About this file

This document is a Vendor Questions & Answers file for a Veterans Affairs (VA) solicitation for a small business courier service contract. The solicitation is exclusively for Small Businesses registered in SAM.gov and searchable in the SBA Small Business search. The incumbent vendor is Citadel Security Group, and the requirement involves courier services that will handle boxes and containers potentially containing patient information, necessitating a Business Associate Agreement to ensure HIPAA compliance.

Key details include the VA's approach to the procurement, which emphasizes vendor flexibility in determining operational specifics like number of drivers/vehicles and vehicle size. The solicitation is a commercial acquisition under FAR 12.6, with the VA intentionally not disclosing budget amounts to encourage competitive bidding. The contract will require strict enforcement of Limitations of Sub-Contracting under FAR 52.219-14, and vendors must carefully review the RFQ, Statement of Work (SOW), and Price/Cost Schedule to prepare their proposals. Specific requirements include protecting patient privacy, potentially utilizing subcontractor licenses, and meeting the SOW specifications for courier services.

Vendor Questions & Answers

1) Is this solicitation only for Small Businesses total set-aside? Or can anybody bid on it?

Answer: Yes, the solicitation is only for Small Businesses (SBs) who are registered in SAM.gov and searchable in the SBA Small Business search to submit their offers. Unfortunately, if a vendor that is not a SB found in SAM.gov and not searchable in the SBA Small Business search submits their offer, the offer would not be evaluated.

2) Who is the incumbent?

Answer: The incumbent is Citadel Security Group.

3) What was the previous/current contract# for this requirement?

Answer: In order to ensure this solicitation’s requirements are met, the previous service contract is not relevant since this is a new requirement with details listed in the RFQ, SOW, and

Price/Cost Schedule.

4) What is the budget/value for this requirement?

Answer: The VA does not disclose the funding/budgeted amount for the requirement since this is a commercial acquisition under FAR 12.6. Therefore, we highly recommend for vendors to provide their best offer that they believe is competitive.

5) Why and how are you going to enforce the Limitations of Sub-Contracting? Answer: Under FAR

52.219-14 the CO is required to enforce the limitations of sub-contracting for any set-aside contracts. Also, for both pre-award & post-award actions, the CO will use any other pertinent

VAAR, VHA Policies, and FAR to ensure that Limitations of Sub-Contracting are enforced.

6) What was the cost of the of the previous contract?

Answer: In order to ensure this solicitation’s requirements are met, the previous service contract is not relevant since this is a new requirement with details listed in the RFQ, SOW, and

Price/Cost Schedule.

7) Please confirm whether licenses can be utilized via subcontractor(s) for this requirement?

Answer: Please review SP1, SP2, and SP3 of the Special Standards of Responsibility from the RFQ document.

8) Why would a Business Associate Agreement be needed for this requirement?

Answer: The courier would be picking up boxes and containers that will likely have patient information that requires protection of patient privacy to prevent a HIPAA violation; therefore, a

Business Associate Agreement shall be required between the vendor awarded the contract and a Veterans Health Administration (VHA) Privacy Officer.

9) How many drivers/vehicles are currently used to service the current contract?

Answer: The current number of drivers/vehicles by the incumbent vendor is not relevant for this requirement. Please review the Statement of Work (SOW) to allow your company to make the determination of the number of drivers/vehicles based on your business’ capabilities. The VA will not state the headcount of courier drivers/vehicles required because it is the contractor's responsibility to properly staff and equip their business to meet the SOW requirements.

10) What is the vehicle size currently servicing this location?

Answer: The current size of the incumbent vendor’s vehicles is not relevant for this requirement. Please review paragraph 4 of the SOW in the RFQ to allow your company make the determination of vehicle size. Reason: Maybe the driver has multiple customer deliveries to support, not just the VA. Therefore, the VA will not state the exact vehicle size, so it is the contractor's responsibility to ensure the vehicle used meets the SOW requirements.
