotes must include the following information: Price: pricing for each Line Item. Pricing must be submitted in the proper format. The proper format consists of QUANTITY * UNIT AMOUNT = NET AMT. In the event there is a difference between a unit price and the extended total, the unit price will be held to the intended price. If the offeror shows only the total price but fails to enter a unit price, the total divided by the estimated quantity will be held to be the intended price.
1. The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items necessary to provide the contracted supplies.
1. Contractors shall quote on all CLINS. CLIN pricing should be all inclusive of labor, labor burden, other direct cost (material, equipment, fees, licenses, etc), G&A and profit.

1. Due to restricted access to Fort Dix, contractors that will be hand carrying their quote are required to submit to the contracting officer a list of personnel planning to deliver the package not later than 24 hours prior to the due date. Contractors must also furnish the approximate time of arrival and the gate they will utilize. Contractors are cautioned that there may be delays at the gates and should allow adequate time for entering the installation to ensure packages are received prior to the time and date for receipt of quote. All individuals must have a picture id and no substitutions are authorized. Vehicles are also subject to search.
1. This project is small business set aside under NAICS 561730 with the business size standard of $7,500,000.
1. Quotes shall be valid for 30 days unless specified.
STATEMENT OF WORK
1.0 General Information.
1.1 Overview. The Contractor shall inspect, service, maintain, and landscape grounds of USAG Fort Devens Reserve Forces Training Area (DRFTA). The work shall include the services described below. Additional clarification/directed may be provided by the Contracting Officer’s Representative (COR) or Alternate Contracting Officer’s Representative (ACOR). The Contractor shall provide all labor, equipment, materials, management, coordination, and supervision necessary to maintain the grounds to the standards specified herein.
1.2 Management and Supervision. The Government and the Contractor understand and agree that the services to be delivered are non-personal services, and both parties recognize and agree that no employer-employee relationships exist between the Government and the Contractor and/or between the Government and the Contractors employees. Contactor personnel performing under this contract shall not be placed in a position where they are employed by a Federal Officer or are under the supervision, direction, or evaluation of a Federal Officer, military or civilian. The Government will neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances will the Government assign tasks to, or prepare work schedules for, contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against actions that are of the nature of personal services, or give the perception of personal services. If particular actions constitute, or are perceived by the contractor to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer (KO) immediately.
2.0 Description of Services.
2.1 Scope. The Contractor shall provide Grounds Maintenance for all High Visibility Areas (Improved Grounds) and Common Areas (Semi-Improved Grounds). The Contractor shall ensure that all work covered by this contract is accomplished in a manner that results in a healthy, clean, neat, and professional appearance of grounds. The Contractor shall mow grass only when the maximum height is reached or exceeded as indicated in the Work Capability Levels table in paragraph 4.0. The Contractor shall set the mower height to three (3) inches for all areas, and shall alternate mowing direction when feasible. Grass areas that can’t be accessed with a mower, e.g., around dumpsters, poles, signs, trees, and HVAC units, shall be trimmed mechanically to the same height.
All work shall be performed by qualified personnel in accordance with (IAW) applicable laws, regulations, and TEs 1 - 2.
2.2 Service High Visibility Areas. Improved grounds that require an intensive level of maintenance. High Visibility Areas, approximately 63 acres, including a 3.5-acre cemetery, are shown in the Installation Grounds Maps referenced in TE 2. The work performed in these areas by the Contractor shall include mowing, edging, and trimming grass; removing grass trimmings from paved areas; removing grass from cracks in sidewalks and pavements; aerating, applying fertilizer / lime, and applying pesticide to fields; removing litter, leaves, and debris: and clearing fence lines. Each subtask applies to the entire 63 acres unless otherwise specified.
2.2.1 Mowing. The Contractor shall mow the High Visibility Areas IAW the Work Capability Levels table. The Contractor shall remove trash, litter, tree limbs, debris, etc., prior to mowing. The Contractor shall remove lawn clippings/debris the same day the mowing is performed. The Contractor shall mulch mow the grass and remove visible grass clippings after mowing, before leaving the work area. The lawn shall be uniform in appearance, free of skips, gaps, rutting, or scalping. The Contractor shall be responsible for any damage incurred as a result of grass cutting operations.
2.2.2 Edging. The Contractor shall, in conjunction with mowing, edge in and around flowerbeds, mulched areas, sidewalks, driveways, street edges, curbs, and other impervious surfaces in the High Visibility Areas to present a neat appearance. Edging includes the removal of all grass or weeds sprouting from cracks in sidewalks, pavement, and curb joints. The Contractor shall not use any post-emergent herbicides for edging purposes. The Contractor shall collect and dispose of all edging debris the same day edging is performed.
2.2.3 Trimming. The Contractor shall, in conjunction with mowing, trim grass and weeds around trees, shrubs, buildings, fences, poles, posts, fire hydrants, parking lot bumper blocks, boulders, headstones, and all other fixed objects in the High Visibility Areas that project above the ground so grass height is maintained consistent with adjacent grass.
The Contractor shall remove all trimming debris from sidewalks, driveways, and headstones on the same day trimming is performed.
2.2.4 Fertilizing and Liming. The Contractor shall apply commercial, N-P-K granular fertilizer and pulverized agricultural lime to the parade and athletic fields (approximately
15.2 acres) and the cemetery (approximately 3.5 acres) IAW the Work Capability Levels table and IAW the product manufacturer’s recommendation.
2.2.5 Seeding, Sodding, and Aeration.
2.2.5.1 Seeding/Sodding. The Contractor shall repair damaged lawn areas by excavating unsuitable material, backfilling with topsoil, leveling, seeding/sodding, and maintaining adjacent turf areas IAW with the Work Capability Levels table. The areas to be repaired and seeded are approximately 1 acre or less annually. Unless hydroseeding, all seeded areas must be covered with straw or an appropriate alternative immediately after the seed has been applied.
2.2.5.2 Aerating and Overseeding. The Contractor shall perform core aeration, or an alternative method approved by the COR, of the parade and athletic fields (approximately
15.2 acres) and the cemetery (approximately 3.5 acres) IAW the Work Capability Levels table. If applicable, the cores shall remain on site.
2.2.6 Pest Control. The Contractor shall control pests (weeds, grubs, etc.) using CORapproved pesticides, or an alternative method approved by the COR, on the parade and athletic fields (approximately 15.2 acres) and the cemetery (approximately 3.5 acres) IAW the Work Capability Levels table and pesticide use requirements described in paragraph 3.2.
2.3 Service Common Areas. Semi-Improved grounds that are used for operational and maintenance purposes. Common Areas, approximately 37 acres, are shown in the Installation Grounds Maps referenced in TE 2. The work performed in these areas by the Contractor shall include mowing; removing grass from cracks in sidewalks and pavements; removing litter, leaves, and debris; and clearing fence lines. Each subtask applies to the entire 37 acres unless otherwise specified.
2.3.1 Mowing. The Contractor shall mow the Common Areas IAW the Work Capability Levels table. The Contractor shall remove trash, litter, tree limbs, rocks, debris, etc., prior to mowing. The Contractor shall be responsible for any damage incurred as a result of grass cutting operations.
2.3.2 Trimming. The Contractor shall, in conjunction with mowing, trim grass and weeds around trees, shrubs, buildings, fences, poles, posts, fire hydrants, parking lot bumper blocks, boulders, and all other fixed objects in the Common Areas that project above the ground so grass height is maintained consistent with adjacent grass.
2.4 Spring/Fall Clean-up. The Contractor shall conduct spring and fall clean-up activities IAW the Work Capability Levels table. The area subject to the spring and fall clean-up, approximately 130 acres, includes the High Visibility Areas (63 acres), Common Areas (37 acres), and an additional 30 acres of impervious surfaces (e.g., roads, driveways, parking lots). The indicated areas are shown on the Installation Grounds Maps referenced in TE 2. The Contractor’s responsibilities shall include, but not be limited to, the removal and disposal of all natural debris, (e.g., tree limbs, rodent habitats, etc.), leaves, and litter/trash. Organic debris shall be disposed of off-site and IAW State regulations for organics disposal.
2.5 Perimeter Fence Lines. The Contractor shall keep all areas (vertical and horizontal) within six (6) feet of perimeter fences lines clear of vegetation including tree limbs, shrubs, vines, etc. as shown in TE 1. This includes grass penetrating impervious surfaces, e.g, where fence lines cross parking lots. Only lawn grass maintained IAW paragraph 2.2.1 is permitted within 6 feet of a perimeter fence.
2.6 Contractor Manpower Data Reporting. The Contractor shall report manpower information (including subcontractor manpower information) required for performance of this contract. The contractor shall submit all the information required in the format specified at the following web address: https://ecmra.mil. The required data is reported for each federal fiscal year (1 October to 30 September) and must be reported by 15 October of each calendar year. If the period of performance of the contract crosses fiscal years, one entry shall be made for each fiscal year.
2.7 Other Special Services. A contingency amount of funds has been included in the contract for unscheduled services. The COR will provide the Contractor a scope of work for any unscheduled services required, and the Contractor shall furnish a written cost estimate to include material and labor costs to the COR for approval. Any work required under this section of the contract that does not exceed the micro-purchase threshold as defined in the Federal Acquisition Regulation, can be approved by the COR. If the estimated cost of the unscheduled services exceeds the micro-purchase threshold, the requirement shall be referred to the KO for approval. Special services that may be requested by the COR include:
a. Services necessary due to unforeseen circumstances, including but not limited to, Very Important Person (VIP) visits, retreats, ribbon cutting ceremonies, and open houses.
b. Maintenance of flower/ornamental planting beds, including but not limited to, removing annuals, fertilizing, weeding, mulching, watering, adding compost, and tilling.
c. Maintenance of hedges and shrubs, including but not limited to, inspecting, pruning/trimming, planting or transplanting, enhancing mulch rings, replacing dead/diseased plants.
d. Servicing and maintaining trees, including but not limited to, inspecting, pruning/trimming, planting or transplanting, enhancing mulch rings, replacing dead/diseased plants, and fertilizing.
3.0 Requirements.
3.1 Equipment Requirements.
3.1.1 All rotary mowers used within High Visibility Areas shall be equipped with mulching blades and have discharges blocked.
3.1.2 All equipment used to perform grass mowing and leaf removal operations on High Visibility Areas shall be equipped with turf type tires. Equipment not essential for the performance of grass mowing or leaf removal functions (e.g., equipment with agricultural tires, wheel weights, snow blades, or other accessories that may damage turf or tree root zones by compaction, rutting, or scalping), shall not be permitted on High Visibility Areas.
3.1.3 A rotary mower capable of negotiating steep slopes and cutting heavy clumps and brushy vegetation may be required to service certain Common Areas.
3.1.4 All power equipment shall be in good operating condition to ensure clean and even mowing. All equipment shall be of appropriate design (including safety features) and sufficient power to perform the mowing requirements; prevent scalping and rutting of the grounds; and damage to trees, shrubs, or any other Government property. If the Contractor causes damage to grounds or buildings (e.g., breaks a window), the incident shall be reported to the COR immediately.
3.1.5 The Contractor shall not use any equipment with an active hazardous material leak. If a leak or spill occurs, follow the requirements in paragraph 3.2 Environmental Protection.
3.2 Pesticide Use Requirements.
3.2.1 Contractor personnel that apply pesticide shall have a Massachusetts Commercial Pesticide Applicator License or Certification. The Contractor shall ensure training and licenses and/or certificates of Contractor personnel are kept current. The Contractor shall provide copies of these licenses or certifications to the COR not later than (NLT) ten (10) calendar days following contract award, and again within ten (10) calendar days upon a change in personnel.
3.2.2 The Contractor shall use pesticides only as approved by the COR. The contractor shall submit a brief written work plan NLT ten (10) calendar days following contract award identifying what, if any, pesticides that the Contractor intends to use and the quantities and locations at which they intend to use them. The Contractor is not to use any pesticide without prior written approval from the COR. Following COR-approved pesticide use, the Contractor shall provide a written monthly report to the COR verifying what pesticides were used and the quantities and locations at which they were used. Any changes that the Contractor wishes to make to the approved work plan must be requested in writing and approved by the COR prior to pesticide application.
3.2.3 All mixing and storage of pesticide shall be performed off the installation. Spills of any pesticide will be reported in accordance with the specifications identified in paragraph
3.3.3 of this PWS.
3.3 Other Environmental Requirements.
3.3.1 Under no circumstances is hazardous waste to be transported onto DRFTA property.
3.3.2 Where hazardous materials are needed, the Contractor will adhere to all applicable federal and State regulations regarding the management and handling of hazardous materials.
3.3.3 Any release of oil (including leaks from hydraulic hoses and equipment), hazardous waste, or hazardous material on DRFTA shall be immediately reported to the Devens Fire Department at 978-772-2117 and the DPW Environmental Division at 978- 615-6086/6096. This clause does not relieve the Contractor of any federal or State reporting requirements.
3.3.4 Oil, fuel, or hazardous material/waste released to the environment (including leaks from hydraulic hoses and equipment) by the Contractor in the performance of this work shall be the sole responsibility of the Contractor and shall be cleaned up at no expense to the Army. Any release shall be cleaned up without delay to the standards set forth in 40 CFR 260 and 310 CMR 30.00. Any vehicle found to be releasing oil or hazardous substance shall be immobilized and spill contained immediately upon discovery of the leak.
3.4 Safety Requirements. All power equipment used in the performance of this contract shall have safety design features to prevent injury to the operator and damage to persons or property. The Contractor shall ensure all workers are properly trained and understand how to safely operate the power equipment. All Personal Protective Equipment (PPE) shall conform to the applicable OSHA standards. PPE shall be worn at all times during the operation of power equipment.
3.5 Anti-Terrorism and Operations Security. Contractor and all associated subcontractor employees requiring access to the installation shall (1) provide all information required for background checks to meet installation access requirements to be accomplished by the Director of Emergency Services or Security Office, and (2) comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). Should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days (insert the period of time within which the Contracting Officer may exercise the option).
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 (provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires.
