About this file

This is a voluntary pre-proposal conference sign-in sheet for the Oregon Department of Transportation (ODOT) related to the ESB US395C MP 40.38 to 67.78 Crack Seal Project in Harney County. The project involves crack sealing work on US395C from milepost 40.38 to 67.78, covering approximately 27 miles of highway with an estimated 97,820 linear feet of crack sealing required. Prospective bidders were invited to attend the pre-proposal conference to receive clarification on project requirements and specifications. Competitive bids were required to be submitted through the OregonBuys eProcurement system by the specified bid opening date, with contract completion required by November 17, 2022. The procurement is exclusively restricted to qualified Emerging Small Business (ESB) firms certified by the State of Oregon, limiting competition to emerging small businesses only.

ODOT will award the contract to the responsible prospective contractor with the lowest compliant price. The contractor must supply labor, equipment, and traffic control, while ODOT will provide the crack sealing material. Pricing is based on actual measured quantities with a lump sum contract price and no retainage to be withheld unless ODOT determines otherwise at its discretion. Two bidders were identified in preliminary results: Commsurf Pro and O'Malley Brothers Corp, both Oregon-based companies, with bid prices of $1.32 and $1.24 per unit respectively. Prior to award, contractors must submit a Taxpayer Identification Number, Certificates of Insurance, a Responsibility Inquiry Form, and any required Conflict of Interest Disclosure Forms. The contractor must be duly authorized to transact business in Oregon and comply with prevailing wage requirements. ODOT reserves the right to adjust quantities as needed and has applied the State of Oregon's General Conditions for Public Improvement Contracts as governing terms.
