About this file

This is a Vendor Preference Certificate form issued by the State of West Virginia Purchasing Division to allow qualifying vendors to request preference consideration based on residency status and other criteria in accordance with West Virginia Code 5A-3-37. The certificate does not apply to construction contracts and serves as an evaluation method applied only to cost bids at the time of bidding. The form allows bidders to certify their eligibility for preference consideration and requires submission of the completed certificate with their bid.

The certificate outlines seven primary preference categories with varying preference percentages: 2.5 percent for resident vendors or entities meeting four-year residency requirements; 2.5 percent for resident vendors employing 75 percent West Virginia residents on the project; 2.5 percent for nonresident vendors with in-state affiliates or subsidiaries meeting employment thresholds; 5 percent for bidders meeting multiple residency and employment criteria; 3.5 percent for individual veteran resident vendors; 3.5 percent for resident veteran vendors meeting employment requirements; and preference consideration for certified small, women-, and minority-owned businesses under West Virginia Code 5A-3-59. Bidders must certify the accuracy of all information provided and agree to disclose requested information to the Purchasing Division. The Secretary of Revenue may rescind contracts or assess penalties up to 5 percent of the bid amount if a preference-receiving bidder fails to maintain qualification requirements during contract performance. Bidders are required to notify the Purchasing Division immediately in writing if any information in the certificate changes during the contract term.
