CASE MANAGEMENT/ELECTRONIC CASE FILES (CM/ECF)

CM/ECF – the Case Management/Electronic Case Files Program – was developed by the Administrative Office of the U.S. Courts (AO) to replace the old case management systems with a system that provides the federal courts with the ability to maintain electronic case files and to offer electronic filing of documents filed by attorneys over the Internet.

The CM/ECF system for bankruptcy courts began implementation nationally in early 2001. The district court CM/ECF system began to roll out nationally in May 2002. Implementation of the CM/ECF system for appellate courts began in2006. Millions of cases and their documents are on CM/ECF systems, and more than 800,000 attorneys across the country have filed documents electronically. All 94 bankruptcy courts now use CM/ECF.

CM/ECF offers a number of benefits for attorneys and the public.

• Case Information, including docket sheets and the filed documents, is available for viewing and downloading to attorneys and the public at any time from locations other than the courthouse, via the Internet through the Public Access to Court Electronic Records (PACER) system. Attorneys and/or parties are provided with a copy of each document filed electronically in their cases via a link in the Notice of Electronic Filing that is e-mailed to each registered attorney upon the filing of each electronic document.

This document may be printed or saved for future use.

• Parties, the judge, court staff, and the public can review the case file simultaneously.

• Registered attorneys can file case documents 24 hours a day, 7 days a week, over the

Internet. Attorneys can file case documents from their offices or homes right to the filing deadline without worrying about postage, messenger services, or traffic congestion.

• Attorneys filing over the Internet automatically create docket entries, and the docket sheets are updated immediately when documents are filed.

• A notification of activity in a case, in the form of a Notice of Electronic Filing, is sent by e-mail to the filer and all registered participants in the case immediately after each electronic filing. The Notice of Electronic Filing contains a hyperlink to the filed document and the docket sheet.

• Because CM/ECF can be accessed using standard office PC equipment, the cost to use CM/ECF is very low for the typical attorney.

Filing documents using the CM/ECF system requires the following hardware and software:

• A personal computer running a standard platform such as Windows or Mac OS X;

• A portable document file (PDF)-compatible word processor such as Microsoft Word;

• Internet service;

• A web browser (For CM/ECF, the latest versions of Mozilla Firefox or Microsoft Internet

Explorer are recommended. Some users have had positive experiences with other web

J3 browsers, but those listed here have been tested and certified for compatibility with

CM/ECF.);

• For appellate CM/ECF, the Java plug-in or Java Web Start (beginning in January 2017 for Firefox and Chrome browsers);

• Software to convert documents from word processor format to PDF (Microsoft Word can convert documents to PDF, or an additional tool such as Adobe Acrobat can be used.);

• Adobe Acrobat Reader for viewing PDFs; and

• A document scanner, if litigants need to create PDF images of documents they wish to file using CM/ECF.

Training for CM/ECF users is available from each court. If an attorney is trained and registered in one court, that attorney may be authorized to register and file in another court without further training, at that court’s discretion. Filing documents in CM/ECF is relatively simple and a minimal amount of training is needed.

Filing a document using CM/ECF requires a login and password. Each court determines for itself the persons to whom it will issue filing logins and passwords. Courts offering electronic filing provide document filing access principally to attorneys, U.S. Trustees, and bankruptcy case trustees. Some courts permit bankruptcy claimants and other pro se litigants to file electronically.

Subject to court orders in individual cases, policy, or other individual court limitations, the public may view dockets and documents in CM/ECF through the PACER system. Logins are available through the PACER registration page at https://www.pacer.gov/. As directed by Congress, the judiciary’s electronic public access program is funded entirely through user fees set by the Judicial Conference of the United States (Judicial Conference). Documents are currently available at a rate of ten cents per page with a maximum cost per document calculated to be the equivalent of a 30-page document ($3.00). Transcripts of court proceedings and docket sheets are not subject to the fee limit. Copies of court opinions, as designated by the authoring judge, are available at no charge. There are no added fees for filing documents over the Internet using CM/ECF, although existing court document filing fees do apply.

CM/ECF systems are designed to accept only documents in PDF format. This format was chosen because it allows a document to retain its pagination, formatting, and fonts no matter what type of computer is used to view or print the document. It is also an open standard format.

Adobe developed the format and offers software that allows conversion of documents created in most word processing systems into PDF. Several word processing and other programs contain features that convert documents created in those programs into PDF. To improve security and archiving capabilities, plans are underway to require that all filers use the new PDF/A format.

https://www.pacer.gov/

There are two utility programs that verify documents filed using the CM/ECF system. One program is used to verify the integrity of a PDF document as it is filed in CM/ECF. A second, separate program runs automatically at preset times to verify that the documents have not changed since they were filed.

Rule 5(e) of the Federal Rules of Civil Procedure and Rule 5005(a) of the Federal Rules of Bankruptcy Procedure authorize individual courts by local rule to permit or require papers to be filed by electronic means. Most courts that offer electronic filing have issued an authorizing local rule; most have supplemented the local rule with a general order and/or procedures that set forth the relevant procedures governing electronic filing with that court. Individual court rules and procedures are generally available on their websites. Rules 5(b) of the Federal Rules of Civil Procedure, and Rules 7005, 9014, 9022, and 9036 of the Federal Rules of Bankruptcy Procedure also authorize service of documents by electronic means if the party being served consents. There is an amendment to Fed. R. Civ. P. 5(b) pending that would make electronic service via the CM/ECF system on registered users an option without requiring consent of the party served. The amendment would take effect on December 1, 2018. Consent would still be necessary under Fed. R. Bankr. P. 9036, however. The amendments do not apply to service of process. Most individual bankruptcy courts require consent to electronic service of papers (other than service of process) as a condition of using the system. This saves the judiciary money as it eliminates paper notices sent to registered users.

United States Bankruptcy Courts Electronic Bankruptcy Noticing

Agreement To initiate Electronic Bankruptcy Noticing via E-mail

Complete this agreement to receive your bankruptcy notices via e-mail.

Name of Subscriber:

All U.S. Bankruptcy Courts OR Specific districts only. District(s) of:

The courts referred to above are requested to transmit bankruptcy notices electronically through the Bankruptcy Noticing Center (BNC) Electronic Bankruptcy Noticing (EBN) program pursuant to Federal Rule of Bankruptcy Procedure 9036.

If you, or your organization, wish to receive bankruptcy notices from the courts electronically instead of through the U.S. mail, complete this Agreement indicating your consent to notice by e-mail.

Advantages of Notification through E-mail: Subscribers are able to retrieve their notices through a hyperlink by e-mail. Receiving the notices by e-mail ensures that the size of e-mails is small and will not clutter in-boxes. E-mail allows a subscriber to receive notices days faster than the current postal service delivery time. Notices are sent electronically the same day the court produces them. Notices normally sent to all your branch locations can be sent to one e-mail address. E-mailed notices can be sent to a shared group e-mail address or easily forwarded to others. Additionally, e-mailed notices stored on your computer are easier to find when you need them.

Email Enhanced by Extensible Mark-Up Language (XML): E-mail recipients can access and process case data elements from each PDF notice file through XML. This provides two great advantages, as the subscriber can retrieve variable data elements from the PDF notice for easy processing and still have the PDF file for archives/records retention.

How the Program Works:

Redundant Mode. Entities that complete and return this form to the BNC will have EBN service initiated in approximately two weeks. During the first 30 days of EBN service, the BNC will send the notice electronically and by U.S. mail to allow you to confirm the process is working properly. This initial 30-day period is called “redundant mode,” and it begins from the date the BNC sets up your service, not the date of your first EBN notice. Upon expiration of redundant mode, all future notices processed by the BNC for the courts will only be sent electronically without further notice.

Name Matching. The BNC software will attempt to match the name and address provided on this form to the address included in the court’s notice instructions. In most cases, the addresses in the court’s computer files are provided by the debtor. The BNC software will attempt to match the name (without punctuation) and address and send the notice electronically. If the recipient name and address in the court’s notice instructions do not match the name and address on this form, the BNC will mail the notice. Submit to the BNC additional names and addresses if you are still receiving paper notices from the BNC after the first 30 days of EBN service. Use the name(s) and/or address(es) used by debtors for your organization in the paper notices you receive from the BNC. You must notify the BNC if your e-mail address, names, and mailing addresses used for electronic noticing change.

Either party may terminate this Agreement without cause by giving the other party written notice. The U.S.

Government will provide you with 14 days advance notice of any changes in the terms of this Agreement.

NOTE: The BNC does not process all the notices you may receive in a case. Notices generated by trustees, attorneys, debtors, and some court-generated notices or orders will continue to be mailed to your address specified in the court record.

Electronic Bankruptcy Noticing Agreement

To initiate Noticing via Email

With Option of Electronic Data Interchange (EDI) for Certain Notices

Name of Subscriber: __________________________________________________________________

All U.S. Bankruptcy Courts OR

Specific districts only. District(s) of: ______________________________________________

A subscriber may consent to receive bankruptcy court notices and orders electronically, pursuant to

Federal Rule of Bankruptcy Procedure 9036 and Federal Rule of Civil Procedure 5(b). By completing this agreement, the subscriber is consenting to notice via email. There is also a supplemental option

(below) to receive certain notices via Electronic Data Interchange (EDI).

The Bankruptcy Noticing Center (BNC) provides centralized notice production and distribution services to the courts.

Email: The BNC will email bankruptcy court notices and orders to the subscriber. The email will contain a hyperlink to a PDF file. Receiving the notice via hyperlink ensures that the size of the email is small and will not clutter the subscriber’s inbox. Additionally, the subscriber can access and process case data elements from each PDF notice through Extensible Mark-up Language (XML). This provides two great advantages, as the subscriber can retrieve the case data elements from a PDF file for easy processing while maintaining the PDF image for archives/records retention.

During the first 30 days of email usage, the BNC will send notices via email and U.S. mail to allow the subscriber to confirm the process is working properly. This redundant mode begins from the date the

BNC sets up the subscriber’s email service, not the date of the subscriber’s first emailed notice. The subscriber may request that redundant mode end sooner than 30 days.

Name and Address Matching: In this noticing agreement, the subscriber will enter its name and address exactly as it appears on bankruptcy court notices that it currently receives. Additionally, the subscriber will enter any other name and address variations that appear on bankruptcy court notices received by the subscriber. The BNC software will attempt to match the subscriber’s name and address included in the court’s record with any name(s) and address(es) provided in this agreement. If there is a match, the notice will be sent electronically. If the subscriber’s name and address in the court’s record do not match any name(s) and address(es) included in this agreement, the BNC will send the notice via U.S. mail.

EDI: EDI is an option for entities that receive a large-volume of bankruptcy court notices and are seeking an automated method for processing the data contained in those notices. Using the American National

Standards Institute (ANSI) X12 3060 175 Court Notice Transaction Set, the BNC will transmit case data elements (e.g., debtor name, trustee name) for the following types of bankruptcy court notices to the subscriber: (1) notices of meeting of creditors (341 notices), (2) notices of assets, (3) notices of dismissal, and (4) notices of discharge.

The BNC will transmit all EDI notices to the Defense Logistics Agency (DLA) Transaction Services, which serves as the collection point for the bankruptcy courts’ EDI notices. DLA Transaction Services also serves as the Value Added Network (VAN) and routes the EDI notices to the subscriber’s EDI server. DLA Transaction Services collection point and VAN services are free. In case of a DLA system failure, the BNC will provide paper notice to the subscriber.

Electronic Bankruptcy Noticing Agreement (continued)

For a limited period of time, the BNC will provide paper notification in addition to notices sent via EDI transmission. This is known as “redundant mode.” The BNC will terminate redundant mode when it determines that a sufficient period of electronic transmission has been provided to permit effective capture of data. Redundant mode will terminate no later than three months from the first day of EDI usage, but the subscriber may request that redundant mode terminate sooner. The subscriber may request in writing for an extension of redundant mode, not to exceed six months from the first day of EDI usage.

The Administrative Office of the U.S. Courts will consider the subscriber’s request and determine whether an extension is warranted.

Either party may terminate this agreement without cause by giving the other party written notice.

NOTE: The BNC does not process all the notices a subscriber may receive in a case. Notices generated by trustees, attorneys, debtors, and some court-generated notices or orders will continue to be mailed to the subscriber’s address specified in the court record.

E-mail allows a subscriber to receive notices days faster than the current postal service delivery time. Notices are sent electronically the same day the court produces them. Notices normally sent to all your branch locations can be sent to one e-mail address. E-mailed notices are easy to forward to people.

Additionally, e-mailed notices stored on your computer are easier to find when you need them.

Email Enhanced by Extensible Mark-Up Language (XML): E-mail recipients can access and process the case data elements from each PDF notice file through XML. This provides two great advantages, as the subscriber can retrieve variable data elements from the PDF notice for easy processing but still have the PDF image for archives/records retention.

I. E-mail

Recipients are able to retrieve their notices through a hyperlink by e-mail. Receiving the notices by e-mail ensures that the sizes of e-mails are small and will not clutter in-boxes.

Specify E-mail Address for Notice Delivery:

Please select a delivery option:

1. E-mail Option 1 One e-mail contains a link to a single PDF file. The PDF file contains multiple notices (e.g., 20 notices in one PDF file). This option is the default if no option is selected.

2. E-mail Option 2 An e-mail contains multiple links to PDF files. Each link contains one notice (e.g., 20 notices have 20 individual links).

3. E-mail Option 3 An e-mail for each notice contains one link to a PDF file (e.g., 20 notices are sent as20 e-mails, each e-mail with one link).

III. How E-mail Notification Works

A. Redundant Mode for 30 Days Only

E-mail service will begin approximately two weeks after you complete and return this form to the Bankruptcy Noticing Center (BNC). During the first 30 days of e-mail service, the BNC also will mail paper copies of notices so that you can confirm the process is working properly. This process is called redundant mode, and it begins from the date the BNC sets up your e-mail service, not the date of your first e-mailed notice. Upon termination of the 30-day redundant mode period, all notices will be sent electronically only.

B. Name and Address Matching

When you completed the EDI Trading Partner Agreement, or any update thereto, you supplied the BNC with all names and addresses for which you wanted court notices to be sent electronically. This list of names and addresses also will apply to your e-mail service. The BNC sends a notice electronically when the names and addresses that you provided per your Agreement match a name and address on the bankruptcy court mailing matrix. If the recipient name and address on the court’s mailing matrix does not match any names or addresses that you provided pursuant to your Agreement, the BNC will mail the notice through the U.S. Postal Service. The U.S. Courts and BNC do not warrant that all court notices will be sent electronically, and court notices that are not transmitted electronically, will be sent via U.S. Mail. You must notify the BNC if your e-mail or names and addresses used for electronic notice change. You can make updates by completing a Change of Account Information Form available at ebn.uscourts.gov.

C. Termination

Either the U.S. Courts or EDI Trading Partner may terminate supplemental e-mail notification without cause by giving the other party written notice.

Note: The BNC does not process all notices you may receive in a case. Notices generated by trustees, debtors, attorneys and some court-generated notices are not processed by the BNC.

IV. Sign and Return

This constitutes an addendum to your EDI Trading Partner Agreement. Neither the BNC nor the courts bear any liability for errors resulting from information submitted herein.

I, the undersigned, am authorized to make the modifications specified on this form or attached hereto on behalf of the EDI Trading Partner. The information submitted on this form is true and correct.

Electronic Bankruptcy Noticing Agreement

(To initiate Electronic Bankruptcy Noticing via Internet e-mail with PDF attachment)

Complete this agreement to receive your bankruptcy notices via e-mail.

Name of Subscriber: _________________________________________________

All U.S. Bankruptcy Courts participating in the National Creditor Registration Service

(NCRS) OR

Specific Districts only. District(s) of: ________________________________________________

The courts referred to above are requested to transmit bankruptcy notices electronically through the Bankruptcy Noticing Center (BNC) Electronic Bankruptcy Noticing (EBN) program pursuant to Federal Rule of Bankruptcy Procedure 9036.

If you, or your organization, wish to receive bankruptcy notices from the courts electronically instead of through the U.S. mail, please complete this Agreement indicating your consent to notice by e-mail.

Advantages of Notification through E-mail: Subscribers are e-mailed their notices attached in Adobe PDF.

You must notify the BNC should your e-mail address, names, and mailing addresses used for electronic noticing change.

Either party may terminate this Agreement without cause by giving the other party written notice. The U.S.

Government will provide you with 14 days advance notice of any changes in the terms of this Agreement.

NOTE: The BNC does not process all the notices you may receive in a case. Notices generated by trustees, attorneys, debtors, and some court-generated notices or orders will continue to be mailed to the address of record at the court.

MARCH 1998 EDI COURT NOTICE MAPPING GUIDE - INTRODUCTION PAGE: i

Introduction

This document is provided to you, the Trading Partner to assist you in preparing your EDI system to receive and process EDI Bankruptcy Notices generated by the latest implementation of the BNC’s bankruptcy Noticing EDI system. This new implementation employs the ANSI X12 3060 175 Court Notice Transaction Set and was designed with maximum noticing flexibility in mind. This EDI layout will allow nearly all Court-specific Bankruptcy notices to be formatted and sent out via EDI. This release supports the notices that generate the most volume. These notices are Section 341 First Meeting of Creditors, Discharge, Notice of Assets and Order Dismissing Case notices.

How to Use This Guide

This guide is divided into 3 sections and one appendix. The Transaction Set Overview section illustrates the subset of the segments and loops from the ANSI X12 3060 175 Court Notice used in this specific Bankruptcy Notice implementation. The Segment/Element Description section of this document provides information on the mapping of the segments (and their elements) listed in the Transaction Set Overview section. The third section, describes all possible instances of CED Loops and their component segments that can be mapped to the EDI document.

A typical approach to mapping this EDI Court Notice to your internal system might be something like the following:

1) Peruse the Transaction Set Overview section to familiarize yourself with the looping and segment layout of this Transaction Set.

2) Prepare to capture in a flat-file and/or a database all EDI segments and elements described in Segment/Element Description section.

3) Prepare to process segments other than those contained in this Transaction Set’s CED Loop structures. These are the ST, BGN, CDS and SE segments. Please refer to the Segment/Element Description section for guidance. To decode CDS07 - Court District Code use Appendix A - U.S Courts District/Division Code Reference Table Code Source 36A.

4) Use the 3 tables in the Segment/Element Instance section to implement application program logic to process each specific instance of the CED Loops which are formatted with case information and case events.

Transaction Set Overview Section

The segment and loop overview is provided to familiarize you with the overall structure of the EDI notice. It also serves as a table of contents for the other two sections of this document. In the first column, the corresponding page in the Segment/Element Description section is indicated. In the second column, the corresponding table in the Segment/Element Instance section is indicated.

Segment/Element Description Section

The Segment/Element Description section describes each of the segments listed in the Segment and Loop Overview in further detail. Each segment contains information on the segment as an atomic unit and in terms of the segment’s component elements.

On the atomic unit level, the segment ‘s properties are described - what level of the overall Transaction Set does the segment belong to (Level), what loop within the Transaction Set does it belong to (Loop), whether the segment is mandatory or optional in the context of the EDI loop structure to which it belongs (Usage), maximum use of the segment (Max. Use) and for loop header segments, maximum number of loops (Repeat). The purpose for the loop is also listed along with any implementation notes that apply to the segment as a whole.

The rest of the Segment/Element Description is dedicated to the Data Element Summary. Each element that is mapped in this implementation is listed in this area. The name, X12 Data Dictionary ID#, description, usage, data type and Min./Max. lengths for each element are listed. Optionally, implementation notes for the element may follow.

For elements that are of data type “ID”, a list of the valid EDI codes used in this implementation are listed and described.

MARCH 1998 EDI COURT NOTICE MAPPING GUIDE - INTRODUCTION PAGE: ii

Segment/Element Instance Section

The Segment/Element Instance section of this document is at the heart of this mapping guide. This section, composed of three separate tables, list in detail all the possible CED loops that can be mapped in this EDI implementation to describe court events and case information. These three tables are related in a top down approach starting with the CED Loop - CED/DTM/LM/LQ then moving to the NM1 Loop Segment and Element Mapping and ending with the NM1 Loop’s REF Segment and Element Mapping table.

The CED Loop - CED/DTM/LM/LQ table lists each possible instance of the CED loop structure in terms of what is mapped to its CED, DTM, LM and LQ segments. Each CED loop is labeled with a descriptive name (CED Loop Name) and is categorized by CED Context which is a descriptive phrase summarizing the element values formatted in the CED segment. The entire table is sorted first by the CED elements formatted, then by the DTM01 value and finally by the LQ01 value. This sort order should be of assistance to you when you devise “Switch” or “Select Case” logic to process this information in your application.

Certain CED loops contain additional segments that are not described in the CED Loop - CED/DTM/LM/LQ table.

These segments are indicated in the “Additional Segments Formatted” column of this table. When this column indicates that the CED Loop contains one or more NM1 Loops, please refer to the NM1 Loop Segment and Element Mapping table to assist you in mapping. To do so, simply cross-reference the “CED Loop Name” column in the CED Loop - CED/DTM/LM/LQ table to the “Parent CED Loop Name” column in the NM1 Loop Segment and Element Mapping table. If this column indicates that a segment other than an NM1 Loop is formatted within a particular CED Loop, please refer to the cited segment in Segment/Element Description section of this document for specific mapping instructions.

The NM1 Loop Segment and Element Mapping table in turn lists what values are mapped to the NM1 segment’s elements for the different CED loop instances. Please note the “Case Entity Information” CED Loop contains a separate instance of an NM1 Loop for each entity in the case. The “Additional Segments Formatted” column indicates what additional segments are formatted within each NM1 Loop.

For REF segments formatted, please use the NM1 Loop’s REF Segment and Element Mapping table to assist you in mapping. To do so, simply cross-reference the “NM1 Loop Name” column in the NM1 Loop Segment and Element Mapping table to the “Parent “NM1 Loop Name” column in the NM1 Loop’s REF Segment and Element Mapping table. For the N2, N3, N4 and PER segments, please refer to the cited segment in Segment/Element Description section of this document.

A Word About Y2K

Since we are currently using EDI ANSI X12 3060 version, the year portion of the dates mapped throughout the document are expressed using two digits. Therefore, to interpret the century portion of the year (19 or 20) please use a simple over/under rule. If the year portion of a date falls between 00 and 30 then the date falls in the 21st century, otherwise if the year is between 31 and 99 then the date falls in the 20th century.

Special Information Regarding EDI Format Changes Effective 09/08/08

The Mapping Guide has been updated to reflect EDI format changes to discharge and dismissal dates and dispositions that were made effective 09/08/08. All previous Mapping Guide format and layout information has been left intact in order that all EDI trading partners, current and new, may have access to the original EDI format and layout.

Effective 09/08/08 the CED loop for the discharge and dismissal date and/or disposition in all discharge and dismissal notices (single and joint cases) is modified to contain a REF segment indicating that the date or disposition is related to the debtor or joint debtor. The changes are made in conformance with the ANSI X 12 3060 175 Court

Notice Transaction Set and should not cause any noticing partner translation software to fail.

Please see the following for details on the new implementation of the REF segment:
