I. PROGRAM OVERVIEW:

DLA Land and Maritime is considering a solicitation and subsequent Award of an Indefinite Quantity Contract (IQC) or Long-Term Contract (LTC) for the item(s)/NSN(s) listed on the attached spreadsheet. As a potential supplier of these items, we are asking that you fill out this market survey to the best of your knowledge so that we can generate a realistic and beneficial solicitation.

III. POSSIBLE SCOPE:

Orders may be for Customer Direct shipments, DLA Direct (stock replenishment), or Foreign Military Sales (FMS) shipments, depending on the individual NSN requirements. First Destination Transportation (FDT) applies to all non-FMS shipments.

Indefinite Quantity Contract (IQC): These contracts are intended for use with item(s)/NSN(s) for which recurring demands are anticipated, and as a means of reducing the time and expense required to solicit and make repetitive individual awards. Establishment of an IQC Contract (called a “Basic Contract”) will permit future Purchase Requests to be awarded by issuing a delivery order against the basic contract. All terms, conditions, and pricing are negotiated/awarded up front with the basic, allowing the delivery order to be issued quickly. Most contract terms will be for a one (1) up to a three (3) year base period with the possibility of two (2), up to four (4) option years. The item(s)/NSN(s) on the contract will be ordered on each delivery order (DO) within stated minimum and maximum quantities, and on an as needed basis.

The delivery order quantities are estimated based on previous and forecasted demands, and the contractor will be guaranteed a minimum quantity as specified in the contract.

VI. COMMERCIALITY -

The resultant solicitation will be issued as either a Commercial (FAR Part 12) or Non-Commercial (FAR Part 15) procurement. In order for us to determine if an item is commercial, we need you to provide the types of documentation specified within the Market Survey questionnaire. Based on that documentation, the government will determine if your items are commercial per the definition found at FAR 2.101(b). It is your responsibility to provide the data that helps the Contracting Officer make that determination.

In order to substantiate your claim to the Government or Prime Contractor, here are samples of types of data you should be willing and ready to provide:

a) Prior non-government sales data of the proposed item for non-governmental purposes, including the name of the customer and the end use of the item that was sold

b) Evidence of the proposed item (or the item from which the proposed item evolved from) was sold, leased, licensed, or offered for sale; an advertisement on a website does not constitute an “offer”

c) Information and descriptions of similar item(s) that are customarily used by the general public for nongovernmental purposes

d) Relevant sales data of similar item(s) sold to non-governmental entities for non-governmental purposes 5. Prior signed DoD PCO CID for the proposed item (not a FAR part 12 - SF1449 commercial contract); if you do not have a copy of the signed CID, provide the contract number and military department, defense agency, or other DoD component that rendered such determination, and if available, a Government point of contact

e) Market Research results (if prime determining commerciality for its subcontracted item(s)): market prices of same or similar items and publicly available data of similar items and/or with the same modifications (evidence of customarily available)

f) Market Industry data showing how and by who the same or similar items are used for nongovernmental purposes

g) Technical Analysis of the differences between the proposed item and the commercial comparison item(s)

The following pertain to the requirement for certified Cost or Pricing Data or Information Other Than Cost or Pricing Data. For contracts estimated over $2,000,000*, certified Cost or Pricing Data “may” be required. Contractors are greatly encouraged to view the sample format found at http://www.dcaa.mil to understand the in-depth information required for submission. Certified Cost or Pricing Data is not required for commercial item(s)/NSN(s). However, it is the contracting officer’s authority to determine an item(s) commercial or not. A failure to provide adequate cost or pricing data upon request by the Contracting Officer may result in the solicitation being cancelled with no award being made.
