This a Request for Quotations (RFQ) to establish multiple 5-year Blanket Purchase Agreements (BPAs) for Hazardous Waste and Special Waste Collection and Disposal at USDA, Animal and Plant Health Inspection Service (APHIS) and Agricultural Marketing Service (AMS) facilities located throughout the United States and outlying territories. This RFQ is issued as full and open (no set-aside used) under NAICS code 562112, Hazardous Waste Collection, with a Size Standard of $47 Million in annual sales. Other Than Small Businesses are encouraged to submit a quote, which must include a Subcontracting Plan.

The USDA intends to establish multiple BPAs to ensure competition and service coverage for all geographic areas. After award of the BPAs, RFQs for hazardous waste disposal services for APHIS or AMS will be sent to BPA holders as removal requests are received from the facilities. Each RFQ will be competed between those BPA holders which include the facility requesting removal in their designated service area. The total estimated need over five (5) years is $2,000,000. Each order will be awarded to the lowest price quote that is determined to be technically acceptable (addresses all items listed in the RFQ). There is no minimum guaranteed amount in either dollars or number of orders.

NOTE: Price reasonableness will be evaluated at the BPA call order level, and fair opportunity will be provided to each BPA holder in each applicable geographical area on an order-level basis.

All relevant documents (requirements, locations, materials for removal, terms and conditions, etc.) are included as attachments to this notice. Interested vendors should thoroughly read and complete all requested documents to confirm their ability to provide the services as requested.

A Question-and-Answer session with the Contracting Specialists will be available on March 28, 2024 (3/28/24) and will be recorded and posted with this notice to ensure all interested vendors receive the same information. If interested in participating in this Q&A session, you must contact Katie Maloney at katie.maloney@usda.gov by March 27, 2024 (3/27/24) for the session link.

Quotes for the BPA must be received by email to the point(s) of contact specified within the solicitation by May 10, 2024 @ 5PM Eastern to be considered. The BPA quotes will be evaluated on a best value basis for the non-price factors listed below per FAR 52.212-2. Multiple BPAs may be established based on the quality of the quotes received and a determination of what is most advantageous to the Government. Incomplete quotes will not be considered.

A COMPLETE QUOTE MUST INCLUDE ALL OF THE FOLLOWING:

1. The company name, address, phone number, contact person, and SAM.gov Unique Entity Identifier (UEI).

2. A Technical Quote that addresses the following Key Evaluation Factors:

Factor 1: Technical Approach – For this factor, the Vendor must include specifics on their intended technical approach to satisfy all of the requirements of this BPA. These requirements include but are not limited to the following list:

- Geographical coverage: Vendors must complete Attachment 3 to indicate the geographic areas in which they can provide the requested services.

- Cost control methodology: Vendor must demonstrate how they will ensure that they have identified the lowest-cost transportation and disposal methods, including use of subcontractors.

- Adherence to timelines: Vendor must provide a statement acknowledging the response and action timelines outlined in the SOW (14 business days to submit a quote at the order level; facility contact within 10 business days of awarded order; service/pickup date within 60 calendar days of award) (72 hours to submit a quote for urgent requests;

service/pickup date within 14 calendar days of award or Notice to Proceed).

- Manifest deliverables: Vendor must provide a statement acknowledging that manifest documents are required prior to or at the same time as invoices, and invoices submitted without manifest documents attached or already received by the Government will be rejected.

- Subcontracting plan: Vendors that cannot be classified as a Small Business under the NAICS provided above must submit a subcontracting plan using Attachment 5. For the purposes of the subcontracting plan, vendors are advised to use the estimated total BPA value of $750,000 while calculating the “Goal Total Dollars” and “Goals Percentage” values in the Small Business Subcontracting Plan attachment.

Factor 2: Experience – Each vendor must submit details on a minimum of three (3) but no more than five (5) separate projects within the last 5 years of the closing date of this solicitation (Attachment 4). The projects described should consist of experiences that are similar to the scope and magnitude of this requirement.

Factor 3: Past Performance – Past Performance will be evaluated for the same projects as submitted for Factor 2. The Vendor must include complete contact information for each customer and each project submitted in response to Factor 2. The government reserves the right to contact references to verify any information provided.

In the case of a Vendor without a record of relevant past performance or for whom information on past performance is not available, the Vendor’s quotation will not be evaluated favorably or unfavorably on past performance.

The evaluation will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition.

I. Project This is a Multiple Award Blanket Purchase Agreement (BPA) for Hazardous Waste Removals from USDA Facilities Across all 50 States and Designated Territories. This multiple-award BPA is established in accordance with FAR Subpart 13.3.

II. Background Information

The Animal and Plant Health Inspection Service (APHIS) and Agricultural Marketing Service (AMS) are Agencies of the U. S. Department of Agriculture (USDA). APHIS and AMS collectively operate hundreds of small inspection stations and labs as well as several larger research facilities (see Attachment 3). Some of these facilities are in remote locations, and disposal services may be needed in locations such as Alaska, Hawaii, and Puerto Rico.

Most of the facilities are very small quantity generators. Some facilities are intermittent large quantity generators (LQGs), at least one of which produces poisons such as cyanide and strychnine. Contractors are expected to coordinate and/or perform waste retrieval from the designated USDA facility and transport all collected waste to a US Environmental Protection Agency (EPA) registered Commercial Treatment, Storage, and Disposal Facility (TSDF) for proper treatment and/or disposal.

APHIS and AMS together intend to establish one or more Blanket Purchase Agreements (BPAs) to collect and dispose of its hazardous waste as needed from its facilities located in all 50 states and some US territories. The majority of this waste will be hazardous, biological, or controlled substance waste. Some requests for waste removal may also include non-hazardous waste for which there are no alternative disposal methods. All BPA holders are expected to be thoroughly familiar and compliant with all federal, state and local hazardous waste regulations in the geographic areas in which they and their subcontractors have been contracted to operate for this project.

The estimated value of this project across all facilities over five years is $2 million. Orders will be competed at the time each service is needed between all BPA holders whose service area includes the relevant facility’s location.

While this opportunity is not restricted to small businesses as designated by the Small Business Administration (SBA), we anticipate some prime BPA holders and several subcontractors could be classified as small businesses based on the SBA size standard for the following North American Industry Classification System (NAICS) code. The main NAICS is 562112 – Hazardous Waste Collection, which has a small business size standard of $47 million.

A. Definitions The following definitions are sourced from EPA.gov and apply to this Statement of Work.

Hazardous waste management facilities receive hazardous wastes for treatment, storage or disposal.

These facilities are often referred to as treatment, storage and disposal facilities, or TSDFs, and their activities are described in more detail below:

• Treatment – Using various processes, such as incineration or oxidation, to alter the character or composition of hazardous wastes. Some treatment processes enable waste to be recovered and reused in manufacturing settings, while other treatment processes dramatically reduce the amount of hazardous waste.

• Storage - Temporarily holding hazardous wastes until they are treated or disposed. Hazardous waste is commonly stored prior to treatment or disposal, and must be stored in containers, tanks, containment buildings, drip pads, waste piles, or surface impoundments that comply with the Resource Conservation and Recovery Act (RCRA) regulations. The regulatory requirements for these types of storage units are found in title 40 of the Code of Federal Regulations (CFR) in:

o part 264 for permitted facilities and o part 265 for interim status facilities

• Disposal - Permanently containing hazardous wastes. The most common type of disposal facility is a landfill, where hazardous wastes are disposed of in carefully constructed units designed to protect groundwater and surface water resources.

Under RCRA, Congress authorized EPA to promulgate regulations establishing design and operating requirements for hazardous waste management units. The requirements are intended to protect human health and the environment from the risks posed by hazardous waste.

Specific regulations have been developed for various types of hazardous waste management units under Subtitle C of RCRA in 40 CFR parts 264, 265 and 266. These units include:

Containers

A hazardous waste container is any portable device in which a hazardous waste is stored, transported, treated, or otherwise handled. The most common hazardous waste container is the 55-gallon drum.

Other examples of containers are tanker trucks, railroad cars, buckets, bags, and even test tubes.

III. Contractor Requirements

A. GENERAL REQUIREMENTS

Any language in this document that assigns responsibility to “the Contractor” also applies to any subcontractor who has been contracted to do the work being described.

1. The Contractor must provide all containers, materials, labor, equipment and related services for pickup and disposal services of hazardous, non-hazardous, universal, biological, and controlled substance wastes as requested on each order. All containers removed from a facility property as part of the collection process must be replaced by the Contractor if requested by the facility at the same time as the removal request is sent to the BPA holders for quotes. The price for replacement containers must be included in the quote for removal services or risk non-payment for the replacement container.

2. Wastes that may be disposed of under this BPA include, but are not limited to:

• Drum, tanks, buckets, jars and other containers containing chemicals

• Gas cylinders

• Contaminated equipment

• Contaminated soil

• Waste oil

• Waste pesticides

• Biological wastes including specimens, samples, laboratory equipment and medical equipment

• Waste pharmaceuticals, including controlled substances

• Universal wastes

• Paints and construction materials

• Unknown wastes

• Spill cleanup wastes

• Metal-containing wastes including metals that may be salvageable

• Pyrotechnics

• Radioactive or mixed wastes.

3. The Contractor must comply with all Federal, State and local regulations and prudent practices governing the safe handling, packaging, storing, transportation, and disposal of all wastes as applicable. Due to the wide range of USDA facility locations and the limited availability of commercial TSDFs, a single task order may require transportation across county and state lines and/or through US or International Waters. Failure to comply with ALL applicable regulations at any step or location during performance on the task order may result in the termination of the contract. Additionally, the Government will not be liable to the Contractor for the cleanup of spills, accidental releases, damage to equipment, or harm to persons caused by the Contractor or their Subcontractor(s).

Contractor will indemnify the USDA for any damages, fines, or the like, issued as a result of Contractor performance under a task order.

4. The Contractor is solely responsible for ensuring that all licenses, permits, etc. relating to the work of handling, transportation, storage, treatment, and/or disposal of materials covered by this BPA are maintained and current for their business, vehicles, and/or employees as applicable.

5. The Contractor must provide prompt assistance (within 2 business days) to a COR/CO with any questions related to this and orders placed against it. The Contractor should expect the same prompt assistance with any questions related to this BPA and its orders from the Government CORs and COs administering this contract.

B. SCOPE OF WORK FOR WASTE COLLECTION SERVICES

1. Service Request Procedure and Timelines

a) All BPA holders who service the applicable geographic location will be contacted by one of the Contracting Officer’s Representatives (CORs) or Contracting Officers (COs) when a service request is received from a facility. Each Contract Holder will then have 14 business days to submit a quote for removal and transportation of the materials listed on the provided form. The form will contain a list of the wastes, amounts and container type of each waste, the facility location, and contact information for use during scheduling and pickup. Each quote must include and list any container replacements, labor categories, rates, and levels of effort (hours), and must be inclusive of all costs required to complete each instance of hazardous waste removal, including materials, supplies, equipment, shipping and/or delivery, general and administrative costs, supervision, subcontracts, profit, etc. The Contractor must advise the CO or the COR if any of the waste requires special handling or special analysis. If the Contractor would be unable to pick up some or all of the waste for any reason (type or quantity of material, location, temporary employee shortage, etc.) the Government may request additional information for future reference when competing similar requirements.

b) Quotes not received within 14 business days will not be considered. Quotes for partial or multi-trip removal will not be considered. The order will be awarded to the lowest priced quote meeting all order specifications.

c) Once the order has been awarded, the Contractor is responsible for scheduling a date and time for pickup at the facility per the order documents. The service date must be scheduled with the facility contact within 10 business days after award. The service date must be within 60 calendar days after award. Any situations which would delay the service date past 60 days must be brought to the attention of the COR or CO identified on the order.

d) At the time of pickup, the Contractor is responsible for ensuring that only the materials in the quantities as described in the original service request are removed from the facility. As these are intermittent orders, individual facilities may not adhere to our request that any materials added to the collection area after the service request was submitted should be kept separate. Important Note: Any materials picked up in excess of the type and quantity specifically identified on the order documents is removed at risk of non-payment. The CO should be contacted immediately (before leaving the facility property) if the facility insists on the removal of extraneous materials.

e) The Contractor must monitor, maintain, and remove any materials, waste, and personal protective equipment generated as a result of work performed in accordance with this contract.

f) The Contractor must notify a COR/CO of any obvious non-compliance seen at a facility while performing work under an order.

g) The Contractor must transport all waste collected from a USDA facility to an appropriate Treatment, Storage and Disposal Facility (TSDF) in accordance with applicable Federal, State, and local regulations. TSDFs must be appropriately licensed to accept the type of waste received from the Contractor. The Contractor must submit the completed hazardous waste manifest to the COR or CO prior to or with the submission of the invoice for the order.

2. Shorter Timelines for Urgent Service Requests

a) If the COR/CO identifies a pickup request as urgent, interested Contractors must provide a quote for the requested services within 72 hours of initial contact.

b) The Contractor must pick up the waste within 14 calendar days of Notice to Proceed from the COR or after receipt of award from a USDA CO. Earlier pickups are encouraged when feasible based on Contractor and facility availability.

c) Reasons for issuing an urgent request include warnings or pending citations from the EPA, state departments, health agencies, etc. Incidents that should be covered by a facility’s emergency response plan are not included in the scope of work for this contract.

C. CONTRACTOR SPILL AND ACCIDENT PROCEDURES

1. Accidental Releases by Contractor. In the event of a spill due to Contractor negligence, the Contractor must immediately and properly treat the affected area and dispose of all contaminated materials according to the applicable regulations. The affected area must be returned to the same condition it was prior to the Contractor’s arrival onsite at no additional cost to the Government.

2. Accidental Releases Caused in Part by the Government. In the event of a spill due to full or partial Government negligence during the scheduled pickup, the facility manager and one of the COs must be notified to determine the need for activation of the facility emergency response plan. If the facility response plan is not activated, the Contractor must immediately and properly treat the affected area and dispose of all contaminated materials according to the applicable regulations. A separate invoice for the cleanup and additional disposal as applicable must be submitted to the COR and CO for review as soon as possible. The percentage of the invoice to be paid by the Government will be dependent upon the negotiated division of responsibility between the Government and Contractor.

3. Accident Reporting. Contractor must report to the COR all releases, employee exposures, occupational related illnesses and injuries, or other unusual occurrences that occur when providing services under this BPA and make all required notifications to Federal, State, and local agencies.

D. OTHER SERVICES AS REQUESTED

1. Decontamination Services. The Contractor may be asked to submit a quote for decontamination services (including project management) for equipment and/or facilities on an as-needed basis. The Contractor must dispose of any waste generated by the decontamination project.

2. Metal Recovery and Recycling. If a service request includes sufficient concentrations of recyclable metal materials, the Contractor may be requested to submit a quote to transport the materials to an approved off-site recycling facility. The Contractor must arrange metals recovery, provide proof of reclamation, and issue any credit received by the Contractor from the recycling facility for the materials recycled to the Government for use on future orders under this contract.

3. Regulatory Compliance. The Contractor may be requested to submit a quote for regulatory compliance assistance. This assistance may be in the form of compliance advice, information on recent or upcoming regulatory changes, identifying non-compliance at APHIS facilities, and/or bringing non-compliant facilities into compliance by providing necessary training, equipment or services.

E. SUBCONTRACTING

Each Other Than Small Business (OTSB) BPA holder (based on NAICS and SBA size standard) must adhere to the subcontracting requirements as described in FAR Subpart 19.7. Each BPA established with an OTSB hereby incorporates the associated entity’s approved subcontracting plan by reference.

F. PERFORMANCE REQUIREMENTS

Contractor must meet the performance requirements in Section III B & C for 95% of all pickups in a period of performance to receive a satisfactory CPARS rating.

G. CONDUCT ON FEDERAL PROPERTY

1. Contractor employees shall be escorted by a facility escort officer while on grounds. The facility escort officer shall ensure that contractor employees receive a brief overview of emergency procedures to first-time visitors and when there any major changes in procedure. Facility escort officer shall also provide timely instructions to contractor employees during an emergency. If a facility escort officer is not present at any point during the contractor’s time on site, contractor shall immediately contact the COR for direction. If the COR cannot be reached, contractor shall contact the other POCs and/or facility security for directions.

2. All contractor employees shall have a valid picture identification, such as a driver’s license or state identification card, and shall adhere to the facility requirements for identification.

3. Contractor employees shall not operate any vehicles without a valid driver’s license. Each contractor provided vehicle or towed trailer shall display the contractor’s name so that it is clearly visible on the vehicle. A valid state license plate, vehicle registration, and insurance are required for each vehicle. All vehicles operated on government property shall be maintained in a good state of repair.

4. Contractor is advised that the facility grounds are under security camera surveillance at all times and employees are subject to all facility regulations concerning Closed Circuit Television while on grounds.

5. Contractor employees are prohibited from taking any photos or video recordings while on grounds, per facility regulations, unless authorized by facility escort officer or security officer.

6. Contractor employees shall comply with all facility and Federal Property regulations and policies, including:

a) Rules and Regulations Governing Conduct on Federal Property:

b) Title 41 CFR Part 102-74, subpart C at https://www.ecfr.gov/current/title-41/subtitle- C/chapter-102/subchapter-C/part-102-74

c) United States Code, Title 18, Section 930, Possession of Firearms and Dangerous Weapons in Federal Facilities at http://www4.law.cornell.edu/uscode/18/930.html
