About this file

This document is a summary of vendor questions from the preproposal conference for the State of Maryland Developmental Disabilities Administration (DDA) Request for Proposals (RFP) BPM039329 for FORENSIC SERVICES. The RFP seeks a contractor to conduct evaluations and testing of defendants in the community, court medical offices, detention centers, and/or Maryland State facilities to determine competency to stand trial, criminal responsibility, and dangerousness. Contract requirements also include report writing, testifying in court, collecting/maintaining data, providing training, and participating in a peer review program. The RFP addresses vendor questions regarding certification requirements, availability of referenced exhibits, hardware and software cost limitations, contract initiation and transition requirements, background check and fingerprinting policies, and proposal submission instructions. Pricing terms, set-asides, incumbent information, funding requirements, and other salient details were not provided in this summary.

Vendor Questions from Preproposal Conference

Issued: 10/03/2023

1. On page, 1 of the RFP. Section 1.1, b. it says that the offeror shall be certified, by the Maryland

Insurance Administration. Is that a misprint? Should it be the Board of Examiners instead?

The vendor does not require certification from the Maryland Insurance Administration. Please see the amended RFP.

2. On page 2 Section 2.2 B under general requirements, it refers to exhibit two. I’ll give you a chance to take a look at that. We did not find an exhibit too in the RFP. So we're just assuming that it refers to the statues and title, three of the Criminal Procedure article.

This RFP does not include a copy of Sec. 3- 106 of the Criminal Procedures Article, Maryland

Annotated Code labeled as Exhibit 3. Please see the amended RFP. Please also follow this link to see the statute:

3. On page, 8 Section 2.10, it's talking about the hardware and software costs incurred as part of the RFP. Could you explain this a little bit further? what expenses are going to be covered?

Section 2.10 E - States the following: Hardware and software costs procured as part of the RFP cannot exceed 49 percent of the total Contract value.

This section is referencing any hardware or software purchased by the contractor and used to perform services required by the scope of work in this RFP.

4. On Page 13, section 3.1 under the contract initiation requirements. Is there an Start date? And is there also a date when the success offer will be notified?

We do not have a specific start or end date for the anticipated contract at this time, however we would like to award a contract and begin services as soon as possible. Notifications of recommendation for a contract award are generally sent to apparent awardees after evaluations and internal approvals are complete. Those recommendations for contract award are subsequently subject to approval from the Board of Public Works.

5. Section 3.1, page 13. We understand that the RFP specifies, an end of contract transition in year five but will be current contractor provided transition and do we know what that will look like?

We do not have a specific start or end date for the anticipated contract at this time, however we would like to award a contract and begin services as soon as possible.

6. Section 3.7.1 and 3.7.2. It's the paragraphs on Security Clearance Background Check and

Fingerprinting; the Board of Examiners of Psychologist. Now requires all psychologists to have background checks and fingerprinting prior to renewing their licenses. So by April 1st, this is actually a state law. I think for all health occupation providers, maybe staggered in terms of implementation, but by April 1st 2024, all psychologists will have submitted their background checks and fingerprinting directly to the board.

Will that be a Requirement by the Board for all licensed psychologists, who would be working under the contract? (Will) That board requirement be sufficient to satisfy the requirement of the

RFP. I'm asking because to do it again, would be repetitious.

The Maryland Department of Health is a separate organization from the Board of Examiners of

Psychologist, and we will require our own background check.

7. The background check and finger printings required for all personnel, providing services under contract by services under the contract. Do you mean the forensic psychological evaluations or any services under the contract. Specifically Does the RFP require a background check and fingerprinting for the administrators of the contract?

We require background checks for all Contractor Personnel – Employees and agents and subcontractor employees and agents performing work at the direction of the Contractor under the terms of the Contract awarded from this RFP; this would include administrators.

8. On page 49 Section 5.3.2 under 16 for references. Should the original letter letters from the references? Be sent directly to Mr. Brian Matz or to you, Mr. Spence. Or should we just include the original in the proposal?

Please refer to section 5.3.2. Your proposal should be organized into Tabs A -O. References belong under Tab H. Your proposal should be submitted in its entirety directly to eMMA.

Please do not submit anything to directly me or anyone else.

9. On page 87 Section, 37.1 under the Contract Monitor and Procurement Officer. The paragraph starts with an incomplete sentence and appears to be missing some information. Could you, please clarify if there's anything that needs to be added?

Section 3.7.1 appears in the solicitation without typographical errors.
