About this file

This is an Amendment (Modification 0001) to Solicitation USCA27R0019 issued by the Administrative Office of the United States Courts (Procurement Management Division) for W-2 and 1099 printing and mailing distribution support services. The amendment extends the proposal due date to November 6, 2026 at 12:00 PM Eastern Time and provides responses to on-time questions received, with updates to Sections B, C, L, M, and the Price Workbook.

The contract requires printing and mailing of IRS tax forms (W-2, 1099-R, 1099-INT, 1099-MISC, and 1099-C) for calendar years 2026-2031, with approximately 45,000 information returns to be printed and mailed within seven business days of file receipt each January 18th. The contractor must securely receive and store electronic files using SFTP encryption, provide samples for approval, deliver forms to domestic and international addresses, and submit electronic copies of all mailed records within three business days. Key deliverables include test file processing, printing and mailing of five separate W-2 files, one 1099-R file, 1099-INT, 1099-MISC, and 1099-C files, corrected forms, and data files of mailed records. The contract uses Fixed-Price (FFP) line items with base quantities of 25,000 W-2s and 3,000 1099-Rs per year, reflecting reductions from original estimates of 71,000 each. Contractor personnel must pass suitability checks, and strict data security requirements per the Judiciary Information Security Framework apply, including immediate incident reporting for any unauthorized disclosures. Award will be made using a Best Value Tradeoff process, with technical and management factors weighted more heavily than past performance, and past performance more heavily than price. Proposals are classified under NAICS 541213 (Tax Preparation Services) and PSC R431 (Support – Professional: Human Resources).

C-1 W-2 and 1099 Printing and Mailing Distribution Support

1. Introduction

The Administrative Office of the United States Courts (AO) is seeking contractor services for the printing and mailing of the following Internal Revenue Service (IRS) information returns:

• W-2, Wage and Tax Statement

USCA27R0019 /0001 - Page 4 of 14

• 1099-R, Distributions from Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc.

• 1099-INT, Interest Income

• 1099-MISC, Miscellaneous Income

• 1099-C, Cancellation of Debt

The printing and mailing support service will allow the Federal Judiciary to accomplish the requirement on the annual IRS tax reporting obligations. This contract will be for printing and mailing services ONLY and DOES NOT include the contractor providing any other tax-related services. The AO will provide ready-to-print and mail Portable Document File (PDF) data files to the contractor with all W-2 and 1099 boxes prepopulated with the appropriate tax information along with appropriate instructions of each tax form.

The contractor must be able to print and mail W-2s and 1099s domestically, as well as to U.S. territories and international addresses as provided by the judiciary.

2. Background

The AO’s Court Human Resources Division (CHRD) is required to generate and distribute a W-2 to each eligible judicial officer and judiciary employee and a 1099-R to each eligible retired judicial officer annuitant and judicial officer survivor annuitant. HRO performs this service on behalf of the following federal judiciary agencies and programs of the Federal Judiciary: Administrative Office of United States Courts (AO), Federal Judicial Center (FJC), United States Sentencing Commission (USSC), United States Federal Courts, Judicial Retirement and Survivors Annuity System (JRSAS) and the United States Judges. All W-2’s and 1099-R forms are generated in the Human Resources Management Information System (HRMIS).

The AO’s Financial Operations Division (FOD) is also required to generate and distribute Forms 1099-INT, 1099-MISC and 1099- C to each eligible judiciary vendor and employee on an annual basis. FMO performs this service on behalf of the following Federal Judiciary agencies: AO, U.S. court units and FPDOs, FJC, and USSC. All 1099-INT, 1099-MISCs and 1099-Cs are generated in the Judiciary Integrated Financial Management System (JIFMS), a customized CGI Momentum product.

3. Scope of Work

The contractor shall only print and mail paper copies of the Judiciary W-2 and 1099-R, 1099-INT, 1099-MISC, and 1099-C Forms for calendar years 2026-2031. The forms will be printed on paper from PDF data files provided by HRO and FMO and mailed to the correct recipient as directed by the Judiciary. All supplies and equipment for printing and mailing the tax forms other than the AO’s USPS bulk mailing permit shall be provided by the contractor. The contractor shall mail W-2s and 1099 forms to address in the Continental United States (CONUS), Outside of Continental United States (OCONUS), as well as to U.S. territories and international addresses as provided by the judiciary. The contractor shall provide the judiciary with electronic copies of all W-2s and 1099s printed and mailed to the recipients.

The contractor must have the capability to securely receive and store electronic files from the AO using AO approved encryption methods such as Secure File Transfer Protocol (SFTP) for files in-transit and hard disk encryption for files at-rest. The contractor shall make available their secure file system for remote AO security testing and inspection by the AO DCIO Information Assurance Branch immediately after award, and prior to any work performed under this contract. In the event the contractor’s system is deemed incapable of performance, and the contractor is unable to fully comply with the requirements to securely receive and store electronic files from the AO, the results shall be relayed to the AO Department of Administrative Services (DAS) Acquisition Management Office (AMO) for potential contract action, to include immediate termination.

Each January 18th (or next business day if the 18th falls on a weekend day), the contractor will receive electronically transmitted secure data files containing approximately 45,000 information returns from the AO. The information returns must be printed and mailed within SEVEN BUSINESS DAYS after receipt of the electronic file.

Note: This schedule may be changed at the AO's discretion due to changes in processing schedules or other (un)planned events.

The contractor will print the information returns as instructed by the Judiciary. The printed information return, if any, will be bi-folded/tri-folded with the name and address from the information return facing up. The contractor shall use a mailing label or panel with the recipient’s name and address as stated on the form, accompanied by a USPS barcode. The contractor shall adjust the recipient’s address to a more accurate address in accordance with the USPS database to enhance delivery assurance.

USCA27R0019 /0001 - Page 5 of 14

The information return envelope will have the words “IMPORTANT TAX DOCUMENT ENCLOSED” clearly showing on the front of the envelope. The address for each recipient and the AO’s return mailing address must be fully visible if a suitable double window envelope is not used. Each envelope is to be completely sealed if placed into an envelope.

Each sealed envelope is to be stamped using the AO's USPS bulk mailing stamp; for government certificate/permit mailing by pre-printed permit and penalty certificate on the envelopes. The contractor may use pressure seal paper if the document mailed to the recipient complies with IRS tax form requirements.

The contractor will batch the sealed and stamped envelopes and deliver them to a USPS facility to be mailed. There shall be no loss of control over the stuffed envelopes at any time. The batch must remain under exclusive control of the contractor until it is received by the USPS. The contractor may use machine control marks (2D Barcodes) to enhance quality assurance.

The contractor shall obtain properly completed and signed Postal Service Form(s) 3606, Certificate of Bulk Mailing – International, and 3606-D, Certificate of Bulk Mailing – Domestic, as proof of delivery to USPS.

The contractor shall use sanitization and/or destruction methods allowable under the NIST Special Publication 800-88, Guidelines for Media Sanitization (or its successor) to delete and dispose of Judiciary information in their possession once printed, folded, sealed and delivered to USPS. The contractor shall provide a copy of their sanitization/destruction process to the AO COR.

Upon successfully completing the mailing process with the USPS, the contractor shall confirm completion by emailing the AO’s COR, within 48 hours, and providing the following information:

• Number of information returns inserted into envelopes.

• Number of envelopes stamped.

• Number of envelopes delivered to USPS categorized by File Types provided below.

• Postmaster’s Certification (i.e., Form(s) 3606 and 3606-D).

• Verification that the file was successfully purged from the contractor's systems in accordance with guidance contained in NIST 800.88, Guidelines for Media Sanitation Paragraph 5, Methods for purging data. This verification shall include a description of the data and the asset on which it was stored, the date and method of sanitization/destruction, and the name of the person who purged the data.

USCA27R0019 /0001 - Page 10 of 14

(b) For item(s) identified in paragraph (a) of this clause, the contractor agrees to perform up to the point at which the total amount payable by the judiciary, including reimbursement in the event of termination of those item(s) for the judiciary’s convenience, approximates the total amount currently allotted to the contract. The contractor is not authorized to continue work on those item(s) beyond that point. The judiciary will not be obligated in any event to reimburse the contractor in excess of the amount allotted to the contract for those item(s) regardless of anything to the contrary in the clause entitled “Termination for Convenience of the Judiciary.” As used in this clause, the total amount payable by the judiciary in the event of termination of applicable contract line item(s) for convenience includes costs, profit, and estimated termination settlement costs for those item(s).

(c) Notwithstanding the dates specified in the allotment schedule in paragraph (j) of this clause, the contractor will notify the contracting officer in writing at least ninety days prior to the date when, in the contractor’s best judgment, the work will reach the point at which the total amount payable by the judiciary, including any cost for termination for convenience, will approximate 85 percent of the total amount then allotted to the contract for performance of the applicable item(s). The notification will state: (1) the estimated date when that point will be reached; and (2) an estimate of additional funding, if any, needed to continue performance of applicable line items up to the next scheduled date for allotment of funds identified in paragraph (j) of this clause, or to a mutually agreed upon substitute date. The notification will also advise the contracting officer of the estimated amount of additional funds that will be required for the timely performance of the item(s) funded pursuant to this clause, for a subsequent period as may be specified in the allotment schedule in paragraph (j) of this clause or otherwise agreed to by the parties. If after such notification additional funds are not allotted by the date identified in the contractor’s notification, or by an agreed substitute date, the contracting officer will terminate any item(s) for which additional funds have not been allotted, pursuant to the clause of this contract entitled “Termination for Convenience of the Judiciary.”

(d) When additional funds are allotted for continued performance of the contract line item(s) identified in paragraph (a) of this clause, the parties will agree as to the period of contract performance which will be covered by the funds. The provisions of paragraphs (b) through (d) of this clause will apply in like manner to the additional allotted funds and agreed substitute date, and the contract will be modified accordingly.

(e) If, solely by reason of failure of the judiciary to allot additional funds, by the dates indicated below, in amounts sufficient for timely performance of the contract line item(s) identified in paragraph (a) of this clause, the contractor incurs additional costs or is delayed in the performance of the work under this contract and if additional funds are allotted, an equitable adjustment will be made in the price or prices (including appropriate target, billing, and ceiling prices where applicable) of the item(s), or in the time of delivery, or both. Failure to agree to any such equitable adjustment hereunder will be a dispute concerning a question of fact within the meaning of the clause entitled “Disputes.”

(f) The judiciary may at any time prior to termination allot additional funds for the performance of the contract line item(s) identified in paragraph (a) of this clause.

(g) The termination provisions of this clause do not limit the rights of the judiciary under the clause entitled “Termination for Default.” The provisions of this clause are limited to the work and allotment of funds for the contract line item(s) set forth in paragraph (a) of this clause. This clause no longer applies once the contract is fully funded except with regard to the rights or obligations of the parties concerning equitable adjustments negotiated under paragraphs (d) and (e) of this clause.

(h) Nothing in this clause affects the right of the judiciary to terminate this contract pursuant to the clause of this contract entitled “Termination for Convenience of the Judiciary.”

(i) Nothing in this clause shall be construed as authorization of voluntary services whose acceptance is otherwise prohibited under 31 U.S.C. § 1342.

(j) The parties contemplate that the judiciary will allot funds to this contract in accordance with the following schedule:

On execution of contract [$] [Month, Day, Year] [$] [Month, Day, Year] [$] [Month, Day, Year] [$]

M-1 Evaluation of Offers

1. Basis of Award

The Government intends to make a single award resulting from this solicitation using a Best Value Tradeoff process. Award will be made to the Offeror whose proposal represents the best value to the Government, considering the evaluation factors described in this section. The Government may award to other than the lowest priced Offeror or other than the Offeror with the highest technical rating if a tradeoff determination concludes that price and non price factors justify such a decision. Non-price factors, when combined, are significantly more important than price.

2. Evaluation Approach

Volume I - Technical

Factor 1: Technical Approach The Judiciary will evaluate the Offeror's understanding and capability of performing the requirements in accordance with Section C-1, the ability to be in complaint with Section C-1, paragraph C.6.

Factor 2: Management Approach The Judiciary will evaluate the Offeror's management structure, execution strategy, execution and effectiveness quality control plan and the experience of the key personnel.

Factor 3: Corporate Experience The Judiciary will evaluate to assess the contractor’s performance at least five (5) and subcontractor's performance for at least three

(3) existing and/or prior contracts of similar size and scope and complexity that have been completed within the past three (3) years or are currently being performed and will be evaluated to assess the likelihood of successful performance in fulling the requirements through demonstrated success on recent and relevant prior engagements. All experiences Prime and Subcontractor will be combined for one rating.

For a proposal to be considered for award, the proposal must, at a minimum, meet all proposal submissions requirements (Section L), Statement of Work requirements (Section C), and all other terms and conditions as provided in the RFP. An assessment will be made of each offeror's proposal based upon the non-price and price evaluation factors listed herein and discussed below: 1) Technical and Management, 2) Past Performance, and 3) Price/Business.

Award is based on the most highly rated proposal, technical and management is more important than past performance and when combined, non-price factors are more important than price.

The Judiciary reserves the right not to award a contract depending on the quality of the proposals submitted. Any resultant award will be made to the responsible party whose proposal is deemed most advantageous to the Judiciary by proposing the best overall value.

The Judiciary reserves the right to make awards based solely upon initial proposal submission. Therefore, the contractor should ensure their initial proposal constitutes their best proposal in terms of technical/management solution and price being proposed.

In determining the most highly rated quote, the Judiciary considers Technical and Management is more important than Past Performance and when combined, all non-priced factors are more important than price. The Government may make trade-offs between technical excellence and price when determining which proposed offer is the most highly rated proposal. Trade-offs will be based on the Judiciary’s assessment of whether the technical excellence proposal provides added value, added capability, and/or reduced risk. The importance of pricing in the evaluation will increase with the degree of equality of the technical and management proposal or when the price is so significantly high as to diminish the value of the technical superiority.

Volume II - Price and Business

USCA27R0019 /0001 - Page 14 of 14

The Judiciary will evaluate price reasonableness based on the total value of Tab 1 - Section B Pricing in accordance with standard acquisition practices and principles. Price is less important than the combined non price factors but will be considered in the best value tradeoff.

The Offeror's evaluated price should be priced based on their proposed solution for this order. The total price base plus options will be evaluated. Any offer that is materially unbalanced as to prices for base period, options, and comparisons to other data sources may be rejected. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is determined by the judiciary to be significantly overstated or understated.

Business: The Judiciary will make sure the page count does not extend the amounts shown in Section L, all items listed under Section L are completed and submitted, RFP and amendments are acknowledged via a signature.

Enforceability of Proposal The proposal must set forth full, accurate and complete information as required by this RFP. The Judiciary will rely on such information in the award of a contract.
